PC_08-28-84_Meeting_MinutesMINUTES OF THE WORKSESSION OF THE FREDERICK COUNTY PLANNING COMMISSION Held in the Board of Supervisors' Meeting Room, 9 Court Square, Winchester, Virginia, on August 28, 1984. PRESENT: Frank H. Brumback, Chairman; W. French Kirk; A. Lynn Myers; Manuel C. DeHaven; Carl M. McDonald; Marjorie H. Copenhaver; George L. Romine; John T. P. Horne, secretary; Stephen M. Gyurisin, advisory; John R. Riley, County Administrator ABSENT: James Golladay, Jr., Vice- Chairman; Kenneth Y. Stiles CALL TO ORDER Chairman Brumback opened the meeting and requested that Mr. Horne brief the Commission on the contents of the staff memorandum. ,Mr. Horne proceeded to outline the highlights of the staff memorandum concerning the I proposed application for amendment to the M -1 zoning regulations to allow for gymnastics centers. Mr. Horne briefly outlined the findings that the staff had compiled concerning the activities of other communities and the potential impacts of an amendment to the industrial zones and location of this type of use in an industrial zone in the area. Mr. Brumback then proceeded to poll the Commission on their attitudes concerning this particular request. Mr. Romine expressed concerns as to the impact of this proposed use on the marketability of land in our industrial park areas. Mr. Myers felt that the Commission had a contract with the previous owners in that those owners were relying on the industrial zoning in the area to make their future plans. Mr. DeHaven felt that possibly agricultural zones with a conditional use permit may be more suitable for this type of use. Mrs. Copenhaver felt that the gymnastics training center could be a valuable addition to the community, but other areas may be more 1956 - 2 - suitable than an industrial zone. Mr. Kirk agreed with the concensus of the Commission. The Chairman then asked the applicant and her representatives to express their opinions on this particular item. Mr. Jim Wilson, who would be the proposed builder of a building for Ms. Hadley, felt that the future use of a building in a B -2 zoning district that would meet the physical requirements of a gymnastics center would be quite limited. This is due to the physical characteristics such as large ceilings and large open areas. Mr. Wilson stated that he did not necessarily disagree with the Commission's view on the M -1 zoning district. Ms. Hadley stated that her primary concern was to open the business by spring of 1985 and would be willing to do this in any appropriate zoning district that the Commission felt was suitable. , She did state that the price for most B -2 properties in Frederick County at this time was far too high to justify the purchase of the property for this type of building. After receiving these comments, the Commission had a brief discussion and came to the concensus that the B -3 zoning regulations could be amended to allow this type of use. The Commission also agreed that the definition of this use should be relatively broad so as to allow other similar type uses in the B -3 and not restrict the use simply to gymnastics centers. Chairman Brumback informed Ms. Hadley of her right to petition for amendment to the M -1 section of the zoning ordinance, if she chose to do so. The staff was directed by the Commission to draft an amendment to the B -3 zoning districts to allow this use and similar uses as permitted uses in the B -3 zoning district. 1957 - 3 - There being no further business, the Chairman adjourned the meeting.
