FREDERICK COUNTY PLANNING
Held in the Board Room of the Old Frederick County Courthouse
in Winchester, Virginia on March 15, 1989.
PRESENT: James W. Golladay, Jr., Chairman; Beverly Sherwood,
Vice Chairman; Manuel C. DeHaven, Stonewall District; Carl M.
McDonald, Gainesboro District; John R. Marker, Back Creek
District; Marjorie H. Copenhaver, Citizen at Large; George L.
Romine, Citizen at Large; Douglas Rinker, Citizen at Large;
Kenneth Y. Stiles, Board Liaison.
ABSENT: S. Blaine Wilson, Shawnee District
Planning Staff Present: Robert W. Watkins, Secretary; and Kris
C. Tierney.
Chairman Golladay called the meeting to order at 7:00
p.m.

Chairman Golladay formally introduced the newly
appointed Back Creek District representative, John R. Marker.

The first order of business was the consideration of
the minutes of February 15, 1989. Upon motion made by Mr.
McDonald and seconded by Mr. DeHaven, the minutes of February
15, 1989 were unanimously approved as presented.
The next order of business was the consideration of
the minutes of March 1, 1989. A correction was made on page
one and then Mrs. Copenhaver moved for approval. This motion
was seconded by Mr. McDonald and passed unanimously.

Chairman Golladay accepted the Bimonthly Report for
the Commission's information.

REPORTS
Economic Development Commission
Mr. Romine, Coordinator for the Economic Development
Commission, said that Century Graphics will be moving to the
area shortly. Mr. Romine said that he would be announcing two
more additions to the area's industrial community in the near
future.
Final Subdivision Plat of the Mark Jon Tenenbaum Land to
subdivide 12.5 acres into an 8.5 acre parcel and a 4 acre
parcel in the Shawnee District.
Action - Approved
Mr. Watkins noted that the lot in question did not
have frontage on a state - maintained road. He said that the
subdivision ordinance requires that lots front on a dedicated
road. He explained that the applicant is re- establishing a
lot that previously existed on the original JIC subdivision
plat. He said that, at one time, this lot was added to the
larger tract and now it is being divided back off. Mr.
Watkins further explained that an industrial access request is
currently pending for the section of right -of -way that would
go from this area back to Route 728, which would be relatively
close to the Tenenbaum lot. He said that the industrial
access request is currently tied up because one of the
property owners on Route 728 has not yet dedicated a small
triangle of property for the radius for the entrance on Route
728. Mr. Watkins felt that the industrial access question
needed to be resolved and a road constructed back to this area
in the industrial park.
Mr. Stiles said that if a response is not received
from the property owner on the acquisition of the triangle of
property needed for the radius, the Board would proceed with
condemnation.
Mr. Mark Tenenbaum, the owner, explained to the
Commission what was proposed for this lot.
Upon motion made by Mr. DeHaven and seconded by Mr.
Romine,
BE IT RESOLVED, That the Frederick County Planning Commission
does hereby unanimously approve the final subdivision plat of
the Mark Jon Tenenbaum Land, zoned M -1, for the subdivision of
an 8.5 acre lot and a 4 acre lot from the existing 12.5 acres

located north of Route 728, at the intersection of Route 50
and Route 728, in the Shawnee District.
Final Subdivision Plat of Lenoir City Company of Virginia
land, zoned M -1, for the subdivision of two lots, Parcel D -3
(0.9242 acres) and Parcel E (11.0166 acres) in the Stonewall
District.
Action - Approved
Mr. Watkins said that an application for industrial
access has been applied for on this right -of -way and the Board
of Supervisors has passed a resolution on it. He said that
the staff recommends approval of this subdivision with the
understanding that this road is being provided through the
industrial access process.
Mr. Tom Gilpin, with Lenoir City Company of Virginia,
explained that they were in a "Catch -22" situation in that the
County Ordinance states that before subdivision can occur,
access to a state- maintained road is needed and the State
Highway Access Program prohibits applying for access funds if
there is access to a state - maintained road. Mr. Gilpin said
that they had to subdivide the property in two different
parcels. Mr. Gilpin noted that this lot is for Century
Graphics.

Upon motion made by Mr. DeHaven and seconded by Mr.

does hereby unanimously approve the final subdivision plat of
Lenoir City Company of Virginia land for the subdivision of
two M -1 lots: Parcel D -3 (0.9242 acres) and Parcel E (11.0166
acres). Parcel D -3 is located on the southeast side of Lenoir
Drive and Parcel E is located on the northwest side of the
Penn Central Railroad.
Final Subdivision Plat of Ki_merly G. Henry land for the
subdivision of one B -2 lot from 27f acres on Baker Lane in the
Stonewall District.
Action - Approved
Mr. Kimerly G. Henry, owner, was present to answer
questions.
Mr. Watkins noted that this lot will be made square
by the staightening of Baker Lane.
Upon motion made by Mr. DeHaven and seconded by Mrs.
Sherwood,
BE IT RESOLVED, That the Frederick County Planning Commission
does hereby unanimously approve the final subdivision plat of
Kimerly G. Henry for the subdivision of one B -2 lot from a 27±
acre tract located on Baker Lane in the Stonewall District.
The staff presented the 1988 -89 Work Program for the
Department of Planning and Development. Mr. Watkins said that
this program will go to the Board of Supervisors at their next
meeting.
Upon motion made by Mr. Romine and seconded by Mr.
Rinker, the Work Program was unanimously approved as
presented.
ORDINANCE SUBCOMMITTEE MEETING
Mr. Watkins announced that there would be an
Ordinance Subcommittee meeting on Monday evening, March 20, at
7:30 p.m.
