OF THE
FREDERICK COUNTY PLANNING COMMISSION
Held in the Board Room of the Old Frederick County Court House in
Winchester, Virginia on January 17, 1990.
PRESENT: Planning Commissioners present were: James W. Golladay,
Jr., Chairman; Beverly Sherwood, Vice - Chairman; John
Marker, Back Creek District; Manuel C. DeHaven, Stonewall
District; Douglas Rinker, Citizen at Large; Marjorie H.
Copenhaver, Citizen at Large; Roger L. Thomas, Citizen
at Large; and George L. Romine, Citizen at Large.
Planning Staff present were: Robert W. Watkins,
Secretary; Kris C. Tierney; W. Wayne Miller; and Ron
Lilley
ABSENT: Carl M. McDonald, Gainesboro District; S. Blaine Wilson,
Shawnee District; Kenneth Y. Stiles, Board Liaison.
CALL TO ORDER
Chairman Golladay called the meeting to order at 7:00
p.m.
MINUTES
Upon motion made by Mr. Romine and seconded by Mr.
Marker, the minutes of January 3, 1990 were unanimously approved
as presented.
BIMONTHLY REPORT
Chairman Golladay accepted the Bimonthly Report for the
Commission's information.
COMMITTEE REPORTS
ECONOMIC DEVELOPMENT COMMISSION
Mr. Romine reported a high level of inquiries. Mr.
Romine thanked the Planning Department staff for their support
during the past year. He said that the Planning Department is the

• Economic Development Commission's greatest information source.
TRANSPORTATION COMMITTEE
Mr. Tierney presented a report from the Transportation
Committee's January 8 meeting. Highlights of the report concerned:
1) the committee's endorsement of a proposed network of arterial
and collector roads for the eastern portion of the county; 2)
improvements scheduled for the Merrimans Lane /Cedar Creek Grade
intersection; 3) placement of flashing school zone signs for all
county schools; 4) possible improvements to Welltown Pike.
HISTORICAL RESOURCES ADVISORY BOARD
Mr. Thomas reported on the Historical Resources Advisory
Board's (HRAB) January 16 meeting. He said that the Foundation for
the Preservation of Civil War Sites gave a detailed presentation
concerning the civil war site on the Caleb Heights property, north
of Route 7. Mr. Thomas said the HRAB received input on what
historical societies would like to see preserved on the property.
Mr. Thomas said that another meeting is scheduled for January 31
and the committee will formulate a recommendation to the Planning
Commission on areas within the Caleb Heights property that should
be reserved for historical preservation, how the areas should be
reserved and what impacts this preservation would have cn a
possible rezoning.
SUBCOMMITTEE APPOINTMENTS
The Chairman and planning staff presented a list of
subcommittee and liaison assignments for 1990. (list attached at
end of minutes.)

Rezoning Request #020 -89 of Alson H. Smith and Margarette M. Smith
to rezone seven acres from B -2 (Business General) to B -3
(Industrial Transition) in the Stonewall District.
Action - Approval
The staff noted that the Planning Commission held a
public hearing on this application on November 1, 1989 and
unanimously recommended approval. It was noted that the Board of
Supervisors held a public hearing on December 13, 1989, but
referred the rezoning back to the Planning Commission because of
their concerns about traffic problems on Welltown Pike associated
with industrial truck traffic and inadequate water pressure for

appropriate fire protection.
Mr. Harry Benham, an attorney representing the
applicants, said that the Board wanted to know whether his clients'
specific use might add substantial truck traffic to the road. Mr.
Benham felt that substantial truck traffic would not be added
because his clients only have eight trucks that go out once a day
and then return at night. Mr. Benham said that the Board also
questioned whether his clients' particular use would require more
water pressure than currently exists. He said that his clients'
operation will not require a sprinkling system and could even be
operated with a well, so they do not have a need for water
pressure.
The Commissioners noted the existence of the adjoining
500 acres of industrial property. They felt that a B -3 use would
produce less traffic than than a B -2 use.
The staff noted that the Transportation Committee
discussed northbound right and left turning lanes for Stonewall
Industrial Park. Also discussed was the feasibility of a rear
connection to Route 37 to avoid Welltown Pike. The staff noted
that the Transportation Committee decided to pursue industrial
access funding after the next eligible industry entered the
industrial park in order to make improvements needed in the area.
Upon motion made by Mr. DeHaven and seconded by Mr.
Romine,
BE IT RESOLVED, That the Frederick County Planning does hereby
approve Rezoning Request #020 -89 of Alson H. Smith and Margarette
M. Smith to rezone seven acres from B -2 (Business General) to B -3
(Industrial Transition). This property is located on Route 661
( Welltown Pike), about two miles north of Winchester, in the
Stonewall District.
DISCUSSION OF ZONING ORDINANCE CHANGES
Staff noted that the Board of Supervisors discussed the
proposed revised zoning ordinance at their last meeting and had
some concerns for the Planning Commission to examine. Some of
those concerns were: 1) the 150' minimum width requirements in the
RA District may not be sufficient in relation to five acre lots;
the staff suggested a 3 -1 lot- length ratio, similar to the rural
lot in the RP District; 2) re- examine the gross density and
dimensional requirements in the RP District; 3) suggested an
additional sentence in the "Statement of Intent" section of the R-
4 and R -5 Districts emphasizing the importance of master plan
• approval; 4) suggested decreasing maximum density requirement in
the MH -1 District from eight to six and increasing the minimum lot

• requirement from 4,000 to 6,000 square feet; 5) suggested allowing
certain types of veterinary offices in B -2 Districts.
Mr. Donald Richardson, representing Citizens for a
Quality Community (CQC) , stated that the CQC was concerned that the
proposed density standards would haphazardly locate high- density
development. He said that CQC felt this section should not be
adopted until possible impacts have been studied.
Mrs. Eleanor White, a citizen of Frederick County, was
representing herself and the Winchester Garden Club (WGC). Mrs.
White said that the WGC felt that billboards and large advertising
signs should be regulated along roads, particularly new roads in
Frederick County.
Ms. Theo Rezba, a Frederick County citizen, encouraged
the Planning Commission to include regulations in the new ordinance
to require developers to landscape residential developments using
certain legislative guidelines, in particular, street tree
planting.

Upon motion made by Mr. Romine and seconded by Mr.
BE IT RESOLVED, That the Frederick County Planning Commission does
hereby unanimously recommend approval to the Board of Supervisors
on the revised zoning ordinance with the changes presented by the
staff. The Commissioners felt that the concerns presented by the
citizens were important to include in the ordinance, however, more
discussion was needed by the Commission. The commissioners felt
these additions could be added to the ordinance as amendments in
the near future.
Mr. Rinker moved that the Ordinance Subcommittee be
charged with the responsibility of not only the subdivision
ordinance, but to begin work on the issues of lot density
requirements in MH -1, signs and billboards, and street tree
landscaping. This motion was unanimously approved.
ADJOURNMENT
No further business remained to be discussed and the
meeting adjourned at 8:00 p.m. by unanimous vote.
