PC_03-16-88_Meeting_MinutesMEETING MINUTES OF THE FREDERICK COUNTY PLANNING COMMISSION Held in the Board of Supervisors' Meeting Room in the Old Frederick County Court House, 9 Court Square, Winchester, Virginia, on March 16, 1988. PRESENT: Planning Commissioners present were: Frank H. Brumback, Chairman; James W. Golladay, Jr., Vice - Chairman; Manuel C. DeHaven; Beverly Sherwood; Marjorie H. Copenhaver; George L. Romine; Kenneth Y. Stiles; and Carl M. McDonald. Also present were: Robert W. Watkins, Secretary; Stephen M. Gyurisin, Advisory; and A. Bray Cockerill, Advisory ABSENT: S. Blaine Wilson Chairman Brumback called the meeting to order at 7:00 p.m. The first order of business was the consideration of the minutes of March 2, 1988. Upon motion made by Mr. Romine and seconded by Mr. Golladay, the minutes of March 2, 1988 were unanimously approved as presented. --------------------- BIMONTHLY AND MONTHLY REPORTS The Commission and staff discussed pending applications. --- -------- ---- ---- -- COMMITTEE REPORTS Economic Development Commission Mr. Romine reported that the Economic Development Commission has been very busy and has received several interesting prospects. Capital Improvements Plan Subcommittee Mr. Romine said that the CIP will have their final meeting on March 17 and will present their report to the Planning Commission on April 6, 1988. Comprehensive Plan Subcommittee Mr. Golladay presented the background reports for the Comprehensive Plan. He said that the subcommittee hopes to have one additional meeting this month on land uses dealing with rural areas. He added that rural and 2657 - 2 - urban areas will be discussed at the next Planning Commission worksession. Sanitation Authority The Sanitation Authority met on March 14, 1988. Mrs. Copenhaver reported that the Lakeside upgrade should be finished this week and this will divert Albin, Section 2, and Greenbrier to Lakeside. Mrs. Copenhaver said that this will reduce Stephens Run by about 10 %, but will not alleviate all the problems at this plant. She said that after this diversion is made, Lakeside will be about 75% -80% of capacity. Mrs. Copenhaver also reported on the following items: It is still not certain whether the moratorium will be lifted; The Route 50 work is progressing nicely; The Authority approved an extension of water and sewer along Route 522 to where the City services are located. Mrs. Copenhaver also reported that the Gas Company ran a line under I -81 to the Shackleford Farm and while the gas line was going under the road, the Authority installed a water line (approx. 10" -12 ") for additional water supply over to the Shackleford Farm area. Mrs. Copenhaver added that Federal Law now requires every wholesaler of water to advise the consumer of the lead content of the water. She said that in the Winchester /Frederick County area, the lead content is well below the acceptable level. She said that the City of Winchester and Frederick County will publish a joint ad in the newspaper. Ordinance Subcommittee Mr. Watkins reported that the Ordinance Committee will meet on March 21, 1988 and the Worksession will be on March 28, 1988. DISCUSSION WITH DR. MALCOLM TENNEY, JR., ACTI DIRECTOR,ILORD FAIRFAX Dr. Malcolm Tenney, Jr., Acting Director of the Lord Fairfax Health District, was present to discuss discharge permits and their impact on the environment in Frederick County. Mr. Tenney felt these systems needed to be regulated, as the Health Department was beginning to receive numerous requests for them. He said that there are no problems with the discharge from a sewage treatment system if it is properly regulated and operated. Mr. Tenney said that Frederick County should establish guidelines on how many systems should be allowed to discharge into a particular stream, on lot size requirements for system use, on the distance between systems, and whether or not'to approve systems for subdivisions or just for individual homes. Mr. Tenney explained the two basic kinds of systems: 1) the package treatment plant, consisting of an electrical or mechanical apparatus. He noted that there is always the possibility of mechanical failure with these systems; and 2) the sand filter, with no moving parts. Mr. Tenney's recommendation for a single, individual home was the sand filter. 2658 - 3 - The Commission and staff were very concerned about the protection of health and the maintenance of clean streams in Frederick County. They felt, however, that Frederick County did not have the expertise to determine how discharge systems affect streams and health and they felt guidance was needed from the Health Department and the State Water Control Board. Mr. Tenney said that he would present some recommendations to the Commission for review, so that the process for developing guidelines in Frederick County could begin. Mr. Stiles arrived at this point of the meeting. FINAL MASTER DEVELOPMENT PLANS Final Master Development Plan #017 -87 of Carlisle Estates II, Zoned RP, 153.111 acres, for single family traditional and townhouse lots in the Shawnee Magisterial District. Action - Approved Mr. Gyurisin said that this master plan was tabled at the last Planning Commission meeting because of concerns with street connections to Valley Mill Road (Route 659). Mr. Gyurisin said that the Transportation Committee has several ideas, but no final recommendation for the Greenwood Road / Senseny Road /Valley Mill Road area at this time. He said that Greenwood Road is currently listed in the County's Secondary Road Plan for improvements from Senseny Road (Rt. 657) to Valley Mill Road (Rt. 659). He added that the bridge on Valley Mill Road, near Route 820, is scheduled for replacement and should occur in about three years. Mr. Gyurisin said that Mr. Bushman, of the Virginia Department of Transportation, felt it was not advisable to cross Abrams Creek because of elevations and creek width. Mr. Charles Longerbeam, owner, was present to answer questions. Mr. Stiles noted that when the subdivision plat for this development was submitted, the Commission would probably require turn' lanes at the intersection on this property. Upon motion made by Mr. Romine and seconded by Mr. DeHaven, BE IT RESOLVED, That the Frederick County Planning Commission does hereby unanimously approve Final Master Development Plan #017 -87 of Carlisle Estates II for single family traditional and townhouse lots, located at the intersection of Virginia Secondary Routes 656 and 659, in the Shawnee Magisterial District. SUBDIVISIONS 2659 - 4 - Final subdivision plat of the Village at Lakeside, Section 8, Zoned RP, 4.4493 acres, for eight single family traditional lots in the Lakeside Subdivision, Shawnee Magisterial District. Action - Approved Mr. Charles Maddox, Engineer with G. W. Clifford 6 Associates and representative for this subdivision, said that this plat represents the last single- family detached traditional lots in Lakeside. Upon motion made by Mr. Romine and seconded by Mr. McDonald, BE IT RESOLVED, That the Frederick County Planning Commission does hereby unanimously approve the final subdivision plat of the Village at Lakeside, Section 8, for eight single family traditional lots in the Lakeside Subdivision, in the Shawnee Magisterial District. Final subdivision plat of Lakeridge Subdivision, Section 1, Zoned RP, 6.0334 acres, for 28 duplex lots in the Lakeside Subdivision, Shawnee Magisterial District. Action - Approved Mr. Charles Maddox, Engineer with G. W. Clifford 6 Associates and representative for this subdivision, said that this plat represented the first section of duplexes in Lakeridge. I Upon motion made by Mr. Romine and seconded by Mr. McDonald, BE IT RESOLVED, That the Frederick County Planning Commission does hereby unanimously approve the final subdivision plat of Lakeridge Subdivision, Section 1, for 28 duplex lots in the Lakeside Subdivision, north of Route 642, in the Shawnee Magisterial District. SITE PLANS i Site Plan #001 -88 of Robert H. Claytor, Zoned B -1, .34 acres, for a 3,000 square foot steel building to be used as a retail store in the Shawnee Magisterial District. Action - Approved Mr. Watkins said that two corrections on the plan will need to be made: 1) The applicant shows a 20 foot rear yard, however, a 30 foot rear yard is required. 2) The plan shows a gravel parking area, but this area will need to be paved. Mr. Watkins said that all other site plan requirements have been fulfilled. Mr. Robert H. Claytor said that he intends to blacktop the parking WERE - 5 - area and apply for a variance for the rear yard. Mr. Claytor said that he wanted to keep the proposed building in line with the existing building, which also has a 20 foot rear yard. Upon motion made by Mr. Romine and seconded by Mr. Stiles, BE IT RESOLVED, That the Frederick County Planning Commission does hereby unanimously approve Site Plan #001 -88 of Robert H. Claytor, ET. UX. Land for a 3,000 square foot steel building to be used as a retail store. This property is located along the northwest corner of the intersection of Williamson Road (Route 1213) and Senseny Road (State Route 657) in the Shawnee Magisterial District. --------------- - - - --- Site Plan #002 -88 of Marathon Bank, zoned B -2, 1.5 acres, located in the Battlefield Partnership Subdivision, Back Creek Magisterial District. Action - Approved Chairman Brumback turned the proceedings over to Vice Chairman Golladay for this item due to a conflict of interest. Mr. Brumback said that he would not vote or participate in any discussion on this proposal. Mr. Thomas Nida, representing Marathon Bank, was present to answer questions from the Commission. It was noted that the entrance would be from a side street and there would be two exits onto Route 11. Upon motion made by Mrs. Copenhaver and seconded by Mr. Stiles, BE IT RESOLVED, That the Frederick County Planning Commission does hereby approve Site Plan #002 -88 of Marathon Bank to be located on the east side of U.S. Route 11, approximately 3,000 feet south of the intersection of Route 11 and Route 37, in the Back Creek Magisterial District. The vote on this site plan was: YES: Copenhaver, McDonald, Stiles, Sherwood, Golladay, DeHaven, Romine ABSTAIN: Brumback Vice Chairman Golladay turned the proceedings back over to Chairman Brumback for the remainder of the meeting. Site Plan #003 -88 of Bethesda Management Company for a 10,000 square foot, one -story metal warehouse building, zoned M -1, 5 acres, in the Stonewall Magisterial District. Action - Approved 2661 - 6 - Mr. Chris Jones, owner, stated that they planned to have a one -way 30 foot entrance and a one -way 30 foot exit, both onto Lenoir Drive. Upon motion made by Mr. Stiles and seconded by Mr. Romine, BE IT RESOLVED, That the Frederick County Planning Commission does hereby unanimously approve Site Plan #003 -88 of Bethesda Management Company for a one - story, 10,000 square foot metal warehouse on Lenoir Drive in the Stonewall Industrial Park, Stonewall Magisterial District. Site Plan #056 -87 of E. Bruce Noland for a one -story steel building to be used as a warehouse, zoned M -1, 4.1667 acres, in the Stonewall District. Action - Approved Mr. Watkins noted that this was the final plan for the footer/ foundation approved previously for this site. Mr. E. Bruce Noland, property owner, was present to answer questions. Upon motion made by Mr. Stiles and seconded by Mr. Romine, BE IT RESOLVED, That the Frederick County Planning Commission does hereby unanimously approve Site Plan #056 -87 of E. Bruce Noland for a one -story steel building to be used as a warehouse. This property is located at 1655 Tyson Drive in the Stonewall Industrial Park, Stonewall District. TRANSPORTATION COMMITTEE RECOMMENDATIONS Mr. Gyurisin said that the Transportation Committee met on March 7, 1988 and acted on the following two items: 1) Approval of the right- of-way vacation request of Leonard D. Newcome Upon motion made by Mr. Golladay and seconded by Mr. Stiles, BE IT RESOLVED, That the Frederick County Planning Commission does hereby unanimously recommend to the Board of Supervisors the approval of the request of Leonard D. Newcome for the right -of -way known as Stanford Drive located between lots 57 and 58 of the College Park Subdivision. 2) Approval of the primary road plan recommendations to be 8, 1988 in Staunton at the Virginia Department of Transportation Preallocation Hearings. The Transportation Committee listed eight C s. Mr. Stiles moved to amend Item #2, that Route 37 be extended not just to 522 South, but on to Route 50 East. This motion was seconded by 2662 - 7 - Mr. Golladay and was unanimously approved. Upon motion made by Mr. Golladay and seconded by Mr. Stiles, BE IT RESOLVED, That the Frederick County Planning Commission does hereby unanimously recommend to the Board of Supervisors the approval of the primary road plan recommendations to be presented April 8, 1988 in Staunton at the Virginia Department of Transportation Preallocation Hearings, as follows: FREDERICK COUNTY PRIMARY ROAD IMPROVEMENTS SUMMARY OF RECOMMENDATIONS - LISTED IN ORDER OF PRIORITY 1. Route 522 North (West of Winchester) From: West Virginia State Line To: Route 127 (near Cross Junction) Proceed with four lane improvements as scheduled. 2. Route 37 (South of Winchester From: 1I- 81/11/37/642 Intersection, South of Winchester To: Route 522 South and to Route 50 East Plan for and acquire right -of -way to extend Route 37 as a four lane improvement to Route'522 South (north of Route 642 andlsouth of Route 644) and to Route 50 East. I 3. Route 522 South (East of Winchester) From: Route 50/17 East Intersection To: Route 277 East Intersection (North of Double Toll Gate) Improve to four lanes and provide intersection improvements as necessary to coordinate with Route 37 extension and Route 277 improvements. 4. Route 277 (East of Stephens City) i From: I -81 Intersection To: Route 340/522 Intersection (East of Double Toll Gate) Improve the existing two lane road facility by widening and strengthening immediately. Conduct detail studies to determine future needs for four lane improvements. 5. Improve Major Intersections Conduct improvement studies and improve existing major primary road intersections to be improved along with planned primary roads. Intersection improvements include: 2663 - -I -81/11 North /37/661 Intersection (North of Winchester) - -I -81/11 South /37 Intersection (South of Winchester) - -I -81/50 6 17/522 Intersection (East of Winchester) - -I -81/7 East Intersection (East of Winchester) -- 37/522 North Intersection (West of Winchester) - -37/50 West Intersection (West of Winchester) 6. I -81 (East of Winchester) From: Interchange #82 (Stephenson) To: Interchange #79 (Kernstown) Improve to six lanes between the Winchester Exits. 7. Route 11 (North and South of Winchester) A. Route 11 South From: Middle Road To: 37 Interchange Widen and improve to five lanes. B. Route 11 North From: Winchester City Limits To: 37 Intersection Widen and improve as necessary. 8. Eastern By- pass /loop From: Route 522 South To: Route 7 East and I -81 at Stephenson Plan and acquire necessary right -of -way along the existing Greenwood Road corridor (Route 656) to provide future improved north -south access east of Winchester. This should be studied as part of the Winchester thoroughfare plan process. ADMINISTRATIVE APPROVAL OF DOG KENNEL SITE PLAN Mr. Gyurisin said that the staff had received a request from the County Administrator's office to approve a site plan for a dog kennel on Sulphur Springs Road.
