PC_10-17-84_Meeting_MinutesMINUTES OF THE MEETING OF THE FREDERICK COUNTY PLANNING COMMISSION Held in the Board of Supervisors' meeting room, 9 Court Square, Winchester, Virginia, on October 17, 1984. PRESENT: Frank Brumback, Chairman; James Golladay, Vice - Chairman; Carl M. McDonald; A. Lynn Myers; Manuel C. DeHaven; Kenneth Y. Stiles; Marjorie H. Copenhaver; W. French Kirk; John T. P. Horne, secretary; Stephen M. Gyurisin, advisory ABSENT: George L. Romine CALL TO ORDER Chairman Brumback called the meeting to order at 2:00 p.m. BIMONTHLY AND MONTHLY REPORTS The Commission and staff reviewed pending applications. INFORMAL DISCUSSION ON PROPOSED REZONING Mr. Horne said that Mr. Richard Hardison and Mr. Ralph Gregory were present to informally discuss a proposed rezoning of property located on Route 11 South across from the Division of Motor Vehicles between Route 11 and Interstate 81. He said the immediate short -range plan for use of some of the property is for an air - freight delivery service. The long -range plan is to use the remaining portions of the property for additional industrial and /or commercial growth. Mr. Horne explained that there is some concern on the extension of sewer facilities from the Lakeview Townhouse area because of an infiltration problem in that system. Mr. Horne added that the State Water Control Board may place a limitation or moritorium on further connections to this system. 1974 -2- Mr. Richard Hardison came forward and introduced himself to the Commission. Mr. Hardison stated that Mr. Jones of the Sanitation Authority felt that the infiltration problem would be cleared within a year. He said that the possibility also exists of installing their own treatment facility. Mr. Ralph Gregory next came forward and introduced himself to the Commission. Mr. Gregory explained that he wanted to receive the Planning Commission's feelings on the rezoning of this property before they actually submitted an application or continued with planning. Mr. Gregory felt that this property was the key to the development of the whole Kernstown area. He added that this land has an underpass under I -81 which could be useable to run sewage under. The Commission members expressed their general support for the concept, but felt that they would need a more specific development plan in order to comment further. SUBDIVISIONS Subdivision Request of James M. Horton to subdivide one 4.50 acre lot for the sale of existing market, miniature golf course, and additional land on Route 11, south of Route 37, at Horton's Market. ACTION - Approved Mr. Horne read the background information. Mr. James Horton came forward and introduced himself to the Commission. Chairman Brumback inquired on how much of the commercial complex would be subdivided off. Mr. Horton answered that he would subdivide off the market and golf course which includes about 4 1/2 acres. Mr. Horton said that he would retain the fence, road, go -cart area, and flea market area which totals 45 acres. 1975 -3— Upon motion made by Mrs. Copenhaver, seconded by Mr. Stiles, and unanimously approved, BE IT RESOLVED, That the Frederick County Planning Commission does hereby approve the subdivision request of James M. Horton to subdivide one 4.50 acre lot for the sale of existing market, miniature golf course, and additional land on Route 11, south of Route 37, at Horton's Market in the Back Creek Magisterial District. DISCUSSION OF PROPOSED „ORDINANCE AMENDMENTS Mr. Horne presented two ordinance amendment proposals for review by the Commission. The first amendment dealing with gas pump canopies for retail service stations and stores would allow canopies to be placed closer to the right —of —way than other structures. Motion was made by Mr. Stiles, seconded by Mr. Myers, and unanimously approved to advertise for public hearing as presented. The second proposal dealing with mobile homes and trailers would prohibit the use of these structures as accessory buildings secondary to the main building or house. Mr. Stiles requested that the staff provide a list of properties in the county where this situation is currently taking place. The Commissioners felt that the prohibition of these mobile homes as accessory structures in'residential zones was acceptable, but they should study the matter further in agricultural zones. UPCOMING MEETINGS Mr. Gyurisin announced that the next Rural Community Center meeting will be October 23, 1984 at 7:00 p.m. for the Reynolds Store, Cross Junction, and Whitarce area. He also announced that the rural meeting for the Star Tannery area will be held on November 1, 1984 at 7:00 p.m. at the Star 1976 -4- Tannery Fire Hall. Mr. Gyurisin stated that all Planning Commission members are invited to attend. ADJOURNMENT There being no further business to discuss, the meeting adjourned.
