FREDERICK COUNTY PLANNING COMMISSION
Held in the Board of Supervisors' Meeting Room, 9 Court Square, Winchester,
Virginia, on October 16, 1985.

CALL TO ORDER
Chairman Brumback called the meeting to order at 2:00 p.m. The first
order of business was the minutes of October 2, 1985. Upon motion made by
Col. Myers and seconded by Mr. Romine, the minutes were unanimously approved
as presented.
MONTHLY AND BIMONTHLY REPORTS
The Commissioners and staff discussed pending applications.
Mr. Riley noted that the Board of Supervisors amended Mr. Donald
Fowler's rezoning application from 202 acres to 197 acres. Mr. Riley said
that the 5 (+ or -) acres that Mr. Stiles thought was zoned EM was not
reflected on the zoning map, but was noted in the Board's minutes. As a
result, there will be a separate application coming before the Planning
Commission to rezone that five acres from EM to MH.
COMMITTEE REPORTS
Economic Development Commission
Mr. Romine, Economic Development Coordinator, reported that
Winchester- Frederick County has accomplished its certification. Mr. Romine
said that signs will be placed on approach to the City and County designating
this area as a certified community. Mr. Romine thanked the Board of
Supervisors, Planning Commission, and staff for all their efforts on this
project.

Sanitation Authority
Mrs. Copenhaver, liaison to the Santation Authority, said that the
television surveillance of the Lakeside and Wakeland Manor sewer and water
system is still in process. She said that the Commission is also working on
a policy for the granting of permits during a moratorium.
Rural Ordinance Subcommittee
Mr. McDonald said that the Subcommittee studied the road standards for
the rural ordinances for five to ten acre tracts. Mr. McDonald said that the
Subcommittee decided to use current State Road Standards for those.
SITE PLANS
Amended Site Plan #008 -81 of Winchester Warehousing to construct a 70' x 430'
warehouse.
ACTION - Approved
Mr. Riley read the background information.
Mr. Robert Solenberger, Treasurer of Winchester Warehousing, said that
the warehouse will probably be used by National Fruit for storage of apple
products.
Chairman Brumback asked if the building would be sprinkled. Mr.
Solenberger said that they will use fire walls instead because there is no
water available to the property.
Col. Myers asked the applicant if there would be difficulties
constructing the firewalls to the Inspection Department's recommendation.
Mr. Solenberger said they have no problem constructing the building to the
Code specifications stated by the Inspections Department.
Upon motion made by Mr. DeHaven, seconded by Mr. Romine,
BE IT RESOLVED, That the Frederick County Planning Commission does hereby
unanimously approve Amended Site Plan #008 -81 of Winchester Warehousing to
construct a 70' x 430' warehouse on the east side of Smithfield Avenue in the
Stonewall Magisterial District.
Site Plan #023 -85 of Walter Aikens for a three -story office building.
ACTION - Approved

Mr. Riley gave the background material. Mr. Riley stated that Mr.
Aikens received approval of the Inducement Resolution by the Industrial
Development Authority for applying to the State Reserve for Industrial
Revenue Bonds at the Board of Supervisors' last meeting.
Mr. Charles Maddox, Engineer, and Mr. Thomas Price, Designer, both
from G. W. Clifford and Associates; and Mr. Harry Aikens and Mr. Walter
Aikens, owners, were present.
Chairman Brumback asked if there was adequate water for fire
protection. Mr. Maddox replied that a hydrant was located internal to the
project on the side of the building near the restaurant. He said that
another hydrant is located across Route 522 near the Zayre's store. Mr.
Maddox said that he understands that this is satisfactory from a fire
protection standpoint.
Upon motion made by Mr. Wilson, seconded by Mr. Romine,
BE IT RESOLVED, That the Frederick County Planning Commission does hereby
unanimously approve Site Plan #023 -85 of Walter Aikens for a three -story
office building comprising 32,400 square feet to be located at the
intersection of Routes 522 and 50 in the Shawnee Magisterial District.
Site Plan #029 -85 of Potomac Edison for the Meadowbrook Electrical
Substation.
ACTION - Approved
Mr. Riley said that Potomac Edison is making two separate requests -
one is the substation under consideration today; later they will come back to
the Planning Commission with the other request which is for a line location
between this substation and Camp 7. Mr. Riley said that Potomac Edison is
now in the process of selecting the route.
Mr. Daniel Spofford, Real Estate Representative with the Potomac
Edison Company, said that this will be a 500 kVA substation that will

generally serve the Winchester /Front Royal and outlying areas with 138 kV
service.
Mr. Ronald Dembroski, Substation Engineer for Potomac Edison, said
that studies done by Potomac Edison determined that the electrical load
center in this area was located between Winchester and Front Royal. He said
that this area is becoming weak due to the electrical demand over the past
years and a source is needed to reinforce the area. Mr. Dembroski said that
the substation will be built between two existing stations owned by Vepco --
Mt. Storm and Morrisville. He said that the Morrisville substation is a 500
kV source that will be transformed at the new substation to a more useable
voltage, which is the 138 kV. Mr. Dembroski explained that this will
reinforce and strengthen the area by feeding out to the Strasburg, Riverton,
Ridgeby, and Bartonville substations.
Upon motion by Mr. Golladay, seconded by Mr. McDonald,
BE IT RESOLVED, That the Frederick County Planning Commission does hereby
unanimously approve Site Plan #029 -85 of Potomac Edison for the Meadowbrook
Electrical Substation to be located west of Route 11 (also west of the B & 0
Railroad) along the south side of Route 638 in the Opequon Magisterial
District.
SUBDIVISIONS
Subdivision Request of Greenbrier Village, Section II, for single - family
detached traditional housing.
ACTION - Tabled
Due to the lack of a representative for this subdivision, Mr. Golladay
moved that it be tabled until November 6, 1985

ACTION - Approved
Upon motion made by Mr. Golladay, seconded by Mr. Romine,
BE IT RESOLVED, That the Frederick County Planning Commission does hereby
unanimously approve an ordinance to amend the Frederick County Code, Chapter
21, Zoning, Article XIX, Site Plans, Paragraph 19 -5 -17, as follows:
There shall be installed on sites adequate fire protection measures, as
required by Chapter 10 of the Frederick County Code.
An ordinance requiring adequate fire protection measures for all
subdivisions.
ACTION - Approved
Upon motion made by Mr. Golladay and seconded by Mr. Romine,
BE IT RESOLVED, That the Frederick County Planning Commission does hereby
unanimously approve an ordinance to amend the Frederick County Code,
Chapter 18, Subdivisions, Article III, Design Standards, Paragraph 3 -3 -4,
Fire Protection, as follows:
3 -3 -4 Fire Protection
There shall be installed in all subdivisions adequate fire protection
measures, as required by Chapter 10 of the Frederick County Code.
PRESENTATION BY WESTMINSTER - CANTERBURY OF WINCHESTER
Mr. Riley said that the people from Westminster- Canterbury have worked
with the adjoining property owners for the last three months to install a
storm sewer to drain their property down to the creek by the auto sales
business. Mr. Riley explained that the adjoining property owners cannot come
to an agreement on granting the easements for this line. Mr. Riley said that
Westminster- Canterbury is requesting that the Planning Commission reconsider
their previous motion to allow them to construct the retention /detention
facility on their own property. Mr. Riley added that Westminster - Canterbury
is at the stage of development where some type of drainage facilities are
needed for the site.

Mr. Allen said that since June 6, 1985, they have called meetings with
property owners on two separate occasions, with some people attending only
one or none of the meetings, and they have corresponded with the residents on
three different occasions relative to meetings or options available. Mr.
Allen said that to this date, they have received no written response from the
residents of Sunnyside. Mr. Allen said they have also learned that one
parcel of property is owned by two sisters -- one which resides in Annandale
and the other residing in Herndon. Mr. Allen said that one of the sisters
has indicated that she will not grant an easement, but will be happy to sell
one. Mr. Allen felt the intent of the Planning Commission was for
Westminster - Canterbury to exercise all options to the landowners, however,
the purchasing of easements was not a part of the arrangement.
The Planning Commission felt it was unfair to delay Westminster-
Canterbury on their project any longer; however, they felt the property
owners should be notified that unless the Planning Commission hears
otherwise, they will grant Westminster - Canterbury's original request for a
retention /detention facility on the site at their meeting of November 6,
1985, due to an unworkable situation for alternative drainage methods. Mr.
Riley said that he would contact the residents of Sunnyside by letter on the
matter.
