Dear Ms. Underwood:
On November 20, 2007 an appeal hearing was held by the Board of Zoning Appeals to
discuss the above - referenced property and your appeal application as it related to the
number of allowed dwellings on your property. It was determined by that Board, that
only one primary residential structure is permitted on your lot, and that any other
accessory dwellings should conform to Section 165 -26B (1) of the Frederick County
Zoning Ordinance.
On November 26, 2007, you applied for change of use permit, building permit number
2571 -07, to change the use of an existing building from a storage shed into an accessory
dwelling. In accordance with Section 165 -26B (1) of the Frederick County Zoning
Ordinance, the floor area of the accessory dwelling shall be no more than 25% of the
Bross floor area of the primary residential structure on the lot.
Based on your building permit application, the primary dwelling is 1,258 square feet,
25% of which is 314.5 square feet. The change of use permit indicates that the proposed
accessory dwelling is 567 square feet, 252.5 square feet larger than the maximum
allowed for an accessory dwelling. Therefore, a permit will not be issued to change the
current storage building into an accessory dwelling until the square footage of the
proposed accessory dwelling is brought down to 314.5 square feet or less.
My office left a message for you to contact me on November 28, 2007 to discuss this
issue and determine an appropriate solution. At this time, I have not heard from you
regarding this issue.
This letter is to inform you that the permit cannot be issued as applied for, and I would
request that you contact this department at your earliest convenience to amend your
permit application as necessary.

RE: APPEAL APPLICATION #24 -07
Dear Ms. Underwood:
This letter is to confirm that the above - referenced appeal application was denied by the Board of
Zoning Appeals at their meeting on November 20, 2007. This denial was of request 924 -07, to
appeal the decision of the Zoning Administrator as to the number of dwellings on a lot. The subject
property is located at 521 Marple Road (Route 654), .08 miles from Route 522 north, and identified
by Property Identification Number 41 -A -117 in the Gainesboro Magisterial District.
The decision of the Board of Zoning Appeals may be appealed to the Circuit Court of Frederick
County within 30 days of the Board's decision. If you have any questions regarding this action,
