OF THE
FREDERICK COUNTY PLANNING COMMISSION
Held in the Board of Supervisors' Meeting Room, 9 Court Square, Winchester,
Virginia, on February 4, 1985.
PRESENT: Frank H. Brumback, Chairman; James Golladay, Jr., Vice - Chairman;
Kenneth Y. Stiles; W. French Kirk; A. Lynn Myers; Manuel C. DeHaven;
Carl M. McDonald; Marjorie H. Copenhaver; George L. Romine; John T.
P. Horne, secretary; Stephen M. Gyurisin, advisory. In attendance
from the Rural Ordinance Subcommittee were Stanley Bauserman, Dave
Holliday, Ron Ward; also present was Bruce Edens.
CALL TO ORDER
Chairman Brumback opened the meeting at 7:00 p.m. and stated that he
felt in lieu of further explanation of the proposal by the subcommittee that
this meeting should be devoted to questions that various Planning Commission
members may have. Mr. DeHaven had a question as to family variances and
asked if the intent of the family variance would be that only one family
variance lot would be available per family member per county. Mr. Brumback
stated that this was the intent of the subcommittee. Mr. DeHaven then had a
question as to the minimum lot size of the minor subdivision lots. Mr.
Brumback stated that there would be no minimum lot size and the lot size
would be dictated by the requirements of the Health Department and the yard
regulations of the Zoning Ordinance.
Mr. Stiles stated that he felt the upper -end acreage cut -off of 20
acres should be changed to 5 acres and this could possibly be combined with
increased road standards on the private road ways. Various members of the
subcommittee mentioned that they had considered road standards and felt they
would be too difficult for the existing county staff to enforce and therefore
had resolved to concentrate their efforts on the establishment of an
effective home owners' association.
Mr. DeHaven had a question as to the effects and necessity of the
required 300' setback for major subdivision housing from adjacent farming
uses and the required 300' frontage on lots that front on arterial and
collector roads. There insued a long discussion as to the necessity and
effects of these requirements and the Commission by consensus agreed to add
additional wording to allow for flexibility to the Planning Commission and
Board of Supervisors in the application of these 300' setbacks. It was
agreed that the 300' frontage requirement would remain. Mr. Stiles next
requested that the County Attorney review the legality of Factor #1 in the
site factors and to review the entire ordinance package prior to any
advertisement for public hearing.
Mr. Brumback next polled the Commission as to their feelings as to
the package as it was presented by the subcommittee. Mr. Brumback, Mrs.
Copenhaver, Mr. Kirk, Mr. Myers, Mr. McDonald, Mr. Romine, Mr. Bauserman, Mr.
Holliday, Mr. Ward, and Mr. Edens stated that they were in agreement with the

package as it was presented. Mr. DeHaven and Mr. Stiles expressed their
feeling that the upper -end acreage cut -off should be reduced. Mr. Golladay
expressed some general concerns about the proposals. It was agreed that the
staff would be directed to request a worksession with the Board of
Supervisors as soon as possible.
ADJOURNMENT
There being no further business, Mr. Brumback adjourned the meeting.
