PC_09-04-91_Meeting_MinutesMEETING MINUTES OF THE FREDERICK COUNTY PLANNING COMMISSION Held in the Board Room of the Old Frederick County Court House in Winchester, Virginia on September 4, 1991. PRESENT: Planning Commissioners present were: James W. Golladay, Jr., Chairman; Carl M. McDonald, Gainesboro District; S. Blaine Wilson, Shawnee District; Manual C. DeHaven, Stonewall District; Marjorie H. Copenhaver, Citizen at Large; Douglas Rinker, Citizen at Large; George L. Romine, Citizen at Large; and Roger L. Thomas, Citizen at Large; and Joseph Kalbach, City Liaison. Able John Marker, Back Creek District; Beverly Sherwood, Vice Chairman; Kenneth Y. Stiles, Board Liaison Planning Staff present were: Robert W. Watkins, Secretary; Kris C. Tierney; W. Wayne Miller; and Evan Wyatt. CALL TO ORDER/MINUTES Chairman Golladay called the meeting to order at 7:00 p.m. The first order of business was the consideration of the minutes of August 7, 1991. Upon motion made by Mr. Romine and seconded by Mr. McDonald, the minutes of August 7, 1991 were unanimously approved as presented. BIMONTHLY REPORT Mr. Watkins said that the staff has received a site plan request from the Gainesboro Fire Company for the addition of a one -story metal building onto the rear of their fire station which will be used as an apparatus room and dormitory for volunteers. The Commission requested that the staff proceed with administrative approval of the plan. information. Chairman Golladay accepted the Bimonthly Report for the Commission's COMMITTEE REPORTS 3385 2 Historic Resources Advisory Board Mr. Tierney said that the HRAB will probably not meet again until October. He said that they are scheduling. the Historic Overlay regulations for public hearing with the Commission on the 18th of September. --------------- - -- - -- Rural Issues Subcommittee Mr. Wilson said that a public meeting on the proposed Rural Areas District regulations is scheduled for September 9 at 7:30 p.m. at the James Wood High School cafeteria on Amherst Street. Mrs. Copenhaver reported that the Sanitation Authority is planning to alleviate the problems with the Stephens Run sewage treatment facility and the Stephens City Lagoon by enlarging the Parkins Mill Plant and abandoning those two plants. Route 37 Technical Advisory Committee - 9/3/91 Mtg, Mr. Watkins reported that there will be a public meeting dealing with Route 37 at the Greenwood Fire Hall, probably the first week in October. A video, slide show and graphics will be available to present 13 different alternative routes. Mr. Watkins reported that considerable activity is currently taking place on this project. Revised Preliminary Master Development Plan #004 -91 for Wakeland Manor for single - family detached houses and multi- family dwellings in the Shawnee District. Action - Denied Mr. Tierney said that at the last meeting, a number of concerns were raised by the staff and review agencies on information that was lacking or that appeared not to meet the ordinance requirements. Mr. Tierney said that staff recommendation for August 17 was for denial and the Planning Commission tabled the application until such time as the applicants could 3386 3 resubmit. Regarding review of the revised plan, Mr. Tierney said that stormwater calculations were submitted by the applicant and have been reviewed by the county's engineer. Mr. Tierney noted the items that were still lacking on the revised plan. He said that the staff's primary concern- -the overall road layout -- remained unchanged from the plan submitted in August and is of poor design, in the staff's opinion. He said that the location of Golladay Road was indicated on the plan; however, the applicants have stated that they do not intend to build the road or dedicate the right -of -way. Mr. Tierney stated that there are no internal connections to Golladay Road and the result is that the entire development, consisting of over 600 units, is served entirely by cul -de -sacs. Mr. Eds Coleman, attorney on behalf of the Wakeman, said that the applicants believe that they have addressed most of the concerns stated by the staff and he introduced Mr. David Furstenau, the surveyor, who proceeded to review those revisions with the Commission. Chairman Golladay requested that Edward Strawsnyder, the County Engineer, elaborate on the stormwater management review. Mr. Strawsnyder said that he received a copy of a limited amount of stormwater calculations relative to the design of a drainage channel that would parallel the proposed Golladay Road. He said that it was the design of a trapezoidal channel that would carry the upstream flow as the conditions exist today. Mr. Strawsnyder said that he had not received any stormwater management calculations for the remainder of the development. Mr. Strawsnyder said that he commented only on the drainage channel in the evaluation of the upstream drainage area and those calculations were satisfactory for the condition as they exist today. Members of the Commission felt that the plan submitted did not meet the intent of the Comprehensive Plan for transportation planning or the ordinances for good transportation planning, stormwater management, layout features, etc. They were concerned about traffic and stormwater impacts on the surrounding community. The Commissioners felt it was important to have a collector road within the development, that the current design did not provide through - flow traffic, and that the maize of cul -de -sacs did not allow easy access for emergency services. Upon motion by Mr. Wilson and seconded by Mr. Romine, BE IT RESOLVED That the Frederick County Planning Commission does hereby deny Revised Master Development Plan #004 -91 of Wakeland Manor based on the concerns expressed in the staffs report. This proposal was for property located north of Route 642, Macedonia Church Road, and identified as 75 -A -100 and 75 -A -101 in the Shawnee Magisterial District. This plan was recommended for denial by the following majority vote: 3387 YES (FOR DENIAL). Thomas, Rinker, Romine, Wilson, Golladay, McDonald, Copenhaver, NO. DeHaven PUBLIC HEARINGS: Conditional Use Permit #007 -91 of Otis and Roxann Goodwin for an office to administer the "Outreach to Asia Nationals' program to be located off of Route 522 North, in the Hunting Ridge Retreat Subdivision, Gainesboro Magisterial District. Action - Approved Mr. Miller reported that the accessory building, which is currently used as a garage, is to be converted into an office. He said that this location is isolated by the terrain and is not visible from any other dwelling. He said that the proposed type of operation will have no external visibility and should have no impact on the neighborhood. Mr. Miller noted that the staff's recommendation was for approval with the condition that the applicant comply with the request of the fire marshal to insure unrestricted access of emergency vehicles. Mr. Miller continued, stating that this is not a customer /service type of organization as they create no traffic or road use. There will be two employees. Mr. Miller said that since "the application was submitted, the applicant has determined that he will need to increase the size of the building. Mr. Miller said that the applicant can increase the size of the building without a conditional use permit, since it is an accessory building, provided he meets all of the setback requirements. Mr. Otis Goodwin, the applicant, came forward and stated that both he and his wife are the owners of the property. Mr. Goodwin said that Outreach to Asia Nationals is a Christian Mission Board and is not a very visible organization. Employees will be part-time in the sense that they travel a great deal. He said that they work with churches from Florida to Maine and must travel to these churches and are away much of the time. Mr. Goodwin explained that they plan to add 700 square feet onto the existing 950 square foot building, which will increase they size of the structure to 1,654 square feet. Mr. Goodwin explained that the building will be used for an office, conference room, work areas and utility room. Upon motion made by Mr. McDonald and seconded by Mr. Romine, BE IT RESOLVED, That the Frederick County Planning Commission does hereby unanimously approve Conditional Use Permit #009 -91 of Otis and Roxann Goodwin for a cottage occupation for an office to administer the "Outreach to Asia Nationals" program with the following condition: 5 1. The applicant comply with the request of the Fire Marshal to insure unrestricted access of emergency vehicles. This property is located off of Route 522 North in the Hunting Ridge Retreat Subdivision and is identified with property identification number 3000 - 007 - 0000 -0000- 0001 -0 in the Gainesboro Magisterial District. An ordinance to revise all portions of Chapter 18, Subdivision Ordinance, of the Frederick County Code. Action - Approved Mr. Wyatt presented the proposed revisions to the Subdivision Ordinance which were prepared by the staff and Ordinance Subcommittee. Mr. Wyatt said that the revisions were reviewed by the Commonwealth Attorney's Office, VDOT, the County Engineer, Donohue & Associates, local surveyors and engineers, the industrial sector, Frederick County Sanitation Authority, as well as members of the Top of Virginia Builders Association. He said that the new ordinance provides better organization which makes the ordinance easier to use, creates better surveying and platting standards to assist the staff, enhances public safety by creating specific design standards for roads prior to occupancy as well as location of signage and lighting, it provides for better infrastructure in the subdivisions, attempts to provide a better property owners association and ties down bonding procedures. Mr. McDonald commented that the Top of Virginia's (TOV) main concern was the 15,000 square foot lot with curb and gutter. Mr. McDonald said that the Ordinance Committee's view on this was that a 15,000 square foot lot would be easier to enforce as to whether curb and gutter would be required. He said that if a 70' requirement at the setback line is used, which TOV is recommending, every lot in the subdivision would be 72' and there would still be open ditches. Mr. Harrington Smith, Board of Supervisors Representative for Shawnee District, came forward with several concerns and suggestions on the proposed subdivision ordinance: 1) a definite formula for bonding; 2) Before the bonding expires with the financial institution at the end of the 12 -month period, the financial institution will notify the county one or two months prior to that time as to whether funding will be available; 3) After three occupancies have taken place on a street, the developer will have a time limit on getting the streets ready to be taken over by VDOT. Mr. Watkins read two letters from Kit Moulden, Chairman of the Developers Ad Hoc Committee for the Top of Virginia Building Association dated September 3, 1991 and September 4, 1991 regarding the TOV's concerns on the proposed subdivision ordinance. Mr. Watkins reviewed each'of the concerns with the Commission and made suggestions on 3389 handling those concerns. The Commissioners and staff decided to table action on the subdivision ordinance in order to give the staff time to address the concerns raised. Upon motion made by Mr. McDonald and seconded by Mr. Rinker, BE IT RESOLVED, That the Frederick County Planning Commission does hereby unanimously agree to table the ordinance to revise all portions of Chapter 18 of the Frederick County Code, Subdivision Ordinance, for thirty days.
