PC_03-19-86_Meeting_MinutesMINUTES OF THE MEETING OF THE FREDERICK COUNTY PLANNING COMMISSION Held in the Board of Supervisors' Meeting Room in the Old Court House, 9 Court Square, Winchester, Virginia, on March 19, 1986. PRESENT: Frank H. Brumback, Chairman; Col. Lynn Myers; Carl M. McDonald; S. Blaine Wilson; Marjorie H. Copenhaver; Kenneth Y. Stiles; Robert W. Watkins, Secretary; Stephen M. Gyurisin, Advisory ABSENT: James W. Golladay, Jr.; George L. Romine; Manuel C. DeHaven CALL TO ORDER Chairman Brumback called the meeting to order at 2:00 p.m. MINUTES The first order of business was the consideration of the minutes of March 5, 1986. Upon motion made by Mr. Wilson, and seconded by Col. Myers, the minutes were unanimously approved as presented. BIMONTHLY AND MONTHLY REPORTS Mr. Gyurisin said that a site plan has been submitted by Shockey Company, Inc, for a minor addition to the existing craneway on Route 11 North. Mr. David McClure, Architect for Howard Shockey and Sons, described the structure as being 25' high and two bays wide. He said that the east end is 155' from the Pennsylvania Railroad right —of —way and the west end is 230' from the Shockey rear property line. Mr. McClure said that they are proposing a 72' expansion on both the east and west ends of the structure. Mr. McDonald moved to allow staff review and approval of this item. This motion was seconded by Mr. Wilson and unanimously approved. Mr. Stiles arrived at this point of the meeting. Final Subdivision Plat of Lenoir City Company of Virginia -- James Wilson Parcel for Industrial Refuse Facilities, Inc. ACTION — Approved 2198 -2- Mr. Gyurisin said that this is a subdivision of an existing parcel in the Stonewall Industrial Park. He said that the developer could not originally meet the required radius on the curbing with his 50' right -of -way. However, by sharing an entrance with the Red Star facility, the applicant will be able to meet the flaring requirements, and this arrangement has been approved by the VDHST. Mr. Gyurisin noted that a site plan has already been submitted for this entire site and the staff will insure that those initial requirements are met. Mr. James Wilson, applicant, said that his site plan was approved for the entire site and he wishes to subdivide now for financial reasons. Mr. Wilson described the buildings to the Commission and pointed to their locations on the site plan. Upon motion made by Mr. Stiles, seconded by Mr. Wilson, BE IT RESOLVED, That the Frederick County Planning Commission does hereby unanimously approve the final subdivision plat of Lenior City Company of Virginia -- James Wilson Parcel for Industrial Refuse Facilities, Inc, on McGhee Road in the Stonewall Industrial Park, Stonewall Magisterial District. Discussion of a Proposed Amendment to the Frederick County Code, Chapter 21, zoning, Article V, Residential Performance District (RP), Section 5 -5, Dimensional Requirements, Paragraph 5 -5 -3, Single Family Detached Cluster, by the Deletion of Paragraph 5 -5 -3.5 Maximum Lot Size - 10,000 Square Feet Mr. Watkins presented a proposal to delete the maximum lot size for the RP (Residential Performance) cluster housing type. Mr. Watkins said that 5 -5 -3.1 calls for a minimum lot size of 10,000 square feet and 5 -5 -3.5 calls for a maximum lot size of 10,000 square feet which doesn't give the developer any leeway between the two. John Riley, County Administrator, said that the amendment to incorporate maximum lot size was advertised along with the "access through buffer zones" amendments. He said that at the time of review, there seemed to be no problems with the amendment although there had been no practical application of its use. Mr. Riley said that at this time, however, it did not seem to be a good solution to our problem and he agreed with the staff that it should be changed. Mr. Ron Ward, developer, said that he and Bruce Edens, engineer - surveyor, were in favor of deleting this maximum lot size. Mr. Ward said that they discussed this item at the Subcommittee meetings last August and September, and it was his opinion that the proposal was not workable. He said that he thought the issue was dead, but in the last 30 days, he realized it had been approved. Chairman Brumback instructed the staff to advertise this amendment for public hearing. -3- PRESENTATION ON THE FREDERICK COUNTY GYPSY MOTH SUPPRESSION PROGRAM Jennifer Whitlock, Frederick County's Gypsy Moth Program Coordinator, gave a presentation on the Gypsy Moth Suppression Program and showed a film on the gypsy moth. 1986 PROGRAM OF WORK FOR THE DEPARTMENT OF PLANNING AND DEVELOPMENT Mr. Watkins presented the 1986 Program of Work for the Department of Planning and Development. Mr. Watkins reviewed the upcoming reorganization of the Permit Center with the Commissioners. Upon motion made by Col. Myers and seconded by Mr. Stiles, the Commission unanimously approved the 1986 Work Program for the Department of Planning and Development. DISCUSSION ON MILLBANK HOUSE, ROUTE 7 EAST Mrs. Glynnell Headley asked for the Commission's support in the preservation of the Millbank House on Route 7 East and located on the property of the new sewage treatment facilities. Mrs. Hedley stated that the Winchester Historical Society is interested in seeing this house restored. ADJOURNMENT There being no further business to discuss, the meeting adjourned.
