OF THE
FREDERICK COUNTY PLANNING COMMISSION
Held in the Board of Supervisors' Meeting Room in the Old Court House,
9 Court Square, Winchester, Virginia, on June 18, 1986
PRESENT: Frank H. Brumback, Chairman; James W. Golladay, Jr.,

CALL TO ORDER
Chairman Brumback called the meeting to order at 2:00 p.m.
MINUTES
The first order of business was the consideration of the minutes of
June 4, 1986. Upon motion made by Mr. Romine and seconded by Mr. Golladay,
the minutes were unanimously approved as presented.
BIMONTHLY REPORT
Mr. Gyurisin informed the commissioners that a preliminary plat for
Shenandoah Hills, Section 3, had been submitted. Mr. Gyurisin said that a
preliminary plat for the overall subdivision had already been submitted and
had been on record for some time. Ile explained that the developer
originally proposed to plat this using the RP Zoning, but then later
requested if it could fall under a nonconforming status (previous R -3 Code)
because the preliminary plat on file for the first few sections had already
been developed. Mr. Gyurisin said that the staff confirmed that this would
fall under the nonconforming status and instructed the developer to proceed
with the final plat stage. Mr. Gyurisin said that the final plat will be
brought to the Planning Commission for approval at a later date.
Mr. Gyurisin also informed the commissioners of a site plan
submitted for Louis Foltz. He said that the developer would like to change
the use of the building from warehouse to office and storage of classic
cars, trading under the name of J &J Corvette Classics. Mr. Gyurisin
explained that no additional access or parking is required and only changes
to the interior of the building will be made. Chairman Brumback instructed
the staff to administratively review and approve the site plan.

Sanitation Authori
Mrs. Copenhaver, liaison to the Sanitation Authority, stated that
the Sanitation Authority is conducting a feasibility study and it will
probably be 1990 before they need to have additional water and sewer at
Lakeside. Mrs. Copenhaver said that a tour was given of the industrial
parks and sewage treatment plants in some of the developments.
Potomac Edison Request to Extend 138kV Line
Mr. Stiles said that Potomac Edison is in the process of extending a
138kV line from the Meadowbrooke Substation, south of Stephens; City, east
to Double Toll Gate. He said that at this time, the power company is
seeking acquisition of right— of-way for surveying only. Mr. Stiles said
that there has been considerable interest expressed by the citizens in the
area and consequently, he and Mr. Owings have tentatively scheduled a
meeting with representatives of Potomac Edison and the property owners
involved at Fairview Chapel on Route 641 on Tuesday, July 8, at 7 :30 p.m.
comments have been included in the plan.
SITE PLANS
Site Plan #015 -86 of Regency Lake Estates for planned residential
development of 169.47 acres with 641 mobile home units and 72 single — family
traditional lots.
Action — Approved
Mr. Watkins said that because this project is divided into two
uses -- Regency Lake Mobile Home Park and Regency Heights (single— family
residential) - -the plan for the mobile home park is a final site plan while
that portion showing the single — family development is a preliminary
subdivision plat. Mr. Watkins said that due to the scale of this project,
a master development plan was submitted and approved for the entire
project, even though a master development plan is only required for the
single — family portion. Mr. Watkins stated that the concerns of the Highway
Department on the this project were: 1) details of the dam design; 2) the
proposal to provide a second access; 3) drainage details and pavement
design of the streets; 4) cross —over lanes, turning lanes, and
acceleration lanes on Route 7; 5) traffic signals on Route 7.
Mr. William H. Bushman, Resident Engineer with the Virginia
Department of Highways and Transportation, said that the developer and his
engineer have been very cooperative in addressing the requirements of the
Highway Department.
Mr. Stiles asked Mr. Bushman if the speed limit on Route 7 would be
reduced to 45 mph for this project. Mr. Bushman stated that a traffic
study needs to be done, but he would keep the Commission informed.

Mr. Charles Maddox, Engineer with G. W. Clifford & Associates, was
present to represent the owner of this development. With regard to the
stop light, Mr. Maddox said that the owner has agreed to install it when
the Highway Department feels it is necessary. In answer to Mr. Stiles'
question, Mr. Maddox said that he was in concurrence with all of the
comments of the Highway Department, Sanitation Authority, and the
requirements of the Fire Code.
Chairman Brumback inquired on the steps necessary to insure that a
traffic light would be installed when the Highway Department requires it.
Mr. Gyurisin stated that a bond or letter of credit could be required
during the subdivision stage of development. Mr. Gyurisin explained that
the subdivision portion of the Code gives the County the jurisdiction to
ask for performance bonds.
Upon motion made by Mr. Stiles and seconded by Mr. DeHaven,
BE IT RESOLVED, That the Frederick County Planning Commission does hereby
unanimously approve the Preliminary Subdivision Plat for Regency Heights
and the Final Site Plan for Regency Lake Mobile Home Park for presidential
development on 169.47 acres at the end of Warner Lane, just east of the
intersection of Route 7 and I -81 in the Stonewall Magisterial District.
Final Master Development Plan #006 -86 of Country Club Pines Apartments for
a multi- family apartment housing project on Williamson Road.
Action - Approved
Mr. Watkins stated that this proposal is for 65 two - bedroom
apartments and 1 one - bedroom apartment in four structures on the site. He
added that all review evaluations have been met.
Mr. James Anderson, developer, and Mr. Bruce Edens, engineer, were
present to represent this application. Mr. Anderson said that nearly 100%
screening is already existing. Mr. Anderson said that more screening will
be added if it is necessary, but they will have to wait until they know for
certain the locations of the buildings.
Upon motion made by Mr. Wilson and seconded by Mr. Romine,
BE IT RESOLVED, That the Frederick County Planning Commission does hereby
unanimously approve Final Master Development Plan #006 -86 of Country Club
Pines Apartments for a multi- family apartment housing project on 5.62 acres
located on Williamson Road in the Shawnee Magisterial District.
Preliminary Master Development Plan /008 -86 of Brentwood Terrace for 114
single - family cluster lots.
Action - Approved

Mr. Watkins said that the applicant has estimated that they will be
disturbing 33.68% of the slopes over 15 %, however, the ordinance requires
that no more 25% be disturbed. Mr. Watkins said that there will need to be
some reorientation of the lots for the additional steep slope area, which
amounts to less than one acre. Otherwise, this proposal meets the intent
of the ordinance for a preliminary master development plan.
Mr. Golladay noted that the Commission has had concerns) about single
driveways extending to secondary roads. Mr. Golladay asked if this would
be the case for these lots fronting on Valley Mill Road (Route 659). Mr.
Gyurisin said that Valley Mill Road is not an arterial or collector road,
therefore, requirements in the Residential Performance Section of the
ordinance will have to be met, but the ordinance does not strictly prohibit
driveways fronting on an exiting state — maintained road.
Mr. Ronnie Ward and Mr. Randolph Larrick, co— owners and developers
of Brentwood Terrace, were present. Also present was Mr. Bruce Edens,
engineer. In response to the concerns of the driveways, Mr. Ward said that
they have restricted the number of lots fronting on Route 659. Mr. Ward
stated that all of the cut —de —sacs have right —of —ways to the open space and
they plan to put in a culvert and grass walkway for access to the open
space. Mr. Ward said that they have elected to have all the common area
along Valley Mill Creek. Mr. Ward added that the types of recreational
equipment installed will be decided on at a later date.
Upon motion made by Mr. Wilson and seconded by Mr. Romine,
BE IT RESOLVED, That the the Frederick County Planning Commission does
hereby unanimously approve Preliminary Master Development Plan #008 -86 of
Brentwood Terrace to develop 114 single— family cluster lots on 35.981 acres
located on the southern side of State Route 659 in the Shawnee Magisterial
District. (Mr. Stiles was not present for this vote.)
CUT —OFF TIME FOR SITE PLANS, SUBDIVISIONS, AND MASTER PLANS
Mr. Watkins stated that with the heavy load of plans tolreview, the
staff has had difficulty with late requests for inclusion on Planning
Commission agendas. He said that with the agenda to be mailed on the
Friday before the Commission meeting, the department has received complete
plans submissions as late as Thursday or Friday, with the expectation on
the part of the applicant that the plan would be on the agenda. Mr.
Watkins said that it is sometimes difficult for the staff to prepare the
agenda under these conditions. Mr. Watkins said that the staff is
proposing that a cut —off time of two weeks prior to the Planning Commission
meeting be established as the cut —off period. He added that the staff is
also proposing that the applicant be responsible for insuring that comments
on site plans, subdivisions, and master plans are received.
Upon motion made by Mr. Romine and seconded by Mr. Wilson,

BE IT RESOLVED, That the Frederick County Planning Commission does hereby
approve the establishment of a cut —off time of two weeks prior to the
Planning Commission meeting for submittal of all site plans, subdivisions,
and master plans. The Commission does also approve the proposal of
requiring the applicant to be responsible for insuring that comments on
site plans, subdivisions, and master plans are received as part of that
submittal. (Mr. Stiles was not present for this vote.)
RESOLUTION HONORING VOLUNTEERS OF THE 1986 FREDERICK COUNTY GYPSY MOTH
SUPPRESSION PROGRAM
Jennifer Whitlock, Frederick County Gypsy Moth Program Coordinator,
presented the names of the citizens who volunteered to assist in the gypsy
moth suppression program.
Upon motion made by Mr. McDonald and seconded by Mr. Golladay,
BE IT RESOLVED, That the Frederick County Planning Commission does hereby
honor:
Rual Anderson, Scott Bean, Raymond Berthrong, Fred Burlingame, Jessie
Brittain, Richard Cather, Fred Cooke, Gerald Crowell, Gary DeOms, Donna
Dick, Carlton Dyke, Marynell Eyles, Kenneth Gentry, Lewis Gleason, Paul
Harris, Robert Kaval, Jane Larrick, James Marquardt, Dean Naddeau, Albert
Qualls, Frank Sherwood, Robert Sutton, Mary Jane Wyatt, Randolph Larrick,

For service provided to the citizens of Frederick County, Virginia as
volunteers for the 1986 Frederick County Gypsy Moth Suppression Program.
BE IT FURTHER RESOLVED, This 18th day of June 1986, that the Frederick
County Planning Commission wishes to express its thanks and appreciation to
each of the volunteers and organizations.
