At this time, administrative approval cannot be granted. This site plan cannot be approved until the issues in this letter, as well as all issues of the other review agencies, have been adequately addressed. Please review Staff’s comments listed below and then prepare a revised site plan which adequately addresses each concern. Review Comments: (1) Cover Sheet/General Notes. a) Reference Number. Add the site plan reference number #52-25. b) Excavation Notes. Excavation shall be no closer than 100 feet from any property zoned RA, RP, R4, R5 or MH1. No excavation shall be located closer than 200 feet from any dwelling or platted residential subdivision. (§165-608.05(B)(2)). Excavation shall be no closer than 100 feet from any road, street, or highway right-of-way. The Board of Supervisors may reduce the required front setback for excavation to 50 feet if it determines that, through the use of measures, such as landscaping or screening, the effective protection afforded to adjacent properties has not been reduced. (§165-608.05(A)(2)). Provide these notes on the coversheet and distances, measured in feet, to the site plan. c) Machinery Notes. All crushing or screening machinery shall be set back at least 300 feet from any property boundary. (165-608.05(B)(3). Provide these notes on the coversheet and the distances, measured in feet, to the site plan. (2) Additional Requirements. All uses in the EM District must conform with all state, federal, and local regulations. All mining operations shall submit to the Zoning Administrator a copy of the operations plan required by state agencies with the required site plan. Provide the necessary documentation from the Department of Mining & Minerals. (3) Photometric Plan. A photometric plan is required to be provided that includes lighting levels (foot candles) at the property line. Additionally, a note shall be added stating all outdoor lighting shall conform to §165-201.07 and be designed, shielded, aimed, located and maintained to shield adjacent properties and shall be full-cutoff fixtures. (§165-201.07(B)(1). If no lighting is proposed provide a note that states so. (4) Agency Approvals. Comment sheets (approvals) are required from the following agencies: the Frederick County Inspections Department, the Frederick County Fire Marshal, Virginia Department of Transportation, Frederick Water, and the Frederick County Engineer (Public Works). Additional comments may be provided on subsequent submission. After you have revised the site plan, please resubmit one (1) hard copy so that Staff may verify the information contained on the plan addresses the above comments. Staff will also need all approved review agency comment sheets, recordation of the plat (as applicable), at least five (5) copies of the final plan set and a digital (PDF) copy for approval.
