RE: Perry Engineering Retail Site Plan — Site Plan #53-22
Master Development Plan Waiver Request
Dear Mr. Pearson,
I am writing to request a waiver of the master development plan (MDP) requirement for the Perry
Engineering Retail Site Plan (Site Plan #53-22). As you are aware, Section 165-801.03.C.7. of the
Frederick County Zoning Ordinance (Zoning Ordinance) allows the Planning Director to waive the
MDP requirement for proposed development in the B2, General Business Zoning District when an
applicant opts to process a site plan in lieu of an MDP, with the condition that the site plan must
contain all information generally required on both an MDP and site plan.
The Perry Engineering Retail Site Plan (Perry Site Plan) encompasses the total area of B2 zoning on
the parent tract, includes all planned road infrastructure serving the property, establishes shared
buffers, and incorporates the stormwater management facilities required for the B2-zoned area. As
such, the Perry Site Plan provides a comprehensive framework for development of the B2-zoned area
that affirms a compatible and complementary relationship with surrounding property, which is
consistent with the stated purpose of an MDP. Moreover, the Perry Site Plan includes the required
contents of an MDP as outlined under Section 165-801.05 of the Zoning Ordinance. The Perry Site
Plan is therefore suitable to be accepted in lieu of a full MDP.
Based on the above considerations, I respectfully request that you accept a site plan in lieu of a full
MDP for the Perry Engineering Retail project, and in turn grant the requested waiver.
