PC_11-01-89_Meeting_MinutesMEETING MINUTES FREDERICK COUNTY PLANNING COMMISSION Held in the Board Room of the Old Frederick County Courthouse in Winchester, Virginia on November 1, 1989. PRESENT: Planning Commissioners Present Were: James W. Golladay, Jr., Chairman; Beverly Sherwood, Vice Chairman; John Marker, Back Creek District; Carl M. McDonald, Gainesboro District; Manuel C. DeHaven, Stonewall District; S. Blaine Wilson, Shawnee District; Douglas Rinker, Citizen at Large; Roger L. Thomas, Citizen at Large; and Kenneth Y. Stiles, Board Liaison. Planning Staff Present Were: Robert W. Watkins, Secretary; Kris C. Tierney; W. Wayne Miller. ABSENT: Marjorie H. Copenhaver, Citizen at Large CALL TO ORDER Chairman Golladay called the meeting to order at 7:00 p.m. MINUTES The first order of business was the consideration of the minutes of October 4, 1989. Upon motion made by Mr. McDonald and seconded by Mr. Romine, the minutes of October 4, 1989 were unanimously approved as presented. Upon motion made by Mr. Marker and seconded by Mr. Romine, the minutes of October 18, 1989 were unanimously approved as presented. BIMONTHLY REPORT Chairman Golladay accepted the bimonthly report for the Commission's information. COMMITTEE REPORTS Ordinance Committee Mr. McDonald reported that the Ordinance Committee is continuing their work on upgrading the zoning ordinance. Transportation Committee Mr. Tierney reported that the Board of Supervisors approved the Six -Year Secondary Road Improvement Plan. He said 788 -2- that Route 699 was moved up on the priority list from #17 to #10. Historic Resources Advisory Board Chairman Golladay introduced Mr. Ray Ewing, Chairman of the Historic Resources Advisory Board. CONTINUATION OF A PUBLIC HEARING Rezoning Request #019 -89 of Wayne Wilson to rezone 19.263 acres from RP (Residential Performance) to B -2 (Business General) for a combination of general retail with professional townhouses in the Opequon District. Action - Approved It was noted by the staff that this rezoning was tabled at the Planning Commission's October 4, 1989 meeting in order for the applicant to perform a traffic analysis and to present a possible solution to the potential traffic problem on Route 641. Mr. Watkins noted that the applicant had provided a detailed traffic analysis as requested. He said that the analysis suggested that the impacts on Route 641 and the Route 641 and Route 277 intersection would be acceptable if certain road improvements were made, which included right and left turn lanes on Route 641. Mr. Watkins noted that the applicant has submitted an addendum to his proffers, adding the right turn lane only. Mr. Wayne Wilson explained that in his original set of proffers, the right turn deceleration lane was on Route 277. He said that at that point, they did not intend to do much on Route 641. Mr. Wilson said that the addendum to the proffers is for the new northbound right turn lane on Route 641, servicing the main entrance to the proposed development. Mr. Wilson added that their study has shown that the proposed use of the property will not adversely affect either points in question. Some of the Commissioners were concerned that no provisions were made for pedestrian traffic on Route 641. There was some discussion on whether a request could be made to the Transportation Department to construct a sidewalk. Rinker, Upon motion made by Mr. Thomas and seconded by Mr. BE IT RESOLVED, That the Frederick County Planning Commission does hereby unanimously recommend approval, with proffers, of Rezoning Request #019 -89 of D. Wayne Wilson to rezone 19.263 acres (a 9.612 acre tract and a 9.651 acre tract) from RP (Residential Performance) to B -2 (Business General) for a combination of general retail with professional townhouses. This property is located east of the I -81 interchange at Stephens City, at the northeast corner 2989 -3- of Routes 277 and 641, in the Opequon District. 41l 7 0 to1Lpt l:� 4 u Rezoning Request #020 -89 of Alson H. and Margarette M. Smith to rezone seven acres from B -2 (Business General) to B -3 (Industrial Transition) for a wholesale business and offices for Shenandoah Foods, Inc., in the Stonewall District. Action - Approved It was noted by the staff that the site was an appropriate B -3 location, adjacent to an existing industrial park. Mr. Harry Benham, attorney, was present on behalf of Mr. and Mrs. Smith. Mr. James W. Parsons, an adjoining property owner, was concerned about water runoff from the property. Mr. Parsons said that runoff from the Smith's property drains across his property. The Commissioners were aware that water naturally drains in this area and noted that at the time of site plan review, Mr. Parsons concerns would have to be addressed. A question was raised on the use of the remainder of the property. Mr. Benham said that the eastern portion of the property, which is the majority, will be used for Shenandoah Foods and that portion will have one entrance. He said that the western part of the property will have the other entrance and at the present time, no specific use is planned, although it was anticipated that a similar type of business would be located there. Romine, Upon motion made by Mr. DeHaven and seconded by Mr. BE IT RESOLVED, That the Frederick County Planning Commission does hereby unanimously recommend approval of Rezoning Request #020 -89 of Alson H. Smith and Margarette M. Smith to rezone seven acres from B -2 (Business General) to B -3 (Industrial Transition) for wholesale businesses and offices. This property is located on Route 661 (Welltown Pike) about two miles north of Winchester in the Stonewall District. Rezoning Request #021 -89 of the Evans Company (Robert and Rosie Snyder) to rezone 54.625 acres from RA (Rural Areas) to B -2 (Business General) (15.3 acres) and RP (Residential Performance) (39.6 acres) for residential and commercial uses in the Opequon District. Action - Approved 2990 The commission and staff reviewed the proffers submitted by the applicant. Mr. Ronald Mislowsky, an engineer with G. W. Clifford & Associates, was present to represent the applicant. Mr. Mislowsky said that the applicant has proferred to construct the Golladay Expressway from Route 277, through their property and across Wrights Run, which would be at considerable expense, and then onto Westmoreland Drive. He noted that 20 -29 acres will be single - family and just over 11 acres will be for townhouses. Also, the density will be 2.4 -2.5 units per acre for single - family and 7.9 units per acre for townhouses. The Commissioners questioned the applicant's proposal for three access points onto Route 277. They felt that three curb cuts would inhibit traffic flow on Route 277. The Commissioners were also concerned that the 50' right -of -way dedicated to construct a portion of the Golladay Expressway was not wide enough. They also felt that a pedestrian walkway /sidewalk was needed along the Golladay Expressway through the residential areas. Finally, it was felt that the school systems were already overloaded and any further rezonings would only add to the overcrowded school problem. Romine, Upon motion made by Mr. Thomas and seconded by Mr. BE IT RESOLVED, That the Frederick County Planning Commission does hereby recommend approval of Rezoning Request #021 -89 of the Evans Company (Robert & Rosie Snyder) to rezone 54.625 acres from RA (Rural Areas) to B -2 (Business General) and RP (Residential Performance) with proffers and with concerns noted above to be sent to the Board of Supervisors. This property is located north and adjacent to Route 277, east of Stephens City, and 1,750' east of Route 641, approximately 1.75 miles east of I -81, in the Opequon District. The vote on this rezoning was: YES (TO APPROVE): McDonald, Sherwood, Golladay, DeHaven, Wilson, Romine, Thomas NO: Marker, Rinker Conditional Use Permit #018 -89 of Lake Centre for a day care facility in the Shawnee District. Action - Approved Mr. Charles Maddox, Jr., Engineer with G. W. Clifford & Associates, was present to represent the applicant. Mr. Maddox pointed out that the entrance to the day care center will be placed 2997_ -S- as far from the Route 642 /Chinkapin Drive access as possible, for safety reasons. He said that berms, screening and fencing will be used to safely control the use of the grounds. Mr. Maddox requested the elimination of the condition that requires permit renewal if ownership changes. Romine, Upon motion made by Mr. Wilson and seconded by Mr. BE IT RESOLVED, That the Frederick County Planning Commission does hereby unanimously recommend approval of Conditional Use Permit #018 -89 of Lake Centre for a day care facility to be located at the southeast corner and intersection of State Route 642 and Chinkapin Drive (Lakeside Estates) in the Shawnee District, with the following conditions: 1) The site plan approval process must be completed with all review evaluation comments that require action being properly addressed. 2) Approval to be for unlimited time unless the use or occupancy of the property changes. Should this occur, this conditional use permit shall expire and a new conditional use permit will be required. 3) The owner /operator shall comply with all Federal, State and local laws governing operation of a day care facility. Conditional Use Permit #019 -89 of Joanne R. Happ for an artist's studio in the Stonewall District. Action - Approved Mrs. Joanne R. Happ, the applicant, was present to answer questions from the Commission. Upon motion made by Mr. DeHaven and seconded by Mr. Rinker, BE IT RESOLVED, That the Frederick County Planning Commission does hereby unanimously recommend approval of Conditional Use Permit #019 -89 of Joanne R. Happ for an artist's studio near Grimes, on the northern side of Route 671, at the intersection of Route 661 (Welltown Pike), with the following condition: 1) If the use, occupancy or ownership of the property changes, this conditional use permit shall expire and a new conditional use permit will be required.
