Meeting: Planning Commission Item: 8) Citizen Comments eComment: I am writing as a resident of Lake Frederick to support Rezoning #07-25 of Madison 277 from RA to R4 as requested by Madison II LLC. The reason for my support is essentially twofold: equity and legitimacy. Equity in that this was discussed in December, where the Commission asked that Madison revise its submitted plans for the rezoned parcel. My understanding is they have materially done so. It is hardly fair to say on the one hand “make these changes”, only to come back the very next month and say “just kidding, your request is denied”. Legitimacy in that Frederick County should be seen as governing fairly and impartially. Denying this rezoning request after Madison has made requested changes would send a message to other potential businesses and developers that the Planning Commission is arbitrary and capricious in its dealings. Rezoning is a complicated undertaking. So I leave it to this Commission to do what they professionally think is the best thing. But I do think that if Madison has materially done as the Commission asked, and that no major new information becomes known at the January meeting, that approval of their request should be made. One other thing of note. I suspect you’ll be told that there is a general consensus or popular view within Lake Frederick about this matter. But whether Lake Frederick residents generally support, oppose, or are neutral on rezoning simply isn’t known. All that is known is some residents gave a presentation heavily weighted against rezoning, and that those same residents asked the attending audience (under 10% of the community) to immediately choose between support or opposition. That’s it. Some were for rezoning, some weren’t, and some doubtless didn’t care – although that latter option wasn’t given. Extrapolating those results to the entire community is unwarranted, as is relying on anecdotal tales.
