Held in the Board of Supervisors' Meeting Room in the Old Court House,
9 Court Square, Winchester, Virginia, on July 16, 1986

CALL TO ORDER
Chairman Brumback called the meeting to order at 7:00 p.m.
MINUTES
The first order of business was the consideration of the minutes of
July 2, 1986. Col. Myers noted that on page 10, the project to be moved on
the CIP list is the new elementary school, not the Gore /Gainesboro School.
Upon motion made by Mr. Romine and seconded by Mr. Golladay, the minutes
were unanimously approved with this amendment.
BIMONTHLY REPORT
Mr. Gyurisin informed the commissioners that a site plan for Quik
Stop, located on the south side of Route 50 East, has been received. Mr.
Gyurisin said that they would like to add a 1,800 square foot storage
addition to their existing metal building. Chairman Brumback requested
that this plan be brought before the Commission for review.
COMMITTEE REPORTS
Economic Development Commission
Mr. Romine, Economic Development Coordinator, reported a
considerable amount of inquiries about our area.
Transportation Subcommittee

Mr. Golladay, Liaison to the Transportation Committee, reported that
this Subcommittee would be meeting in the near future, probably September.
Mr. Golladay said that this is the year that projects are added to the Six —
Year Plan.

Potomac Edison Meetin¢ on Extension of 138kV Line
Mr. Stiles reported that the Potomac Edison Company will be holding
a second meeting on the extension of the 138kV Line, from the Meadowbrooke
Substation, south of Stephens City, east to Double Toll Gate on July 23,
1986 at 7:00 p.m. at the Robert E. Aylor School.
Sanitation Authority
Mrs. Copenhaver, liaison to the Sanitation Authority, stated that
in addition to setting the rates on their new quarterly billing and rates
for the hookups on the Route 7 waterline, the Sanitation Authority
presented two items that may be of interest to the Planning Commission.
She said that the Sanitation Authority's consulting engineers have been
conducting a study on the Parkins Mill's sewage treatment plant, which will
replace or be an addition to the existing Lakeside plant. Secondly, they
have completed a feasibility study on the proposed Clearbrook plant and
have determined that it is not economically feasible. Mrs. Copenhaver said
that the Sanitation Authority does not foresee enough useage in that area
to pay for the plant and unless something in the Clearbrook area comes up
that would make this project economically feasible, they would not be
interested in pursuing it.
Virginia Community Development Block Grant Funds
Mr. John R. Riley, Jr., Frederick County Administrator, stated that
the Chairman of the Frederick County Board of Supervisors was notified that
Frederick County did not receive funding on its grant application for water
and sewer for the Airport Road area. Mr. Riley said that Mr. Jones,
Director of the Sanitation Authority, and himself met with representatives
of the Virginia Resources Authority who were presently closing on a
$100,000,000 issue at 7 5/8% interest and they are in a position to loan
money to Authorities and local governments. Mr. Riley said they obtained
an application and it should not take long to provide the Virginia
Resources Authority with the financial information they need. Mr. Riley
felt confident that the County could still go forward with the project and
meet the time schedule everyone had originally discussed.
REQUEST FOR PUBLIC USE DEDICATION — LAKESIDE ESTATES SUBDIVISION
Mr. Gyurisin explained that the Planning Commission and Board must
first approve the concept of the open area being used for a public use and
secondly, if that concept is approved, the master plan would need to be
amended. Mr. Gyurisin stated that at the last Commission meeting, there
was considerable discussion on the amount of acreage. He said that Dr.
Walker does understand that the acreage that is required for open space
cannot be built on. There are approximately 16 acres, not required for
open space, that could be used for school construction. Mr. Gyurisin added
that the developer must define this area specifically on a subdivision
plat.

Mr. Stiles asked the developer how much land he was proposing to
dedicate and Mr. David Holliday replied that he proposed to dedicate 26.5
acres. Mr. Stiles said that if the developer proposes to donate 16 acres,
he had no problem with this concept. However, Mr. Stiles said that if the
developer insists on proposing to donate 26.5 acres, which would require
part of the open space that is maintained by the Homeowners Association to
be transferred to the School Board which would then have to maintain it not
as school property, but as property open only to the members of that
subdivision, then he was against the concept at this point.
Dr. Kenneth E. Walker, Superintendent of Frederick County Schools,
said that the School Board has discussed this item at length and feels that
a 16 —acre site would be adequate for an elementary school, but more would
be preferrable for additional playground space and buffer zones. Dr.
Walker felt that the ordinance does give the option of dedicating land for
public use and ownership. He said that the School Board would be willing
to write a letter of understanding to the Commission and Board of
Supervisors, if needed, that they would not build on the acreage beyond the
16 acres. Dr. Walker stated that if the land is deeded, however; it would
be School Board property and would be used for school activities. He added
that as with other school property, the School Board usually makes
available school playgrounds and so forth for public use. He said that
they would recommend that the Commission and Board approve the donation of
the larger tract with the understanding that the ten or so acres would be
kept open. Dr. Walker said that with the rapid growth we are experiencing
In some parts of Frederick County, when we reach the point when we have to
have another school, we will have pay a premium price for land. He said
that if we can anticipate future needs and acquire some land reasonably,
particularly through donation, it would be an asset to the taxpayers of
Frederick County.
The Chairman conducted a consensus of the Commission over whether or
not the commissioners found it acceptable for the School Board to own the
extra 10 acres and also include it as open space for the developement. The
commissioners felt that the 16 acres would be a good location for a school,
but the extra ten acres should remain as open space for the development and
maintained by the Homeowners Association.
Chairman Brumback asked the School Board and the developer to come

SITE PLANS
Site Plan #017 -86 of Timber Ridge Residential Treatment Center for a
vocational science building.
Action — Approved
Mr. Watkins stated that this will be a 6,451 square foot building,
which is an addition to other school facilities on the property. Mr.
Watkins said that the staff agrees with the fire company that the existing

dirt road should be designated as a fire lane.
Mr. David Ganse, architect representing this site plan, stated that
they are in agreement to designating the dirt road as a fire lane in order
for the fire company to have access to the lake. Mr. Ganse added that they
are working with the Highway Department and have no problems providing the
commercial entrance that they require.

Treatment Center for a vocational science building to be located on the
existing campus located on Route 699 in the Gainseboro Magisterial
District.
MASTER DEVELOPMENT PLANS
Final Master Development Plan M008-86 of Brentwood Terrace for single —
family cluster lots.
Action — Approved
Chairman Brumback turned the chair over to Vice — Chairman Golladay
and stated that he would not participate in any discussion or vote on this
item due to a possible conflict of interest.
Mr. Watkins noted that all of the open space is located along Abrams
Greek and is accessible to each cul —de —sac street.
Messrs. Ronald Ward and Randolph Larrick, the owners and developers
of Brentwood Terrace, were present to answer questions.
Col. Myers was concerned about the 27 lots fronting on Route 659.
Mr. Ward said that there are several existing houses that front on Valley
Mill Koad and to keep all the houses uniform, they designed the layout to
have all the houses face the same direction. Mr. Ward said that they have
spent a lot of time addressing a different road network and they will have
deed restrictions requiring residents to use the development's road, when
possible, and not the state — maintained road.
Upon motion made by Mr. Wilson and seconded by Mr. McDonald,

approve Final Master Development Plan #008 -86 of Brentwood Terrace for
single— family cluster lots on 35.981 acres, located on the southern side of
State Route 659, in the Shawnee Magisterial District.
The vote on this final master plan was:

Final Master Development Plan #009 -86 of Valley View Subdivision for ten
duplex dwellings on the south side of Route 641 in the Opequon Magisterial
District.
Action — Approved
Mr. Watkins said that the Board of Supervisors approved the
waiving of the open space requirement. Mr. Watkins said the Board took
into consideration the adjacent school with its open school ground. He
said that the Board also considered the fact that open space is to provide,
in addition to a place for enjoyment of the residents, various kinds of
environmental protection. Mr. Watkins noted that this is a level site with
no woodlands or other areas in need of protection.
Mr. David Holliday, developer, was present to answer questions.
Upon motion made by Mr. Golladay and seconded by Mr. Stiles
BE IT RESOLVED, That the Frederick County Planning Commission does hereby
unanimously approve Final Master Development Plan #009 -86 of Valley View
Subdivision for ten duplex dwellings on the south side of Route 641, in the
Opequon Magisterial District.
SUBDIVISIONS
Final Subdivision Plat of Albin Village, Section 2, to subdivide 36
single— family detached cluster lots, utilities, roads, and open space on
Route 647 in the Opequon Magisterial District.
Action — Approved
Mr. Watkins stated that the construction plans will need to be
revised to reflect Highway Department requirements and location of fire
hydrants to meet Chapter 10 of the Frederick County Code.
Mr. Charles E. Maddox, Architect /Engineer with G. W. Clifford &
Associates, was the representative for this subdivision.

Upon motion made by Mr. Golladay and seconded by Mr. Wilson,
BE IT RESOLVED, That the Frederick County Planning Commission does hereby
approve the final subdivision plat of Albin Village, Section 2, to
subdivide 36 single — family detached cluster lots, utilities, roads, and
open space, located on Route 647, in the Opequon Magisterial District.
Final Subdivision Plat of The Village at Lakeside, Section 3, for the
subdivision of 33 lots for residential use (single — family detached
traditional), utilities, roads, and open space in the Shawnee Magisterial
District.
Action — Approved
Mr. Watkins stated that all Highway Department requirements must be
snown on the construction plans and fire hydrants must be added or
relocated to be within 400' of all structures.
Chairman Brumback asked if the Commission could be assured that the
roads would be completed before the homes are occupied. Mr. Gyurisin said
that the staff has required that a bond or letter of credit be submitted by
the developer in order to assure completion of the roads. Mr. Gyurisin
added that adequate and safe access must be provided to the properties
before a Certificate of Occupancy can be issued.
Mr. Charles E. Maddox, Engineer /Architect for the developer, stated
that all items required by the Highway Department have been met.
Mr. Stiles asked at what point the open space applicable to this
acreage has to be designated. Mr. Watkins replied that 2.5 acres of open
space has already been dedicated as part of this subdivision.
Upon motion made by Mr. Wilson and seconded by Mr. Stiles,
BE IT RESOLVED, That the Frederick County Planning Commission does hereby
unanimously approve the Final Subdivision Plat of the Village at Lakeside,
Section 3, for the subdivision of 33 lots in Section III for residential
use (single — family detached traditional), utilities, roads, and open space,
located on the northeast side of State Route 642, northeast of Stephens
City, in the Shawnee Magisterial District.
REQUEST FROM BOARD OF SUPERVISORS TO REVIEW RP DISTRICT
Mr. Watkins said that on July 10, 1986, the Board of Supervisors
requested by motion that the Planning Commission undertake a serious review
of the Residential Performance District. After considerable discussion on
the type of housing the County was experiencing under the RP District, the
Commission proposed that the Ordinance Subcommittee hold its first meeting
on Monday, August 4, 1986 at 7:00 p.m. in the Conference Room.
