PC_02-21-90_Meeting_MinutesMEETING MINUTES OF THE FREDERICK COUNTY PLANNING Held in the Board Room of the Old Frederick County Court House in Winchester; Virginia on February 21, 1990. PRESENT: Planning Commissioners present were: James W. Golladay, Jr., Chairman; Beverly Sherwood, Vice - Chairman; John Marker, Back Creek District; Manuel C. DeHaven, Stonewall District; Carl M. McDonald, Gainesboro District; Roger L. Thomas, Citizen at Large; George L. Romine, Citizen at Large; Marjorie H. Copenhaver, Citizen at Large; Douglas Rinker, Citizen at Large; and Kenneth Y. Stiles, Board Liaison. Planning Staff present were: Robert W. Watkins, Secretary; Kris C. Tierney; and W. Wayne Miller. ABSENT: S. Blaine Wilson, Shawnee District. CALL TO ORDER Chairman Golladay called the meeting to order at 7:00 p.m. BIMONTHLY REPORT Chairman Golladay accepted the Bimonthly Report for the Commission's information. COMMITTEE REPORTS ECONOMIC DEVELOPMENT COMMISSION Mr. Romine reported on current activities of the Economic Development Commission. CAPITAL IMPROVEMENTS PLAN SUBCOMMITTEE Mr. Romine reported that the CIP's last meeting dealt with school issues. He said that the CIP Subcommittee will issue • a final report to the Board in approximately one week. 3044 2 SANITATION AUTHORITY Mrs. Copenhaver reported that the Sanitation Authority has entered into an agreement whereby they will pay for the cost of drilling wells at the quarry. The Authority will operate a water treatment plant and wholesale the water to the Town of Stephens City. She also reported that the Sanitation Authority is investigating the cost of providing water storage tanks at three different locations in Frederick County in order to provide a backup supply of water, a backup for fire protection and better water pressure. HISTORIC RESOURCES ADVISORY BOARD Mr. Thomas said the after several months of trying to reach a compromise with the developer of Caleb Heights, the H.R.A.B. came to the conclusion that there was no room for compromise and by majority vote decided that any development on the property was unacceptable. He said that the H.R.A.B. recommended that the rezoning be denied because of the historical significance of the area and that no development be allowed. CITIZEN COMMENTS Mr. Richard Keeler, who was developing a site in the county, asked the Commission to expedite his site plan application because he wanted to obtain a building permit and begin work as soon as possible. MASTER DEVELOPMENT PLANS Revised Preliminary Master Development Plan #013 -89 of Georgetown -� Court for townhouses on 6.63 acres, zoned RP, and located on the north side of Rt. 277, about one mile east of Stephens City, in the Opequon District. Action - Approval Mr. Charles Maddox, project engineer, said that this plan was revised because of the potential for an improved development design due to the acquisition of additional property by the developers. Romine, Upon motion made by Mr. Thomas and seconded by Mr. BE IT RESOLVED, That the Frederick County Planning Commission does hereby unanimously approve Revised Master Development Plan #013 -89 of Georgetown Court with review agency comments and staff comments noted above addressed prior to approval of the final master plan. Preliminary Master Development Plan #014 -89 of Evans /Snyder for single - family detached cluster houses, townhouses and commercial uses on 54.625 acres, zoned RP and 82, and located north and adjacent to Route 277, east of City, and 1,750' east of Route 641, approximately 1.75 miles east of I -81, in the Opequon District. Action - Tabled The staff said that the applicant has submitted a letter requesting that his application be considered at the next Planning Commission meeting, on March 7, 1990. Romine, Upon motion made by Mr. Thomas and seconded by Mr. BE IT RESOLVED, That the Frederick County Planning Commission does hereby table Preliminary Master Development Plan #014 -89 of Evans /Snyder until March 7, 1990, per the applicant's request. • Preliminary Master Development Plan #015 -89 of Greenbriar North for single - family detached urban homes on 2.9166 acres, zoned RP. This property is located on the northwest side of Route 647, northeast 3046 4 of Stephens City, adjacent to Greenbrier Village, Section 1, and across Route 647 from Albin Village, in the Opequon District. Action - Approved Mr. Charles Maddox, the project engineer, presented the plan to the Commission. The Commissioners questioned whether the plan allowed for the future expansion and widening of Route 647. Mr. Maddox said that they would dedicate 10' of the 50' buffer shown along the front of the site for right -of -way. The Commissioners questioned whether or not the ordinance allowed for the 10' reduction in the 50' buffer. The staff noted that the applicant will have to have a 50' buffer and workable lots before the subdivision could be approved. Mr. Paul List, a Greenbriar Village property owner, wanted to know which lot the water and sewer easement would run through. He was also concerned about whether the proposed development would be compatible with Greenbriar Village. Mr. Elliott Richie, a resident of the area, felt that the traffic situation in the area was dangerous and that Route 647 should be improved before any further development occurred. Upon motion made by Mr. Thomas and seconded by Mr. Romine, BE IT RESOLVED, That the Frederick County Planning Commission does hereby unanimously approve Preliminary Master Development Plan #015 -89 of Greenbriar North for single - family detached dwellings with the minimum road efficiency buffer of 50' as measured from the right -of -way following a 10' dedication for future expansion of Route 647. Review agency and engineer's comments must also be addressed. PUBLIC HEARINGS Annual Review, renewal and cancellation of all conditional use permits approved beginning July, 1979. Happ - Art Studio 661 • 3058 - 16 - 11 NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM (NPDES) APPLICATION OF ELLIOTT J. RITCHIE, JR. The staff presented a National Pollutant Discharge Elimination System (NPDES) application by Mr. Elliott J. Ritchie, Jr. to serve six four - bedroom residential dwellings. The staff asked that the Planning Commission determine whether the application was in conformance with the Comprehensive Plan. The location of the property is on the south side of Route 636, one mile west of the intersection with Route 640 in the Opequon District. Mr. Elliott Ritchie, Jr., the applicant, was present to answer questions from the Commission. The Planning Commission felt that the NPDES Permit would not be in conformance with the Comprehensive Plan for the following reasons: 1) the property was located outside of the urban development area as defined by the County's Comprehensive Plan; and 2) the county does not encourage small community package treatment plants because of the potential for precedent setting and maintenance problems. The staff noted that the Sanitation Authority would not be interested in operating such small systems because of the high cost involved. It was noted that the maintenance of such systems would have to be accomplished by the users and could present significant problems. Upon motion made by Mr. Thomas and seconded by Mr. Rinker, BE IT RESOLVED, That the Frederick County Planning Commission, by unanimous vote, determined that the NPDES Application of Elliott Ritchie, Jr. was not in conformance with the Comprehensive Plan. They further recommended that a letter be sent to the Lord Fairfax Health District making a strong statement that we will only support individual systems for this type of development in Frederick County. PRIMARY ROAD IMPROVEMENT RECOMMENDATIONS - APRIL. 1990 The staff noted that the Transportation Committee reviewed the list of priorities for primary road allocations at • their meeting of February 5, 1990 and recommended it to the Board of Supervisors for the upcoming allocation hearings in April. 3059 i - v - I I i • Upon motion made by Mr. McDonald and seconded by Mrs. Sherwood, BE IT RESOLVED, That the Frederick County Planning Commission does hereby unanimously endorse the Primary Road Improvement Recommendations for April, 1990 as presented by the Transportation Committee, as attached. (list is attached at end of minutes) PRELIMINARY STORMWATER MANAGEMENT PLAN The staff presented a proposal from Donohue & Associates for a preliminary stormwater management plan for the County. The staff noted that the plan is intended to provide information on stormwater management policy and will be used to establish minimum stormwater management criteria. The staff noted that they are looking for a recommendation for the Board of Supervisors on dealing with this issue. Thomas, Upon motion made by Mr. Rinker and seconded by Mr. BE IT RESOLVED, That the Frederick County Planning Commission does hereby unanimously endorse the proposal for a Preliminary Stormwater Management Plan for Frederick County and that the Comprehensive Plan Subcommittee act as the working group between the Board of Supervisors and the county engineer. ANNUAL REPORT AND REVISIONS TO THE COMPREHENSIVE PLAN The staff presented the Commission with a copy of the 1990 Annual Report from the Planning Department.
