This letter serves to confirm action taken by the Frederick County Board of Supervisors at their
meeting of July 8, 2026. The above-referenced application was approved to rezone 0.56+/- acre
parcel from B2 (General Business) Zoning District with proffers to B2 (General Business) Zoning
District with revised proffers. The property is located at 4489 Martinsburg Pike on the west side
of Martinsburg Pike south from Woodbine Road and is identified by Property Identification 33-
A-93 in the Stonewall Magisterial District.
The proffer statement originally dated May 9, 2001, with final revision date of May 7, 2026, that
was approved as part of this rezoning application is unique to the above referenced property and
is binding regardless of ownership. Enclosed is a copy of the adopted proffer statement for your
records. Pursuant to §165.303.05, the County Attorney will present the written proffer to the
Frederick County Clerk of Circuit Court for recordation.
