PC_02-01-84_Meeting_MinutesMINUTES OF THE MEETING OF THE FREDERICK COUNTY PLANNING COMMISSION Held in the Board of Supervisors' Meeting Room, 9 Court Square, Winchester, Virginia, on February 1, 1984. PRESENT: Frank Brumback, Chairman; James Golladay, Vice - Chairman; George L. Romine; W. French Kirk; A. Lynn Myers; Manuel C. DeHaven; Kenneth Y. Stiles; Carl M. McDonald; John T. P. Horne, advisory; Stephen M. Gyurisin, advisory ABSENT: Marjorie H. Copenhaver CALL TO ORDER Chairman Brumback called the meeting to order at 7:00 p.m. The first order of business was the consideration of the minutes of January 4, 1984. Mr. Kirk noted that Mrs. Lennie Mather's name should be typed the same throughout the minutes. Mr. Kirk also pointed out a typographical error on page 9. There being no further corrections, motion for approval of the minutes was made by Mr. Golladay, seconded by Mr. Kirk, and passed unanimously. (Mr. Stiles was not present for this vote.) BIMONTHLY REPORT The staff discussed pending applications with the Commission. 1983 ANNUAL REPORT Mr. Horne presented the Department of Planning and Development's 1983 Annual Report. Mr. Horne reviewed each section of the report with the Commissioners. Upon reviewing the section on permit statistics, Mr. Stiles asked if an ordinance could be drafted to automatically renew conditional use permits, but continue giving the Planning Commission and Board of Supervisors the right to take action on a permit if needed. Mr. Stiles felt that the number of conditional use permits was becoming overwhelming and in 1850 - 2 - the future, it may be difficult to review each one individually. The staff agreed to work on a draft amendment. SCHEDULE OF FUTURE MEETINGS The Commission scheduled a February 28th Worksession with the Rural Ordinance Subcommittee and tentatively scheduled a March 14th joint meeting with the Board of Supervisors. Mr. Gyurisin stated that the Community Center Subcommittee has scheduled its first community center meeting for February 16th at 7:00 p.m. at the Gainesboro Fire Hall. TRANSPORTATION COMMITTEE Mr. Gyurisin stated that the Transportation Committee met on a request to allow 28' double bottom (twin) trailers, 102" wide trailers, and 48' trailers to use Route 11 South from the southern Winchester City limits (Kernstown) to Route 37. Mr. Gyurisin said that the Transportation Committee recommended to allow Route 11 South from Kernstown to Route 37 to be designated for 96" and 28' double bottom trailers (twin). The Transportation Committee recommended to deny that portion of Route 11 South to be designated for the wider 102" trailers or 48' trailers, until the travel lanes of Route 11 South are enlarged or made wider than the existing width of less than 10' and until the intersection of Route 11 and Shawnee Drive is improved to accomodate a larger turning width for the larger trailers. Mr. Stiles moved to approve the recommendation of the Transportation Committee and to forward it to the Board of Supervisors seconded this motion. Mr. Golladay 1851 - 3 - BE IT RESOLVED, That the Frederick County Planning Commission does hereby approve the recommendation of the Frederick County Transportation Committee as stated above by the follwoing majority vote: YES: Messrs. McDonald, Stiles, Myers, Brumback, Golladay, Kirk NO: Messrs. Romine, DeHaven ZERO LOT LINE BUILDING SPACING Mr. Horne presented a draft amendment to the Frederick County Code, Chapter 21, Zoning, Article V, Residential Performance District, Section 5 -5 -4, Single Family Detached -Zero Lot Line, Paragraph 5- 5 -4.6, lowering the minimum building spacing from 25' to 20' Upon motion by Mr. Stiles, second by Mr. McDonald, BE IT RESOLVED, That the Frederick County Planning Commission does hereby direct the staff to advertise the above ordinance amendment for public hearing. The vote on this action was as follows: YES: Messrs. McDonald, Stiles, Golladay, DeHaven, Kirk, Romine NO: Messrs. Myers, Brumback TRUCK TERMINALS Mr. Horne presented a draft amendment to the Frederick County Code, Chapter 21, Zoning, Article XV, Industrial General District, M -2, Section 21- 127(c), Permitted Uses; Article XIV, Light Industrial District, M -1, Section 21 -120, Permitted Uses; and Article XIII, Industrial Transition District,.B -3, Section 21 -115, Use Regulations. Mr. Horne stated that this amendment would shift truck terminals from M -2 to B -3, M -1, and M -2 Districts as long as the terminals were 300' from a residential structure of a residental neighborhood and a minimum buffer area was provided for all 1852 - 4 - activities to the property line. Upon motion by Mr.�Stiles, second by Mr. Romine, BE IT RESOLVED, That the Frederick County Planning Commission does hereby direct the staff to advertise the above ordinance amendment for public hearing for amendment of the M -1 zone only. The vote on this action was as follows: YES: Messrs. McDonald, Stiles, Myers, Brumback, Kirk, Romine NO: Messrs. DeHaven, Golladay SUBCOMMITTEES OF THE PLANNING COMMISSION The Commissioners reviewed their list of Subcommittees and felt it was not good policy to rotate Subcommittee members each year. The Commissioners felt that it took some time for members to develop expertise in the particular area that they were dealing with and therefore, it would be better for persons to remain on the same subcommittee for a while. Mr. Stiles then moved to delete the sentence in the Subcommittee Section of the Planning Commission Policies that states, "These appointments shall rotate among different members of the Commission on an annual basis." This motion was seconded by Mr. Golladay and passed unanimously. DISCUSSION OF ROUTE 671 Mr. DeHaven brought the Commission's attention to a bad curve on Route 671 near Cedar Hill and said that there have been several severe accidents on this curve. He felt a sign should be placed on the road to temporarily help the situation until a permanent measure could be taken to make the road safer. 1853 - 5 - Mr. Stiles stated that he would bring this to the attention of the Highway Department.
