FREDERICK COUNTY PLANNING COMMISSION
Held in the Board of Supervisors' Meeting Room, 9 Court Square, Winchester,
Virginia, on April 17, 1985.

CALL TO ORDER
Chairman Brumback called the meeting to order at 2:00 p.m. The first
order of business was the consideration of the minutes of April 3, 1985.
Upon motion made by Mr. Golladay and seconded by Mr. Romine, the minutes were
unanimously approved as presented.
BIMONTHLY REPORT
The Commission and staff discussed pending applications.
COMMITTEE REPORTS
Economic Development Commission
Mr. Romine, Coordinator for the Economic Development Commission,
reported that an Inducement Resolution was approved for a new company,
McElroy Metal Mill, Inc., and they will be coming before the Planning
Commission with a site plan and subdivision in the near future. Mr. Romine
said that the EDC will also be meeting with the Leland Corporation tomorrow
in order to introduce this new company to the community.
Sanitation Commission
Mrs. Copenhaver, Liaison to the Sanitation Commission, stated that the

Sanitation Commission met Monday to review the budget. She added that after
reviewing costs and recovery for the extension of a water line out Route 7 to
a trailer park, the Sanitation Commission tabled this item for further
study.
PUBLIC HEARING
South Frederick Agricultural and Forestal District
ACTION — Approved
Mr. Horne gave the Commission some background information regarding
the Agricultural and Forestal District. Mr. Horne said that the Agricultural
Advisory Board met on March 4, 1985 and recommended that the existing South
Frederick Agricultural and Forestal District remain in affect as is and also
recommended approval of the inclusion of the additional parcels and owners
petitioning to be added to the District.
Chairman Brumback asked if the review period was set as a permanent
date and Mr. Horne replied that the ordinance could be amended to approve a
review date.
Mr. Golladay inquired on how far you could be from the core of the
District and still be eligible for inclusion. Mr. Horne replied that an
applicant could be no more than one mile from any point of the continuous
edge of the District.
Mr. Golladay moved to recommend to the Board of Supervisors the
approval of the renewal of the present South Frederick Agricultural and
Forestal District and the inclusion of the additional acreage to that
District. Mr. Golladay also moved that the review period for the District be
no less than four years and no more than five years from the last review
period. Mr. Romine seconded these motions.

BE IT RESOLVED, That the Frederick County Planning Commission does hereby
unanimously recommend to the Board of Supervisors that the present South
Frederick Agricultural and Forestal District be renewed, that the additional
acreage be added to that District, and that future review periods be no less
than four years and no more than five years from the last review period.
DISCUSSION OF PROPOSED AMENDMENTS TO THE FREDERICK COUNTY ZONING ORDINANCE
The Commission first discussed three ordinance proposals on
dimensional requirements. Those proposals were:
1. An ordinance to amend the Frederick County Code, Chapter 21, Zoning,
Article V, RP (Residential Performance) District, Section 5 -5, Dimensional
Requirements Paragraph 5 -5 -3, Single - Family Detached Cluster, with the
addition of the following:
5 -5 -3.8 Maximum Lot Area - 10,000 square feet
2. An ordinance to amend the Frederick County Code, Chapter 21, Zoning,
Article V, RP (Residential Performance) District, Section 5 -5, Dimensional
Requirements Paragraph 5 -5 -4, Single - Family Detached Zero Lot Lines, as
follows:
5 -5 -4.1 Minimum Lot Area - 6,000 square feet (reduced from 7,000 sq.ft.)
5 -5 -4.2 Average Lot Area - 7,000 square feet (reduced from 8,000 sq.ft.)
5 -5 -4.10 Maximum Lot Area - 8,000 square feet
3. An ordinance to amend the Frederick County Code, Chapter 21, Zoning,
Article V, RP (Residential Performance) District, Section 5-5, Dimensional
Requirements Paragraph 5 -5 -5, Patio House, as follows:
5 -5 -5.1 Dimensional Requirements- 1 Bedroom 2,800 minimum lot area sq.ft.
3,000 average lot area sq.ft.
- 2 Bedroom 3,200 minimum lot area sq.ft.
3,600 average lot area sq.ft.
- 3 Bedroom+ 3,800 minimum lot area sq.ft.
4,000 average lot area sq.ft.
5 -5 -5.6 Maximum Lot Area - 4,200 square feet
Mr. Horne said that after talking with several developers, the staff
felt that the first three proposals on dimensional requirements may be too
rigid and may not meet the intent of cluster development.

Mr. Ronnie Ward, developer and member of the Rural Ordinance
Subcommittee, said that he would like to see these changes go back before the
Subcommittee for review.
Chairman Brumback requested that the staff send these changes to the
Subcommittee.
The next item discussed was an ordinance to amend the Frederick County
Code, Chapter 21, Zoning, Article VI, Master Development Plan, Section 6 -7,
Master Development Plan Procedures The specific change involved was the
submittal of 20 copies of the Preliminary Master Development Plan instead 12
in order in give the Board of Supervisors an opportunity to review the
Preliminary Master Development Plan. The applicant would submit only 12
copies of the Final Master Development Plan because the Final Plan would only
be reviewed by the Planning Commission. This amendment was unanimously
approved for advertising after motion by Mr. Golladay and seconded by Mr.
McDonald, as follows:
6 -7 -1 All applicants shall submit twenty (20) copies of a Preliminary
Master Development Plan and application to the Department of
Planning and Development and request a review conference. The
purpose of the review conference is to review and discuss the
nature of the proposal in relationship to this article. Upon
receipt, the Director of Planning and Development shall notify
necessary departments and agencies to solicit comments and shall
forward such comments to the Planning Commission and Board of
Supervisors along with a description of the Preliminary Master
Development Plan for Planning Commission recommendation to the
Board of Supervisors for approval or disapproval. Upon approval
of a Preliminary Master Development Plan, the applicant may submit
a Final Master Development Plan.
6 -7 -2 All applicants shall submit twelve (12) copies of a Final Master
Development Plan and application to the Department of Planning and
Development after Board of Supervisors approval of the Preliminary
Master Development Plan. Upon receipt, the Director of Planning
and Development shall notify and solicit comments from appropriate
agencies and shall forward such comments and a description to the
Planning Commission for approval or disapproval.
With regard to the amendment on drainage, Minimum Standards and
Improvements Required motion was made by Col. Myers, seconded by Mr.
McDonald, and unanimously approved for advertising, as follows:
An ordinance to amend the Frederick County Code, Chapter 21, Zoning, Article
XIX, Site Plans, Section 19 -5, Minimum Standards and Improvements Requir

19 -5 -13 Adequate drainage for the disposition of storm and natural waters
both on and off the site shall be provided the extent and nature
of both on -site and off -site treatment is to be determined by the
developer in conference with the agent for Frederick County. The
agent may require that post development runoff rates not exceed
predevelopment runoff rates for storm and natural water on
individual proposals requiring site plans or amended site plans.
The specific change on this ordinance amendment was the addition of
the last sentence to Paragraph 19 -5 -13.

The next item discussed was an ordinance to amend the Frederick County
Code, Chapter 21, Zoning, Article XIV, M -1 (Light Industrial) District by the
deletion of Paragraph 14- 2 -1.3: All outside storage shall be fully screened
in accordance with Section 14 -3 of this article and all outside storage areas
shall be identified on the site plan; and by the amending of Paragraph 14 -3 -2
to read: Permitted uses shall be conducted wholely within a completely
enclosed building or within an area shown on the site plan. Motion was made
by Mr. Golladay, seconded by Mr. Romine, and unanimously approved for
advertisement.
The last item discussed was an ordinance to amend the Frederick County
Code, Chapter 21, Zoning, Article XV, M -2 (Industrial, General) District.
This amendment involved the use of adequate landscaping and /or screening, to
be determined by the administrator, to protect surrounding property.
Motion was made by Mr. Golladay, seconded by Col. Myers, and
unanimously passed to approve the amendment for advertising as follows:
Section 15 -4 Requirements for Permitted Uses:
Paragraph 15 -4 -2 Permitted uses shall be conducted wholely within a
completely enclosed building or in an area shown on the
site plan. Within any required yards there may be
required adequate landscaping and /or screening to
protect surrounding property from adverse affects. The
extent of such required landscaping and /or screening
shall be determined by the administrator who may refer
the matter to the Planning Commission.
