Re: Site Plan #38-25 – Middletown Data Center Property IdenƟficaƟon Number (PIN): 90 A 58C Dear Ms. Amy Feltner, The following are responses to the comments dated October 6th, 2025 on the above referenced project: 1. COVER SHEET/GENERAL NOTES. a. FEMA Flood Plain. Provide notaƟon of whether the parcel is or is not located within a FEMA Flood Plain. Response: Note #8 has been added to General Notes on cover sheet states: “The property is not located within a FEMA flood plain. The current flood insurance rate map (FIRM) of Frederick County panel number for the property is 51069C0320E.” b. Proposed/ExisƟng square footage. The proposed square footage of 72,840 square foot is less than the exisƟng square feet of the facility. The site plan does not address any alteraƟons to the facility. Verify and update the exisƟng and proposed square feet of the facility. IdenƟfy any building area demoliƟon or addiƟons accordingly. Response: Per previously approved revision plan #SP 44-19, the proposed building area is 72,840 square feet. The label has been revised as 72,840 square feet of building area and this plan does not change any alteraƟons to the facility. c. Setbacks. Provide the actual setbacks measurements to the site and zoning tabulaƟon chart (page 1) and the building restricƟon lines (page 2). Refer to the approved variance enclosed. Response: Setback lines have been provided, see site plan sheet 05. d. Parking. Parking totals should reflect any office area and any company vehicles parked on site. Verify the office area square footage and any company vehicles with the parking spaces required and parking spaces provided calculaƟons. Response: The parking tabulaƟon has been revised to reflect office area, industrial use (data hall) and company vehicles, see sheet 02. e. Building Height. Provide the exisƟng building height. 2 Response: ExisƟng building height has been labeled as 31Ō, see sheet 04. f. Sheet index. IdenƟficaƟon of the landscaping details shall be included in the Sheet Index. You may list Landscaping and refer to Sheet 3 and Sheet 5. Response: New sheet 05A has been added to the plan as “Landscape Plan & Details” sheet. 2. SITE PLAN a. Building RestricƟon Line. Add the south side BRL to the site plan. Response: South side building restricƟon line has been provided to the site plan, see sheet 05. b. Trash Enclosure. All commercial and industrial developments shall be provided with outdoor trash containers (§165-204.11(D)(2). Such trash containers shall not be located in the front yard areas of such uses. (§165-204.11(D)(3). Provide the locaƟon of the outdoor trash enclosure. Response: Trash is stored inside the building at the loading dock area of the building. A separate outdoor trash enclosure is not needed. c. Curb & GuƩer. Ensure that the 6” curb and guƩer is provided along the drive aisle/parking area at the newly proposed equipment site. Refer to the details of the curb and guƩer on Page 3 of 15. Response: The “CG-6” label has been provided along the drive aisle/parking area at the newly proposed equipment site, see site plan sheet 05. 3. LANDSCAPING. a. Interior Parking Lot Landscaping. In addiƟon to the landscaping trees provided, 165-202.01(D)(13)(b) requires an addiƟonal shade tree per 10 (ten) parking spaces provided on the site. AddiƟonally, a minimum of 5% of the interior porƟon of parking lots shall be landscaped for the purpo se of providing shade trees. Provide the calculaƟons for the minimum 5% of the interior parking lot required and update the landscaping plan accordingly. Response: The landscape plan has been revised to provide addiƟonal shade trees. See sheet 05A for landscape plan, details and computaƟons. b. Headlight Screening. Headlight screening shall be provided to prevent headlights from shining into right- of-way or adjacent properƟes. (§165-202.01(13)(a)). Response: The landscape plan has been revised to add 3’ hedge shrub along the parking area to provide screening. c. Plant SelecƟon. Verify the types of permiƩed Trees and Shrubs as listed in §165-203.01(B). Leyland Cypress is not listed on the acceptable trees and shrubs in Table §165-203.01(B). Response: The plan has been revised to select permiƩed Trees and Shrubs based on Table §165-203.01(B). 4. PHOTOMETRIC PLAN. A photometric plan shall be provided. All building mounted lights and site lighƟng shall conform to §165-201.07. AddiƟonally, a note shall be added staƟng all outdoor lighƟng shall be designed, shielded, aimed, located and maintained to shield adjacent properƟes and shall be full-cutoff fixtures. (§165- 201.07(B)(1). 3 Response: This revision plan does not change any light pole exisƟng on site per previous approve site plan; therefore, photometric plan is not required. 5. AGENCY APPROVALS. Comment sheets (approvals) are required from the following agencies: the Frederick County InspecƟons Department, the Frederick County Fire Marshal, Frederick Water, the City of Winchester (Engineering: Julie Cater) and the Frederick County Engineer (Public Works).
