FREDERICK COUNTY PLANNING COMMISSION
Held in the Board Room of the Old Frederick County Court House in Winchester,
Virginia on September 19, 1990.
PRESENT: Planning Commissioners present were: James W. Golladay, Jr., Chairman;
Beverly Sherwood, Vice - Chairman; Carl M. McDonald, Gainesboro District;
John Marker, Back Creek District; Manual C. DeHaven, Stonewall District;
Marjorie H. Copenhaver, Citizen at Large; George L. Romine, Citizen at
Large; and Roger L. Thomas, Citizen at Large.
Absent: Douglas Rinker, Citizen at Large; S. Blaine Wilson, Shawnee
District; Kenneth Y. Stiles, Board Liaison
Winchester City Liaison: Joseph Kalbach
Planning Staff present were: Robert W. Watkins, Secretary; Kris C.
Tierney; W. Wayne Miller; and Evan Wyatt.
CALL TO ORDER /MINUTES
Chairman Golladay called the meeting to order at 7:00 p.m. The first order
of business was the consideration of the minutes of August 19, 1990. Upon motion made
by Mr. McDonald and seconded by Mr. Marker, the minutes of August 18, 1990 were
unanimously approved as presented.
BIMONTHLY REPORT

Chairman Golladay accepted the Bimonthly Report for the Commission's
COMMITTEE REPORTS
Ordinance Subcommittee - 9/17190 Mtg.
Mr. Wyatt reported that the Subcommittee discussed revisions to the
• subdivision ordinance, specifically the property owners association section, lot grading
requirements and avigational easements. The next meeting is scheduled for October
31,96

• 15, at which time representatives from the Top of Virginia will present their concerns
with the proposed revisions.
Sanitation Authority - 8/20190 Mtg.
Mrs. Copenhaver reported that the 30 -day pump test at Stephens City
quarry will start at the end of this month; the City approved the sale of water to Camp
7; the Stonewall water storage tank design has been completed and bids are due on
September 27.
Historical Resources Advisory Board - 9/18/90 Mtg.
Mr. Tierney reported that the HRAB Committee finalized recommendations
on the revisions to the Comprehensive Plan; reached an agreement with the applicant
of the Wiseman /Shiho rezoning to protect the fortification on the property. At their next
meeting, the committee will run through their portion of the presentation for the
Comprehensive Plan public hearings.
Transportation Committee - 9111/90 Mtg.
Mr. Teirney reported that the committee reviewed the Six -Year Secondary
Road Plan and made some minor additions. They will need to schedule a public hearing
before their recommendations come to the Planning Commission.
SITE PLANS
Site Plan #047 -90 of Aberdeen Acres Kennel for an addition to the existing kennels,
north of State Route 836 in Stephenson, in the Stonewall District.
Action - Sent to Board of Supervisors for Disposition
Mr. Wyatt reported that the Andersons have proposed to increase the
existing 3,715 square foot kennel to 15,696 square feet, which is an increase of 11,981
square feet or a 322% increase in the size of the existing structure. Mr. Wyatt said that
the Planning Commission advised the planning staff to require a revised conditional use
permit at their August 16, 1989 meeting, however, the Andersons have not provided that
revised CUP to this date.
0 Mr. Thomas Schultz, counsel for the Andersons, requested that the site plan

• be approved for Aberdeen Acres Kennel without a revised conditional use permit. He
said that the conditional use permit for a kennel was approved in 1986 and the staffs
approval letter to the applicant made no stipulation in terms of the size or number of
dogs. Mr. Schultz felt that since the Anderson were not planning to change the use,
there should be no need to apply for a revised conditional use permit.
It was noted that the improvements planned for the kennel expansion would
probably improve noise control. Mr. DeHaven noted that during the annual review of
conditional use permits, there were no complaints by neighbors concerning the kennel
operation.
A motion was made by Mr. DeHaven to approve the site plan and this
motion was seconded by Mr. McDonald. However, the motion failed by the following
vote:

NO: Thomas, Romine, Golladay, Sherwood, Marker
The Commissioners felt that a revised conditional use permit was necessary
in order for the Commission to address the impacts of the change in intensity and
increase of occupancy. They felt that a dangerous precedent could be set if the site plan
was addressed before a revised conditional use permit was presented. They wanted
adjoining property owners to be able to voice their opinions on the expansion.
Upon motion made by Mr. Romine and seconded by Mr. Thomas,
BE IT RESOLVED, That the Frederick County Planning Commission does hereby
forward Site Plan #047 -90 of Aberdeen Acres Kennel to the Board of Supervisors for
final disposition without a recommendation from the Planning Commission.
The vote on this motion was:
YES (TO SEND TO BOS W/O RECOMMENDATION): Marker, Copenhaver,
Sherwood, Golladay, Romine, Thomas
NO: McDonald, DeHaven

No further business remained to be discussed and the meeting adjourned
at 8:30 p.m. by unanimous vote.
