PC_10-15-86_Meeting_Minutes MINUTES OF THE MEETING OF THE FREDERICK COUNTY PLANNING COMMISSION Held in the Board of Supervisors' Meeting Room in the Old Frederick County Court House, 9 Court Square, Winchester, Virginia, on October 15, 1986. PRESENT: Frank H. Brumback, Chairman; James W. Golladay, Jr., Vice — Chairman; Marjorie H. Copenhaver; Kenneth Y. Stiles; A. Lynn Myers; Carl M. McDonald; S. Blaine Wilson; Robert W. Watkins, Secretary; Stephen M. Gyurisin, Advisory. ABSENT: George L. Romine; Manuel C. DeHaven CALL TO ORDER Chairman Brumback called the meeting to order at 2:00 p.m. MINUTES The first order of business was the consideration of the minutes of October 1, 1986. Upon motion made by Mr. Golladay and seconded by Col. Myers, the minutes were unanimously approved as presented. BIMONTHLY REPORT The staff and Commission discussed pending applications. COMMITTEE REPORTS Sanitation Authority Mrs. Copenhaver, liaison to the Sanitation Authority, gave a general report on the activities of the Authority. SUBDIVISION REQUESTS Subdivision request of James M. Horton for the subdivision of one lot consisting of 9.710 acres and fronting on Route 11 South. Action — Approved Mr. Watkins stated that this parcel was rezoned to B -3 (Industrial Transition) for an apple processing business and has 75 feet of frontage on Route 11. 2295 -2- Mr. James M. Horton was present to answer questions. Upon motion made by Mrs. Copenhaver and seconded by Mr. Stiles, BE IT RESOLVED, That the Frederick County Planning Commission does hereby unanimously approve the subdivision request of James M. Horton to subdivide one lot, consisting of 9.710 acres, fronting on Route 11 South in the Back Creek Magisterial District. Subdivision Request of Texaco, Inc. Land for the subdivision of one lot (4.4398 acres) to create two lots. Action — Approved Mr. Bruce Edens, Greenway Engineering and Surveying Company, Inc., was the representative for this subdivision. Mr. Edens said that this was originally a 6.5 acre tract. He said that this parcel (Parcel B) is a division of the excess four acres from the Weaver and McDonald's parcel (Parcel A). Mr. Golladay was concerned about the maintenance of Parcel A along the chainlink fence. He said the adjoining property owners and himself were under the impression that McDonald's would be responsible. Mr. Edens replied that McDonald's is leasing this property from Texaco all the way back to the chain —link fence. Upon motion made by Mr. Golladay and seconded by Mr. Wilson, BE IT RESOLVED, That the Frederick County Planning Commission does hereby unanimously approve the Subdivision request of Texaco, Inc. Land for the subdivision of one lot (4.4398 acres). This property is located on the northeast side of the Route 277 and Route 647 intersection in the Opequon Magisterial District. Subdivision Request of Brentwood Terrace, Section 1, for 31 single — family cluster lots, with required streets and open space, in the Shawnee Magisterial District. Action — Approved Chairman Brumback turned the Chair over to Vice Chairman Golladay due to a possible conflict of interest and did not participate in any discussion or vote on this subdivision. Mr. Ronnie Ward came forward and introduced himself, Mr. Randolph Larrick and Mr. Bruce Edens as the owners /developers of this subdivision. Mr. Ward said that revised subdivision plats have been made which include both VDH&T and Sanitation Authority comments. 2296 — 3 — Mr. Golladay asked how many lots would be available. Mr. Ward said the entire subdivision contains approximately 113 lots, but at this point they would be developing 31. Upon motion made by Mr. Wilson and seconded by Mr. Stiles, BE IT RESOLVED, That the Frederick County Planning Commission does hereby approve the Final Subdivision Plat of Brentwood Terrace, Section 1, for 31 single - family cluster lots, with required streets and open space. This property is located on the south side of Valley Mill Road, east of Winchester, in the Shawnee Magisterial District. The vote on this subdivision was: YES: Mrs. Copenhaver and Messrs. McDonald, Stiles, Myers, Golladay, Wilson ABSTAIN: Mr. Brumback (Vice Chairman Golladay turned the Chair back over to Mr. Brumback) Final Subdivision Plat of Regency Heights for the subdivision of 72 single - family detached traditional lots with access right- of-way and open space in the Stonewall Magisterial District. Action - Tabled Mr. Stiles asked if the issue of the right - of-way at the entrance was resolved. Mr. Stiles stated that the letter from the Highway Department does not indicate that the matter had been resolved and he was reluctant to approve the final plat until the Commission received something in writing. Mr. Gyurisin stated that the staff is expecting to receive a revised plat from the Snapp property (adjoins this entrance on the eastern side) to show the additional acquired right -of -way. Mr. Scott Marsh, from G. W. Clifford & Associates, was the representative for this application. Mr. Marsh stated that the Highway Department reduced the requirement for a turning radius from 40 feet to 25 feet and therefore, the right - of-way will not affect the adjoining property. Due to the uncertainty of the right - of-way situation, Mr. Stiles made a motion to table this request until the next meeting. This motion was seconded by Mr. Golladay and unanimously approved. BE IT RESOLVED, That the Frederick County Planning Commission does hereby table the Final Subdivision Plat of Regency Heights for the subdivision of 72 single-family detached traditional lots until the meeting of November 5, 1986. 2297 V — 4 — (Mr. Stiles left the meeting at this point.) Preliminary Master Development Plan #007 -86 of Shenandoah Hills, Section 3, for 80 single — family cluster lots, streets, and open space in the Shawnee Magisterial District. Action — Approved Mr. Watkins stated that the applicant is proposing screening along arterial Routes 7 and 656 in order to reduce the buffer zone to the minimum 50 feet required by the RP District. The Commission and staff next discussed the screening requirements and who would be responsible for maintenance of the screening. Mr. Bruce Edens, of Greenway Engineering & Surveying Company, Inc., was the representative for this application. Mr. Edens said that some of the lots would be sold with an easement in order to provide for the buffer. Mr. Edens said that the Homeowners Association would be responsible for maintenance. Mr. Doran D. Hoskins, owner of Lot 112 in Section 2, stated that he and his neighbor personally installed a 30" concrete pipe between their houses for drainage. He said that drainage under the road is minimal. Mr. Hoskins said that the pipe channels the water to the rear of their property and onto the proposed lots of Section 3. Mr. Edens stated that if the lots needed filling to channel the water to the easements, they would certainly do that. Upon motion made by Mr. Wilson and seconded by Mr. McDonald, BE IT RESOLVED, That the Frederick County Planning Commission does hereby unanimously approve Preliminary Master Development Plan #007 -86 of Shenandoah Hills, Section 3, for 80 single — family cluster lots, streets, and open space. This property is located on Route 656 (Greenwood Road) and Route 7 in the Shawnee Magisterial District. Revised Final Master Development Plan 11011 -86 of Lakeside Estates for the removal of 16 acres from the designated open space, with adjusted property lines for parcels A, B, and C, along Route 642 in the Shawnee Magisterial District. Action — Approved There was concern expressed by the Commissioners on the Sanitation Authority's comment that existing wastewater treatment capacity was insufficient to serve the proposed development. The staff said that the 2298 - 5 - Authority had stated that planning to provide additional capacity has been initiated and is currently scheduled for completion in 1989. Mr. Watkins pointed out that rezonings and a master development plan had been approved, prior to this revised plan, with the recommendation that sufficient capacity was available. Mr. David Holiday, President of Lakeside Development Company, said that the Sanitation Authority has treated this revision as a brand new master development plan. Mr. Holiday realized there was not sufficient capacity for the entire development, but said he knew how many units the system could handle. He said he had two additional sections of Lakeside coming before the Planning Commission in November and if there was not sufficient capacity, the Commission should deny it at the subdivision stage. Dr. Kenneth Walker, Superintendant of the Frederick County School Board, stated that Lakeside Development Company has verbally agreed to donate the 16 acres to the Frederick County School Board and the School Board has unanimously voted to accept it. Dr. Walker said that no definate plans have been made; however, if the School Board reaches the point where they needed to build a school on this site, they would fill in the very shallow, muddy end of the lake. Dr. Walker said that as far as safety was concerned, he had thoroughly investigated the matter with the insurance carriers and there will be no problem. If a school is built, a fence would be constructed so that children would not have access to the lake. Upon motion made by Mr. Wilson and seconded by Mr. McDonald, BE IT RESOLVED, That the Frederick County Planning Commission does hereby unanimously approve Revised Master Development Plan #011 -86 of Lakeside Estates for the removal of 16 acres from designated open space areas with adjusted property lines for parcels A, B, and C along Route 642. This property is located on the northeast side of Route 642, northeast of Stephens City, in the Shawnee Magisterial District. FREDERICK COUNTY TRANSPORTATION COMMITTEE RECOMMENDATIONS Mr. Golladay presented the recommendations of the Transportation Committee for action by the Planning Commission. PRIMARY ROAD ALLOCATIONS FOR FY 1987 -88 Upon motion made by Mr. Golladay and seconded by Col. Myers, BE IT RESOLVED, That the Frederick County Planning Commission does hereby unanimously approve the following resolution for primary road allocations for FY 1987 -88. This resolution lists projects in the following priority: - -Route 522 North, four lanes to the West Virginia line - -Route 522 South, four lanes, Route 50 to Route 277 -- Improving Route 11 North and South railroad crossings -- Allocation of funds for intersections as identified in the Comprehensive Plan 2299 - 6 - PRIMARY ROAD ALLOCATIONS FOR FY 1987 -88 WHEREAS, the Virginia Department of Highways and Transportation is conducting the 1987 -88 Annual Preallocation Public Hearing for interstate, primary, urban systems and public transportation on October 29, 1986; and, WHEREAS, the Frederick County Transportation Committee recommends that the Route 522 North project presently listed in the Six -Year Road Improvement Program for 1.8 miles in Frederick County be updated and accelerated with the revised scope of the project to include a new four -lane divided highway on the new right - of-way for all sections of the planned Route 522 North project complete to the West Virginia line; and, that project funding be accelerated for all planning, engineering and construction phases thereby reducing the time span for completion of this project; and, WHEREAS, the Frederick County Transportation Committee recognizes that the segment of Route 522 North from the end of the existing divided four -lane road surface to the West Virginia line is a very dangerous section of the road serving as a shortcut for interstate traffic that mixes with local traffic causing existing highway safety problems and increasing future traffic hazard potentials; and, WHEREAS, the Frederick County Transportation Committee recognizes that the updated and accelerated Route 522 North project is the County's highest priority primary road improvement project; and, WHEREAS, the Frederick County Transportation Committee recommends that as a second priority Route 522 South from the intersection of Routes 50/17 at the City of Winchester line and I -81 intersection south to Double Tollgate or the Route 277 interchange or placed on the primary road improvement project list for Frederick County; and, WHEREAS, the Frederick County Transportation Committee recommends that funding be provided for railroad crossing improvements on Route 11 North and Route 11 South, just outside of the City of Winchester lines; and, WHEREAS, the Frederick County Transportation Committee recommends that funding be provided for intersection studies as identified in the Frederick County Comprehensive Plan, and that such studies be forwarded to the Frederick County Transportation Committee for review and discussion on the most congested intersection of Frederick County; and, THEREFORE, BE IT RESOLVED, that the Frederick County Transportation Committee does very strongly urge that the Virginia Department of Highways and Transportation place the updated and accelerated Route 522 North project, the County's highest priority project, on the primary allocation funding schedule as its highest priority and that the Route 522 South project be placed as Frederick County's second priority, with funding for railroad crossing improvement on Route 11 North and South and additional funding be allocated for intersection studies as identified as the Frederick County Comprehensive Plan. /s/ Franklin D. Myers, BE IT RESOLVED, That the Frederick County Planning Commission does hereby approve the 1986 -87 Revised Secondary Road Construction Budget, which would add approximately $250,000 to help speed —up the construction for the top road projects. SIX YEAR ROAD IMPROVEMENT PLAN Upon motion by Mr. Golladay and seconded by Col. Myers, BE IT RESOLVED, That the Frederick County Planning Commission does hereby approve the following Six —Year Road Improvement Plan: 2301 - 8 - MAJOR PROJECTS Major projects are projects where reconstruction of hard surfaced (paved) roads is needed for safety reasons. Road width, alignment, strength and gradient improvements are considered for major projects. Bridge improvements were recommended by the Committee to be left up to the discretion of the Virginia Department of Highways and Transportation. 2. Routes 608 and 681, unpaved sections, need special attention for maintenance, spot widened, and tree removal for improved site distance. 3. Route 627, west of Middletown, requires special attention for maintenance to improve site distances at curves. 2304 - 11 - ADJOURNMENT There being no further business to discuss, the meeting adjourned.
