PC_06-20-90_Meeting_Minutes• MEETING MINUTES OF THE FREDERICK COUNTY PLANNING COMMISSION Held in the Board Room of the Old Frederick County Court House in Winchester, Virginia on June 20, 1990. PRESENT: Planning Commissioners present were: James W. Golladay, Jr., Chairman; Beverly Sherwood, Vice - Chairman; Manuel C. DeHaven, Stonewall District; John Marker, Back Creek District; S. Blaine Wilson, Shawnee District; Carl M. McDonald, Gainesboro District; Douglas Rinker, Citizen at Large; Roger L. Thomas, Citizen at Large; Marjorie H. Copenhaver, Citizen at Large; George L. Romine, Citizen at Large; and Kenneth Y. Stiles, Board Liaison. Planning Staff present were: Kris C. Tierney; W. Wayne Miller CALL TO ORDER Chairman Golladay called the meeting to order at 7:00 p.m. The first order of business was the consideration of the minutes of May 16, 1990. Upon motion made by Mr. Romine and seconded by Mr. Thomas, the minutes of May 16, 1990 were unanimously approved as presented. BIMONTHLY AND MONTHLY REPORTS Chairman Golladay accepted the Monthly and Bimonthly Reports for the Commission's information. COMMITTEE REPORTS RURAL ISSUES COMMITTEE - 6/11/90 MTG. Mr. Wilson reported that mapping has been completed. ORDINANCE COMMITTEE - 6/18/90 MTG. Mr. McDonald reported that the Ordinance Subcommittee • discussed a request from Mr. Billy Tisinger concerning large lot subdivisions, reviewed amendments to the soil and erosion 3120 • E ordinance, and reviewed subdivision amendments on street standards. HISTORIC RESOURCES ADVISORY BOARD - 6119190 MTG. Mr. Tierney reported that HRAB met with area groups interested in historic preservation to discuss plans for a historic weekend in Frederick County. OTHER Mr. Stiles asked the staff to review recent changes in the City's ordinance to determine if the changes would have impacts on the county. SITE PLANS Site Plan #028 -90 of Reading Landscapes, zoned B2, for landscaping v on 2.001 acres in the Gainesboro District. Action - Approved Mr. Wilson and Mrs. Sherwood abstained from discussion and voting due to a possible conflict of interest. Michael Bryan, attorney, was present on behalf of Reading Landscapes. The staff noted that this site plan was proffered by Reading Landscapes, during the rezoning process, to comply with Sections 21 -3 -11 and 21- 3- 12 -2.1 of the Zoning Ordinance. Upon motion made by Mr. McDonald and seconded by Mrs. Copenhaver, BE IT RESOLVED, That the Frederick County Planning Commission does hereby unanimously approve Site Plan #028 -90 of Reading Landscapes, zoned B2, for landscaping on 2.001 acres located on Route 522 North at Albin in the Gainesboro Magisterial District. The vote was unanimous with Mr. Wilson and Mrs. Sherwood abstaining. 3121 ® 3 SUBDIVISIONS Subdivision Application of Pembridge Heights, Phase III, for the division of eight lots (4.5185 acres), zoned RP, for single - family dwellings in the Shawnee District. Action - Approved Staff noted that this final stage of Pembridge Heights was in conformance with the master development plan. It was noted that sewer and water would be furnished by the City. Mr. Mark Nelis, of Brownell, Inc., was present to represent this subdivision application. Mr. Leonard Newcome, present on behalf of the College Park Subdivision, was concerned about stormwater management. Mr. Nelis noted that a swale between Harvard Drive and Yale Drive, which will carry the water to Abrams Creek, was determined to be adequate by the Transportation Department. Romine, Upon motion made by Mr. Wilson and seconded by Mr. BE IT RESOLVED, That the Frederick County Planning Commission does hereby unanimously approve the subdivision request of Pembridge Heights, Section III, for the division of eight lots (4.5185 acres) for single - family detached cluster dwellings. This property is located at the southeast corner of the intersection of Routes 642 and 647, just north of Albin Village, in the Opequon District. Subdivision Application of Frederick Woods for the division of 91 lots (33.50 acres), zoned RP, for single - family detached cluster dwellings in the Opequon District. Action - Approved Mr. Charles W. Maddox, Jr., project engineer with G. W. Clifford & Associates, noted that the owner had agreed to contribute to the Route 642 improvement project. He said that the plan also provides connectors to adjacent properties. It was pointed out that when the right -of -way is established for Route 642, the 15% open space for the development would not be met. The staff felt that Lots 12, 13, 14 88 and 89 were ® questionable building lots due to the size and shape of the permitted building area. Mr. Maddox presented a handout of house 3122 • plans that could be constructed within the building area of the questionable building lots. Some Commissioners were hesitant about approving the questionable building lots because of the situation that could be created for potential future homeowners. Chairman Golladay felt that a legal situation could be created if the Commissioners denied the subdivision based on suspicious building lots, because the applicant had demonstrated that the lots were buildable. Although the commissioners felt they could not dictate to the developer the house size for the lots, they felt that the Planning and Inspections Departments needed to be coordinated so that setbacks were met. Upon motion made by Mr. DeHaven and seconded by Mr. Wilson, the Commission voted unanimously to make Mr. Maddox's handout regarding housing types that could be built on the questionable lots a part of the official record. McDonald, Upon motion made by Mr. Thomas and seconded by Mr. BE IT RESOLVED, That the Frederick County Planning Commission does hereby approve the subdivision application of Frederick Woods for the division of 91 lots (33.50 acres), zoned RP, for single - family detached cluster dwellings. This property is located south of Route 37 and east of Route 651 in the Back Creek District. Action - Tabled This application was tabled by unanimous vote to the July 18, 1990 meeting, due to lack of representation. 3123 0 5 PRE- APPLICATION CONFERENCE ON SENSENY GLEN MASTER DEVELOPMENT PLAN BY G. W. CLIFFORD & ASSOCIATES Mr. Ron Mislowsky, engineer with G. W. Clifford & Associates, presented a master development plan proposal for Senseny Glen. The Commission's major concern was the traffic impact on Senseny Road. Chairman Golladay noted that the county's engineer had recommended that a traffic impact study be done for Senseny Road. INFORMAL DISCUSSION WITH MR. TIMOTHY MALONEY OF ONE DESIGN ON A i DEVELOPMENT PROPOSAL AT SHAWNEELAND Mr. Maloney was not present, therefore, the Planning Commission tabled this discussion by unanimous vote until their July 18, 1990 meeting. DISCUSSION OF REZONING OF JAMESWAY PROPERTY The staff noted that the Jamesway property was zoned B4 under previous zoning regulations and this district was removed in the Zoning Ordinance revisions. The staff proposed that the Planning Commission initiate a rezoning of the property to B2 to remove any doubts about the zoning of the property. The Planning Commission instructed the staff to proceed with advertisement. ADJOURNMENT No further business remained to be discussed and the meeting adjourned by unanimous vote.
