PC_07-17-85_Meeting_MinutesMINUTES OF THE MEETING OF THE FREDERICK COUNTY PLANNING COMMISSION Held in the Board of Supervisors' Meeting Room, 9 Court Square, Winchester, Virginia, on July 17, 1985. PRESENT: Frank H. Brumback, Chairman; James Golladay, Jr., Vice - Chairman; W. French Kirk; A. Lynn Myers; Manuel C. DeHaven; Kenneth Y. Stiles; Marjorie H. Copenhaver; Stephen M. Gyurisin, advisory ABSENT: George Romine; Carl M. McDonald CALL TO ORDER Chairman Brumback called the meeting to order at 2:00 p.m. The first order of business was the consideration of the minutes of July 3, 1985. Upon motion made by Mr. Golladay and seconded by Mr. Kirk, these minutes were unanimously approved as presented. BIMONTHLY REPORT The Chairman accepted the Bimonthly report for the Commission's information. COMMITTEE REPORTS Sanitation Commission Mrs. Copenhaver, Liaison to the Sanitation Commission, stated that a contract has been prepared with the Blue Ridge and Oak Hill Mobile Home Parks for a total of 190 connections. On other business, Mrs. Copenhaver reported that the Church of Christ bought land across from the Shackelford farm and this newly purchased land doesn't perk. She said that the church is asking permission to hook onto the sewer line that Gregory and Hardison are working on. Final Master Development Plan #002 -85 of Greenbrier Village to develop 98.8 acres for residential use. ACTION - Approved Mr. Gyurisin gave the background information. Mr. Bruce Edens, representing the owner, was present to answer questions from the Commission. Mr. Edens said that they have completed the 2091 -2- redesigning of the water and sewer lines and those lines are now located out of the proposed roadway paving as requested by the Highway Department. Upon motion made by Mr. Golladay and seconded by Mr. DeHaven, BE IT RESOLVED, That the Frederick County Planning Commission does hereby unanimously approve Final Master Development Plan #002 -85 of Greenbrier Village to develop 98.8 acres for residential use with 270 single - family detached traditional housing lots, open space, state - maintained roads, and bonus recreational facilities located on the northwest side of Route 647 in the Opequon Magisterial District. DISCUSSION OF REQUEST FOR ZONING ORDINANCE AMENDMENT Mr. Gyurisin stated that the staff has received a request from Mrs. Betty Benegar to construct a community center on Route 641 East of Stephens City. Mr. Gyurisin said that the zoning ordinance has no specific provisions for community centers as a principal use in any zoning district. He said that the staff suggestion is to allow non - profit community centers in the A -1 and A -2 Zoning Districts as a permitted use and in the RP Zoning District with a conditional use permit. He said that the B -2 District currently allows such a use, if you consider a community center a recreational type activity. Chairman Brumback inquired about the difference between a community center and a fraternal club. Mr. Gyurisin stated that a fraternal club is an internationally or nationally chartered fraternal club whereas a community center is a local organization. Mrs. Betty Benegar came forward and stated that she wanted to start a non - profit Christian Community Center. She said that this will be a place for the children to play where there is no drugs or alcohol. She said there will be a building for year -round indoor recreation for senior citizens and all age groups. Mrs. Benegar said that she would like to install basketball 2092 0912 and tennis courts. She added that James Bowman donated 14 acres of land off Route 641 on condition that a community center be built there. After some discussion, Chairman Brumback instructed the staff to draft an amendment proposal for the Commission to review at their next meeting. Mr. Stiles arrived at this point of the meeting. DISCUSSION OF SEWAGE FACILITIES AT CLEARBROOK /STEPHENSON Mr. Gyurisin explained that the Sanitation Authority has requested the Planning Commission to review a potential project that the Authority has been approached about undertaking to determine if it is in conformance with the Comprehensive Plan. He said that the project involves a couple options to provide a package wastewater treatment plant at the Clearbrook interchange and Route 11 to serve the businesses and industries around that interchange. Mr. Gyurisin next explained the Authority's options to the Commission. The Commission directed the staff to refer this matter to the Rural Community Center Subcommittee, who will meet in the near future to consider land development patterns in Clearbrook and Stephenson, for a specific recommendation on these utility proposals. FIRE PROTECTION COMMITTEE REPORT Mr. Golladay presented a set of recommendations from the Fire Protection Committee concerning proposed additions to the Frederick County Code to systematically regulate the provision of fire protection measures in the County. Mr. Golladay stated that these recommendations define fire protection in urban areas with water and sewer. He said that the Committee used the County's Sanitation Authority requirements on hydrants, water lines, 2093 -4— and they also took the amount of water pressure that the Authority could supply under consideration. Mr. Walt Cunningham, Chairman of the Board of Supervisors' Fire and Rescue Committee, said he felt sure these recommendations would solve a lot of the problems they had experienced in the past. Mr. C. William Orndoff, Board of Supervisors' liaison to the Fire and Rescue Committee, stated that in the near future they will begin work on fire protection for rural areas without public water and sewer. Upon motion made by Mr. Golladay, seconded by Mr. Stiles, BE IT RESOLVED, That the Frederick County Planning Commission does hereby unanimously approve of the Fire Protection Committee recommendations with the following two additions: 1. A decision by the County Administrator and Permit Center Administrators should be made to determine who will administer the interpretation of the ordinance. 2. All references made to the N.F.P.A. 1231, "Standard on Water Supplies for Suburban and Rural Fire Fighting," be deleted until such code is reviewed and approved by the Fire Protection Committee. Col. Myers and Mr. Stiles left the meeting at this time. URBAN ORDINANCE SUBCOMMITTEE RECOMMENDATIONS Mr. Gyurisin presented the Urban Ordinance Subcommittee recommendations dealing with the RP (Residential Performance) Zoning District and Subdivision Codes. He said that these recommendations are being presented to the Commission at this time for information only and will later be written in ordinance form by the staff for the Commission's approval. Mr. Gyurisin next reviewed each of the recommendations with the Commission. The Commission accepted the recommendations of the Subcommittee for their information. 2094 -5- ADJOURNMENT There being no further business to discuss, the meeting adjourned.
