PC_01-21-87_Meeting_MinutesMINUTES OF THE MEETING OF THE FREDERICK COUNTY PLANNING COMMISSION Held in the Board of Supervisors' Meeting Room in the Old Frederick County Court House, 9 Court Square, Winchester, Virginia, on January 21, 1987. PRESENT: Frank H. Brumback, Chairman; James W. Golladay, Jr., Vice- Chairman; Marjorie H. Copenhaver; Kenneth Y. Stiles; A. Lynn Myers; S. Blaine Wilson; George L. Romine; Manuel C. DeHaven; Robert W. Watkins, Secretary; Stephen M. Gyurisin, Advisory. ABSENT: Carl M. McDonald CALL TO ORDER Chairman Brumback called the meeting to order at 2:00 p.m. MINUTES The first order of business was the consideration of the minutes of December 17, 1986. Upon motion made by Mr. Romine and seconded by Mr. Wilson, the minutes of December 17, 1986 were unanimously approved as presented. The next order of business was the consideration of the minutes of January 7, 1987. Upon motion made by Mr. Golladay and seconded by Col. Myers, the minutes of January 7, 1987 were unanimously approved as presented. BIMONTHLY REPORT Mr. Watkins reviewed pending applications with the Commission. Mr. Gyurisin stated that he had received a request for administrative approval from W. S. Frey for the addition of a stone crusher and screening operation equipment. After discussing the details of the addition, the Planning Commission permitted the staff to proceed with administrative approval. COMMITTEE REPORTS Sanitation Authority Mrs. Copenhaver, liason to the Sanitation Authority, stated that at their 2345 MM last Authority meeting, Run and Lakeside. Mrs. discussions. the Authority discussed sewage capacity at Stephens Copenhaver updated the Commission on those SITE PLANS Site Plan 11001 -87 of Technicon Instruments Corporation for an addition to the existing facility on Route 11 South in the Opequon Magisterial District. Action - Approved Mr. Golladay said that he would abstain from discussion and voting on this site plan, due to a possible conflict of interest. Mr. Watkins stated that Technicon will be adding a 66,000 square foot warehouse addition, which will include an additional entrance and changing the parking configuration. Mr. Watkins said that Technicon will need to install an additional fire hydrant, in order to comply with the Fire Code. Mr. John Tyson, Plant Manager, said that they have no problem with installing the fire hydrant. Col. Myers inquired if there would be a liquid nitrogen and freon tank on the site and Mr. Tyson replied that there would. Col. Myers asked if industrial waste would be generated. Mr. Tyson confirmed this and added that they would treat the waste before sending it to the Middletown facility. Col. Myers asked Mr. Tyson if Middletown was aware of this and Mr. Tyson said that they were. Upon motion made by Mr. Stiles and seconded by Mr. Romine, BE TI RESOLVED, That the Frederick County Planning Commission does hereby approve Site Plan 11001 -87 of Technicon Instruments Corporation for the addition of a 66,000 square foot warehouse, parking access, and site improvements to the existing manufacturing facility, with the addition of a fire hydrant on the south side of the addition. The location of this property is on US Highway 11 South at Middletown in the Opequon Magisterial District. The vote on this site plan was as follows: YES: Mrs. Copenhaver and Messrs. Stiles, Myers, Brumback, DeHaven, Wilson, Romine ABSTAIN: Mr. Golladay 2346 - 3 - CONTINUATION OF A PUBLIC HEARING Rezoning Request #020 -86 of Athey Trucking, Inc. to rezone 4.09 acres from RP (Residential Performance) to M -2 (Industrial General) in the Opequon Magisterial District. Action - Tabled to February 4, 1987 Mr. Watkins stated that this item was tabled from November 5, 1986 for 90 days or until a resolution of the litigation. Mr. Watkins said that he has received two requests from the applicant: 1) to change the rezoning request from M -2 to M -1; Mr. Watkins said that this will not require re- advertisement; 2) that this item be tabled until the first meeting in February. Mr. Watkins pointed out that the 90th day is the day after the Commission's next meeting. Mr. Massie, attorney representing Mr. Athey, was present'to answer questions. Upon motion made by Mr. Golladay and seconded by Mr. Stiles, BE IT RESOLVED, That the Frederick County Planning Commission does hereby unanimously agree to table Rezoning Application #020 -86 of Athey Trucking, Inc. until February 4, 1987, at the applicant's request. PUBLIC MEETING Preliminary Master Development Plan #015 -86 of Greenwood Heights for a single - family .traditional development in the Shawnee Magisterial District. Action - Approved Charles E. Maddox, Jr., P.E., with G. W. Clifford and Associates, was present to represent Greenwood Heights. Mr. Stiles asked for the size of the lots fronting this and Mr. Maddox replied that they were 18,000 square feet. Mrs. Regina Baldwin, adjoining property owner, was concerned about the price range for the proposed dwellings. Chairman Brumback said that the Planning Commission does not have the legal right to deal with price ranges for homes in developments. Mrs. Baldwin said that she had observed a mixture of housing price ranges in other areas of the county and did not want this to occur in her area. Mrs. Baldwin was opposed to townhouses being constructed here. Upon motion made by Mr. Wilson and seconded by Mr. Romine, BE IT RESOLVED, That the Frederick County Planning Commission does hereby unanimously approve the Preliminary Master Development Plan of Greenwood Heights for a single - family detached traditional development to be located south on Route 656 (Greenwood Road), and south of the Route 656 and 657 2347 - 4 - (Senseny Road) intersection in the Shawnee Magisterial District. Preliminary Master Development Plan #001 -87 of Fredericktowne Estates for a single - family traditional development in the Opequon Magisterial District. Action - Tabled for 60 days Mr. Watkins said that the proposal is for 274 single family residences on lots averaging 12,000 square feet. Mr. Watkins said that the Sanitation Authority has stated that the existing sewerage (transmission line) facilities in Fredericktowne, Section II, do not have sufficient capacity to provide service to this area. In addition, the Sanitation Authority has stated that the Stephens Run and Lakeside Treatment Plants do not have the capacity to serve this entire area at this time. Mr. Watkins stated that it is the staff's recommendation that no lots should be approved unless sewer service is provided and, in this case, a master plan should not be approved until a plan for connecting with existing sewer systems has been provided and approved. Mr. Golladay commented that the plan showed only one entrance /exit way. Mr. Golladay stated that the plan shows a future entrance adjoining Frederick County park land and he wondered if this was suitable, since the county parks are secured during closing times. Mr. Gyurisin explained that a stub road could be put in at the end of that street and access provided to the county property. In light of the comment received by the Sanitation Authority, Mr. Golladay said that he would like to see approvals from all the agencies before Planning Commission action. Mr. Bruce Edens, Engineer with Greenway Engineering and Surveying Company, was the representative for this plan. In regards to the Sanitation Authority comments, Mr. Edens said that their general plan for method of connection is to have a pump station in the southeast corner of the site. Mr. Wellington Jones, Engineer /Director with the Sanitation Authority, stated that the preliminary plan does not show the proposed location of utility systems as required in Section 21 -6 -4 -3.1.8 of the County Code and therefore, he cannot make specific comments at this time. Mr. Stiles commented that when the Lakeside master plan was reviewed, he thought the Authority said there was sufficient capacity, even though homeowners said there was not. Mr. Jones said that at that time, and even before the Sanitation Authority took the system over in October of 1984, that the plant did not have sufficient capacity to accomodate the entire 800 -unit master plan. Mr. Jones said that this is on record in the minutes of the Planning Commission. Mr. Jones said that the Sanitation Authority understood the capacity and the need to address the infiltration issue and to expand the treatment capacity by either building a new plant or upgrading the existing plant. Mr. Jones said that at this time, the 2348 - 5 - Sanitation Authority is considering building a new plant at Parkins Mill. Mr. Stephen R. Eisesbaugh, adjoining property owner, stated that his property is in the far corner of this development and his main concern is the cul -de -sac located very near to the front of his home. Mr. Eisesbaugh wanted to know if he would be given access to that cul- de-sac, in light of the fact that he was going to be experiencing some inconvenience with homes being constructed on two locations beside him. Mr. Eisesbaugh said that he had no problems with the development itself. Chairman Brumback suggested that Mr. Eisesbaugh contact the developer /engineer in regards to the cul -de -sac. Upon motion made by Mr. Golladay and seconded by Mr. Romine, BE IT RESOLVED, That the Frederick County Planning Commission does hereby table Preliminary Master Development Plan #001-87 of Fredericktowne Estates for 60 days or until the Sanitation Authority can make a comment on the utility systems. 1987 WORK PROGRAM Mr. Watkins stated that the staff will be preparing a work program for 1987 for the Planning Department and presented the Commission with some general areas of importance for the upcoming year. Mr. Watkins generally discussed the following topics as areas needing work in 1987: Comprehensive Plan Review, Transportation, Ordinance Revisions, Development Review, Requests for Information and Interpretation, Complaints, Violations, and Enforcement, Assisting with Improvements in the Permitting Process, Interaction with State and Local Agencies and Organizations. Chairman Brumback felt that after committees have been established to work on a project, that a time table should be established for completion of the project. The Commissioners and staff next discussed how to better handle complaints and violations. The commissioners discussed the planning staff's and code enforcement personnel's role on addressing complaints and violations. The Commission felt the system for handling complaints and violations needed to be addressed and improved. UPCOMING MEETINGS The staff announced the following upcoming meetings: 1) RP Ordinance Review Subcommittee with Mr. Bushman to discuss curb and guttering on January 26, 1987 at 7:00 p.m. in the Conference Room in the Frederick County Court House. 2) Transportation Meeting is scheduled for February 12, 1987 at 7:00 p.m. in the Conference Room of the Frederick County Court House. 2349 - 6 - 3) Planning Commission Worksession on January 29, 1987 at 7:00 p.m. in the Conference Room of the Frederick County Court House. 4) Comprehensive Plan Subcommittee on February 3, 1987 at 11:30 a.m. in the Conference Room of the Frederick County Court House.
