HomeMy WebLinkAboutPC_02-01-89_Meeting_Minutesi - 1 - MEETING MINUTES COUNTY PLANNING COMMISSION Held in the Board Room of the Old Frederick County Courthouse in Winchester, Virginia on February 1, 1989. PRESENT: James W. Golladay, Jr., Chairman, Opequon District; Beverly Sherwood, Vice Chairman, Citizen at Large; Manuel C. DeHaven, Stonewall District; S. Blaine Wilson, Shawnee District; George L. Romine, Citizen at Large; Marjorie H. Copenhaver, Citizen at Large; and Kenneth Y. Stiles, Board Liaison. Also present were: Robert W. Watkins, Secretary; and Kris C. Tierney, Advisory. ABSENT: Carl M. McDonald, Gainesboro District; and Frank Brumback, Back Creek District. Chairman Golladay called the meeting to order at 7:00 p.m. The first order of business was the minutes of December 21, 1988 and January 18, 1989. Upon motion made by Mr. Romine and seconded by Mr. Wilson, the minutes of December 21, 1988 were unanimously approved as presented. Upon motion made by Mr. Romine and seconded by Mr. DeHaven, the minutes of January 18, 1989 were unanimously approved as presented. REPORT The Commission and staff discussed pending applications. SUBDIVISIONS Final Subdivision Plat of Lakeview Townhouses, Sections 6 and 7, zoned RP, for 96 townhouse units in the Shawnee District. Action - Approved : - 2 - The staff noted that the subdivision conformed to the approved master development plan. Mr. Dave Holliday, President of Lakeside Development Company, and Mr. Charles Maddox, the engineer, were present to answer questions. Mr. Maddox reviewed an overall site plan for the Lakeside area. Mr. Maddox noted that a very good stormwater management plan has been developed for the Lakeside area, at some expense to the developer. He said that drainage is diverted and carried to the Opequon. He also noted that the original road network is still in place. Romine, Upon motion made by Mr. Wilson and seconded by Mr. BE IT RESOLVED, That the Frederick County Planning Commission does hereby unanimously approve the Final Subdivision Plat of Lakeview Townhouses, Sections 6 and 7, for 96 townhouse units on 9.148 acres, located on the northeast side of Route 642, northeast of Stephens City, in the Shawnee District. Final Subdivision Plat of Dominion Knolls, zoned RP, for townhouses in the Stonewall Magisterial District. Action - Approved The staff noted that the subdivision plat was in conformance with the approved final master development plan. Mr. Eddie Yost was present to represent the owner, Mr. Peter P. Wideline. It was noted that Mr. Wideline purchased the property from Mr. J. P. Darlington in May of 1988. Mr. Edward Dove, the engineer, reviewed the plan with the Commission. Wilson, Upon motion made by Mr. DeHaven and seconded by Mr. BE IT RESOLVED, That the Frederick County Planning Commission does hereby unanimously approve the final subdivision plat of Dominion Knolls for two - bedroom townhouses on 20.28+ acres, 2839 - 3 - located on Baker Lane, just north of the City of Winchester, in the Stonewall Magisterial District. DISCUSSION ON CONCRETE BLOCK MANUFACTURING IN THE M - 1 ( INDUSTRIAL LIMITED ZONING DISTRICT The staff presented a draft of a proposed use category for concrete block manufacturing in the M -1 (Industrial Limited) Zoning District. Mr. Tom Gilpin, President of Lenoir City Company of Virginia, was present to speak to the Commission. Mr. Gilpin also introduced Mr. Paul Muldowney, Vice President of Supreme Concrete Block, Inc. Mr. Muldowney was interested in locating his business in the Stonewall Industrial Park. Mr. Gilpin and the Planning Commissioners had some minor changes to the wording for the amendment; but overall, they were in agreement and instructed the staff to proceed with advertising for public hearing. PUBLIC HEARINGS Rezoning Application #004 -88 of Robert and Kitty Hockman to rezone 46.5 acres from A -2 (Agricultural General) to M -1 (Industrial Limited) in the Back Creek District. Action - Tabled Mr. Watkins said that the applicant has requested that the Commission table their request for one month. Mr. Watkins said that this application was tabled by the Board of Supervisors and sent back to the Planning Commission nearly 12 months ago. He said that due to legal requirements, this application needed to come before the Commission, unless the applicant requests it be tabled further. The Chairman called for public comment, but no one came forward. Upon motion made by Mr. Romine and seconded by Mrs. Copenhaver, 017. - 4 - BE IT RESOLVED, That the Frederick County Planning Commission does hereby unanimously table Rezoning Request #004 -88 of Robert and Kitty Hockman to rezone 46.5 acres from A -2 (Agricultural General) to M -1 (Industrial Limited). This property is located on Route 651, on the south side of Route 37, in the Back Creek District. Rezoning Request #018 -88 of Nicholas Smart, et al, to rezone 3.96 acres from RP (Residential Performance) to B -2 (Business General) in the Shawnee District. Action - Approved The staff felt that this area, across from Delco Plaza, was appropriate for commercial use. Mr. Watkins noted that this request was tabled at the Commission's December 7, 1988 meeting, due to concerns about entrances along Route 50. Mr. Nicholas Smart was present to represent himself and the three other property owners involved in this rezoning. Mr. Smart noted that the Transportation Department had no objections to the rezoning of the property. Mr. Stiles said that a service entrance would need to be built when this property develops to eliminate the possibility of eight or ten separate entrances on Route 50. Mr. Smart said that it is the desire of the property owners to sell the parcels to one user as a single property, instead of selling all the lots separately. Chairman Golladay called for public comment, but no one came forward. Upon motion made by Mr. Wilson and seconded by Mr. Romine, BE IT RESOLVED, That the Frederick County Planning Commission does hereby unanimously approve Rezoning Application #018 -88 of Nicholas Smart, et al, to rezone 3.96 acres from RP (Residential Performance) to B -2 (Business General). This property is located on Route 50 East, on the left -hand side of Route 50 starting at the Shenandoah Valley National Bank and ending at Purdue Drive, in the Shawnee District. 2841 - 5 - Rezoning Request #021 -88 of Kimerly Henry to rezone 4.88 acres from M -1 (Industrial Limited) to B -3 (Industrial Transition) in the Stonewall Magisterial District. Action - Approved The staff noted that this rezoning would adjust the boundary between existing M -1 and B -3 areas by moving it slightly to the north. Mr. Watkins said that no negative impacts were anticipated. Mr. Kimerly Henry, the owner, was present to answer questions. Chairman Golladay called for public comment, but no one came forward. Upon motion made by Mr. DeHaven and seconded by Mr. Romine, BE IT RESOLVED, That the Frederick County Planning Commission does hereby approve Rezoning Application #021 -88 of Kimerly Henry to rezone 4.88 acres from M -1 (Industrial Limited) to B- 3 (Industrial Transition). This property is located on Baker Lane (Parcel 3) in the Stonewall Magisterial District. HAYMAKER - HOUSTON DISCUSSION Mr. Watkins said that in separate letters, Allyn K. and Mary B. Houston and Richard B. Haymaker have requested an informal discussion with the Planning Commission to talk about the same parcel of land. He said that they were interested in the possible use of a 3.9 acre parcel on Route 644, just east of Interstate 81. Mr. Watkins said that this location is not in the existing or proposed urban development area or an existing interchange area. He said that the staff expects that this area will become part of the urban area in the not too distant future, particularly after road planning in this area is further developed. Mr. Watkins felt it was unclear whether this area would ultimately be for residential or business use and felt it may depend on whether a new interchange was planned on I -81. Mr. Allyn Houston, the owner of the property, said that an existing, nonconforming business (a store) was currently in operation on the property. Mr. Houston wanted to either sell or develop the property and he felt that business zoning would be best for this location. He said that a potential purchaser wanted to start a business that would require B -3 Zoning. Mr. Richard B. Haymaker, the potential buyer for the property, said that he represented himself and Mr. Willis White. Mr. Haymaker said that they would like to put mini - storage units on the property. Mr. Haymaker answered questions from the Commission on the use proposed. The Commission felt the property could be rezoned without putting it into the urban development area. It was noted that there have been ongoing discussions about the desirability of an interchange on I -81 and Papermill Road. The Commissioners felt they could not hold up the owner and the developer until the Transportation Department made definite plans for this area. Mr. Houston said that when the Transportation Department constructed I -81, they platted for an interchange and acquired property for the right -of -way. Mr. Houston said that according to the design of the interchange at that time, it would not interfere with any business on this property. No action was necessary by the Planning Commission at this time. Mr. Watkins said that Mr. Carper has requested that land on Route 723 be included in the Urban Development Area in the proposed Comprehensive Plan. Mr. Watkins said that the Comprehensive Plan Subcommittee discussed this matter, but did not recommend that the area in question be included in the Urban Development Area. Mr. Ryland Carper was under the assumption that his request was denied because the land was not in a gravity flow area for sewage. He also noted that the soil was not well suited for agriculture. The Commission explained that the boundaries of the urban development area did not solely involve pumping. It was noted that the limits of the urban development area were, to N - 7 - the extent possible, designed by drainage areas or subdrainage areas to provide a rational basis for a boundary. It was also an effort to have controlled growth in the county. It was noted that the only way Mr. Carper's land could be included, at this point, would be to include several thousand acres between the urban development area and this parcel. The Commissioners felt that they could not simply take a parcel that was not even connected to the area designated and say it was a part of the urban area. The Commissioners felt that if they added to the urban development area outside of the guidelines established in the process, they may have serious legal problems. The Commissioners felt that since the Comprehensive Plan was reviewed annually, this request could be considered in the future. PRE- APPLICATION DISCUSSION WITH DONALD E. SAGER Mr. Watkins said that Mr. Donald E. Sager is proposing a business development on land zoned B -1 (Business Limited), located on Route 647. Mr. Watkins said that since this land involved less than ten acres, the Planning Commission had the option to waive the master plan. Mr. Don Sager said that he owned the property in partnership with his cousin, Ms. 'Jane Miller. Mr. Sager wanted to divide the 2.8 acres into six tracts for an office building complex. The Commission felt that a master plan was needed for this development because of the numerous complaints received from the residents of Plymm Owens, over the years about the business uses in the area. It was noted that the following items would need to be addressed: Screening between this project and the lots in Plymm Owens, entrances on Route 277 and Route 647, and the potential entrances for the front two lots on Route 647. PRESMU-ATION BY WELLINGTON JONES ' ENGINEER / DIRECTOR OF THE FREDERICK COUNTY SANITATION AUTHORITY Mr. Wellington Jones, Engineer /Director of the Frederick County Sanitation Authority, gave a presentation on growth projections for the county,,'the water and wastewater demands resulting from this growth, and the relation of these ;m demands to the capacity that the Sanitation Authority has available. Mr. Jones said that because of the projections presented and because of a request by the Board of Supervisors, the Sanitation Authority favors expanding the Parkins Mill Plant, which is currently under construction. OUTLINE FOR ZONING Mr. Watkins noted that the staff has begun preparing comprehensive revisions to the zoning ordinance. He said that the staff intends to bring various sections to the Commission and Board for adoption as they are completed. Mr. Watkins presented a new outline for the ordinance that he hoped would provide a more useful and efficient ordinance. 1 •• • t No further business remained to be discussed and the Commission adjourned at 9:05 p.m. Respectfully submitted, Ja es W.
