REVIEW EVALUATIONS: Virginia Dept. of Transportation: The application for subdivision of this property appears to have little measurable impact on Route 621, the VDOT facility which would provide access to the property. Before development, you will need to contact Mr. Bill Stover, Maintenance Superintendent, at our Stephens City Headquarters at (540) 869-1100 to secure the necessary private entrance permits. Public Works: At the time of application for building permits, engineered site plans shall be submitted and a flood plain analysis performed to locate the limits of the 100-year flood plain. /cam Ptrs nc le-, c,- �& ,ol"'%s Chu i 3 r ` Planning and Zoning: Public Meeting Requirement The Subdivision Ordinance requires that land divisions in the RP (Residential Performance) Zoning District, without an approved master development plan, be presented to the Board of Supervisors for final approval (§144-12-B). The Master Development Plan (MDP) requirement may be waived, and has been waived for this project, when a development proposal does not include provisions for proposed roads and/or regional stormwater management facilities. This project contains land zoned RP and does not have an approved MDP; therefore, Board review and action is necessary. Staff Review Stonebrook L.C. owns approximately 20.86 acres of land, zoned RP (Residential Performance) in the Back Creek Magisterial District along Jones Road. Stonebrook L.C. wishes to subdivide a portion of their property, creating two new lots of approximately 4.93 acres and 4.15 acres each. The two proposed lots are allowed in the RP District under Chapter 165-65A of the Zoning Ordinance and are categorized as a "Single Family Detached Rural Traditional" housing type. This housing type is permitted to be served by well and septic systems and the applicant has chosen these services for the proposed lots. The subdivision as submitted, generally, satisfies the requirements of the Subdivision Ordinance. STAFF CONCLUSIONS FOR 12-19-01 PLANNING COMMISSION MEETING: The proposed subdivision plats conform to the requirements of the Subdivision Ordinance. Should further division of these lots be proposed, the applicant will need to request an additional waiver to the County's master development plan requirements. Subdivision 924-01, Stonebrook, L.C. Page 3 January 3, 2002 PLANNING COMMISSION SUMMARY & ACTION OF THE 12/19/01 MEETING: The Planning Staff pointed out the most significant issue involved with this request was that the vast majority of the proposed lots fell within the Opequon Creek Flood Plain Area. The applicant's representative stated that the subdivision ordinance requirements have been met; they have received approved perc sites and all Health Department approvals; access is available; and despite the fact that the majority of the proposed lots are within the floodplain, there are building sites available outside of the floodplain on each lot. The applicant's representative added that there is an existing contract to purchase both lots by an engineering and surveying professional who is aware of the floodplain situation. An adjoining property owner at 2344 Jones Road stated that she has seen both lots completely flooded on four separate occasions. She inquired if FEMA flood plain boundaries were determined for this application; she commented about a reference made in the application to a dry hydrant being placed in the Opequon Creek for fire protection; and she was concerned about destruction of the integrity of the Opequon Creek if the lots are re -graded to accommodate housing. Some of the Commissioners were not in favor of approving lots within floodplain areas, while other Commissioners believed that their role was to determine whether or not the plat met the requirements of the subdivision ordinance. Other Commissioners believed they could vote in favor of the subdivision based on the fact that building sites on each of the lots were found outside of the floodplain area. The Plat accurately shows the metes and bounds of the Lots and the Remainder Tract, together with the dimensions thereof. Further, the Plat sets forth the location of septic drainfields, building restriction lines and proposed wells. 4. The subdivision of said real estate, as it now appears on the attached Plat, is with the free consent and in accordance with the desires of the undersigned Declarant. The Declarant further desires to subdivide the Property in accordance with the provisions of "The Virginia Land Subdivision Act", as are applicable and in force and effect as of the date of execution of this Deed of Dedication. 5. The lands more particularly described by the Plat are subject to the lien of that certain Deed of Trust dated December 29, 1999, of record in the Clerk's Office of the Circuit W W Court of Frederick County, Virginia in Deed Book 955, at Page 874, wherein the lands of the Declarant were conveyed to H. Edmunds Coleman, III and Phillip S. Griffin, II, Trustees, either of whom may act alone, given to secure that certain indebtedness in the sum of $915,000.00, payable to Shenandoah Valley National Bank. The Trustee and the Lender join herein to evidence their consent to the terms of this Deed of Dedication and the subdivision of the Lots and the Remainder Tract as set forth herein. NOW, THEREFORE, THIS DEED OF DEDICATION WITNESSETH: That for and in consideration of the premises and the benefits which will accrue by reason of this Dedication, the Declarant does hereby subdivide all of that certain tract or parcel of land, containing 20.8559 acres, more or less, lying and being situate in Back Creek Magisterial District, Frederick County, Virginia, into Lot #1, containing 4.9263 acres, Lot #2, containing 4.1471 acres, and the Remainder Tract containing 11.7825 acres, as more particularly set forth on the Plat, attached hereto and incorporated herein by reference as if set out in full. Lot #1 and Lot #2 (and only Lot #1 and Lot #2) shall be subject to the following restrictions, covenants and conditions, which shall constitute covenants real running with the land for the benefit of the Remainder Tract, and shall be binding upon all parties having any right, title and interest in and to the aforesaid Lot #1 and Lot #2, or any portion thereof, their heirs, successors and assigns. ARTICLE I DEFINITIONS Section 1. "Lot" or "Lots" shall mean and refer to Lot #1, containing 4.9263 acres and/or Lot 92, containing 4.1471 acres, as shown on the Plat, as appropriate. Section 2. "Owner" shall mean and refer to the record owner, whether one or more persons or entities, of a fee simple title to any Lot as shown on the Plat, including contract sellers, but excluding those having such interest merely as security for the performance of an 2 CD W obligation. Section 3. "Declarant" shall mean and refer to Stonebrook, L.C., a Virginia Limited Liability Company, its successors and assigns. ARTICLE II USE, RESTRICTIONS AND COVENANTS The Lots shall be subject to the following restrictions, which are constituted covenants real to run with the land: All Lots shall be used for single-family residential purposes only. No business, commercial enterprise or occupation of any kind other than a home occupation shall be carried on, conducted or permitted in or on any Lot. A home occupation is defined to be an occupation carried on by the occupant of a residence or dwelling house as a secondary use in connection with which there is no display or commercial signage, and no one is employed other than members of the family residing on any such Lot. 2. Not more than one single-family dwelling house shall be erected on any Lot. 3. No signs or advertising of any nature shall be erected or maintained on any Lot except for a temporary "For Sale" sign for said Lot, which sign shall not exceed five (5) square feet in area. No "For Rent" signs shall be allowed or displayed on any Lot. 4. No boats, mobile homes, motor homes, campers, commercial buses, trailers of any type, tractors, trucks or other motor vehicles (other than automobiles, motorcycles, pickup trucks, and 3/4 ton [or less] vans) shall be permitted on any Lot, unless stored in a garage out of public view. No motor vehicle, or material portion thereof, which does not have a current license and current Virginia inspection sticker shall be permitted on any Lot. (a) No animals of any kind (including horses, cows, or other livestock, poultry or birds) shall be permitted on any Lot, except that dogs, cats and other usual household pets may be kept, provided that they are not kept, bred or maintained for commercial or charitable purposes or in unusual numbers. (b) No dogs, cats or other household pets shall be co W 110 Un allowed to run at large. 6. No noxious or offensive activities shall be carried on upon any Lot nor shall anything be done thereon which may be, or may become, an annoyance or nuisance to the Declarant, or any of the Declarant's business invitees. 7. In the event that a dwelling or other appurtenant structure situate upon the Lot is destroyed, the owner of the Lot upon which such dwelling or other appurtenant structure is situate shall, within thirty (30) days from said destruction, shall clear away any debris and the remaining portion of the dwelling, or other appurtenant structure, and maintain the Lot in a neat and orderly condition. 8. In the event a dwelling or other appurtenant structure situate upon the Lot is damaged, or has materially deteriorated, the owner shall immediately repair the damage or deterioration. 9. No Lot shall be used or maintained as a dumping ground for rubbish. Trash, garbage or other waste shall be in sanitary containers. No refuse or any container for same shall be placed or stored in front of any house, except on the date of garbage pickup, unless placed in sanitary containers. 10. No exterior clothes lines, or hanging device, shall be permitted on any Lot, except for an umbrella -type with a diameter not to exceed seven (7) feet; provided, however, that the same may only be used in the rear of any dwelling house constructed on said Lot and the clothes line is stored within a garage, utility building or the equivalent when not in use. 11. (a) Each Owner shall keep each Lot owned by him and all improvements therein or thereon in good order and repair and free of debris, including, but not limited to, the seeding, watering, and mowing of all lawns, the pruning and cutting of all trees and shrubbery, and the painting (or other appropriate external care) of all buildings and other improvements, all in a manner and with such frequency as is consistent with good property management. (b) The Owner of any Lot shall maintain any wooden fence which may be erected on the Lot in good condition and repair, including, but not limited to, the appearance of said fence as originally constructed, and the repair, construction, reconstruction and maintenance thereof. 12. No dwelling shall be erected on any Lot which shall contain less than the minimum square footage of finished living space as follows: V CD W a. Split foyer: 2,400 square feet b. Ranch/single story: 1,800 square feet Cape cod/story and half: 2,400 square feet d. Two story: 2,400 square feet "Finished living space" shall not include basements or attics, whether habitable or not, or carports, garages, porches, terraces, decks or outbuildings. In split level homes only, finished portions of the lowest floor shall be counted toward the minimum required herein. 13. The exterior of the dwelling, garage, and any other outbuildings erected on any Lot shall be of wood, stone, brick, Dryvit or stucco, or a combination thereof. Any utility, garage, or other out building erected on any Lot shall be of the same material and construction as the main structure on such Lot. Declarant reserves the right to add to the list of approved materials. 14. Fences and walls shall be constructed of wood, stone or brick, except that gates may be of iron. Declarant reserves the right to add to the list of approved materials for fences and walls. Use of wire or chain link fencing is expressly prohibited upon any Lot, excepting therefrom the existing wire fence located on the north side of Lot #2, which existing wire fences is excepted from the terms of this restriction or covenant; provided, however, that any replacement by the owner of Lot #2 of such existing wire fence or any portion thereof shall be in conformity with the terms of this Restriction No. 14. 15. All structures erected upon any Lot shall have brick, stone or stucco on the exposed foundations thereof. In addition, parged block foundations shall be allowed. 16. No satellite dish with a diameter greater than 30 inches for the transmission or reception of television, radio, or electronic signals, or any other form of electromagnetic radiation shall be erected, used or maintained outdoors on any Lot. 17. No lines, wires, or other devices used for the communication or transmission of electric current or power, including telephone, television or radio signals, shall be erected, placed or maintained in or upon any Lot unless the same shall be contained in conduits or cables installed or maintained underground. 18. (a) No dwelling, structure, addition or exterior alteration shall be constructed upon any Lot, unless the plan of k" 0 t..L7 construction, including quality of workmanship, design, colors and materials shall have been approved in writing by the Declarant or its designee(s). Buildings may be of either traditional or contemporary design, but must be situated, designed, constructed and finished so as not to detract from the natural beauty of the surroundings. The power to determine compliance with this standard shall rest solely in the discretion of the Declarant or its designee(s). (b) No construction of any dwelling, garage, or other outbuilding shall be commenced until the Declarant or its designee(s) has approved in writing the [1] siting or location, [2] design or style, [3] construction materials, and [4] color scheme of the dwelling, garage, utility or other outbuilding. (c) The Declarant or its designee(s) shall not be liable to any person or entity for any exercise or non -exercise of the powers herein accorded. 19. No motorcycle, snowmobile, all terrain vehicle, "dirt bike", or other motorized recreational vehicle shall be operated upon any Lot, except as a means for transportation directly to and from a dwelling house or residence. 20. No Lot may be further subdivided or conveyed except as a whole. This restriction shall not be construed so as to prohibit the conveyance of such minimal amounts of land as may be necessary to resolve boundary adjustments. 21. All of the covenants and restrictions herein shall be binding and remain in full force and effect for a period of twenty (20) years from the date of this instrument and shall be renewed automatically for additional successive ten (10) year periods, unless the owners of both of the Lots and the owner of the Remainder Tract shall, at least six (6) months prior to any such renewal date, execute and record an agreement declining to renew the covenants and restrictions set forth herein. 22. The invalidation of any one of the covenants or restrictions contained herein by judgment or Court Order shall in no wise affect any of the other provisions which shall remain in full force and effect. The failure of the owners of the Lots or the Declarant herein to enforce any covenants or restrictions shall not be deemed to be a waiver of the right to do so thereafter as to a default occurring prior or subsequent thereto. 23. The Declarant herein reserves and shall have the right alone to waive any one or more of the restrictive 1.1 I covenants and conditions contained herein as to any Lot owed or transferred by it, except for the restriction contained in the first sentence of Restriction No. 1 pertaining to single family residential use of all Lots, which shall not be waived hereafter by the Declarant as to the Lots or either of them. This waiver shall not affect the binding effect of the covenants and restrictions upon the remaining Lot. The Declarant furthers reserves the right alone to impose additional restrictive covenants and restrictions as to any Lot or Lots owned by it at the time of the imposition and such imposition shall not affect the binding effect of these provisions upon any other Lot owned by the Declarant. ARTICLE III EASEMENTS Section 1. Public Utility Easements: Lot #1 is subject to, and the Declarant (and it successors and assigns) hereby reserves, a 10 foot utility easement (the "Utility Easement") along the Southern boundary line of Lot #1 for the construction, reconstruction, maintenance and repair of any electric, telephone, tv cable or other utility line which is presently or hereafter installed within the bounds of said Utility Easement. Section 2. Additional Easements: Designated upon each of the Lots are the location of drainfields, building restriction lines and proposed wells as set forth on the Plat. Section 3. Reservations: The Declarant reserves unto itself, its successors or assigns, the right to erect, maintain, operate and replace underground telephone and electrical conduits, related equipment, and other facilities, sewer, gas, water and television lines and related equipment, and other utility equipment where such utility lines and equipment are located within the utility easements are presently located upon the Lots. Section 4. No Access: A. No access, right of way or easement serving Lot 92 shall be had over the Remainder Tract or any portion thereof. No right of way, easement or access whatsoever to Lot #2 shall exist over any portion of the Remainder Tract, including, but not in any way 0 W 110 limited to, over that portion of the Remainder Tract located along the southern side of Lot #1 designated as "Ex. 60' RW". The sole right of access, easement or right of way to Lot #2 shall be directly from Jones Road (Route 621) and not over any portion of the Remainder Tract. B. No right of way, easement or access for purposes of a driveway serving the principal residence or dwelling situate on Lot #1 shall exist over the Remainder Tract, or any portion thereof, including, but not limited to, that portion of the Remainder Tract situate along the southern side of Lot #1 designated as "Ex. 60' RW". The sole right of access or easement for purposes of a driveway serving the principal residence or dwelling situate on Lot #1 shall be directly from Jones Road (Route 621) and not over any portion of the Remainder Tract whatsoever. Purchaser shall have a right of secondary access to the western portion of Lot #1 over that portion of the Remainder Tract situate along the southern side of Lot #1, designated as "Ex. 60' RW", provided that such right of secondary access shall not be allowed through the existing stone wall located over the northern boundary of the "Ex. 60' RW". There shall be no right of secondary access whatsoever over any portion of the Remainder Tract situate west of Lot #1. ARTICLE IV GENERAL PROVISIONS Section 1. Enforcement: A. Any Owner shall have the right to enforce, by a proceeding at law or in equity, all restrictions, conditions, covenants, reservations, now or hereafter imposed, by the provisions of this Declaration. Failure by any Owner to enforce any covenant or restriction herein contained shall in no event be deemed a waiver of the right to do so thereafter. All costs which any Owner shall incur in the successful enforcement of the restrictions, conditions, covenants, and reservations, now or hereafter imposed, shall be borne by the party against which action is taken and which costs shall include reasonable attorney's fees, costs, M and damages. B. The owner of the Remainder Tract shall have the right to enforce against the owner of any Lot, by a proceeding at law or in equity, all restrictions, conditions, covenants, and reservations, now or hereafter imposed, by the provisions of this Declaration. Failure by the owner of the Remainder Tract to enforce any covenant or restriction herein contained against the owner of any Lot shall in no event be deemed a waiver of the right to do so thereafter. All costs which the owner of the Remainder Tract shall incur in the successful enforcement of the restrictions, conditions, covenants, and reservations, now or hereafter imposed, shall be borne by the party against which action is taken and which costs shall include reasonable attorney's fees, costs, and damages. Section 2. Severability: Invalidation of any one of these covenants or restrictions by judgment or Court Order shall in no way affect any other provision which shall remain in full force and effect, as described under Article II, Restriction No. 22, above. Section 3. Binding Effect/Amendment: The covenants and restrictions of this Declaration shall run with the title to the Lots for the benefit of the Remainder Tract and shall inure to the benefit of and be enforceable by the Owner of any Lot subject to this Declaration and by the owner of the Remainder Tract, their respective legal representatives, heirs, successors and assigns, for a term of twenty (20) years from the date this Declaration is recorded, after which time, said covenants shall be automatically extended for successive periods of ten (10) years, as described under ARTICLE H, Restriction No. 21, above. The covenants and restrictions of this Declaration may be amended during the first twenty (20) year period by an instrument signed by the owners of the Lots and the owner of the Remainder Tract. Any amendment must be properly recorded among the land records of the Clerk's Office of the Circuit Court of Frederick County, Virginia. Section 4. Consent: The Dedication and Subdivision of the land as shown on the attached Plat is with the free consent and in accordance with the desire of the undersigned Declarant and is in conformity with the provisions of "The Virginia Land Subdivision Act" as are applicable, together with the applicable ordinances and regulations of the governing 9 body of the County of Frederick, Virginia, or other agency having jurisdiction thereof.
