PC_07-18-84_Meeting_MinutesMINUTES OF THE MEETING OF THE FREDERICK COUNTY PLANNING COMMISSION Held in the Board of Supervisors' Meeting Room, 9 Court Square, Winchester, Virginia, on July 18, 1984. PRESENT: Frank H. Brumback, Chairman; James Golladay, Jr., Vice - Chairman; George L. Romine; W. French Kirk; A. Lynn Myers; Manuel C. DeHaven; Carl M. McDonald; Marjorie H. Copenhaver; John T. P. Horne, secretary; Stephen M. Gyurisin, advisory ABSENT: Kenneth Y. Stiles CALL TO ORDER Chairman Brumback called the meeting to order at 2:00 p.m. The first order of business was the consideration of the minutes of July 3, 1984. Upon motion made by Mr. Romine and seconded by Mr. Kirk, the minutes were unanimously approved. MONTHLY AND BIMONTHLY REPORTS The Commission and staff discussed pending applications. SITE PLANS Site Plan #011 -75 of Capitol Records, zoned M -2 (Industrial - General), for the addition of a tank farm in the Back Creek Magisterial District. ACTION - Approved Mr. Horne gave the background information. Mr. Dave McClure, architect for Howard Shockey and Sons and representative for Capitol Records, came forward to answer any questions. Mr. McClure stated that he is coordinating the work with Capitol Magnetics in Connecticut. Mr. McClure said there will be two tank farms, one with eight six - thousand gallon tanks and the other farm with four twelve- thousand gallon tanks. He stated that there will be three flammable solvents stored in the 1933 09 tanks and blast protection will be provided inside the building in case the solvents catch fire. He added that there is a two -foot high wall around each tank farm with a plugged drainage outlet in case of a spillage. Mr. Horne stated that when the construction proceeds the staff will set up a meeting with officials from the Stephens City Fire Company, Frederick County, and Capitol Records to discuss fire prevention and fire fighting needs. Mr. McDonald inquired as to the distance between the tank farm and the nearest adjoining property. Mr. Horne stated that the nearest structures would be either the homes on Shawnee Drive or Gabler's facility which would be 200 -300 yards away. Mr. Horne added that there is a farm house to the south about 1/4 mile. Mrs. Copenhaver moved to approve amended Site Plan #011 -75 of Capitol Records with the provision that the fire companies work out the emergency plan with Capitol Records officials. This motion was seconded by Mr. McDonald and unanimously passed. BE IT RESOLVED, That the Frederick County Planning Commission does hereby approve amended Site Plan #011 -75 of Capitol Records for an addition of two tank farms to the existing structure located on Route 652, south of Winchester, in the Back Creek Magisterial District. Site Plan #017 -84 of Roadway Express, zoned M -1 (Light Industrial), for a truck terminal and accessory use in the Stonewall Magisterial District. ACTION - Approved Mr. Horne read the background information. He said that a detention basin will be placed on the site which will initially act as an erosion control device and ultimately will serve as a stormwater control device. Mr. Horne said that there will be two entrances to the site. He added that the 1934 -3- sewer and water lines will be extended to the property and the road will be built prior to occupancy. Mr. Tom'Gilpin, representative for Lenoir City Corporation of Virginia and developer for Roadway Express, came forward and introduced himself to the Commission. In answer to Chairman Brumback's question, Mr. Gilpin stated that the site consists of 5.3 acres. Mr. Gilpin then introduced Mr. Lewis Mustian, Terminal Manager for Roadway Express. Chairman Brumback inquired on the frequency of trucks entering and leaving the site. Mr. Mustian stated that on Sunday evenings they will operate from midnight until 9 :00 Monday night and Tuesdays, Thursdays, and Fridays they will open at 4:00 a.m. and close at 9:00 P.M. Chairman Brumback asked how much area would be under pavement. Mr. Mustian said 320' x 350' or 1 3/4 acres will be paved surface.! i Mr. DeHaven inquired on the lease arrangement made on the building. Mr. Mustian stated that the best deal for both parties was a 15 -year lease. Mr. Mustian said that.the building will remain as a Roadway Express operation for 15 years. Mr. DeHaven moved for approval of Site Plan #017 -84 of Roadway Express. This motion was seconded by Mr. Romine and passed unanimously. BE IT RESOLVED, That the Frederick County Planning Commission does hereby approve Site Plan $017 -84 of Roadway Express for a truck terminal and accessory use on Lenoir Drive, off Route 661, in the Stonewall Magisterial District. SUBDIVISIONS Final Plat of Glenmont Village, Sections One, Two, and Three to subdivide 45 single - family cluster lots and state - maintained roadways on Route 657, Senseny Road, and Route 736, Rossum Lane, in the Shawnee Magisterial District. 1935 -4— ACTION — Approved Chairman Brumback relinquished the chair to Mr. James Golladay, Jr., Vice — Chairman, for the hearing on this subdivision because of a possible conflict of interest. Chairman Brumback stated that he would not participate in the discussion of this item of business. Mr. Horne gave the background information. He added that the annual assessment for maintenance and perpetuation of the open areas has been set at $30 per year. Mr. Ronnie Ward, representative of BGW, Inc., came forward to answer questions from the Commission. Vice — Chairman Golladay asked if Route 736 would remain as a gravel road. Mr. Ward replied that a proposal was made to the Virginia Department of Highways and Transportation to have the road tarred and chipped but, unfortunately, it was not approved for this year. Mr. Ward added that Route 736 is a state — maintained gravel road. There being no further questions for Mr. Ward, Mr. Kirk moved for approval of the Final Plat of Sections One, Two, and Three of Glenmont Village Subdivision. This motion was seconded by Mr. Romine. BE IT RESOLVED, That the Frederick County Planning Commission does hereby approve the Final Plat for Sections One, Two, and Three of Glenmont Village to subdivide 45 single — family cluster lots and state — maintained roadways on Route 657, Senseny Road, and Route 736, Rossum Lane, in the Shawnee Magisterial District. The vote on this subdivision was as follows: YES: Mrs. Copenhaver, and Messrs. McDonald, Myers, Golladay, DeHaven, Kirk, and Romine ABSTAIN: Mr. Brumback 1936 -5- Preliminary Master Development Plan #002 -84 of Albin Village for 219 single - family detached housing lots in the Opequon Magisterial District. Chairman Brumback announced that due to some complications that have arisen with the applicant, this Master Development Plan was not ready to be heard by the Commission. Preliminary Master Development Plan #003 -84 of Henry Apartments to construct 54 garden apartment units in nine buildings with required parking and recreational facilities in the Shawnee Magisterial District. ACTION - Approved Mr. Horne read the background material. Mr. Kim Henry, applicant, came forward and introduced himself to the Commission. Mr. Henry said that he realized they were infringing on the buffer zone, but they planned to use total screening and lower the elevation of the first two buildings on the right hand side. In reply to Mr. Golladay's question, Mr. Horne stated that water and sewer would be supplied by the City of Winchester. There were no adjoining property owners present to speak in favor or opposition. Mr. Kirk next moved for approval of the Preliminary Master Development Plan X6003 -84. This motion was seconded by Mr. Romine and passed unanimously. BE IT RESOLVED, That the Frederick County Planning Commission does hereby approve Preliminary Master Development Plan #003 -84 of Henry Apartments to construct 54 garden apartment units in nine buildings with required parking and recreational facilities, located adjacent to Senseny Heights Subdivision on Senseny Road, in the Shawnee Magisterial District. DISCUSSION ON FRONT YARD SETBACK VARIANCES 1937 Mr. Gyurisin stated that the ordinance presently does not allow the administrator any discretion in varying the setback requirement for a new structure being built in a neighborhood where the setback lines have previously been established. The only alternative available is to build the structure at the setback required by the ordinance or appeal to the Board of Zoning Appeals for a variance. Mr. Gyurisin presented an ordinance amendment that would allow the administrator to take the average setback distance of the adjacent lots on the same road and in the same zoning district to establish a setback line for the new structure similar to those structures in the existing neighborhood. Col. Myers moved to instruct the staff to advertise this amendment for the August 1 public hearing. This motion was seconded by Mr. Kirk and passed unanimously. ARMEL RURAL COMMUNITY CENTER MEETING Mr. Golladay announced that the next Rural Community Center Subcommittee meeting will be the Armel meeting, held at the Macedonia United Methodist Church on July 26, 1984 at 7:00 p.m. REVIEW COMMENTS FOR PLANS AND PLATS Mr. Horne stated that he would like to submit an ordinance amendment clarifying which agencies are authorized to make comments on plans and plats. Mr. Horne said that this amendment would not change the intent of the ordinance, but would only be an administrative clarification item. The Commission agreed that the authority for the staff and Planning Commission to require agency comments was somewhat vague in the ordinance and instructed the staff to advertise this admendment for August 1. 1938 . -7— ADJOURNMENT There being no further items of business, the Commission adjourned.
