FREDERICK COUNTY PLANNING COMMISSION
Held in the Board of Supervisors' Meeting Room, 9 Court Square, Winchester,
Virginia, on March 20, 1985.

CALL TO ORDER
Chairman Brumback called the meeting to order at 2:00 p.m. The first
order of business was the consideration of the minutes of March 6, 1985.
Upon motion made by Mr. Romine and seconded by Mr. Golladay, the minutes were
unanimously approved as presented.
BIMONTHLY REPORT
Pending applications were discussed.
COMMITTEE REPORTS
Economic Development Commission
Mr. Romine, Economic Development Coordinator, said that there has been
considerable prospect contact activity.
Sanitation Commission
Mrs. Copenhaver, Liaison to the Sanitation Commission, said that a
request has been made to the Commission for extension of sewer to Route 50
West by Mr. Ralph Poe.
SITE PLANS
Site Plan X1006 -85 of Shockey Brothers, Inc. for a steel fabrication building
on Route 11 North in the Stonewall Magisterial District.
ACTION - Approved
Mr. Horne gave the background information.

Mr. Ralph Shockey came forward to address the Commission. Mr. Shockey
said that over the past several years they have been moving their
manufacturing operations back off of Route 11 North about 1200' onto other
property they own. He said that the steel fabrication is the only operation
left. Mr. Shockey said that this move and proposed structure would house
this operation.
Mr. Douglas Russell, adjoining property owner, came forward. Mr.
Russell said that the dirt and dust was very bad and created a health hazard.
He was also concerned about the heavy traffic.
Mr. Horne said that the operation that is currently taking place
behind Mr. Russell's house is the one to be moved under this proposal.
Mr. Stiles moved for approval of this site plan with the understanding
that the proposal will not change any significant traffic volume on the site.
This motion was seconded by Mr. Romine and passed unanimously.
BE IT RESOLVED, That the Frederick County Planning Commission does hereby
approve Site Plan #006 -85 of Shockey Brothers, Inc. for the construction of a
14,450 square foot addition for steel fabrication, in conjunction with the
existing concrete industry, on Route 11 North of Winchester at the Shockey
property in the Stonewall Magisterial District with the understanding that
this operation will not significantly change any traffic volume on the site.
At this point of the meeting, motion was made by Mr. Golladay,
seconded by Mr. Kirk, and passed unanimously to amend the meeting's agenda to
add the consideration of Conditional Use Permit #003 -85 of Zulfigar Ahmed
which was tabled at the last meeting, but omitted from this agenda.
Site Plan x/007 -85 of Weber's Nursery and Garden Center for the addition of a
greenhouse structure.
ACTION - Approved

Mr. Horne read the background information. Mr. Horne said that a
building permit has been issued and the greenhouse is presently under
construction. He added that the Highway Department has stated that the
entrances are substandard and should be brought to their minimum commercial
entrance standards.
Mr. Michael Weber, owner, said that he would not put in a commercial
entrance because the Highway Department does not maintain Route 11 and they
have not taken care of a flooding problem that has existed for years. Mr.
Weber proceeded to explain his dealings with the Highway and Inspections
Department over the years adding that he has cooperated to the extent of
tearing down greenhouses and putting in flower beds along Route 11. With
regard to the Highway Department's comments stating that an entrance was
recently constructed onto Lee Avenue, Mr. Weber said that there have always
been two entrances onto Lee Avenue.
The Commission felt the Highway Department's comments were vague as to
whether a commercial entrance was required or suggested.
Mr. Horne inquired whether the parking area would be changed and Mr.
Weber replied that it would be enlarged slightly.
Upon motion made by Mr. Stiles, seconded by Mr. Golladay,
BE IT RESOLVED, That the Frederick County Planning Commission does hereby
approve Site Plan #007 -85 of Weber's Nursery and Garden Center for the
addition of one 42' x 164' (6,888 square feet) greenhouse structure on
Route 11 North in the Stonewall District, with the condition that the parking
lot area be designated on the plan.
Site Plan #008 -85 of T. G. Scully to develop a 7,133 square foot retail space
into a variety of small retail establishments.
ACTION - Approved
Mr. Horne stated that the entrance design has been updated to show the
Highway Department's requests. He said that this entrance is proposed on a

road that is not currently in the Highway's system, but will be in the
future. He added that the fire company has requested an additional hydrant
to the east of the existing entrance by Toney's Market which would help
protect adjoining properties. Mr. Horne added that the Building Official has
requested a fire lane on both the north and east sides of the building.
Mr. Golladay felt the applicant should not be required to provide
comprehensive fire protection for the whole corner.
Mr. Dave Holliday, representative for Mr. T. G. Scully, was present to
answer questions.
Upon motion made by Mr. Golladay, seconded by Mr. Romine,
BE IT RESOLVED, That the Frederick County Planning Commission does hereby
unanimously approve Site Plan #008 -85 of T. G. Scully to develop a 7,133
square foot retail space into a variety of small retail establishments,
located on Route 277, in the Opequon District, with the addition of a 12'
fire lane on the north and east sides of the existing and proposed building.
Subdivision Request of Glenmont Village to subdivide 30 lots in Sections 4
and 5.
ACTION - Approved
Chairman Brumback relinquished his chairmanship to Mr. Golladay due to
a conflict of interest and he did not participate in any discussion or vote
on this subdivision.
Mr. Horne explained the fire company's suggested locations for
hydrants.
Mr. Ron Ward, one of the owners and developers of Glenmont, came
forward. Mr. Ward said that the Virginia Department of Highways and
Transportation required an additional drainage easement on the lots and this
has been done. Mr. Ward stated that they would place the hydrants every 800'
as required by the Frederick County Sanitation Authority and Frederick County
Subdivision Ordinance.

Upon motion made by Mr. Kirk, and seconded by Mr. Stiles,
BE IT RESOLVED, That the Frederick County Planning Commission does hereby
approve the request of Glenmont Village, as submitted, to subdivide 30 lots
in Sections 4 and 5 (Section 4 -15 lots; Section 5 -15 lots) with required
utilities and state - maintained roads and no additional fire hydrants, for
single- family detached cluster units in the Shawnee Magisterial District.
The vote on this subdivision request was as follows:
YES: Messrs. Golladay, Romine, Kirk, Myers, Stiles, McDonald, and
Mrs. Copenhaver
ABSTAIN: Mr. Brumback
Chairman Brumback presided over the remainder of the meeting.
Conditional Use Permit #003 -85 of Zulfiqar Ahmed for an Outdoor Recreational
Facility /Miniature Golf Course (new owner).
ACTION - Approved
Mr. Horne said that the new owner would take over the miniature golf
course, market, and gas pumping facilities and the original owner would
retain the flea market and go -cart track.
Mr. Zulfiqar Ahmed came forward and stated that he planned to continue
the operation the same as the previous owner.
Upon motion made by Mrs. Copenhaver, seconded by Mr. McDonald,
BE IT RESOLVED, That the Frederick County Planning Commission hereby
unanimously approve Conditional Use Permit #003 -85 of Zulfiqar Ahmed for an
Outdoor Recreational Facility /Miniature Golf Course (new owner) on Route 11
South in the Back Creek District with the following conditions:
1. This is a one year permit to be reviewed and renewed annually by the
staff, Planning Commission, and the Board of Supervisors.
2. If the use, occupancy, or ownership of the property changes, this
conditional use permit will be required.
FREDERICK COUNTY TRANSPORTATION RECOMMENDATIONS

Mr. Gyurisin presented the Transportation Committee's recommendations
for the Virginia Department of Highways and Transportation Six -Year Road
Improvement Plan for interstate, primary, and urban systems for Frederick
County.
Upon motion made by Mr. Stiles, seconded by Mr. Golladay,
BE IT RESOLVED, That the Frederick County Planning Commission does hereby
approve the Transportation Committee's recommendations for projects for the
Six -Year Road Improvement Plan for interstate, primary, and urban systems as
listed in order of priority with the first being the highest priority
project:
A) Continuation of the Route 522 North project to four -lane the remaining
section of this road from Cross Junction to the West Virginia Line.
B) Begin implementation of the County's Transportation Section of the
Comprehensive Plan by studying key intersections as outlined in that plan.
The priorities should be placed on the 1 -81, 37, and Route 11 North
intersection and the I -81 and 50 East intersection.
C) Widening, strengthening and improving Route 11 North and South from the
Winchester City line to Route 37 with priority being placed on improvement
of railroad crossings. Route 11 South should be considered within the
first phase of these improvements.
D) The reestablishment of a previous primary project, Route 522 South,
four - laning of this road from Route 50 East to approximately Route 277.
1985 Program of Work
Mr. Horne presented the 1985 Program of Work for the Department of
Planning and Development.
Mr. Stiles stated that the Board of Supervisors has asked the County
Administrator to undertake an examination of the way the Permit Center is
operating and to draft some recommendations for revising the operations and
this may have an impact on this Plan of Work.
Upon motion made by Mr. Golladay, and seconded by Mr. Kirk, the
Frederick County Planning Commission unanimously approved the 1985 Program of
Work for the Department of Planning and Development.
