FREDERICK COUNTY PLANNING COMMISSION
Held in the Board of Supervisors' Meeting Room in the Old Frederick County
Court House, 9 Court Square, Winchester, Virginia, on September 16, 1987.
PRESENT: Planning Commissioners present were: Frank H. Brumback, Chairman;
James W. Golladay, Jr., Vice - Chairman; Marjorie H. Copenhaver;
Kenneth Y. Stiles; S. Blaine Wilson; George L. Romine;
Manuel C. DeHaven; and Carl M. McDonald.
Also present were: Robert W. Watkins, Secretary;
Stephen M. Gyurisin, Advisory; A. Bray Cockerill, Advisory;
ABSENT: A. Lynn Myers
CALL TO ORDER
Chairman Brumback called the meeting to order at 2:00 p.m.
MINUTES
The first order of business was the consideration of the minutes of
September 2, 1987 and they were unanimously approved as presented.
BIMONTHLY REPORT
The Commission and staff reviewed pending applications.
Mr. Watkins reminded the Commission that the new procedure for
master development plans, which is to have the applicant initially give a
presentation on the plan, would begin with this meeting.
COMMITTEE REPORTS
Transportation Committee
Mr. Golladay said that the Transportation Committee will be meeting
on September 28, 1987 from 7:00 to 9:00 p.m. to establish a comprehensive
work program for the remainder of the year.
Mr. Gyurisin said that Mr. Gary Lofton, from the City of Winchester,
will be present to present the City's transportation plan.

Sanitation Authority
Mrs. Copenhaver said that the Sanitation Authority toured the new
Regional Sewage Treatment Plant on September 14, 1987. She also reported
that all of the treatment plants operated within limits last month, until
the heavy rains. Mrs. Copenhaver added that the Sanitation Authority is
purchasing equipment in order to repair line breaks themselves.
Final Subdivision Plat of Bowman - Glaize Land, Zoned B -2, located on Route
50, east of Delco Plaza, in the Shawnee Magisterial District.
Action - Approval
Mr. Watkins noted that the City of Winchester has stated that they
will provide the utility service. He said that City policy requires
approval from the Frederick County Board of Supervisors for the main
extension. Mr. Watkins added that the applicant is proposing the
subdivision of a 39,819 square foot tract from the larger tract on Route
50.
Mr. Stiles suggested that as a matter of procedure, the approval of
extensions be sent to the Board of Supervisors before the Planning
Commission approves the subdivision.
Mr. George Glaize, representing James Bowman and Fred Glaize, came
forward to answer questions. Mr. Glaize said that the applicant is
planning retail sales for this property.
Upon motion made by Mr. Wilson and seconded by Mr. Romine,
BE IT RESOLVED, That the Frederick County Planning Commission does hereby
unanimously approve the subdivision of the Bowman - Glaize Land for the
division of a 39,819 square foot lot and a 5.515 acre parcel, located on
Route 50, east of Delco Plaza.
REVIEW AND RECOMMENDATION OF THE SIR YEAR SECONDARY ROAD IMPROVEMENT PLAN
Mr. Gyurisin presented the recommendations of the Frederick County
Transportation Committee for the 1988 -89 Six Year Road Improvement Plan.
Mr. William H. Bushman, Resident Engineer with the Virginia
Department of Transportation, was present to answer questions from the
Commission.
Major Projects
In light of the fact that the new Gore /Gainesboro school was to be
located on Route 600, Mr. Stiles moved to place Route 600 from #11 on the
major projects priority list to #3. This motion was seconded by Mr.

Golladay and unanimously approved.
Upon motion made by Mr. Stiles and seconded by Mr. Golladay,
BE IT RESOLVED, That the Frederick County Planning Commission does hereby
unanimously approve the 1988 -89 Six Year Major Projects Road Improvement
Plan.
New Hard Surface Roads /Bridge and Other Secondary Road Projects
The staff recommended that Route 699, Priority #23, the road serving
the Timber Ridge School, be moved up to #20 on the list of new hard surface
roads.
Upon motion made by Mr. Golladay and seconded by Mr. Romine,
BE IT RESOLVED, That the Frederick County Planning Commission does hereby
unanimously approve the 1988 -89 Six Year New Hard Surface /Bridge and Other
Secondary Roads Improvement Plan, as per staff recommendations.

BRIDGES:

1. Routes 622 and 620 - widen bridge (at Opequon); ADT -845 (Back Creek)
2. Route 659 - widen bridge (near Route 7), see major project 115; ADT-193 (Shawnee)
OTHER:
3. Routes 608 and 681, unpaved sections, need special attention for maintenance, spot
widened, and tree removal for improved site distance (Gainesboro).
4. Route 627, west of Middletown, requires special attention for maintenance to improve
site distances at curves ( Opequon).
5. Route 644 - provide improved maintenance and improve ford signage (Shawnee).
6. Route 522 North - improve intersection at Route 693 (Gainesboro).

SUBDIVISIONS CONTINUED
Shenandoah Hills, Section 3, 27.427 Acres, Zoned RP, for the subdivision of
79 single - family cluster lots, located in the Stonewall Magisterial
District.
Action - Approved
Mr. Golladay inquired if the lot sizes for the proposed Section 3
were approximately the same size as the older section. Mr. Gyurisin
replied that the older sections had lot sizes between 10,000 - 12,000 square
feet and the proposed lot sizes for Section 3 are between 8,000 - 10,000
square feet.
Mr. Bruce Edens, with Greenway Engineering & Surveying, was the
representative for this application.
Upon motion made by Mr. DeHaven and seconded by Mr. Stiles,
BE IT RESOLVED, That the Frederick County Planning Commission does hereby
unanimously approve the subdivision request of Shenandoah Hills, Section 3,
for 79 single - family cluster lots, to be located on the west side of
Greenwood Road (Route 656) and east of the existing Shenandoah Hills
Subdivision on Route 7 East, in the Stonewall Magisterial District.
McGuire Hills, Sections 1, 2, 3, and 4, 60.1013 Acres, Zoned RP, for
subdivision for 20 single family traditional lots (100,000+ square foot) in
the Stonewall Magisterial District.
Action - Approved
Mr. Watkins noted that the applicant's proposal is to incorporate
the open space as an easement on individual lots. He said that the open
space will be the responsibility of each individual property owner and the
property will have deed restrictions. Mr. Watkins added that a homeowners
association will not be required.
Mr. Charles Maddox, Engineer /Designer with G. W. Clifford &
Associates, gave a brief presentation on the proposed development.
Upon motion made by Mr. DeHaven and seconded by Mr. Stiles,
BE IT RESOLVED, That the Frederick County Planning Commission does hereby
unanimously approve the final subdivision plat of McGuire Hills, Sections
1, 2, 3, and 4, for 20 single- family (100,000+ square foot) traditional
lots: Section 1--4 lots; Section 2--5 lots; Section 3--5 lots; Section 4 --
5 lots. This property is located along the east boundary line of VA Route
739, at the intersection of VA Routes 739 and 673, in the Stonewall
Magisterial District.

Mr. Stiles left the meeting at this point.
Final Subdivision Plat of Lakewood Manor, Section 5, 7.1213 Acres, Zoned
RP, for 16 single family traditional lots in the Shawnee District.
Action - Aprpoved
Mr. Charles Maddox, Engineer /Designer with G. W. Clifford &
Associates, introduced himself and Mr. P. Duane Brown, Chief Surveyor. Mr.
Maddox noted that Sanitation Authority recommendations on sewer laterals,
main hole covers, and fire hydrants have been incorporated in the plan.
Upon motion made by Mr. Wilson and seconded by Mr. Romine,
BE IT RESOLVED, That the Frederick County Planning Commission does hereby
approve the final subdivision plat of Lakewood Manor, Section 5, for 16
single family traditional lots, located in the Lakeside Subdivision, in the
Shawnee Magisterial District.
The vote on this subdivision was as follows:
YES (TO APPROVE): Mrs. Copenhaver and Messrs. McDonald, Brumback, DeHaven,
Wilson, Romine
ABSTAIN: Mr. Golladay
Final Subdivision Plat of Lakemont Village, 9.8672 Acres, Zoned RP, for 11
townhouse lots and 28 duplex lots in the Shawnee Magisterial District.
Action - Approved
Mr. Charles Maddox, Engineer /Designer with G. W. Clifford &
Associates, said that all Sanitation Authority recommendations have been
met and revised plans have been sent to the Transportation Department for
their approval.
The Commission proceeded to discuss whether the average lot size for
two - bedroom townhouses had been met. It was determined that the average
lot size for this proposal was met.
Upon motion made by Mr. Wilson and seconded by Mr. Romine,
BE IT RESOLVED, That the Frederick County Planning Commission does hereby
unanimously approve the final subdivision plat of Lakemont Village for 11
townhouse lots and 28 duplex lots, located in the Lakeside Subdivision, in
the Shawnee Magisterial District.

RESIDENTIAL MASTER PLANS
Revised Lakeside Final Master Development Plan for 30 single - family
traditional units, instead of 39 multiplex units, at the northwest corner
of the development, identified as Lake Ridge VII.
Action - Approved
Mr. Watkins said that the revised plan also shows a slightly changed
road access and a continuation of the buffer area between this area and the
proposed Lakeview Apartments. He said that the buffer is proposed as a
reduced buffer with partial screening, consistent with buffers throughout
the Lakeside Subdivision.
Upon motion made by Mr. Wilson and seconded by Mr. Romine,
BE IT RESOLVED, That the Frederick County Planning Commission does hereby
unanimously approve the revised Lakeside Final Master Development Plan for
30 single - family traditional units, slightly changed road access, and a
continuation of the buffer area at the northwest corner of the development,
identified as Lake Ridge VII. This property is located in the Shawnee
District.
Revised Preliminary Master Development Plan of Dominion Knolls, 20.28
(+ or -) Acres, Zoned RP, for 182 two- bedroom townhouses in the Stonewall
District.
Action - Approved
Mr. Edward Dove, President of Dove & Associates, the engineers for
this development, was present to represent the applicant, Dominion
Associates. Mr. Dove said that this was a resubmittal of a plan submitted
approximately one month ago and at that time, the applicant requested
variances in the buffer zones. Mr. Dove said that they have redesigned the
site so that the plan does not require any variances in the buffer zones.
He said that the current plan meets all criteria in the ordinance.
Mr. Golladay inquired if curb and gutter would be used and Mr. Dove
replied that they would not be using curb and gutter.
The commissioners expressed concern that the applicant did not
intend to use curb and gutter, especially since this was such a high -
density development, and due to the fact that this property bordered the
City of Winchester, where curb and gutter was used throughout. The
commissioners were also concerned about the 40 foot parking lot driveways
and whether fire equipment vehicles would have proper access.
The staff noted that these items could be addressed at the site plan
stage.
Because of these concerns, Mr. DeHaven moved to deny the preliminary

plan. This motion was seconded by Mr. Golladay, but the motion was lost by
the following vote:
YES (TO DENY): Messrs. Golladay, DeHaven, Wilson
NO: Mrs. Copenhaver and Messrs. McDonald, Brumback, Romine
Mr. Romine next moved to approve the preliminary plan. This motion
was seconded by Mr. McDonald, and passed by majority vote.
BE IT RESOLVED, That the Frederick County Planning Commission does hereby
approve the revised preliminary master development plan of Dominion Knolls
for 182 two - bedroom townhouses, located on Baker Lane, just north of the
City of Winchester, in the Stonewall Magisterial District.
The vote on the approval of this preliminary plan was:
YES (TO APPROVE): Mrs. Copenhaver and Messrs. Romine, McDonald, Brumback
NO: Messrs. Wilson, DeHaven, Golladay
Preliminary Master Development Plan #007 -87 of Fort Braddock Heights, 8.86
Acres, Zoned RP, for single family detached cluster lots in the Gainesboro
Magisterial District.
Action - Tabled
Mr. Benjamin Butler, representing the applicant, Edward Dove, came
forward and presented the Commission with some general information on the
use of pipestem lots throughout the development.
Since Mr. Butler was not prepared to give a formal presentation on
this plan, Mr. McDonald moved to table the request. This motion was
seconded by Mrs. Copenhaver and passed unanimously.
BE IT RESOLVED, That the Frederick County Planning Commission does hereby
unanimously table Preliminary Master Development Plan #007 -87 of Fort
Braddock Heights, located on the west side of Fox Drive, on the north City/
County border, in the Gainesboro Magisterial District.
Preliminary Master Development Plan #008 -87 of Westside Station, 18.19
Acres, Zoned RP, for 48 single - family detached cluster lots in the Back
Creek Magisterial District.
Action - Tabled
Mr. Benjamin Butler was present to represent the applicants, Mr.
Russell Potts and J. V. Arthur, Inc., who were partners in Westside Medical
Properties, the owners of the property. Mr. Butler proceeded with a formal

presentation on Westside Station. He said that upon discussing this
proposal with members of the Planning Commission and Board of Supervisors,
it was determined that one of the chief objections was using Wayland Drive
as a through -way from Merrimans Lane to the Winchester Hospital or Route
50. Mr. Butler said that this was also a concern of the applicants and
they would prefer to see Wayland Drive end in a cul -de -sac; however, they
would need to work with the County to acquire the land, as it is legally
owned by the County.
Some commissioners expressed concern that 12 out of 48 lots were
pipestem lots and felt the developer was using this approach strictly to
avoid street construction. Mr. Butler defended the use of pipestems by
saying that they provided a degree of privacy and the Commission could use
deed restrictions to require the foundation of the roads to be built to
state standards. Mr. Golladay noted the Commission's desire to see that
this development was compatible with the existing Merriman's Estates
Subdivision.
Mr. Watkins said that Board of Supervisors' approval is needed on
the extension of City water service to this development. He also noted
that the staff supports the approach of using a cul -de -sac to avoid
through- traffic problems, however, a comment from the Highway Department
should be obtained.
Mr. William Pugh, resident of Merrimans Estates and spokesperson for
the residents there, said that their main concern was whether Wayland
Drive was proposed to be a thoroughfare. Mr. Pugh said that the applicant
and Dove and Associates has been very cooperative with the residents of
Merrimans Estates on working out a positive solution to the problem.
Mr. Thomas Monahan, resident on Merrimans Lane, with property both
in the City and the County, expressed concern on the following items: 1)
potential traffic problems on Merrimans Lane; 2) discharge of vehicles
onto Route 50; 3) problems created by pipestem lots; 4) compatibility
with the existing Merrimans Estates Subdivision.
Upon motion made by Mrs. Copenhaver and seconded by Mr. McDonald,
BE IT RESOLVED, That.the Frederick County Planning Commission does hereby
unanimously agree to table Preliminary Master Development Plan #008 -87 of
Westside Station until the Planning Commission's meeting of October 21,
1987 in order to give the applicants time to resolve the issues concerning
access to Route 50, Merrimans Lane design problems, and the Wayland Drive
thoroughfare issue.
Preliminary Master Development Plan of Full Race Estates, 37.136 Acres,
Zoned RP, for 105 single - family traditional lots in the Shawnee District.
Action - Approved
Mr. Bruce Edens, of Greenway Engineering & Surveying, gave a brief

presentation of the Mill Race Estates Master Plan.
Mr. Watkins noted that the plan met all master plan requirements and
all the environmental requirements could be met for the final master plan.
Mr. Wilson commented that he had previously voted against this
master plan due to the condition of Greenwood Road and the bridge; however,
since that time, these projects have been designated for improvement. Mr.
Wilson said that in light of this fact, he would move for approval. This
motion was seconded by Mr. Romine and passed unanimously.
BE IT RESOLVED, That the Frederick County Planning Commission does hereby
unanimously approve the Preliminary Master Development Plan of Mill Race
Estates for 105 single family traditional lots, located on VA. Route 659,
Valley Mill Road, east of Greenwood Road (VA. Route 656), in the Shawnee
Magisterial District, with the requirement that all environmental
disturbance percentages for steep slopes and woodlands be reduced to meet
required minimums.
Preliminary Master Development Plan of Bedford Village, Zoned RP, 6 acres,
for single family traditional dwellings in the Shawnee District.
Action - Approved
Mr. Bruce Edens, of Greenway Engineering and Surveying, noted that
they have shown a 100' foot buffer and a 70' buffer along Senseny Road. He
said that lot sizes would range from 8,700 - 30,000 square feet.
Chairman Brumback asked if these lots would be handled at the one
pumping station and Mr. Edens replied that they would. Mr. Edens said that
the applicant has worked with the developers of the Apple Ridge Subdivision
on this matter.
Mr. Wilson inquired if there was a problem with surface water here
and Mr. Edens said there was not. He said that current surface water runs
along the back of the deep lots to the east.
Mr. Watkins said that the applicant has requested that the open
space be waived. He said that the ordinance allows open space to be waived
if it totaled less than one acre.
Upon motion made by Mr. Wilson and seconded by Mr. Romine,
BE IT RESOLVED, That the Frederick County Planning Commission does hereby
unanimously approve Preliminary Master Development Plan of Bedford Village
for single - family traditional dwellings and waiving of open space, located
on the north side of Senseny Road, across from Glenmont Village, in the
Shawnee Magisterial District.

INDUSTRIAL MASTER PLANS
Preliminary Master Development Plan #009 -87 of Upper Valley Business Park,
238 (+ or -) Acres, Zoned M -1, for the Upper Valley Business Park
Action - Approved
Mr. Robert Mitchell, attorney representing Mr. Douglas Adams,
introduced himself and Mr. Charles Maddox, of G. W. Clifford & Associates,
the engineers for this plan. Mr. Mitchell said that this master plan
includes only the industrially zoned areas.
Mr. Watkins commented that the layout of uses, streets, and
facilities on this plan was appropriate. Mr. Watkins said that the staff
felt that additional details on environmental features and water main
locations would be needed on the final master plan.
Mr. Raymond Wills, homeowner in the Bufflick Heights Subdivision,
requested that sufficient buffering be required. Mr. Watkins said that a
200 foot buffer was required, however, this could be reduced depending on
the type of screening used. Mr. Watkins said that the ordinance states
that the Board of Supervisors could require maintaince of existing
woodlands. Mr. Wills also asked if open storage would be allowed in this
industrial development. Mr. Gyurisin said that generally, in the M -1
District, all outside storage of materials or manufacturing activities must
take place within an enclosed area. Mr. Gyurisin added that outside
storage would be addressed when each individual site plan was presented to
the Commission.
Mr. Thomas Grove, adjoining property owner, was also concerned that
there would be a sufficient buffer adjoining the residential land. Mr.
Grove inquired about the proposed direction for sewer and water. Mr.
Maddox described for Mr. Grove where the sewer line would run.
Upon motion made by Mr. Wilson and seconded by Mr. Romine,
BE IT RESOLVED, That the Frederick County Planning Commission does hereby
unanimously approve Preliminary Master Development Plan #009 -87 of Upper
Valley Business Park, located south of Bufflick Road, across from the
airport, in the Shawnee Magisterial District, with additional details on
environmental features and water main locations to be added to the Final
Master Development Plan.
INFORMAL DISCUSSION WITH JAMES H. CARROLL ON POSSIBLE REZONING OF PROPERTY
ON ROUTE 50
Mr. Golladay said that he would abstain from discussion of this
matter due to a possible conflict of interest.
Mr. Watkins said that Mr. James H. Carroll requested an informal
discussion with the Commission regarding the possible rezoning of his

property located on Route 50 East. Mr. Watkins said that the property that
Mr. Carroll owns joins, and has been suggested as the potential new
entrance for, the Grove Heights Subdivision proposal. Mr. Watkins noted
that Mr. Carroll has been approached by the Grove Heights developers
concerning this matter. He said that Mr. Carroll is interested in the
future of that land and what he could use it for before he makes a final
decision on the entrance. Mr. Watkins added that the staff felt it was an
appropriate location for some type of intensive use.
The Commissioners discussed the location, acreage, and potential
uses of this property with Mr. Carroll.
Chairman Brumback took an informal poll from the commissioners and
they felt that a business that would be complimentary to the residential
subdivision would be appropriate at this location.
