RE: Transfer of Development Rights Program Letter of Intent

Dear Mrs. Watt:
Thank you for your interest in Frederick County’s Transfer of Development Rights (TDR)
Program. The Frederick County Department of Planning and Development has completed
a review of TDR Application Number 08-2025. Our office has received all required TDR
application materials and on March 14, 2024, the required site inspection was completed
to document the property.
This office has determined that Property Identification Number (PIN) 62-A-35 meets the
sending property criteria outlined in §165-302.01 – Sending Properties. PIN 62-A-35 is
the same property identified in the instrument recorded in the Office of the Clerk of the
Circuit Court of Frederick County, Virginia as Instrument Number 250001558.
Frederick County has determined that this property is eligible to transfer up to 48
residential development rights based on the following calculations:
Sending Property TDR Calculations for PIN# 62-A-35:
Total Area = 135.599 acres
Right of Way/Easement = 3.50 acres
Submerged Lands = .108 acres
Steep Slopes = 0.76 acres
Total Eligible Area = 131.231acres
Total Rights based on 5 acre Density = 26
Rights Retained = 2 (required)
Property is Located in Sending Area #1 (1 Density Right =2 Dwelling Units)
Rights Eligible for Transfer Based on Sending Area = 48
Please note that any changes or improvements to PIN 62-A-35 may impact the number of
residential development rights you are eligible to transfer. If site conditions materially
change subsequent to the issuance of this letter of intent, the Department will not issue a
TDR Letter of Intent PIN# 62-A-35

TDR Certificate, and this letter of intent will be null and void. A new application for TDR
certification will be required to re-evaluate potential TDR calculations if this letter of intent
is declared null and void.
If you choose to proceed with the Transfer of Development Rights Program your next step
would be to request a TDR Certificate. This Certificate provides an agreement from
Frederick County to sever the specified residential development rights from the sending
property in exchange for a restrictive deed covenant to which Frederick County is party on
the sending property that restricts further development.
