We relied on the law and zoning plan when purchasing our homes, which are platted and of record in The Frederick County Clerk of Courts. The action of the Planning Commission on June 7 will be the first step in determining if there is to be a significant change to the future of the County. I have made an effort to present, succinctly, my view of the future should the rezoning application be approved. To fully address the subject would require a very sizable statement. Some financial information from O -N's web site (www.oglebaynorton.com) is discussed that suggests the corporation conducts its business in a way that demonstrates a major interest only in the bottom line. As such it is not likely to be any more of a solid, contributing member of the Frederick County community than it has been; rather it could have a serious, detrimental effect on the County. Devaluation of properties near quarries has been studied with the result usually the same; property values decline. One example is at the Mad River Neighborhood Association web site www .greenmountainaccess.net --mma/) regarding a quarry at Moretown, Vermont. My observations regarding the subject rezoning application are attached. My initial reaction to the rezoning application was Not in My Back Yard! I have since concluded that the basic issue at this time is neither NIMBY, water, nor mining only. Rather, the basic issue is very fundamental, the future of Frederick County. FREDERICK COUNTY OUTLOOK Clean businesses are being attracted and tourism is increasing, especially with the Battle of Bull Run to be reenacted at the Cedar Creek Battlefield. Some 5,000 participants have registered and more than 10,000 people are expected in July 2006. The perception of the County is one of a clean, rural environment that provides a family- friendly atmosphere. The future looks rosy but there is, potentially, a very dark cloud on the horizon. OLGEBAY NORTON (ON) FINANCIALS COMMENTS OF ROBERT W. SPANGLER Upon emerging from bankruptcy January 31, 2005, the company proceeded to sell off most of its Great Lakes shipping fleet and expects to sell the remainder soon. It sold a quarry in Oklahoma and is currently in the process of selling 440 acres of land at its quarry in Rogers, Michigan to the Wolverine Power Cooperative that will construct a base load power plant using circulating fluidized bed technology. ON will provide limestone for the process that will use large quantities of coal. Some coal- burning power plants gulp 25 tons of coal per minute and require trains 1 5 miles in length to supply the daily coal usage. In its 2005 first quarter report, ON noted that it had received an average of 13,750 asbestos claims for the previous five years, and, as of March 31, 2005, it was a co- defendant in silica cases involving about 22,000 claimants. ON has filed with the SEC to delist its stock; then, ON will not have to issue reports. Per the March 2000 contract between Chemstone and the Frederick County Sanitation Authority (FCSA), all water in the pits to be excavated and not used by Chemstone would be available to FCSA. ON rezoning costs are to be paid by FCSA according to the contract and all problems related to water issues would be the responsibility of FCSA. The possibility exists that contract paragraph 13 may be exercised by Chemstone to decide, unilaterally, it is not "...obligated to offer any of its land to the Authority." This could become a reality should Chemstone find it more profitable to lease or sell its land to even more undesirable manufacturing activities as it has done in Michigan. This is a very real possibility because ON has acquired Chemstone, gone through bankruptcy proceedings and, reportedly, reorganized to the extent that five of the members of the ON Board of Directors represent creditors. FCSA has chosen a risky partner. PROPERTY VALUES Residential and business property values were found to decrease about 20% at an Alabama quarry. A real estate investment appraiser estimated the property values of the area surrounding the Middletown quarry will be 25% to 45 Just proposing a quarry effects those values as much as 10% to 50% as at Moretown, Vermont; the estimates are from a study by a state certified appraiser who appears to have done a very credible job. The Vermont State Appraiser agrees. Based on the average 2005 sale price of homes in Frederick County of $308,771 and in anticipation of the entire County being impacted by the increase in mining activities (the Environmental Protection Agency reports that dust travels 500 miles), we can expect the average sale price to drop to between about $200,000 and $250,000. It is, of course, anticipated that property taxes would drop in a similar fashion The Vermont appraiser also noted a lack of buyer interest for two years in a house that would have a view of the proposed quarry. Resale of residential and business properties may become very difficult if not impossible to accomplish. Currently, a property directly across the road from the Chemstone property -offered at $420,000 -has already lost one potential buyer when knowledge of the proposed rezoning became known; the owner has reduced the price. ON noted in its application that the quarry has been around for about 110 years. Belle Grove Plantation and the Wayside Inn are both older by about a century and are deserving of a respite from the existing assault and potential ravages that may be imposed by increased mining and possibly heavy industrial, smog- creating industries. POTENTIAL IMPACTS Approval of the application will have adverse effects on ALL of Frederick County. Environment Industrial pollution will increase with more smog. The increased flow of water will increase incidents of sink holes, loss of water from wells and building damage. Health Particulate matter will create more asthma cases of ever greater severity. Agriculture Reduced water availability will make farming more risky and developers will be less interested as the County reputation deteriorates. Noise Traffic increase to 1,306 very large trucks, daily, will disrupt the sleep of people on truck routes as well as create an unfriendly, dirtier traffic situation. Financial Residential and business properties and agriculture land will be devalued with the greatest impact nearest the quarry and tourism will diminish leading to a loss of County income and the necessity of raising taxes. Those properties devalued the greatest amount will experience the greatest decrease in taxes; those properties experiencing the least decrease in value will bear the brunt, i.e., pay the most, of the tax increases needed to maintain County services. And it may not be possible to find a buyer for any property. Water -An essential need that may not be available from quarries that leak or Chemstone could be assured in adequate, consistent quantity from the Shenandoah main stem. Perception of County -The County will lose its family friendly, rural-area reputation and no longer be viewed as a place to tour for pleasure and learn about history. Approval of the application could, literally, put the future of the County at the whims of a single for profit corporation that appears to continue to be ailing financially. Mining and other industrial uses in our porous karst geology can create an underground highway for water pollutants and change the water table enough to deplete local private wells. There is nothing in the Frederick County Comprehensive Plan that designates Middletown for an industrial mining corridor. Limestone deposits throughout the county mean any Frederick County neighborhood could be rezoned for mining. The massive industrial site conflicts directly with the Middletown Comprehensive Plan, which seeks to retain small town character and build on tourism and rural quality of life. Impacts from industrial mining will irreparably degrade Cedar Creek, eligible to be named a state Scenic River, and Route 11, eligible to be named a Virginia Scenic Byway. Industrial Rezoning Permits Much More Than a Quarry Expansion Rezoning to Extractive Manufacturing allows multiple other industrial uses: concrete and asphalt manufacturing, crushed stone operations, brick, block and pre -cast concrete production, oil and gas extraction, mining and processing sand and gravel, and sewage treatment facilities. There is nothing in Chemstone's rezoning application to limit these uses on the 639 acres. Chemstone only needs 78 acres for new quarries and can sell the remaining land. Chemstone sold two parcels at its Clear Brook operation in northern Frederick County to two cement companies, which generate an additional 110 new truck trips on local roads per day. The trend in the quarry industry is to combine one -stop shopping for construction materials: limestone and quarry byproducts, asphalt production and concrete plants. We can expect the rezoned land to be intensely developed as a full industrial mining site, like the one in Strasburg. Frederick County economic development officials are constantly promoting o.r communities as a great place to locate high paying technology and production facilities. So why is the county considering another massive, dirty industrial site that is certain to degrade three jewels: Cedar Creek, the National Battlefield Park and Middletown? Industrial Rezoning Tied to Sanitation Authority The Frederick County Sanitation Authority (FCSA) supports the Chemstone rezoning application because it has an agreement to lease quarry pits for water storage after mining operations cease_ Local residents are expected to accept a dirty industrial site in order to provide for a water plan that was created by a private agency, not in an open, public process. Other communities are rejecting limestone quarries as water storage sites due to the porous nature of the rock, which permits pollutants to easily enter and exit the water supply. How can you persuade authorities to rezone your land? Could an arrangement be made that would support your rezoning application, get rid of possibly contaminated excess water that drains into your pits, and provide other financial benefits for your company? Enter the March 2000 contract between the Frederick County Sanitation Authority and Chemstone in which FCSA agreed to: pay all costs for getting the land rezoned, pay the full construction costs of replacement of ball fields that may be displaced by Chemstone mining operations, pay for installing and maintaining monitoring wells, pay for water Loss from nearby wells that can be proved to be caused by FCSA, pay for pipelines and pumping equipment and permit Chemstone to use same, and hold Chemstone harmless from all issues raised by regulators or private citizens. Of course, FCSA supports your application because after the property is exhaustively mined it would have water storage pits that, if they do not leak, would be a source of water with which to partially serve the Urban Development Area of the County. And Chemstone would not have the expense of filling the pits and reclaiming the land, leaving, instead, a permanent eyesore. The foregoing is subject to approval of the rezoning and to future business decisions of Chemstone that, if certain conditions occur, permit Chemstone to, unilaterally, decide that it is not obligated to offer any of its land to FCSA." Chemstone, alone, can decide it is more profitable to sell or lease portions of the land to possibly heavy- industrial, smog- creating industries. Approval of the Chemstone rezoning application could, literally, make the future of Frederick County subject to the business decisions of one, for profit corporation. TRUST (rHISTORIC PRESERVATION' June 7. 2006 Re: Rezonine Application 303 -06 for O -N Minerals (Chemstone) Quarry I am writing on behalf of the National Trust for Historic Preservation to express our very strong opposition to the proposed rezoning of 639 acres owned by O -N Minerals in order to greatly expand the corporation's quarry and extractive manufacturing operation. The National Trust is the longtime owner of historic Belle Grove Plantation, a National Historic Landmark, which is immediately adjacent to the quarry. Belle Grove also is the heart of the 3,500 -acre Cedar Creek and Belle Grove National Historical Park, which was established by Congress with the strong support of local residents in 2002. We believe this ill- considered proposal to radically expand the O -N Minerals quarry operation would compromise preservation efforts and irrevocably harm historic resources in the Town of Middletown, the Cedar Creek Battlefield National Historic Landmark, the Cedar Creek and Belle Grove National Historical Park, as well as core Civil War battlefield land that is outside the National Historic Landmark and the National Historical Park. We urge the Planning Commission to consider that the National Historical Park and Town of Middletown are being crushed between the proposed expansion of the quarry on one side, and the proposed expansion of Interstate 81 on the other side. Together, these two proposals threaten the quality of life and traditional character of the area. Many local residents believe that the Town of Middletown and the surrounding agricultural and historic landscape merit maximum effort to avoid, reduce, or mitigate adverse impacts. The National Trust concurs with the National Park Service's detailed and expert analysis of the O -N Mineral rezoning proposal, which was submitted to the Frederick County Department of Planning and Development on March 27, 2006. In addition to the noise, vibration damage, and visual intrusion of trucks, this heavy truck traffic is likely to intimidate and endanger residents and visitors alike, thereby frustrating private enterprise and undermining economic development. We concur with the National Park Service's conclusion that the O -N Minerals proffer statement fails to provide "additional protection for the area's historic resources." The National Trust also shares the concerns expressed by Belle Grove, Inc. regarding the proposed rezoning. First, the existing impacts of the quarry are already an unacceptable intrusion on the viewshed of Belle Grove and the National Historical Park. The proposed expansion will significantly exacerbate this existing problem. Second, O -N Minerals in its rezoning proposal has failed to adequately consider the severe adverse impacts on historic properties that are threatened by the quarry expansion. Consequently, before any rezoning or expansion of the quarry is contemplated, O -N Minerals should be directed by the Planning Commission to: 1. Conduct a professional quality viewshed analysis of the current and future adverse impacts of the quarry to nearby historic, scenic, and natural resources. 2. Conduct a professional quality analysis of the current and future adverse impacts of the quarry's haul truck traffic on public safety, the National Historical Park, and the economic well -being of Middletown. 3. Conduct a professional quality analysis of potential vibration impacts on historic properties from the quarry operations, including both blasting activities and haul truck traffic. 4. Negotiate and sign a binding agreement with the National Trust, the National Park Service, the Town of Middletown, Frederick County, and adjacent property owners, which would address the following: a. Mitigation for the existing and future adverse visual impacts of the q quarry's waste pile and lime plant; b. Measures to avoid and minimize the adverse impacts of the quarry's haul truck traffic on the National Historical Park and the Town of Middletown; and c. Measures to protect historic properties from potential vibration damage. Finally, we understand that only 78 of the 639 acres at issue would be used for mining. The remaining 561 acres proposed for rezoning would be used for unspecified extractive manufacturing activities. Local members of the National Trust have raised concerns that the rezoned property could be used for concrete and asphalt manufacturing, crushed stone operations, brick, block, and pre -cast concrete production, oil and gas extraction, mining, and Ms. June Wilmot June 7, 2006 Page 3 processing sand and gravel, and sewage treatment facilities. In our view, these sorts of industrial uses are absolutely inappropriate for this historic and agricultural setting. The National Trust's perspective on appropriate land use in this area of Frederick County is reflected in the 2004 Rural Areas Study and, more specifically, in Mayor Gene T. Dicks's November 8, 2004 letter incorporated in the Study. Mayor Dicks outlines the Town's desire to maintain the rural character of the landscape south of town and to "limit visual impact" to the battlefield and "ensure extensive buffers and setbacks from any new development." Mayor Dicks writes: All new development in this area at the south edge of Town should be designed to preserve the character of the views from the battlefield. Protect the area that will become the new Cedar Creek and Belle Grove National Historical Park from development or land uses that would be detrimental to the historic setting and rural character of the battlefield landscape. In Tight of the unique and irreplaceable nature of the historic resources at risk, and given the potential severe adverse impacts and the high degree of uncertainty about the future use of the rezoned land, we respectfully urge the Frederick County Planning Commission to deny the rezoning request. Graham, PE May 9, 2006 Of all activities of mankind on earth's surface, that of an open strip -mined quarry is the single most destructive permanent one There is no greater scarring of the outer layer of the earth's crust, nor any greater negative impact on the foliage, air or water, than that of a quarry A quarry leaves acres of rock exposed, forever, with little or no chance that water will actually ever approach the edges of the cavity to fill the void or that foliage will ever be able to grow on the remaining exposed rock surfaces. Once initiated, the gouge grows with every truck load of material removed. Most of those loads are accompanied by noise of substantial explosions during a blasting process, and dozens of loaded trucks and traffic for transportation. There was a closing comment at the end of the last meeting by someone on the Board that, "this is going to happen." Really? Why is that? Based on what? Who is holding you hostage to such a demand or expectation? On what basis are you willing to totally ignore the wishes of the landowners and residents (your constituents) in the community most affected? This is 2006. This is no longer the 1920's or 40's or 70's, when portions of ON ChemStone grew and took root in the Shenandoah Valley. During many of those years, a company named AVTEC was also provided an operational permit on the Shenandoah River. What was acceptable to the public or good for the community economy in those past years should no longer automatically be assumed or granted. There is no permit issued anywhere for any activity that is permanent. All permits are subject to review and adjustment or cancellation if conditions surrounding the initial approval change. We, your constituents, are here to voice our position that "conditions" in the Middletown area HAVE changed, significantly, in recent years, such that issuing a permit to ON ChemStone is NO LONGER appropriate, advisable, or safe. The previous discussions of the "berms" to be built to help "hide" the quarry, and to address the concerns of the Belle Grove Historical Preservation group, surrounding home owners, Middletown businesses, and others indicate a clear admission by the quarry company that the hole in the ground and its creation over years will be a significant nuisance and needs to be kept out of sight. Property values of the whole surrounding area will be REDUCED in value by an estimated 25% to 45 according to a Real Estate investment appraisal company. Frederick County would receive less real estate property tax income from the surrounding land owners. Well water and quarry impact remains a big concern for land owners and Board members alike, as discussed in the previous meeting. The Internet has considerable information about quarries. On one website, a Quarry/Mining trade magazine devoted over 1/3 of all the monthly articles to such topics as, "Overcoming Community Opposition to Your Operation," or "Effective Approaches with Local Zoning and Permit Officials." If such a business is so openly blatant about the way they have to "game the system in order to get what they want," is THAT the type of business we want in Frederick County? Given that Virginia is rich in minerals, is there a need to permit such an open scarring of the land here in one of the highest growth counties in the commonwealth? Two elementary schools, a middle school, a community college, one of Virginia's most picturesque historical sites, and the overall Shenandoah Valley setting between the mountains in the Middletown area are additional reasons to not have the significantly increased activity, noise, and destructive outcome of the quarry. One quote from one of the articles in a local newspaper was of a clear -think ng Board Member, who stated, "We thought it was an inappropriate project for that location...." All of these websites, books and articles have identical criteria considered: Impact on Hydrology of the area, including surface and groundwater, particularly addressing water quality, quantity, and the affect on deep aquifer recharge Operational Issues including detail design of settling ponds, fuel handling arrangements, spill contingency plan, domestic water supply and sanitation, detailed design of the haul road The Land Use Assessment, including community, zoning, green areas, value loss Noise and dust including a detailed mitigative strategy and plan considering prevailing wind movement of plume and truck noise and routes Blasting assessment, including flyrock control, wells, and watershed structure, and groundwater contamination Soil survey detailing the characterization, location, quantities, handling, and reclamation of disturbed and relocated soil Acid rock drainage, and metal leaching assessment Geotechnical quarry vertical wall stability evaluation and seismic impact Site specific traffic study and plan, feeder roadway impact and traffic safety Significantly decreased desirability for and value of further development and use of land in the area ON ChemStone can sell their land. It's worth quite a bit if they don't ruin it with a quarry! Or, they can remove the minerals they seek under ground, excavating subterraneanly and leaving the land surface undisturbed. Jeffrey M. Cameron St. Winchester, VA 22601 Dear Congressman Wolf, I am a resident of Middletown, VA and have truly grown to respect the historical treasures that surround me. Because of your leadership, I believe we have made great strides to protect the Civil War battlefields of the Shenandoah Valley. Your sponsorship of H.R. 4944 exemplifies your dedication to protecting these sites. I'm requesting your action because the future of Cedar Creek and Belle Grove National Historic Park is in jeopardy and requires quick and decisive action to protect all that has been accomplished. Recently, an application was submitted to the Frederick County Board of Supervisors for the rezoning of 639.13 acres of land adjacent to the Cedar Creek and Belle Grove National Historic Park. This land is currently undeveloped and zoned rural agricultural. If the application is approved, the land will be zoned for extractive manufacturing and used to expand the current quarrying operation that is visually intrusive from the park itself. If this expansion takes place, the National Historic Park will suffer greatly. While waste piles, silos, dust clouds, bright lights, and noise currently pollute the historic setting and panoramic mountain views from the battlefield grounds, an expansion this significant would devastate the National Historic Park. The sites for the proposed new quarries are expansive and historically significant. I believe much, if not all, of the property in question was originally slated to become part of the National Historic Park because of its significance. While I am uncertain why this property was unable to be included in the final boundary of the park, I do knowkhat uses such as extractive manufacturing should not be allowed on ground that plays such an important role in our nation's history. Uses allowed with extractive manufacturing zoning include the extraction and processing of minerals, concrete and asphalt manufacturing plants, water treatment facilities, and other uses that are inappropriate for battlefield land. The applicant has documented plans for a water treatment facility as well as numerous large -scale mineral extraction pits as deep as 250 feet beneath the ground our ancestors fought and died on. The historical significance of the proposed quarry site is well documented. Custer's decisive flanking attack on John Gordan was staged there. The site of Merritt's bivouac, the ruins of the 18` century Nieswander's Fort, and many other historical sites and staging areas will be eradicated if quarrying is allowed to move forward. Historians and ancestors of those who fought in the battle retrace the steps of the soldiers each day. Quarrying on this large a scale would be among the most detrimental land uses i for the battlefield area. The ground that plays such a significant role in the history of the Civil War would literally be removed, leaving the and unrecognizable even after reclamation. We have reached a turning point with the Cedar Creek Battlefield. The current quarrying facility has been in operation for many decades and has only a few years of extracting left until the desired minerals from the site are exhausted. We can either take a stand, put a stop to the expansion, and eventually reclaim the scenic views of the battlefield for future generations to enjoy, or allow it to happen and watch our National Historic Park decline in support and public interest. Please help all of us who respect the importance of the Cedar Creek and Belle Grove National Historic Park to urge the Frederick County Board of supervisors to deny the application for rezoning. I think you get the picture of what happens when humans continue to pollute the air they breathe and the water they drink; however, there is always the possibility to correct this situation. Bad News: It is my understanding that not only as a fragile nation world, but as an All American Community, we are running out of drinking water and clean air. Good News: The entire community can be and needs to become educated on what it means to build a community on Karst and how to protect its water supply and how to clean its air. Kent Street Winchester, VA 22601 Dear Ms. Wilmot: BELLE GROVE PLANTATION For the public record, here are my comments made on behalf of Belle Grove Plantation's Board of Directors, staff, and volunteers at the June 7, 2006 Planning Commission Hearing regarding the proposed rezoning of 639 acres and subsequent expansion of the O -N Minerals Chemstone property from Rural Areas to Extractive Manufacturing: "Rezoning #3 -06 of O -N Minerals Chemstone.)" Belle Grove Plantation's Board of Directors, staff, and volunteers cannot support the O -N Minerals (Chemstone) Quarry's proposal in its present form. The quarry's current operations, which have direct impact on Belle Grove, are already problematic in terms of Belle Grove's historic landscape and viewshed (see attached photograph) and for the public safety of our visitors from around the world. Without significant, written revisions to the proposal and careful oversight by the Planning Commission, Chemstone's re- zoning application and expansion will only worsen these conditions. We respectfully urge the planning commission to re- address all of the recommendations submitted by the Historic Resources Advisory Board (HRAB) on January 3, 2006, and to require that these be met before the application is considered. Belle Grove Plantation's specific concerns include: 1. Viewshed Impact: We urge the Quarry to work with Belle Grove Plantation, the Cedar Creek Battlefield Foundation, and the National Park Service to undertake a comprehensive viewshed analysis and to subsequently present a written plan and timeline to mitigate, remove, screen and /or plant the existing large waste pile to the Northwest of Belle Grove's property, the existing lime plant visible from Belle Grove and the Cedar Creek Battlefield property, and for any visual impact future expanded mining operations would have, including additional waste (overburden) piles. 2. Traffic and Public Safety Issues: Quarry truck traffic through Middletown and along Route 11 is already a challenge for local vehicle drivers and visitors to area historic sites, including Belle Grove Plantation. We urge the Quarry to undertake a study of traffic patterns in the area and submit a written proposal for alternate route solutions. This is critical for both town and county residents and for expected visitor growth to the new Cedar Creek and Belle Grove National Historical Park. As a National and Virginia Historic Landmark and a National Trust Historic Site, Belle Grove Plantation strives to be a model for historic preservation. This work requires the use of best practices in caring for the 1797 Manor House and related structures, for the 283 acres of original plantation and battlefield land surrounding them, and also for the context for the historic site, including the viewshed. As an independent partner in the new Cedar Creek and Belle Grove National Historical Park, we must also be mindful of our larger role as stewards of a National treasure for the American people and for the safety of more than 25,000 visitors who visit Belle Grove annually; a number which is bound to grow exponentially as the park becomes established. Most_of us bought our property here 8 or 9 years ago. Originally a dairy farm, it was acquired, divided into minimum 5- acre parcels and marketed by prominent Winchester realtor John Scully. We are now approximately 2.5 miles North of the Middletown facility; we can see the dust, feel and hear the blasting, and have watched the spoils pile grow rapidly. If the mining were closer to our homes, it truly would have a major impact on all of us. APR 2 4 Chemstone recently erected a fence on the northern boundary of its property that clearly shows the extent of land Chemstone could mine if the application is approved. Because this is a different sort of rezoning issue of great magnitude and having such far reaching impacts, we are inviting each member of the Commission to visit us so as to develop a personal feel for the situation that our statements may not communicate.
