PC_02-23-82_Meeting_MinutesMINUTES OF THE MEETING OF THE FREDERICK COUNTY PLANNING COMMISSION WORKSESSION Held in the Board of Supervisors' Meeting Room, February 23, 1982 PRESENT: Frank Brumback, James Golladay, Manuel DeHaven, W. French Kirk, A. L. Myers, Kenneth Stiles, M. Domenic Palumbo, Carl McDonald ABSENT: George Romine Chairman Brumback opened the meeting and ask Mr. Horne to introduce the first topic of discussion. Mr. Horne referenced the package of information that the staff had prepared in the Commission's agenda and introduced the subject of go -cart race tracks and recreation tracks. Mr. Horne said that the staff recommendation at this point was to allow the uses in the A -1 and A -2 zoning districts under the designation of "outdoor recreation facilities with conditional use permit." There ensued a lengthy discussion as to the characteristics of this type of use and its suitability in agricultural and business districts. Mr. Brumback inquired if the Commission was in favor of allowing this use at all in business districts. The Commission discussed this issue and did not come to a decision. Mr. Brumback suggested that the Commission leave this particular subject and return to it later in the meeting, as time permitted. The next topic of discussion was the request by some residents of the county to regulate the placement of fencing in the front yards in residential districts. Mr. Horne presented the staff recommendation which would be to require that opaque front yard 1497 fencing above a certain height be placed away from the right of way one half the minimum structural setback. Mr. Horne did mention that this would require the classification of front yard fencings as structures under the zoning ordinance and would require amendment to that ordinance. There was a brief discussion of this issue and the Planning Commission unanimously agreed that they felt that an amendment to the ordinance to address this issue was not appropriate. The next topic of discussion concerned nationally chartered, non- profit civic clubs and organizations and uses in residential areas. Mr. Horne presented the staff recommendation to allow these uses with a conditional permit in residential zoning districts. There was brief discussion of the issues involved and the Planning Commission directed the staff to draft an amendment to the ordinance for consideration which would allow these type uses in residential zones with a conditional use permit. Mr. Horne next introduced the Comprehensive Plan Update as the next topic of discussion. He mentioned that the staff had prepared some revised slides to be used in the presentation and then proceeded to show these slides to the members of the Planning Commission. The Planning Commission members expressed their satisfaction with the slide show presentation as it had been revised. There next ensued a lengthy discussion concerning certain aspects of the public presentation and the plans as proposed by the Planning Commission for the disposition of rural and urban lands. Mr. DeHaven expressed extreme displeasure with the presentation and called for a more detailed presentation including the full ordinances in order to implement the concepts presented in the presentation. Mr. Brumback then polled the Commission as to whether they felt comfortable in proceeding with the public presentation as presently constituted. All members, except Mr. DeHaven, expressed their desire to proceed as planned with the public meetings. Mr. Brumback then asked the staff if they were comfortable with proceeding at this point. Mr. Horne and Mr. Gyurisin stated that they were not comfortable with the support they were receiving from the Planning Commission and therefore, would not be willing to proceed with the public presentation as scheduled.
