OF THE
FREDERICK COUNTY PLANNING COMMISSION
Held in the Board Room of the Old Frederick County Court House in
Winchester, Virginia on April 18, 1990.
PRESENT: Planning Commissioners present were: James W. Golladay,
Jr., Chairman; Beverly Sherwood, Vice - Chairman; John
Marker, Back Creek District; S. Blaine Wilson, Shawnee
District; Carl M. McDonald, Gainesboro District; Douglas
Rinker, Citizen at Large; Marjorie H. Copenhaver, Citizen
at Large; and George L. Romine, Citizen at Large.
ABSENT: Manuel C. DeHaven, Stonewall District; Roger L. Thomas,
Citizen at Large; and Kenneth Y. Stiles, Board Liaison.
Planning Staff present were: Robert W. Watkins,
Secretary; Kris C. Tierney; W. Wayne Miller; and Evan
Wyatt.
CALL TO ORDER
Chairman Golladay called the meeting to order at 7:00
P. m'. The first order of business was the consideration of the
minutes of March 21, 1990. Upon motion made by Mr. Marker and
seconded by Mr. McDonald, the minutes of April 4, 1990 were
unanimously approved as presented.
BIMONTHLY REPORT
Chairman Golladay accepted the Bimonthly Report for the
Commission's information.
COMMITTEE REPORTS
RURAL ISSUES COMMITTEE
Mr. Wilson reported that the Rural Issues Committee
discussed mapping at their April 9th meeting.

Mr. Tierney reported that the Ordinance Committee met on
April 16th and discussed minor corrections to the Zoning Ordinance;
locations for day care centers; interim changes to the subdivision
ordinance; and a rough outline for revision to the overall
Subdivision Ordinance.
SANITATION AUTHORITY
Mrs. Copenhaver reported that the Sanitation Authority
met on April 9th and approved the Route 277 waterline. They also
discussed the new Federal Government regulation that requires
industries to pre -treat toxic waste before it goes into the
municipal plant. There will be a tour of the Parkins Mill Plant
on June 11 and a tour of the Regional Plant on July 9.
HISTORIC.RESOURCES ADVISORY BOARD
Mr. Tierney reported that the H.R.A.B. Committee met on
• April 17 to review the list of historically significant sites and
to formulate their work program for the following months. They
also discussed a proposal to promote a historical weekend in the
County.
SITE PLANS
Site Plan #020 -90 of Fleet Brake and Clutch, Inc. for wholesale
truck parts, located northeast of the City of Winchester, south of
Route 11 and east of I -81, in the Stonewall District.
Action - Approved
The staff noted that VDOT has expressed concerns
regarding the adequacy of Route F -733 to support industrial
traffic.
Mr. Jack Lowe, employed by Fleet Brake and Clutch, Inc.,
stated that they will participate in road improvements, along with
other industries in the area, through industrial access funding
consistent with VDOT requirements. Mr. Lowe said that they have
tentative staff approval to hook -up to City water and will be
installing a fire hydrant per the Fire Marshal's request.

BE IT RESOLVED, That the Frederick County Planning Commission does
hereby unanimously approve Site Plan #020 -90 of Fleet Brake and
Clutch, Inc. for wholesale truck parts contingent upon the approval
of water service from the City of Winchester and that industrial
access funding be applied for to address the concerns of VDOT.
SUBDIVISIONS
Subdivision Application of Stephens Ridge (formerly Towns of
Village Green) for townhouses to be located at the end of Stickley
Drive and Ridgefield Avenue in the Opequon District.
Action - Approved
Staff noted that the screening and buffering requirement
that was a condition for master plan approval by the Commission on
October 18, 1989 had been addressed. This requirement was to
screen the development from the adjacent sewage treatment facility
and also the single - family residential area.
Mr. Charles E. Maddox, Jr. and Mr. P. Duane Brown,
• engineers from G. W. Clifford & Associates, Inc., were present to
represent this subdivision. Mr. Maddox said that they had
established turn - arounds at the end of Stickley Drive for school
buses and road maintenance vehicles. Entrances to the site were
also discussed.
Upon motion made by Mr. Romine and seconded by Mr.
McDonald,
BE IT RESOLVED, That the Frederick County Planning Commission does
hereby unanimously approve the subdivision of 12.2651 acres (91
lots) for Stephens Ridge for townhouses located at the end of
Stickley Drive and Ridgefield Avenue in the Opequon District.
Revised Subdivision Application of Georgetown Court for the
subdivision of 12.9210 acres (83 lots) for townhouses in the
Opequon District.
Action - Approved
Mr. Scott Marsh, with G. W. Clifford & Associates, Inc.,
presented this plan to the Commission. Mr. Marsh said that
according to the conditions on the master plan, the berms were
raised and trees were added at several points. He said that this
• property would be buffered against the M -1 zoned Athey property to
the west.

Upon motion made by Mr. Romine and seconded by Mr.
BE IT RESOLVED, That the Frederick County Planning Commission does
hereby approve the revised subdivision application of Georgetown
Court to subdivide 12.9210 acres into 83 lots for townhouses. This
property is located on the north side of Route 277, about one mile
east of Stephens City in the Opequon District.
PUBLIC MEETINGS
Preliminary Master Development Plan #004 -90 of Coventry Courts for
townhouses on 14.5240 acres,/ zoned RP, and located on Greenwood
Road (Rt. 656), north of Sen'seny Road, in the Shawnee District.
Action - Tabled
Mr. Thomas Davis, with Dove & Associates, was the
representative for this subdivision. Mr. Davis requested that the
Planning Commission table the request in light of the staff's
recommendation for denial, based on the lack of the required
. through connection to the JASBO property.
Staff noted that the need for an eventual through
connection to Greenwood Road is indicated in the County's
Transportation Plan. Staff noted that the lack of provision for
such a connection in the Coventry Court plan is a concern of the
Virginia Department of Transportation.
Chairman Golladay called for anyone wishing to speak
regarding this master development plan and Mrs. Betty Winslow came
forward to speak in opposition. Mrs. Winslow was concerned about
the appearance of the townhouses, water drainage, the types of
buffers proposed, the need for a collector road to Route 37, the
need for open areas for the children to play, and the possibility
of decreased property values.
Mrs. Winslow also presented letters of opposition from
two neighbors, Mr. Kenneth Ashby and Mrs. Brenda L. Vance. Upon
motion made by Mr. McDonald and seconded by Mr. Rinker, the letters
were made a part of the official record by unanimous vote.

Upon motion made by Mr. Wilson and seconded by Mr.
Romine, the Frederick County Planning Commission tabled Preliminary
Master Development Plan #004 -90 of Coventry Courts until the
meeting of May 2, 1990, at the applicant's request.

Preliminary Master Development Plan #001 -90 of Fort Collier y
Industrial Park for M -1 uses on 313.14± acres, zoned M -1, and
located in the Stonewall Industrial Park.
Action - Approved
Mr. James McIlvaine and Mr. Whitt Wagner were present to
represent this preliminary master development plan. Mr. Wagner
said that they have been working on an outlet road to the northern
end of Route it so that industrial traffic could be routed to the
northern end of the park and onto I -81, instead of routing traffic
on the southern end of Route 11 or Baker Lane. He said that they
have also been working with the Frederick County Administrator and
the Jail Board in an attempt to upgrade the water pressure and
water flows in the area.
A discussion followed regarding the realignment of Fort
Collier Road at the southeastern entrance of the park to eliminate
a curve and allow a straight entrance into and through the park.
Staff felt that the Fort Collier Road would serve as a major
collector road for the area and should be designed properly. The
applicants were concerned because they had just completed
realignment of high - pressure gas lines in the area.
• Mr. William Lockhart, owner of the adjoining parcel #81,
said that he has access to Baker Lane through the Arcadia Mobile
Home Park. Mr. Lockhart said that he would appreciate access at
the eastern part of the Fort Collier site.
The staff noted that they would not recommend the
approval of any master plan that would.cutoff the possibility of
an undeveloped parcel's access to a state - maintained road. It was
noted that the normal procedure would be to stub the road out to
the undeveloped parcel and end it at the property line.

Upon motion made by Mrs. Sherwood and seconded by Mr.
BE IT RESOLVED, That the Frederick County Planning Commission does
hereby unanimously recommend approval of Preliminary Master
Development Plan #001 -90 of Fort Collier Industrial Park with the
following conditions provided before Final Master Plan approval:
1. Information on stormwater management be provided as well as
an explanation of how the design requirements of the ordinance
regarding floodplains will be met.
2. Appropriate buffers are to be provided.
3. Comments of review agencies and the county engineer be
addressed and the information listed in the staff comments be

provided and /or shown on the plan.
A stub road to the Lockhart property be extended to the
property line, which would not be extended into the Arcadia
development.
Preliminary Master Development Plan #003 -90 of Frederick County
Townhouses/ Silver Communities, Inc., for townhouses on 22 acres, `
zoned RP, and located on Route 645, off of Route 522 South, in the -'
Shawnee District.
Action - Approved

Mr. Wilson abstained from discussion and vote due to a
possible conflict of interest.
Mr. Richard Tremblay was present to represent Silver
Communities of Fredericksburg, Virginia, the owner/ applicant. Also
present was Mr. Frank Carson, project engineer with Patton, Harris,
Rust & Associates. Mr. Tremblay said that the Winchester Regional
Airport Authority has expressed concern that this site will be
subject to increasing levels of aircraft noise and flyover nuisance
as the airport grows. Mr. Tremblay said that they have agreed to
incorporate a disclosure in all of their sales contracts, deeds and
covenants that this community is in close proximity to the airport.
He said that their sales brochures will include a map which will
clearly show proximity of the airport.
Chairman Golladay called for citizen comments and the
following persons came forward:
Ms. Lorraine Rogers, resident on Bufflick Road, requested
that the screening used to buffer adjoining properties be a solid
wooden fence.
Ms. Kay Pearce, a business owner on Bufflick Road, also
requested that a solid wooden fence be used to screen adjoining
properties. Ms. Pearce said that some of the adjoining properties
are businesses with outside storage and she was concerned about
safety for children and screening of outside storage.
Linette Spicer, resident on Bufflick Road, said that she
and several of her neighbors did not receive notification of the
public meeting. After consulting with the applicant, it was
determined that neither Mrs. Spicer's property or her neighbors'
property adjoined the property in question.

BE IT RESOLVED, That the Frederick County Planning Commission does
hereby unanimously approve Preliminary Master Development Plan
#003 -90 of Frederick County Townhouses /Silver Communities, Inc. for
townhouses on 22.0 acres, zoned RP, with the following conditions:
1. That Silver Communities, Inc. will include a disclosure in all
sales contracts, deeds and subdivision covenants that the
property is in proximity to the Winchester Regional Airport.
2. Sales brochures for the project will include a location map
that will show the proximity of the site to the Winchester
Regional Airport.
3. Silver Communities will provide a navigational easement in
each deed which holds harmless the Winchester Regional Airport
Authority from any lawsuit regarding noise pollution or fly-
over nuisance.
In addition, all review agency, county engineer, and staff comments
must be addressed.
(Note: Mr. Wilson abstained from voting.)
PRE - APPLICATION DISCUSSION WITH MR. WILLIAM RAY OF VALLEY
FERTILIZER
Mr. William Ray of Valley Fertilizer was present for a
pre- application discussion with the Planning Commission to discuss
the subdivision of 20 acres of M2 (Industrial General) land.
DISCUSSION OF CALEB HEIGHTS PROFFERS _�
The staff presented revised proffers submitted by Caleb
Heights and reviewed some of the changes made since the Planning
Commission's public hearing. The revisions noted that the
applicant would mitigate degradation of Redbud Run occurring during
development; references to the homeowners' association and
degradation of Redbud Run were removed; and that contributions
shall be made at the time of recordation of final subdivision plats
with either cash or non - interest bearing notes payable to Frederick
County, Virginia within 12 months from the date of recordation.
Mr. David Holliday, owner and applicant for the Caleb
Heights rezoning application, was present to answer questions from
the Commission.

Re: Coventry Court
Dear Sir:
Please be advised that I am opposed to the development
of the above property adjoining my property with the construction
of townhouses.
Townhouses would depreciate the value of my real estate.
All of the surrounding developments are proposed for single family
dwellings and this property should be as well.
The traffic on Greenwood Road is a major problem at the
present time. The entrance to this development is 70 feet away
from my property line and at the crest of a hill. A single family
development would cut the traffic in half as to :.that a develop-
ment of townhouses. I am interested in the type of landscape
screen between our adjoining properties., What type of buffer
will there be?
I understand that there is to be a collector road connecting
to Route 37. Where will this be located?

With regard to the preliminary Master Development Plan for
townhouses situated on the above, I am opposed.

1. Townhouses would not make for an attractive enviroment.
The property surrounding this development is all single family
dwellings and all proposed developments is single family, this
property should be classified the same.. Townhouses would
depreciate the value of my adjoining property. If they are to be
anything like the ones constructed down the road aways from my
house they are not high quality in appearance.
2. Fourteen acres. is not enough space to development ninety
townhouses and have any place for recreation for the children of
that development.
3. I voice a concern of the water drainage. Will it drain away from
my property and not onto it?
4. What type of buffer will there be from my property line? Will
there be a landscaping screen of trees, fence, etc? The property
line is 25' from my house.
5. I understand there is to be a collector road to connect the Route
37 Bypass. Where will this connector road be located?
6. I feel the growth in Frederick County is uncontrolled, especially
the Senseny Road area. This uncontrolled growth has cost the
taxpayers a.fortune. Taxes have had to be raised to build more
schools. Its getting to the point where volunteers cannot run
the local fire departments. Paid personnel are needed. An
inhanced 911 system has had to be installed in the area because
of the growth. When will it stop in this area? When finished,
would I be as well off living in the City of Winchester? It would
be closer to my job.
