PC_08-15-90_Meeting_Minutes• MEETING MINUTES OF THE FREDERICK COUNTY PLANNING COMMISSION Held in the Board Room of the Old Frederick County Court House in Winchester, Virginia on August 15, 1990. PRESENT: Planning Commissioners present were: James W. Golladay, Jr., Chairman; Beverly Sherwood, Vice- Chairman; John Marker, Back Creek District; Carl M. McDonald, Gainesboro District; Douglas Rinker, Citizen at Large; Marjorie H. Copenhaver, Citizen at Large; Roger L. Thomas, Citizen at Large; and Kenneth Y. Stiles, Board Liaison. Absent: S. Blaine Wilson, Shawnee District; Manual C. DeHaven, Stonewall District; George L. Romine, Citizen at Large. Winchester City Liaison: Joseph Kalbach Planning Staff present were: Kris C. Tierney; W. Wayne Miller; and Evan Wyatt. CALL TO ORDER Chairman Golladay called the meeting to order at 7:00 p.m. BIMONTHLY REPORT information. Chairman Golladay accepted the Bimonthly Report for the Commission's COMMITTEE REPORTS Rural Issues Subcommittee - 8/13190 Mtg. Mr. Tierney said that the Rural Issues Committee compiled a report on their progress to date on their recommendations for new rural regulations. The Rural Issues Committee will present this report to the full Planning Commission at the next Planning Commission's Worksession. 0 3169 0 2 Comprehensive Plan Subcommittee - 8114190 Mt2. Mrs. Sherwood said that Paul Bernard, the county's engineer, updated the committee on progress being made to the stormwater management study. The Committee has also begun to organize dates for public meetings and to review requests for inclusion in the plan. CITIZEN COMMENTS A memo was presented by Mr. Miller, Zoning Administrator, concerning a complaint made by Mr. Louis Hoover at the last Planning Commission meeting. Mr. Miller said that the situation at Mr. Hoover's was investigated by the Transportation Department and by the county's engineer and the determination made was that Mr. Hoover's property was not in jeopardy as far as flooding and that runoff to his property was not increased by the placement of culverts on the Abundant Life Christian Center's property. Mr. Miller said that there was some silt washed through the culvert into the drainage easement adjoining Mr. Hoover's property and the church's contractor was asked to remove the silt from the ditch. Subdivision application of Lenoir City Company of Virginia for the division of one lot (Lot 25), consisting of 2.5962 acres, in the Stonewall District. Action - Approved Chairman Golladay asked if the continuing problems on water drainage in this area had been solved. Mr. Miller said that after meeting on the site with Mr. Gilpin and members of the Board and Commission, Mr. Gilpin redirected a drainage ditch that was intersecting Red Bud Run at a 90 degree angle and he also installed rip -rap, which solved the drainage problem at this time. Mr. Thomas Gilpin, the applicant, was present to answer questions from the Commission. Upon motion made by Mr. McDonald and seconded by Mrs. Sherwood, • BE IT RESOLVED, That the Frederick County Planning Commission does hereby unanimously approve the subdivision application of Lenoir City Company of Virginia for the division of one lot (Lot 25) consisting of 2.5962 acres located on Kentmere Road, 3170 0 3 approximately 250' from the intersection with McGhee Road in the Stonewall Industrial Park, Stonewall District. Subdivision request for Greenbriar North for the division of eight lots (2.9166 acres) for single - family detached urban homes located in the Opequon District. Action - Approved Staff noted that curb and gutter was required and modification of the berming and screening in the road efficiency buffer will be required to insure adequate sight distance. Mr. Charles Maddox, project engineer with G. W. Clifford & Associates, was representing this subdivision. Chairman Golladay asked about the entrance on Route 647 and Mr. Maddox said that the entrance met VDOTs minimum requirements for a state highway entrance. Upon motion made by Mr. Thomas and seconded by Mr. McDonald, BE IT RESOLVED, That the Frederick County Planning Commission does hereby unanimously approve the Greenbriar North subdivision request for the division of eight lots (2.9166 acres) for single - family detached urban homes located on the northwest side of State Route 647, northeast of Stephens City, adjacent to Greenbriar Village, Section I, and across State Route 647, from Albin Village, in the Opequon District. UPDATE ON PLANS FOR ROUTE 37 Mr. Stiles said that county officials met with R. G. Moore, VDOTs Chief Engineer at Stanton, and VDOT has concluded that the most expeditious way to proceed would be for the county to contract with an engineer to do a general location survey for the entire length of Route 37, from 81 to 81, North to South. Mr. Stiles said that contracting an engineer would need to be a public bidding process and the money needed could be drawn from the money that the county has set aside for the design and engineering of Route 37 which would, over a period of time, be reimbursed. Mr. Stiles felt this process would lead to a much more rapid decision as to the location for Route 37. After the survey has been accomplished, the county will then proceed with the actual design. 3171 • PUBLIC HEARINGS MASTER DEVELOPMENT PLANS 4 Preliminary Master Development Plan Application #007 -90 of Fox Ridge to develop 3.94 acres west and adjacent to Fox Drive in the Gainesboro District. Action - Approved Mr. Thomas Price, project engineer with G. W. Clifford & Associates, was representing Mr. A. Donald Russo, the applicant. In response to a commissioner's question on whether their was sufficient right -of -way, Mr. Price stated that there is an existing 40' frontage and an existing 20' right -of -way. Mr. Price noted that the private driveway and the stormwater management area is intended to be maintained by the homeowners association. Chairman Golladay called for public comment and the following person came forward: Mr. Donald Wilson, resident in the area, was concerned about increased traffic on Fox Drive and he was also concerned about the safety of the proposed holding pond at the site. Mr. Maddox, engineer with G. W. Clifford & Associates, responded to Mr. Wilson's concern on the holding pond. Mr. Maddox said that the pond for this development would be wide and shallow and is designed to drain out in a matter of hours. Mr. Stiles said that he had problems with townhouses accessing Fox Drive at this location and on the west side of Fox Drive. He said that this property has in excess of 100' difference in grade from one end to the other. Mr. Stiles felt this plan would set a precedent for additional townhouses along Fox Drive. Commissioners also had concerns with homeowners' associations being responsible for maintenance of holding ponds. Mrs. Ann Carpenter, owner of the property, said that she contacted her adjoining property owners concerning her plans for the property. Mrs. Carpenter said that she also contacted Mr. Luttrell, owner of the stone house along Fox Drive, and he had no objections. She said that Mr. Luttrell felt that the buffer zones were adequate. Upon motion made by Mr. McDonald and seconded by Mrs. Copenhaver, BE IT RESOLVED, That the Frederick County Planning Commission does hereby approve Preliminary Master Development Plan #007 -90 of Fox Ridge to develop 3.94 • acres with 28 townhouses located west and adjacent to Fox Drive in the Gainesboro District. 3172 • The vote on this master plan was: 5 YES (TO APPROVES Marker, Copenhaver, McDonald, Sherwood, Thomas, Rinker NO: Golladay AMENDMENTS TO EROSION & SEDIMENTATION ORDINANCE Mr. Tierney presented a revised version of Chapter 8, Erosion and Sedimentation Control Law, of the County Code. Mr. Tierney noted that the Virginia Erosion and Sedimentation Control Law was amended in 1988 requiring localities to amend their ordinances in order to conform to the revised state regulations. The consensus of the Commission was for the staff to advertise the amended Chapter 8 for public hearing.
