OF THE
FREDERICK. COUNTY PLANNING COMMISSION
Held in the Board Room of the Old Frederick County Courthouse in Winchester,
Virginia on July 19, 1989.
PRESENT: Planning Commissioners present were: James W. Golladay, Jr., Chairman;
Beverly Sherwood, Vice Chairman; John Marker, Back Creek District; Carl M.
McDonald; Gainesboro District; Manuel C. DeHaven, Stonewall District; S. Blaine
Wilson, Shawnee District; Douglas Rinker, Citizen at Large; George L. Romine,
Citizen at Large; Marjorie H. Copenhaver, Citizen at Large; Roqer L. Thomas,
Citizen at Large; and Kenneth Y. Stiles, Board Liaison.
Planning Staff Present were: Robert W. Watkins, Secretary; Eris C. Tierney; and
W. Wayne Miller.
CALL TO ORDER
Chairman Golladay called the meeting to order at 7:00 p.m.
BIMONTHLY REPORT
Chairman Golladay accepted the Bimonthly Report for the Commission's
information.
COMMITTEE REPORTS
Ordinance Subcommittee
Mr. McDonald reported that the Ordinance Subcommittee worked on proposals
for residential lot grading requirements and underground utilities for RP deve-
lopments.
Sanitation Authority
Mrs. Copenhaver reported that the Sanitation Authority is investigating
moving a water tank to the Gilpin Industrial Park for added water supply and
water pressure to that development. She said that a storage tank at Stephens
Run and upgrading of the Parkins Mill Plant were also discussed.
SUBDIVISIONS
Subdivision Plat for the Winchester - Frederick County Industrial Development Cor-
poration for three industrial lots in the Back Creek District.
Action - Approved

Mr. James Largent was the representative for this subdivision. Mr.
Largent said that the 40 -acre tract has already been approved and these are the
final three parcels. He said that this was brought back to the Commission
because the purchasers had a change in the number of acres they wanted to
purchase.
Upon motion made by Mr. Marker and seconded by Mrs. Copenhaver,
HE IT RESOLVED, That the Frederick County Planning Commission does hereby unani-
mously approve the subdivision plat for Winchester - Frederick County Industrial
Development Corporation for three industrial lots (27 acres), zoned M -1. This
property is bounded by Route 37 to the north, Route 11 to the east, and Route
651 to the west.
Subdivision Plat for kerns Lots /Broad Avenue for three lots for duplexes (1.084
acres) zoned RP in the Shawnee District.
Action - Approved
The staff noted that this proposal initially came before the Planning
Commission under a mired use provision, which is no longer in the ordinance.
Several different versions were brought before the Commission, however, this
version conformed with the master plan approved by the Board of Supervisors.
Mr. Butch kerns, the applicant, said that two duplexes were already
located on the property.
Some Commissioners disapproved of the size of the lots and felt that it
did not fit in with the area.
Upon motion made by Mr. Romine and seconded by Mr. McDonald,
BE IT RESOLVED, That the Frederick County Planning Commission does hereby
approve Kerns Lots /Broad Avenue for the subdivision of a portion of two
existing lots to create a third lot for an additional duplex structure. This
property is located on Route 831 (Broad Avenue) in the Lockhart Subdivision,
which is located on the south side of Senseny Road, east of Winchester.
The vote on this subdivision request was:
YES (TO APPROVE): Thomas, Rinker, Romine, Wilson, Sherwood, McDonald,
Copenhaver, Marker.
NO: DeHaven, Golladay
Subdivision Plat of Pembridge Heights, Section II, and a portion of Section III,
for 127 single - family lots in the Shawnee District.

Mr. Jack Williams, the engineer for the applicant, was present to answer
questions. The Commissioners inquired if Route 781 was being used for construc-
tion vehicles and Mr. Williams stated that was correct.
Mr. Leonard Newcome, spokesman for the College Park subdivision, inquired
if any of the street, lot or boundary line layouts were changed since the last
submittal that would affect the perimeter property owners of College Park. Mr.
Newr_ome felt that more green space had been disturbed than originally proposed
and he still had concerns about drainage from Pembridge Heights flowing into the
College Park Subdivision.
Mr. Wayne Nicholson, resident at 1176 Princeton Drive in College Park,
read a statement of events concerning damage to the sewage discharge line at his
residence by construction workers at Pembridge Heights, which occurred over
Memorial Day weekend. Mr. Nicholson was concerned because no one from the
Pembridge Heights development had accepted responsibility for the damages that
occured at his home.
The Commissioners were concerned that the Pembridge Heights developers
were not responsive to Mr. Nicholson's problems, although they were aware that
the situation was a civil matter.
In light of these circumstances, Mr. Stiles requested that this sub-
division be sent to the Board of Supervisors for final action. Mr. Wilson moved
that the Planning Commission approve this subdivision, but that final action be
taken by the Board of Supervisors. This motion was seconded by Mr. Romine, but
failed by the following vote:
YES (TO APPROVE & SEND TO DOS): Romine, McDonald, DeHaven, Wilson, Golladay
NO: Marker, Copenhaver, Sherwood, Thomas, Romine
Mr. Rinker called for a revote, due to a division of assembly:

BE IT RESOLVED, That the Frederick County Planning Commission does hereby
approve the subdivision plat of Pembridge Heights, Section II, and a portion of
Section II1, for 127 single - family lots on 51 acres, zoned RP. This property is
located on the north side of Route 50, approximately 1/2 mile east of the Route
81 intersection, in the Shawnee District. This subdivision will go to the Board
of Supervisors for final disposition.
Subdivision Plat of Oakdale Crossing for 6B single - family lots on .79 acres,
zoned RP, in the Shawnee District.
Action - Approved
It was noted by the staff that the subdivision conformed with the
approved master plan with the exception of the removal of two stormwater
retention ponds.

Mr. Romine presented a letter from an adjoining property owner, Mr. Ken
Kisner, concerning drainage. Upon motion made by Mr. Romine and seconded by
Mrs. Sherwood, the Commission unanimously voted to make the letter a part of the
official record, (letter inserted at end of minutes)
Mr. Charles E. Maddox, Jr., consulting engineer with G. W. Clifford &
Associates, was present to represent this subdivision. Mr. Maddox said that
they visited Mr. Kisner's property to investigate the drainage impacts and
addressed Mr. Kisner's concerns. With regard to the removal of two retention
ponds, Mr. Maddox, said that they determined that the retention pond behind Lots
32, 33, 34 and 35 was sufficient to handle the runoff, even for future develop-
ment in the area.
Mr. Maddox also discussed the developers ideas on a landscaped entrance
with curb and gutter. Mr. Maddox said that they have run into some opposition
from VDOT because it would create problems for snow removal vehicles and it
would require mowing a median strip. Mr. Maddox felt that the entrance planned
was very aesthetic and would be an asset to the area.
Upon motion made by Mr. Wilson and seconded by Mr. Romine,
BE IT RESOLVED, That the Frederick County Planning Commission does hereby unani-
mously approve the subdivision of Oakdale Crossing for 68 single - family
detached, rural traditional lots on 39 acres, zoned RP, with the divided median
entrance as proposed by the developer. This property is located 3,300' east of
the Route 81 /Senseny Road intersection, fronting on Senseny Road, in the Shawnee
District.
Subdivision Plat of Canterbury Square for 20 patio homes on 3.8 acres, zoned RP,
in the Gainesboro District.
Action - Approved
Mr. Bruce Edens, engineer with Greenway Engineering & Surveying Company,
was present to represent this subdivision. Mr. Edens noted that they have pre-
pared a stormwater management plan for the development.
A discussion ensued on the two access roads to Lots 12, 16, and 18. It
was noted that these would be private roads and the state would not be assuming
maintenance for them. Mr. Edens said that there would be deed covenants with
those particular lots stating that maintenance would have to be provided by the
property owner.
Upon motion made by Mr. McDonald and seconded by Mrs. Copenhaver,
BE IT RESOLVED, That the Frederick County Planning Commission does hereby unani-
mously approve the subdivision plat of Canterbury Square for 20 patio lots on
3.8 acres, zoned RP, with the stipulation that all agency comments are met.
This property is located on the east side of Westminster - Canterbury Drive,
1,000' south of its intersection with Route 522, in the Gainesboro District.

PUBLIC MEETING
Preliminary Master Development Plan #004 -b9 of Wakeland Manor for 393 single -
family lots and 219 townhouse units in the Shawnee District.
Action - Approved
Mr. Rex. Wakeman presented the master plan to the Commission. Mr. Wakeman
was concerned about the 30% open space required by the ordinance. He assumed
that 30% open space was required in the high- density townhouse section and not
in the single - family section. He said that the staff has pointed out that when
housing types are mixed, 30% open space is required overall. Mr. Wakeman said
that at present, his open space stood at 66.1 acres or 23%. He noted that-his
single - family lots were 16,500 square feet and because of the large size of the
lots, he felt that dedicating more land to open space was not necessary.
The staff and Commissioners discussed the open space situation and noted
that any adjustment to the ordinance would have to go to the Ordinance Subcom-
mittee.
Mr. Watkins next presented a letter from Benjamin M. Butler, an attorney
representing Dr. James H. Stafford, Jr., the owner of property adjacent to Wake -
land Manor. The two concerns of Dr. Stafford were: 1) There should be a connec-
tor street between the Wakeland Manor development and Dr. Stafford's property
with respect to Section 14, Wakeland Manor; 2) The plans indicate eight -inch
water lines in the project and Dr. Stafford feels proper development engineering
should provide for 10 -inch water lines so that future development will not be
hampered.
Mr. Benjamin Butler was present to answer questions from the Commission
concerning Dr. Stafford's letter. The Commission pointed out that while a
right -of -way could be provided to the property line, the connection would have
to be at Dr. Stafford's expense. It was noted that the Sanitation Authority
would have to be contacted concerning the size of water lines.
A discussion next ensued on the street layout and cul -de -sacs and Mr.
David Furstenau, Surveyor, was present to answer those questions for the Com-
mission.
Upon motion made by Mr. Wilson and seconded by Mr. Romine,
BE IT RESOLVED, That the Frederick County Planning Commission does hereby unani-
mously approve Preliminary Master Development Plan #004 -89 of Wakeland Manor for
393 single - family lots and 219 townhouse units for a total of 612 units on 298.2
acres, zoned RP. This property is located on the north side of Route 642, east
of the itnersection with 647, in the Shawnee District. This approval is con-
tingent on all agency requirements being met and the alignment of roads at the
easternmost entrance of the site.
The vote on this plan was:
YES (TO APPROVE): Marker, Copenhaver, McDonald, Sherwood, Golladay, DeHaven,
Wilson, Romine, Rinker

INFORMAL DISCUSSION WITH MR. RICHARD KEELER ON A PROPOSED REZONING
Mr. Richard A. R':eeler was present to informally discuss his intentions to
rezone 1.04 acres from RA to H -2 for a convenience store. The property was
located .2 miles north of Middletown, directly across from the entrance to Lord
Fairfax Community College. Mr. Keeler discussed his intentions for the property
with the Commission.
