FREDERICK COUNTY PLANNING COMMISSION
Held in the Board of Supervisors' Meeting Room, 9 Court Square, Winchester,
Virginia, on July 3, 1984.

CALL TO ORDER
Chairman Brumback called the meeting to order at 7:00 p.m.
The first order of business was the consideration of the minutes of
June 6, 1984. Upon motion made by Mr. Golladay and seconded by Mr. Romine,
the minutes were unanimously approved.
(Mr. Stiles was not present for this vote.)
The next order of business was the consideration of the minutes of
June 20, 1984. Mr. Golladay noted a typographical error on page 3. Mr. Kirk
then moved to approve the minutes as corrected. This motion was seconded by
Mr. Romine and passed unanimously.
(Mr. Stiles was not present for this vote.)
BIMONTHLY REPORT
The Commission and staff discussed pending applications.
SITE PLANS
Site Plan #014 -84 of House of Jacob for a church and accessory parking in the
Stonewall Magisterial District.
ACTION - Approved
Mr. Horne gave the background information. He stated that the church
will be built close to the existing shelter and the existing shelter will
eventually be removed.

Elder Charles Boles, representing the House of Jacob, came forward.
Elder Boles said the building will be 35' x 66', it will be 150' from Route
661 and 98' from Route 656.
Mr. Stiles inquired if the parking lot would need to be paved. Mr.
Horne stated that there is a provision in the ordinance for Agricultural
Zones which states that the Planning Commission may exempt the applicant from
paving a parking lot. Mr. Horne noted that the parking lot is shown unpaved
on the site plan.
Col. Myers inquired about the Highway Department comments. Mr. Horne
said that the commercial entrance for this site will not necessarily be curb
and gutter. Because this road has a very narrow right -of -way width, the
entrance will be expanded to a 30' wide paved entrance, which is the other
version of a commercial entrance. Mr. Horne stated that this is the way it
is shown on this site plan.
Upon motion by Mr. Stiles, seconded by Mr. Kirk, this site plan was
unanimously approved.
BE IT RESOLVED, That the Frederick County Planning Commission does hereby
approve Site Plan #014 -84 of House of Jacob for a church and accessory
parking at the intersection of Route 656 and Route 661 in the Stonewall
Magisterial District.
DISCUSSION OF ORDINANCE AMENDMENT ON M -1 AND M -2 HEIGHT REGULATIONS
As Coordinator of the Winchester - Frederick County Economic Development
Commission, Mr. Romine requested that an amendment be made to the M -1 and M -2
zoning districts changing the height limitations for buildings from 35' to
45'. Mr. Romine stated that a viable client who is now in the final stages
of negotiations needs a height of between 42' to 43'.
Mr. DeHaven felt this change should be made for the EM (Extractive
Manufacturing) District also.

After some discussion, the Commission agreed that there was a need for
this change to the height limitations and requested that the staff present a
draft at the next meeting.
NATIONAL ASSOCIATION OF COUNTIES ACHIEVEMENT AWARD
Mr. Horne stated that three county departments applied for achievement
awards this year and all three were presented with achievement awards. He
said that the award presented to the Planning Department was for the
Frederick County Comprehensive Plan and the Residential Performance Zoning
District.
PUBLIC HEARINGS
Rezoning Request #006 -84 of J. P. Darlington to rezone 20.011 acres from RP
(Residential Performance) to M -1 (Industrial, Limited) in the Stonewall
Magisterial District.
ACTION - Approved
Mr. Horne read the background information. He added that this request
would be considered a speculative rezoning in that there is no proposal for
the property at this time.
The Commission next discussed zoning of the adjacent properties.
Mr. Randolph Larrick, representing Mr. J. P. Darlington, came
forward.
Mr. Stiles asked if the only access to this property was through
industrial land and Mr. Horne replied that this was correct.
Mr. Golladay asked if sewer and water were available and Mr. Larrick
replied that they were. Mr. Larrick added that Mr. Darlington will extend
lines to the existing sewer main.

Upon motion made by Mr. DeHaven, seconded by Mr. Golladay, and passed
unanimously,
BE IT RESOLVED, That the Frederick County Planning Commission does hereby
approve Rezoning Request #006 -84 of J. P. Darlington to rezone 20.011 acres
from RP (Residential Performance) to M -1 (Industrial, Limited), located west
of I -81, east of Baker Lane, and north of Apple Valley Square in the
Stonewall Magisterial District.
Conditional Use Permit #004 -84 of Wayne M. Brandt III for a Cottage
Occupation /Welding Shop in the Stonewall Magisterial District.
ACTION - Approved
Chairman Brumback asked Mr. Horne about the proximity of adjacent
residences. Mr. Horne stated that Mr. Brandt's house is 14' from his
property line with another 15' to the next house. He said there is another
residence to the rear of the property, about 100' - 150'.
Mr. Wayne M. Brandt III, applicant, came forward and stated that he
would like to open this shop as a part -time business /hobby. Mr. Brandt said
that he will be doing arc welding with a transformer -type electric welder.
Mr. Brandt said that he would like to be permitted to do outside work when he
makes his 5' x 10' tote trailers.
Mr. Stiles suggested the addition of condition #4, "All work to stop
at 10:00 p.m."
Mr. Brumback and other members of the Commission felt that screening
for outside welding for protection of the public should be required.
Mr. DeHaven moved for approval of Conditional Use Permit #004 -84 of
Wayne M. Brandt III with the conditions listed under Staff Recommendations
and the addition of condition #4, All operations to stop at 10:00 p.m. This
motion was seconded by Mr. Romine.
BE IT RESOLVED, That the Frederick County Planning Commission does hereby
approve Conditional Use Permit X6004 -84 of Wayne M. Brandt III for a Cottage

Occupation /Welding Shop on Route 664 in the Stonewall Magisterial District
with the following conditions:
1. This will be a one -year permit to be reviewed and renewed annually by the
staff, Planning Commission, and the Board of Supervisors.
2. If the use, occupancy, or ownership of the property changes,,this
conditional use permit shall expire and a new conditional use permit will
be required.
3. Off- street parking to be provided.
4. All operations to stop at 10:00 p.m.
The vote on this application was:
YES: Mrs. Copenhaver and Messrs. McDonald, Stiles, Myers, Golladay,
DeHaven, Kirk, Romine
NO: Mr. Brumback
Amendment to Conditional Use Permit #004 -81 of Granville M. McCauley for a
public garage in the Gainesboro Magisterial District.
ACTION - Approved
Mr. Horne stated that there are other persons besides members of the
immediate family and the residents of the trailer working on Mr. McCauley's
property. Mr. Horne stated that this is a violation of the conditions of his
conditional use permit. Mr. Horne said that the building is also being used
as an automobile repair facility. He added that Mr. McCauley's original
permit application was for marine motor repairs only.
Mr. Granville McCauley, applicant, came forward and stated that he
would like to amend condition #3 on his permit to allow him three outside
employees.
The Commission next discussed with Mr. McCauley the extent of
automobile repair currently taking place on the property.
Col. Myers next moved to amend the conditions on this permit,
contingent upon Health Department approval. He also moved that repair work

be allowed on automobile motors as well as outboard motors and that there be
a maximum of three employees at the site. This motion was seconded by Mr.
DeHaven and passed unanimously.
BE IT RESOLVED, That the Frederick County Planning Commission does hereby
approve the amendment of conditions on Conditional Use Permit #004 -81 of
Granville M. McCauley, contingent upon Health Department approval, to read as
follows:
1. This will be a one -year permit to be reviewed and renewed annually by the
staff, Planning Commission, and the Board of Supervisors from the date of
final approval.
2. If the use, occupancy, or ownership of the property changes, this
conditional use permit shall expire and a new conditional use permit will
be required.
3. Maximum of three employees at the site.
4. All repair work must be done inside and any outside storage must be
screened.
5. Repair work permitted on both auto and outboard motors.
6. Continued operation is contingent upon Health Department approval of
health facilities at the site.
