THIS DEED AND EASEMENT made and dated �Z day of
March, 1978, by and between FORT COLLIER FARMS, INC., a VirginiE
corporation, party of the first part, hereinafter "Grantor"
and C. BRUCE DAWSON and KATHLEEN M. DAWSON, his wife, parties
of the second part, hereinafter "Grantees".
WITNESSETH: That for and in consideration of the sum
of Ten Dollars C$10.00) and other good and valuable considera-
tion, the receipt of all of which is hereby acknowledged, the
panty of the first part does hereby grant, bargain, sell and
convey with general warranty of title, unto the parties of the
second part, their successors or assigns, the following
described property and appurtenances thereunto belonging:
C11 All that certain unimproved tract
of land containing 5.082 acres, shown as Lot
5-A on the attached plat and survey of H. Bruce
Edens, C.L.S., dated January 24, 1978, attached
hereto as Schedule 1, and by this reference
expressly incorporated herein. The property
conveyed herein being a portion of the land
conveyed to the Grantor by deed of T. Fred Stine,
et al, dated January 21, 1965, recorded in the
Office of the Clerk of the Circuit Court of
Frederick County, Virginia, in Deed Book 307 at
Page 275, said property being located a short
distance north of the City of Winchester and
east of U. S. Route 11 in Stonewall Magisterial
District, Frederick County, Virginia.
C2) A temporary forty-five foot C45'1
easement for ingress and egress leading from
Smithfield Avenue to the property conveyed
herein, said easement to be expanded to a fifty
foot (501) easement across retained portions of
Grantor's property. The forty-five foot (451)
easement was conveyed to Grantor by instruments
of record in the aforesaid Clerk's Office in
Deed Book 253 at Page 87 and in Deed Book 319
at Page 342. Said easement to be a temporary
grant only, with Grantees' right in the easement
to terminate upon completion of construction of
a second building on the property conveyed herein
or upon the termination of the period of eighteen

shall first occur.
(3) A Sixty foot (60') easement for ingress
and egress leading from the intersection of Brooke
Road to Lot 5-A for all purposes which would be

permitted the public upon the recordation of a plat
and acceptance of a dedication by the appropriate
public authorities of the sixty foot C6O1) proposed
service road, as shown on the attached plat and survey.
All individual rights granted under this easement
shall cease and determine upon the due recordation
of a plat and the acceptance of said street by
the appropriate public authorities.
Reference is here made to the aforesaid instruments
and the attachments and references therein contained for a
further and more particular description of the property hereby
conveyed.
This conveyance is made subject to the following
listed covenants and restrictions which shall be covenants and
restrictions running with the land, binding all successive owners
thereof.
COVENANTS
AND
RESTRICTIONS
Cl) No building shall be constructed
upon any Site within seventy-five C75) feet
of the curb line of any street in existence,
or on a recorded map at the time of such
construction or within fifty (50) feet of any
rear line.or within twenty-five (25) feet of
any side line, nor shall more than fifty per
cent (50%) of the area of any Site be covered
by buildings.
(2) All buildings shall be designed and
constructed of material as prescribed in
Planning Standards issued by the Approving
Agent.
(3) With the required setback area from
streets, there shall be maintained on each
Site only paved walks, paved driveways, lawns
and landscaping, and the surface of so much of
the remainder of each Site as is not covered by
buildings, by lawns or by landscaping, shall be
treated so as to be dust free. At least two-thirds
(2/3) of the surface of the required setback area
from streets shall be maintained in lawns or
other landscaping.
(4) A. At least one (1) parking space

shall be provided for each employee. No parking
shall be allowed directly within the front set-
back area in front of the main structure or in the
adjacent streets or rights of way. Front setback
areas to the side of the main structure may be
utilized for passenger car parking, but no nearer
than 25'-0" from the right of way line of any
street or road.
B. The loading and unloading of
materials shall not be allowed within the
front setback area of any building. No truck
parking shall be allowed in the front setback
area. All truck parking and open storage areas
shall be screened, either by fence or planting
approved by the developer.
(5) Each Site shall be used only for
manufacturing, processing, wholesale, warehouse,
distribution center, office, laboratory, pro-
fessional, research and development activities,
and there shall not be permitted any junk or
salvage yard or any other use which will be
offensive to the neighborhood by reason of odor,
fumes, dust, smoke, noise, vibration, electronic,
television or radio interference, or pollution or
will -be hazardous by reason of danger of fire or
explosion.
(6) The exterior of all structures and
all walks, driveways, parking areas, lawns
and landscaping on each Site shall be
maintained in good order, repair and in first-
class condition.
(7) No open storage shall be permitted on
any Site unless protected by screening to a height
of not more than eight (8) feet approved in the
manner hereinafter provided.
(8) No buildings, exterior signs, fences
or structures shall be erected, or exterior
structural alterations or additions made on any
Site except pursuant to plans and specifications
approved in the manner hereinafter provided as to
landscaping and architectural conformity to a
park -type industrial center, which approval shall
not be withheld unreasonably. The requirement
of approval set forth in this paragraph is in
addition to, and not in substitution for, any and
all other restrictions herein contained.
(9) Any building within the estate which has
been destroyed or partially damaged by fire or other
causes must either be repaired or completely
demolished and removed from the Site by its owner.
Repair must be started within a period of six (6)
months after damage. Demolition and removal must
be finished within six (6) months after destruction
or damage. Should demolition or repair and removal
not be implemented or completed within the allotted
time as stated above, the Approving Agent reserves

the right to repair or alter or demolish and remove
any structure which, in the opinion of the Approving
Agent, is either a safety hazard or an eyesore to the
estate, in a manner which will conform with the
esthetics of the estate and backcharge the owner of
the building in question.
(10) No excavation shall be made on, and
no sand, gravel, soil or other material shall
be removed from any site, except in connection
with site preparation or with construction of
Buildings or Improvements. Upon completion of
construction, exposed openings shall be backfilled
to grade, and disturbed ground shall be graded
level and paved or landscaped.
(11) All Improvements on each Site, including
without limitation, all walks, driveways and the
exterior of all structures on each Site, shall be
maintained in good order, repair and condition.
All exterior painted surfaces shall be maintained
in first-class condition and shall be painted at
least once in every six (6) years.
(12) There shall be no subdivision on any
Site, which would result in a parcel of less than
five (5) acres, without approval of the Approving
Agent.
(13) "Approving Agent" shall mean Fort Collier
Farms, Inc. or any successors or assigns as it may
so designate. `
This conveyance is further made subject to the followin;
listed planning standards which shall be binding upon the Grantee
and all successive owners of the property as covenants real
running with the property conveyed herein. The Grantor reserves
unto itself, and unto any successors or assigns it may so designa-
the sole right to enforce the planning standards, and also
reserves unto itself, and unto such designated successors and
assigns, the right to designate standards as they may be applied
to other property within Fort Collier Industrial Estates, such
rights being personal rights of the Grantor and its designated
successors and assigns. The Grantees shall have no right to
enforce the planning standards as to any such other property.

PLANNING STANDARDS
a - WOOD BUILDINGS
No building shall be constructed of
wood frame or wood exterior.
b - EXTERIOR BUILDING 8 MATERIALS
All exterior walls shall be finished
with face brick, its equivalent or better,
except that buildings may have walls without
such facing, provided that same are for future
expansion purposes. However, other exterior
materials may be permitted if, in the opinion
of the Developer, such materials are esthetically
and durably compatible with those already in use
throughout the park.
Exterior materials definitely not
permitted in the industrial park are concrete
block, corrugated siding, unless used in a
limited way as a "design feature" or as an
expansion wall. Expansion walls built of
concrete block shall be painted and maintained.
c - OUTSIDE STORAGE
Outside storage of materials is
permitted, provided that stored materials
are screened from public view in a manner
satisfactory to the Developer.
d - EXTERIOR LIGHTING
All exterior lighting shall be
installed with concealed wiring.
e - PARKING
No vehicular parking what -so -ever will
be permitted on any street within the park.
Limited front yard parking from the street to the
building will be prohibited except for visitor
and executive parking beyond the setback require-
ments. There shall be maintained on each site
facilities for parking, materials loading and
unloading sufficient to serve the business
conducted therein without using adjacent streets.
All driveways and offstreet parking areas shall
be paved in accordance with requirements of the
county.
(i) Employee Parking - At lease one
(1) parking space (8'6" x 18'-0) with sufficient
maneuvering space shall be provided for each
employee per shift. No parking shall be allowed
directly within the front setback area in front
of the main structure. Front setback areas to
the side of the main structure may be utilized

(ii) Loading and Unloading, Truck
Parking and Storage - The loading and unloading
of materials shall not be allowed within the
front setback area of any building. No truck
parking shall be allowed in the front setback area.
All truck parking and open storage areas shall be
screened, either by fence or planting approved by
the developer.
f - TRUCK DOCKS
No loading docks shall be permited to
front or face on any streets within the park
except that same may be permitted provided such
loading docks are limited in number and conform
with the esthetic harmony of the park.
All truck docks shall be so situated in
order that no trucks while loading or unloading
will project into a required side yard or rear
yard area unless a screened buffer area is provided
for.
g - LANDSCAPING
The front yard area from the road to the
building not covered by walks, parking areas,
planted areas, trees, etc., shall be seeded with
grass and maintained as a green area. All other
areas not covered by construction shall be properly
landscaped and/or stabilized to maintain a dust
free surface. All grass shall be cut to a 4 inch
maximum.
h - UNIFORM SIGN STANDARDS
No flashing, blinking, sequential,
intermittent or moving signs or lights shall
be permitted within the park. Each site shall
be permitted one (1) identification sign, to be
in letters only and constructed parallel to the
face of the building below the roof line and
project not more than 6 inches from its face.
Said sign shall not contain more than 200 square
feet of surface and shall not be longer than the
side of the building on which it is erected.
i - ACCESSORY BUILDINGS
No accessory buildings or other
structures shall be permitted within the
required front, side or rear yards, with
the exception of transformer pads or fire
hose cabinets.
j - OBJECTIONABLE USES
No use will be allowed that is
offensive to the park by reason of odor,

industrial waste, fumes, dust, dirt, smoke,
glare and heat vibration, electronic, television
or radio interference, or pollution or will be
hazardous by reason of danger of fire or
explosion.
k - SETBACKS AND LOT COVERAGE
1 - Minimum lot size - 5 acres.
There shall be no subdivision of any Site,
which would result in a parcel of less than
five (5) acres, without approval of the
Approving Agent.
2 - Minimum front yard setback -
75 feet.
3 - Minimum side yard setback -
25 feet or not less than height of building.

1 - ELECTRICAL
All on -site electrical, telephone and
other utility lines shall be underground from
street to building and shall be installed in
buried conduit.
All exterior lighting shall be installed
so that it will be concealed from view from the
street.
This conveyance is further made subject to the twenty
foot (201) sanitary sewer easement shown on the attached plat
and survey. The Grantor reserves from this conveyance a ten foot
C10'3 wide strip of land along the entire inside perimeter of
the property conveyed herein for the purpose of granting
overhead electrical power line easements, including all necessary
pole locations and other facilities, for carrying overhead
lines from a point or points on the property conveyed herein
to serve adjacent property. Such easements shall not interfer
with the Grantees' buildings, other improvements, or rights
of way located on the property conveyed herein.
Except as noted above, the Grantor covenants that it
has the right to convey said property to the Grantees; that it
will execute such further assurance of title to said property

Property conveyed; and that the Grantees shall have quiet
possession of said property free from all encumbrances.
The Grantor covenants that all necessary and proper
corporate action has been taken to authorize the sale and
execution, acknowledgment and delivery of this deed.
As a part of the consideration for this conveyance, th
Grantees join in the execution of this instrument to evidence
their agreement to the obligations imposed upon them herein,
and covenants:
Cl) To be responsible for the service and maintenance
of the sixty foot (60') "service road" shown on the attached
plat until such time as the Grantor has established additional
building sites to be served by said road, or until such time
as such service road has been dedicated to the State Highway
Department, whichever event shall first occur;
(2) To join with Grantor in dedicating said sixty foc
(601) service road as a public street when Grantor shall so
request; and
(3) To join with Grantor in the granting of any over-
head electrical power line easements within the aforementioned
reserved ten foot (101) wide strip along the entire inside
perimeter of the property conveyed herein.

THIS DEED OF CORRl,CTION made and dated ,this �day or
April, 1978, by and between FORT COLLIER FARMS, INC., a Virginia
Corporation (hereafter Fort Collier), and ROTA McDOLE, .INC., a
Virginia corporation (hereafter McDole).
WHEREAS, by that certain Deed and Vendor's Lien dated
September 26, 1977, and recorded in the Clerk's Office of the
Circuit Court of Frederick County in Deed Book 481 at Wage 49,
Fort Collier did in fact convey to McDole a tract of land
containing five (5) acres known as Lot 25-A; and
WHEREAS, the aforementioned Deed and Vendor's Lien
correctly describes Lot 25-A and refers to a plat of Lot 25-A,
but the plat erroneously attached thereto is for a tract
of land containing 7.5 acres known as Lot 25-B; and
WHEREAS, it is agreed by both parties that fee simple
title to Lot 25-A of Fort Collier Farms, Inc., was properly
conveyed to McDole by the aforesaid Deed and Vendor's Lien
dated September 26, 1977, of record in the aforesaid Clerk's
Office in Deed Book 481, Page 49; and
WHEREAS, the sole intent of this Deed of Correction
is to record a plat designated as Lot 25-A, hereto attached and
by this reference made a part of this Deed of Correction, and
to show that the plat of Lot 25-B was erroneously attached, but
its attachment in no way affected the validity of the conveyance
of Lot 25-A or the provisions contained in the aforementioned
E Deed and Vendor's Lien.
NOW, THEREFORE, WITNESSETH: That for valuable
consideration, Fort Collier doth hereby substitute a plat of
Lot 25-A, Fort Collier Farms, Inc., a copy of which is hereto
p attached and by this reference made a part of this Deed of
Correction, for that certain plat designated as Lot 25-B
erroneously attached to that certain Deed and Vendor's Lien
dated September 26, 1977, of record in the aforesaid Clerk's

Office in Deed Book 481, 49, it bCint; e:"Pressly understood
that this substitution of the plat of Lot 25--A in no way affects
the validity of the aforesaid conveyance or the provisions

The accompanying plat represents a survey of a portion of the land
conveyed to Fort Collier Farms Inc, by deed dated.21 January 1965 and
recorded in the Frederick County Court Clerk's Office in Deed Book
307 at Page 275.
The said land adjoins Brooke Road, the land of Shockey Realty Co.,
Kingsdown Inc., Mc Dole, and the retained portion of Fort Collier Farms,
Inc. in Stonewall District, Frederick County, Virginia and is bounded as
follows:
Beginning at an iron pin found in the North boundary line of Brooke
Road, a corner to Shockey Realty Co. and Kingsdown Inc.; thence with
the South line of Kingsdown Inc. by an arc of a curve to the left
640.01 ft. (radius 1920.00 ft. Chord = S86° 18' 26"E - 637.05 ft.)

1978, by and between FORT COLLIER FARMS,
INC., a Virginia corporation, owner and,proprietor, party of
the first part, THE COMMONWEALTH OF VIRGINIA, party of the
second part, KINGSDOWN, INCORPORATED, a North Carolina
corporation, party of the third part, and RON McDOLE, INC.,
a Virginia corporation, party of the fourth part.
WHEREAS, the party of the first part is the owner,
in fee simple, of the hereinafter described land acquired by it
as a part of Tract 1 described in a deed of I, Fred Stine, et
al, dated January 21, 1965, recorded in the Frederick County
Circuit Clerk's Office in Deed Book 307, at Page 275; and
WHEREAS, the party of the first part desires to
dedicate the street shown on the attached plat to the Commonwealt
of Virginia so as to vest fee simple title in said Commonwealth
as apart of its general development of the Fort Collier
Industrial Park so that the street will be maintained by the

the street shown on said plat to become a part of the road
system in the proposed development of the Fort Collier Industrial
Park, said street containing 1.037 acres and described by metes
and bounds with reference to the attached plat and survey of H.

Bruce Edens, C.L.S., dated February 6, 1978, and by reference
expressly incorporated herein.
The party of the third part, as the owner of the
easement created in that deed from Fort Collier Farms, Inc. to
the party of the third part, dated September 7, 1972 recorded in
Deed Book 395 at Page 656 in the aforesaid Clerk's Office, across
the property herein dedicated, hereby joins in this dedication
to convey all of its right, title and interest thereto to the
County of Frederick,.Virginia so that the property hereby conveyer
shall be henceforth acknowledged as a public street in accordance
with the statute in such cases made and provided.
The,party of the fourth part, as the user of a right
of way created by unrecorded contract between Fort Collier Farms,
Inc. and the party of the fourth part, dated. September 6, 1977,
across the property herein dedicated, hereby joins in this
dedication to convey all of its right, title and interest thereto

November, 1982, by and between SHOCKEY REALTY COMPANY, a Virginia
Limited Partnership, party of the first part, and the COUNTY OF
FREDERICK, VIRGINIA, party of the second part.
WHEREAS, the party of the first part is the owner of a
certain tract or parcel of land, containing 12.000 Acres, in the
aggregate, and more particularly described by survey drawn by H.
Bruce Edens, C. L. S., dated November 17, 1982, attached hereto
and by this reference made a part hereof as if set out in full;
and,
WHEREAS, the party of the first part desires to subdi-
vide said tract into parcels of land designated Parcel One and
Retained Portion, as shown on the aforesaid attached survey; and,

by metes and bounds, with the referenced curve

Bruce Edens, C.L.S., dated July 8, 1982, and by
reference expressly incorporated herein.
The land and roadway existing thereon dedicated and
conveyed hereby adjoins and merges with the land previously
dedicated and conveyed by Fort Collier to the Commonwealth of
Virginia by that certain deed of dedication dated November 4,
1980, and of record in the aforesaid Clerk's Office in Deed Book
529, at Page 54, all as a portion of the general development of
the Fort Collier Industrial Park.

THIS DEED OF DEDICATION, made and dated this
day of A V- , 1982, by and between J. P. DARLINGT,
and RUBY S. DARLING ON, husband and wife, owner and proprietor,
party of the first part, THE COMMONWEALTH OF VIRGINIA, party of
the second part, and FORT COLLIER FARMS, INC., a Virginia corpora
tion (hereinafter referred to as "Fort Collier"), party of the
third part.
WHEREAS, the party of the first part is the owner, in
fee simple, of the hereinafter described land, being a portion of
the land acquired by the male party of the first part from C.
Melvin Dunlap, et als., by deed dated December 15, 1975, and
recorded in the Clerk's Office of the Circuit Court of Frederick
County in Deed Book 452, at Page 612; and
WHEREAS, the party of the first part desires to dedicate)
the land shown on the attached plat to the Commonwealth of
Virginia so as to vest fee simple title in and to said land, and
the roadway constructed thereon, in the Commonwealth of Virginia
so that the roadway can be maintained by the appropriate public
authorities; and
WHEREAS, Fort Collier, as the party of the third part,
joins in the execution of this instrument to evidence its approvals
thereof.
NOW, THEREFORE, in consideration of the premises, THIS
DEED OF DEDICATION WITNESSETH:
J. P. Darlington and Ruby S. Darlington, the owner and
proprietor, with their free consent and in accordance with their
desire, and pursuant to the applicable Virginia statutes in such
cases made and provided, do hereby dedicate and convey, in fee
simple and with general warranty of title, unto the Commonwealth
of Virginia the following described property:
All that certain tract or parcel of land
lying and being situate in Stonewall Magisterial
District, Frederick County, Virginia, containing
40,214 square feet, and being designated as Parcel
"C" and being more particularly described and shown
by metes and bounds, with the referenced curve
table, on the attached plat and survey of H. Bruce
Edens, C.L.S., dated August 20, 1980, and by
reference expressly incorporated herein.
Fort Collier, the party of the third part, as the
grantee of that certain 60 foot wide easement granted in that
certain deed of easement and partial release from J. P. Darlington
and Ruby S. Darlington to Fort Collier, dated September 18, 1980,
and recorded in the aforesaid Clerk's Office in Deed Book 527, at
Page 305, said easement being across the same land herein dedicate
and conveyed, hereby joins in this dedication to convey all of
its private right, title and interest in and to said easement to
the Commonwealth of Virginia, so that the land conveyed herein,
with the roadway constructed thereon, shall henceforth be ac-
knowledged as public property in accordance with the statutes in
such cases made and provided.
The land and roadway existing thereon dedicated and
conveyed hereby adjoins and merges with the land previously
dedicated and conveyed by J. P. Darlington and Ruby S. Darlington
to the County of Frederick, Virginia, by that certain deed dated
October 16, 1980, and recorded in the aforesaid Clerk's Office in
Deed Book 528, at Page 108.
Reference is here made to the aforesaid instruments and
the attachments thereto and the references therein contained for
a further and more particular description of the property hereby
conveyed.
This conveyance is made subject to the 10 foot wide
permanent sewer easement and the 10 foot wide permanent water
easement granted to the Frederick County Sanitation Authority by
instrument dated August 9, 1978, and recorded in the aforesaid
Clerk's Office in Deed Book 497, at Page 125.

INC., a Virginia corporation, owner and proprietor, party of
the first part, THE COMMONWEALTH OF VIRGINIA, party of the
second part, KINGSDOWN, INCORPORATED, a North Carolina
corporation, party of the third part, and RON McDOLE, INC.,
a Virginia corporation, party of the fourth part.
WHEREAS, the party of the first part is the owner,
in fee simple, of the hereinafter described land acquired by i
as a part of Tract 1 described in a deed of I, Fred Stine, et
al, dated January 21, 1965, recorded in the Frederick County
Circuit Clerk's Office in Deed Book 307, at Page 275; and
WHEREAS, the party of the first part desires to
dedicate the street shown on the attached plat to the Commonwe
of Virginia so as to vest fee simple title in said Commonwealt
as a part of its general development of the Fort Collier
Industrial Park so that the street will be maintained by the
appropriate public authorities; and
WHEREAS, dedication has been approved by the
appropriate officials of both the County of Frederick and the
City of Winchester, Virginia as evidenced by their endorsement
upon the attached plat.
NOW, THEREFORE, IN CONSIDERATION OF THE PREMISES THI
DEED OF DEDICATION WITNESSETH:
The undersigned owner and proprietor with its free
consent and in accordance with its desire, and pursuant to the
applicable Virginia statutes in such cases made and provided,
hereby dedicate and convey unto the party of the second part
the street shown on said plat to become a part of the road
system in the proposed development of the Fort Collier Industr

Proposed Use As shown on the plat, phase two (2) of development is not specified.
Phase one (1) indicates use as warehousing.
Improvements Phase one proposes apparent parking and loading area composed of six
(6) inch base prime and double seal, a 15,000 square foot warehouse,
and a 3,000-square feet attached office area. Phase two indicates
two (2) buildings for future development.
Review Evaluation
Frederick -Winchester Health Department - Satisfactory
Virginia Department of Highways and Transportation- Entrance would
be satisfactory if the proposed sixty (60) foot street is constructed.
Department of Public Works Land Distrubing Permit required.
Zoning - Suggest requirement that the proposed sixty (69) foot street
be developed to the use access area as shown concurrently with the
parking and warehouse development. Suggest proposed street surfacing
material be indicated and ownership of proposed street and adjacent
property be clearly indicated on the site plan. Suggest screening
of parking and loading areas either by planting or fencing.
Sanitation Authority - Water and sewer main lines are in the Industrial
Park but the lines indicated on the site plan must be built by the
developer.
Subdivision - This lot has not been sold to Dawson Investments by the
Stine`s. Under the amended Subdivision Code, the property owner, Stine,
is required to submit a subdivision plat for approval, and build a
Class III roadway. The roadway will become a critical issue. Mr. Stine
has requested that the County, City and Highway Department study
connecting the Industrial Park roadway with Smithfield Avenue. The City
is against the idea (memo enclosed) and from the County view that street
is not a solution to the Industrial Park's traffic problem and we are
not assured that the right-of-way exists to build what is proposed.
What is presented here is the site plan for a warehouse to front a street.
that is still under study. _
Staff Comment
The staff recommends that this site plan be tabled until the roadway plans
are submitted and accepted. The reason behind this recommendation are:
1. There is no way to know how much roadway can be built, because the
available right-of-way is not known.
2. It is not known whether or not the street will be a dead-end, and
therefore, cul-de-sac or turning areas cannot be incorporated in this

Planning Commission Recommendation
The Planning Commission reviewed this site plan at three meetings and was not
able to achieve an agreement with the applicant or approve the request in the face
of the City's request. By motion of Rosenberger, the Commission voted to send the
site plan to the Board with no recommendation; Brumback - NO, all others - YES.

The. City Planning Commission, at their October 27, 1977 meeting, reviewed
the industrial access roadways for the Fort Collier Industrial Estates. The
Commission unanimously approved the following comments:
1. The proposed right-of-way leading to Route #783 should not be approved
at this time due to the following:
A. Traffic using this road would travel on Smithfield Avenue, which is
zoned primarily for multi -family residential, and is a congested
street. J
B. Smithfield Avenue narrows to aright -of -way of only 40 feet at its
intersection with National Avenue, which is inadequate for the traffic
anticipated.
It should also be noted that Green Street, when completed, wiJ_1 connect
Smithfield Avenue with Baker Lane. However, -:' en completed, over 55 lets
will front on Green Street, containing over 55 separate driveway entrances.
The majority of Green Street is zoned single family residential, and the use
of this street to handle heavy traffic generated by an industrial park would
be inappropriate.
If a Butler Drive alternate were constructed, the advisability of this road
would have to be re-evaluated.
2. The use of the proposed right-of-way to the east should be encouraged.
This could eventually connect to Baker Lane, and could be a controlled

Proposal: Fort Collier is deeding to the State Department of Highways, a
portion of Brook Road 60 feet wide by approximately 690 feet long.
This request is a technicality and should be approved so that this
section of street will be taken by the State for maintenance.
Planning Commission Recommendation:
The Planning Commission unanimously recommends approval.
At a Special Meeting of the Frederick County Board of Supervisors held on
July 19, 1982, at 6:00 P.M., in the Board of Supervisors' Meeting Room, 9 Court
Square, Winchester, Virginia, the following action was taken:
Upon motion made by Will L. Owings and seconded by William H. Baker,
WHEREAS, The Virginia Department of Highways and Transportation and the
Department of Planning and Development have reviewed the request by Fort
Collier Industrial Estates and J. P. Darlington and recommend the inclusion of
approximately .33 miles of Brooke Road extended (Rt. 1322) from the
Northwestern Workshop lot to the intersection with Baker Lane (Rt. 1200), in
the Stonewall Magisterial District, into the seondary road system pursuant to
the provisions of the Code of Virginia, 1950, as amended; and,
WHEREAS, This Board does guarantee the Commonwealth of Virginia an
unrestricted right-of-way of sixty (60) feet with necessary easements for cuts,
fill and drainage, as evidenced in the deeds recorded in deed book 549, page
348 and book 549, page 352 in the office of the Clerk of the Circuit Court of
Frederick County, Virginia.
BE IT RESOLVED, That this Board does approve the request for inclusion

This reports on the status of road construction at Fort Collier Industrial
Estates and further requests the Frederick County Board of Supervisors to
consider a resolution for purposes of dedicating the completed road to
the State Highway Department. A commitment was made by Fort Collier
in 1980 to complete the linkage of its present roadway with a 2nd major
entrance to the Park at Baker Lane. The final portion of the roadway was
linked with the Baker Lane entrance and construction completed October 1, 1981.
The State Department of Highways and Transportation was contacted and with
the exception of some minor culvert and shoulder work and the adjustment in (2)
manholes, the road system meets their engineering specifications. The matter
of the culvert and shoulder work has been covered by Mr. R. C. King directly
with the contractor; Fort Collier is proceeding to review the adjustment in
manhole elevation with the Sanitation Authority.
The segment requested for dedication to the State Highway is represented by
Engineering Drawing, Dtd. March 24, 1980 and prepared by Greenway Engineering
and Surveying Co. of 'Vlinchester. The segment extends from Baker Lane to the
point of intersection with State constructed road adjacent to the boundry line
of Northwestern Workshop. A portion of this segment was constructed over
larc owned by J. P. Darlington and is represented by Survey Plat, Dtd. March 12,
1980. An easement was granted to Fort Collier by Darlington for purposes of
constructing this portion of the road.
By copy of this letter, Mr. Darlington and Fort Collier Farms, Inc. are
requesting that this completed roadway be accepted by the State Highway Depart-
mant for addition to the secondary highway system. We would appreciate
your submittal of this request to the Frederick County Board of Supervisors.

When I discussed with former County Administrator, J. O. Renalds,
III, the action of the Frederick County Board of Supervisors in approv-
ing the temporary use of Smithfield Avenue Extended, by Dawson
Investments, it was my opinion, based on information he had provided
me plus additional information obtained in my discussion with him, that
the Board did have the authority to grant temporary use of this roadway
and to attach certain conditions to said use.
When the temporary use of this road expires in January of 1980, Dawson
Investments 1vill have to make arplication to the Frederick County Board
of Supervisors to obtain new approval for the use of Smithfield Avenue
Extended. Of course, granting of the new use should be temporary and on
the same conditions as before plus any nev, conditions t1he Board feels
appropriate.

Gentlemen:
I received the attached letter today and would like to set the record
straight as to some facts concerning Smithfield Avenue Extended.
Dawson Investments was issued permission to connect to Smithfield Ave. for a period of 18 months or until such time as a second building vas built,
whichever came first. Concurrent with this Fort Collier Industrial Park was
to construct another access road from Brooke Drive to connect Lot 5A at
which time the access from Smithfield Ave. would be closed.
My understanding is that this was a request to satisfy a letter received
by the city concerning excessive traffic.on Smithfield Ave. I don't see the
logic in restricting traffic at this point as Brooke Drive connects to Smith-
field Ave. at it's intersection with Route 11 North and the railroad tracks.
Concerning the maintenance of Smithfield Avenue Extended, I have been
told by Mr. Alfred Robinson at the Exxon Oil Co. that this road has been
routinely refurbished about every six years. r1r. Robinson said it has been
about that long since the last refurbishing.
I agreed that the condition of the road was deteriorated to a point
where it needed repair and that the traffic from Harris Intertype as well as
the construction of the building for Harris.contributed to this..
In December of 1978 I contracted Perry Engineering to repairthe entire
length of said road. (Copy of.bill enclosed).
Since that time I have filled all the holes with,gravel_on two separate
occasimns:.at no expense to other property owners.
Up until July 15 and for 6 years prior no one has contributed, to my
knowledge, anything towards the maintenance of this road.
The construction of the Northwestern Workshop has again contributed to
the disrepair of the road because of the heavy construction equipment and the
cement truths. It would be unwise to resurface until this project is corn
pleted which is scheduled for sometime in October.
In view of the fact that I have been granted only 6 additional months use
of this road, I offered to contribute another $500.00 toward the repair which
would bring my total expense for road repair to about $1,000.00.
The refurbishing of the road was recently quoted by Perry Engineering
at a cost of $7,000.00. Historically this type of investment is resquired
each 6 years for an accrued annual outlay of $1,000.00 to $1,200.00 approximately,
depending on inflation. When you divide this amount by four property owners,
including Dawson Investments, you come up with $300.00 per property owner per
year.
Since I have contributed $500.00 in December and have agreed to contribute
an additional $500.00, and have used the road for only 18 months, I feel your
statement that I have not participated in the maintenance of that road is
unjust.

I would also like to suggest that if I was permitted permanent access
to Smithfield Avenue Mended I would contribute more than my share as this
would save me the cost of extending my road to the proposed road from Brooke
Drive.
I have been in contact with Mr. Fred Stine Jr. today. He advised me he
would contribute a like share not to exceed $2,000.00 ta��,,ards the refurbishing
of Smithfield Avenue Extended if it could be a permanent access road serving
the ajoining existing property owners exclusive of Lot 4. Mr. Stine`s
contribution would be a one time thing and would be contingent upon favorable
action in this regard by the Board of Supervisors.
If a favorable response from the Board of Supervisors could be obtained
on a permanent access I would be willing to pay an equal share of an annual
maintenance fee for the road repairs and for snow removal.
Mr. Stine also advixed me today that he has been denied approval of his
proposed access road to be constructed from Brooke Drive to my Lot 5.4. This
certainly compl-icated matters.in my regard as the original plan was for this
road -construction to coincide with my 18 month temporary access. .Although
this has been extended 6 months, no permanent solution has been formulated.
In view of the fact that no traffic problems or accidents have been
caused by using Smithfield Avenue Extended, and no complaints or problems
other than maintenance, have been brought forward, I would like to make a
request for a permanent access through Smithfield Avenue Extended for Dawson
Investments.
I hope the above request can be acted upon favorably by the Board of
Supervisors. If this request is not acted on favorably. then I wish to request
that the access to Smithfield Avenue Mended be continued until another access
is completed whenever that may be.
Harris Intertype management is very concerned about the threats made by
Mr. Alfred Robinson to put a gate across the road closing it to traffic.
Although I have assured them that Mr. -Stine has documents showing legal right
of way, Harris Intertype is still concerned and feels harrassed by these threats.
Mr. Langdon Gordon of the planning commission at the June 1979 meeting assured
me that they, the planning commission, would not shut off my access.
A fast and permanent solution to these problems would certainly be
appreciated. Please advise me when the next meeting takes place so I might
attend AM answer any questions which might arise. If you have any questions
prior to that time please give me a call.

I would also like to suggest that if I was permitted permanent access
to Smithfield Avenue Mended I would contribute more than my share as this
would save me the cost of extending my road to the proposed road from Brooke
Drive.
I have been in contact with Mr. Fred Stine Jr. today. He advised me he
would contribute a like share not to exceed $2,000.00 towards the refurbishing
of Smithfield .Avenue Extended if it could be a permanent access road serving
the ajoining existing property owners exclusive of Lot 4. Mr. Stine's
contribution would be a one time thing and would be contingent upon favorable
action in this regard by the Board of Sizj)ervisors.
If a favorable response from the Board of Supervisors could be obtained
on a permanent access I would be willing to pay an equal share of an annual
maintenance fee for the road repairs and for snow removal.
Mr..Stine also advixed me today that he has been denied approval of his
proposed access road to be constructed from Brooke Drive to my Lot 5A. This
certainly complicated matters in my regard as the original plan was for this
road -construction to coincide with my 18 month temporary access. Although
this has been extended 6 months, no permanent solution has been formulated.
In view of the fact that no traffic problems or accidents have been
caused by using Smithfield Avenue Extended, and no complaints or problems
other than maintenance, have been brought forward; I would like to make a
request for a permanent access through Smithfield Avenue Extended for Dawson
Investments.
I hope the above request can be acted upon favorably by the Board of
Supervisors. If this request is not acted on favorably then I wish to request
that the access to Smithfield Avenue Extended be continued until another access
is completed whenever that may be.
Harris Intertype management is very concerned about the threats made by
Mr. Alfred Robinson to put a gate across the road closing it to traffic.
Although I have assured them that Mr. -Stine has documents showing legal right
of way, Harris Intertype is still concerned and feels harrassed by these threats.
Mr. Langdon Gordon of the planning commission at the June 1979 meeting assured
me that they, the planning commission, would not shut off my access.
A fast and permanent solution to these problems would certainly be
appreciated. Please advise me when the next meeting takes place so I might
attend AM answer any questions which might arise. If you have any questions
prior to that time please give me a call.

This confirms our conversation this week concerning interest express%by a local
firm in acquiring a 5 Acre site from Fort Collier. I have made the client aware
of the recent action taken by the Board of Supervisors to defer any site Dan approval
until we have cleared the right of way for a second access to our park.
You. axe aware of my recentcontacts with I•tx. Baker representing tha Hughes Fztate
which has title to a portion of the land upon which we are attempting to gain
a right of way. You had planned to give IIr. Baker a follorluo call and advise :ae
of his current position. I had then planned to call r,T. Baker .to.. obtain a definite
answer so that we can proceed with clearing the right of way. Y+e• have stressed to
I`ir. Baker that the dedication of only a small area of land would anable us to
lay final plans for a roadway which would serve the 1iughes property as well.

When I discussed with former County Administrator, J. O. Renalds,
III, the action of the Frederick County Board of Supervisors in approv-
ing the temporary use of Smithfield Avenue Extended, by Dawson
Investments, it was my opinion, based on information he had provided
me plus additional information obtained in my discussion with him, that
the Board did have the authority to grant temporary use of this roadway
and to attach certain conditions to said use.
When the temporary use of this road expires in January of 1980, Dawson
Investments will have to make application to the Frederick County Board
of Supervisors to obtain new approval for the use of Smithfield Avenue
Extended. Of course, granting of the new use should be temporary and on
the same conditions as before plus any new conditions the Board feels
appropriate.
If you or any member of the Frederick County Engineering Committee
have any questions regarding this matter, I will be glad to discuss it with
you.

Gentlemen:
I received the attached letter today and would like to set the record
straight as to some facts concerning Smithfield Avenue Foc-tended.
Dawson Investments was issued permission to connect: to Smithfield Ave.
for a period of 1S months or until such time as a second building was built,
« whichever came first. Concurrent with this Fort Collier Industrial Park was
to construct another access road from Brooke Drive to connect Lot 5A at
which time the access from Smithfield Ave. would be closed_
-My understanding is that this was a request to satisfy a letter received
by the city concerning excessive traffic - on Smithfield Ave_ I don't see the
logic in restricting traffic at this point as Brooke Drive connects to Smith-
field Ave. at it's intersection with Route 11 North and the railroad tracks_
Concerning the maintenance of Smithfield Avenge Extended,, I have been
told by Mr. Alfred Robinson at the Eamon Oil Co. that this read has been
routinely refurbished about every six years. Mr. Robinson said it has been
about that long since the last refurbishing.
I agreed that the Condition of the road was deteriorated to a point
where it needed repair and that the traffic from Harris Int4--rtype as well as
the construction of the building for Harris contributed -to this..
In December of 1978 1 contracted Perry Engineering to a.-epairthe entire
length of said road. (Copy of.bill enclosed).
Since that time I have filled all the holes with gra-vest-on two separate
occasl6h8-,at no expense to other property c:,.ners_
Up until July 15 and for 6 years prior no one has cc)nt3-ibuted, to my
knowledge, anything towards the maintenance of this road_
The construction of the Northwestern `Forkshop has a-ain contributed to
the disrepair of the road because of the heavy construction equipment and the
cement trucl�s. It would be unwise to resLu•face until this project is com-
pleted which is scheduled for sometime in October.
In view of the fact that I have been granted only 6 additional months use
of this road, I offered to contribute another S500. 00 -Lc -. a.rd the repair which
would bring my total expense for road repair to about S1,000.00.
The refurbishing of the road was recently quoted by Perry Engineering
at a cost of $7,000.00. Historically this type of investMe.nt is resquired
each 6 years for an accrued annual outlay of $1,000.00 to S1_,200.00 approximately,

Please regard this as our request to pick up our Clerk -
Typist II position from the exisfng CETA contract upon its
termination the last of September 1979. This position is cur-
rently held by Mrs. Ruth Gilbert, who has done an outstanding
job since August 21, 1978. In working for me, she has maintained
a professional outlook in every task assigned. Her ability to
take on added responsibility has been an asset to our office.
For a period of three or four months, during the time
Planning and Development was without a fully capable secretary,
Mrs. Gilbert filled in by writing the minutes of the Planning
Commission meetings, which, despite the extra work -load, were
completed precisely and on time. Mrs. Gilbert is looked -to
throughout the building for her proofreading capabiili-ties as
other departments ask her to finalize drafts of impor-cant doc-
uments.
Another example of her ability to complete a project in
an exemplary manner was the task of refurbishing the Confederate
soldier statue. She handled from the beginning the bid process,
coordination with contractor, with support groups, grant request,
and transportation, to bring this project to completion_
Her duties also include maintenance of: subdivision and::
site plan file, vehicle maintenance files, contractor and sub-
contractor files and records, Frederick County and State codes,
landfill billing records, data on solid waste collection and
disposal, and others too numerous to mention.
As the new CETA contractor, The National Council on Al-
coholism, would not give Mrs. Gilbert hospitalization benefits
and would also reduce the amount of leave she earns annually,
we feel, based on her contributions to the continuity and effic-
iency of this office and the County's over-all operation, we
should make this a permanent position. I am under the impression
that our office is the last department without a permanent secre-
tary

fore 50% of her pay would come out of our landfill budget_ The
50% which would come out of Public Works would then only require
a supplemental amount of $2,587.50 for the remaining .fiscal year.

As per instruction I am enclosing information with regard.
to the needs of the Frederick County Parks and Recreation
Department for adequate operational space. It is very
apparent that this department has grown tremendously over
the last seven years and steps have not been taken to
assure adequate space with this growth.
We currently employee 16 full time county employees with.
an additional 6 person being employed full time under CETA,
with our department having a minimum of two recreation interns
at all times.
It is further apparent that our programs; continue to
grow in county participation each year with a grK>wth rate
of 30 o to 200 0. With the addition of new fac.ili,".:.i.es such
as a municipal pool and park facilities it is a rreality
that participation will continue to grow. As par-ticipation
grows, so does the services and responsibilities required
of this department. With liability being such an influence
in todays society, I feel we must make ever stride to maintain
quality, safe, and attractive facilities for our taxpayers.
The afore mentioned information should serve as intro—
duction to the problem I am about to address.
At present our Recreation Division is housed on the
third floor of the County Office Building. Aside from being
unaccessable to a large part of our senior citizen clientele,
our staff has very little room to carry out its daily task_
This lack of space creates gross influences and makes our
job much more difficult. More importantly, our operational
cost is increased by not having storage to buy supplies in
bulk. Additional time is spent -driving to pick up other
recreation supplies stored at Clearbrook and returning to the
office. Our present situation will find it necessary to house
10 desks in 3 offices, a formidable task ever for an active
imagination.

Furthermore, the Maintenance Division has no office
facilities at all, they work out of a pole barn in the
winter without bathroom facilities. These 12 employees
need a facility to work in when the weather is inclement.
There is no space available to store any equipment in quantity
nor a place to park vehicles. Equipment costing thousands
of dollars must set out in the weather because storage is
unavailable.
Without becoming long winded, I would appreciate if
consideration could be given to the following area:
.1. A facility that would allow both recreation staff
and maintenance staff to be accessible to each
other and be. centrally located to county citizens.
2. Office space for a total of 10 recreation staff members.

These are all problems which are beyond my solution
without the support needed to accomplish this_ I truly feel
in order to run a successful Parks and Recreation Department

Enclosed please find the executed performance bond and
acknowledgment of principal and affidavit and acknowledgment of surety.
Also enclosed please find three plats of each of the two road sections
[the section through Fort Collier and the section over the Darlington
property] which are affected.
Also please find enclosed a copy of the deed of dedication
dated November 4, 1980, whereby Fort Collier Farms, Inc. dedicated
the land over which the Highway Department has since constructed
a roadway. This deed of dedication is recorded in the Frederick
County Circuit Court Clerk's Office in Deed Book. 529, at Page 54.
You will note that the plat of that dedication is attached to the
enclosed deed.
You also will note that the performance bond is in the
amount of $7,500.00, which I understand is the proper amount for
the bond for 0.33 miles of roadway. You will recall that the County
Board of Supervisors' resolution referred to .65 miles of roadway;
John Horne advises me that this .65 miles is a total of the approximate
.33 miles of roadway being dedicated hereby plus the land and roadway
represented by the November 4, 1980 deed of dedication discussed
in the paragraph above. It is Mr. Horne's understanding that the
portion represented by the November 4, 1980 deed has not yet been
taken into the State system, and therefore it was included in the
resolution. Also enclosed please find a copy of Mr. King's letter,
on behalf of Mr. Bushman, to Fred Stine dated November 10, 1981,
which refers to the two sections of roadway totalling .33 miles.

P.S. After discussing this matter with you on Thursday
morning, July 15th, particularly with regard to the length of roadway
being dedicated and the corresponding amount of the bond, John Horne
called me regarding the fact that the Board of Supervisors will be
holding a•meeting Monday night, July 19th. John is preparing a resolution
which will revise and correct the earlier erroneous resolution which
was adopted by the Board at its meeting on June 23, 1982. The resolution,
a copy of which I sent you under cover of my letter dated July 12th,
refers to approximately .65 miles of Brooke Road extended (the length
of the roadway has been explained previously in this letter); the
resolution erroneously states, however, that Brooke Road is being
extended "to the Fort Collier property line"; the resolution is to
be modified and corrected to reflect that Brooke Road extended runs
acorss the Fort Collier property line, and then over the land of
Darlington to Baker Lane [the portion over the Darlington property
is the subject of the deed of dedication from Mr. and Mrs. Darlington,
with Fort Collier joining in, which was recorded in the Frederick
County Clerk's Office on Monday, July 12th, in Deed Book 549, at
Page 3521. The amended resolution will also refer to "Rt. 1200 to
Rt. 1322."
As I stated to you on Thursday, it is my positionlon behalf
of Fort Collier, that the amendment and correction of the Board's
resolution is purely a technical matter, as the Board, as I understand
it, clearly understood that the roadway which they were approving

for purposes of inclusion into the State system at their meeting
of June 23rd was the roadway as it extends across the Fort Collier
property line, running across the Darlington property, and adjoining
Baker Lane. The proposed amendment, to be considered Monday night,
is not changing the Board's intent or what the Board approved, in
any manner, said amendment merely being made so as to correct the
previous error. Therefore, it is Fort Collier's position that such
technical amendment should not have any detrimental affect upon the
Highway Department taking the two sections of roadway into the State
system.

Enclosed please find copies of two proposed deeds of dedica-
tion for the recently constructed roadway situate in the Fort Collier
Industrial Park and over the property of J. P. Darlington. As you are
probably aware, the recently completed road construction was accom-
plished in four stages, as follows:
(1) The first stage was construction of improvements to
Baker Lane from the City limits; this construction was on property
owned by J. P. Darlington, and Mr. Darlington has previously dedicated
the land upon which that portion of the road is constructed to the
County of Frederick by deed dated October 16, 1980, and recorded in
the Clerk's Office of the Circuit Court of Frederick County in Deed
Book 528, at Page 108.
(2) The second stage involved construction of a road "down"
from Brooke Drive to the "back" of the Northwestern Workshop lot; Fort
Collier, by deed of dedication dated November 4, 1980, and recorded in
the aforesaid Clerk's Office in Deed Book 529, at Page 54, dedicated
and conveyed land to the Commonwealth of Virginia, and it is my under-
standing that the Commonwealth of Virginia has completed construction
of the roadway on that section.
(3) The third stage represented an extension of the roadway
from the improvement of Baker Lane [stage one] across J. P. Darlington's
property over a 60 foot wide easement which had been granted by Mr.
Darlington to Fort Collier by instrument dated September 18, 1980, and
recorded in Deed Book 527, at Page 305. It is my understanding that
road construction has been completed on this section, and enclosed you
will find a proposed deed of dedication for this land, and existing
roadway, from J. P. Darlington and his wife to the Commonwealth of

Virginia. Note that Fort Collier joins in to release its private
easement rights created by the instrument recorded in Deed Book 527,
at Page 305.
(4) The fourth stage represents an approximate 900 foot
section of roadway connecting or linking the roadway constructed by
the State [stage two] and the recently constructed roadway across the
Darlington property [stage three]. Enclosed you will find a proposed
deed of dedication whereby this land, along with the roadway, is
dedicated and conveyed to the Commonwealth of Virginia by Fort Collier.
I have not attached a plat to this proposed deed as I do not have one
in my possession.
It is my understanding that the Board of Supervisors is to
consider a resolution relative to the roadway system at its meeting on
Wednesday, June 23rd, and I wanted to provide you with these proposed
deeds of dedication for your use at that meeting. Please be advised
that I have been in contact with Keith Walker of the Department of
Highways (Edinburg), Wendy Jones of the Frederick County Sanitation
Authority, and Mr. Darlington's counsel relative to the enclosed deeds
of dedication. By copy of this letter to those gentlemen, I am
advising them of the status of this matter and am also enclosing to
them copies of the proposed deeds of dedication for their review and
comment.

concerning this matter.

P.S. The above was dictated on Tuesday, June 22nd. When we
discussed this matter on Wednesday morning, June 23rd, you advised me
that the resolution to be considered by the Board of Supervisors deals
only with the portion of the road constructed through and over Fort
Collier property, and the resolution does not concern itself with the
portion of the road which runs across the Darlington land (formerly
Dunlap) from Baker Lane to the Fort Collier property. Thus, I understand
that the Board will be concerning itself only with the proposed deed
of dedication which is granted by Fort Collier, and will not be concerning
itself with the deed of dedication to be granted by Mr. and Mrs.
Darlington (and to be joined into by Fort Collier).
Enclosed please find a copy of a letter sent to you dated
December 17, 1981, from both Fort Collier Farms, Inc. and Mr. Darlington.

The letter reflects that a portion of the road construction was over
land owned by Mr. Darlington and a portion was over the Fort Collier
property, and that Fort Collier and Mr. Darlington were jointly requesting
that the completed roadway be accepted by the State Highway Department

and recorded in Deed Book 528, at Page 108; this previous deed of
dedication is the dedication of the improvements to Baker Lane).
It is my understanding, from discussing the matter with
John Horne, that the resolution, although technically in error, was
understood by the members of the Board to be a recommendation that
the roadway, as it extends from Brooke Road across the Fort Collier
property line and across the land of Darlington to Baker Lane, should
be recommended for inclusion into the State system. I also understand
from Mr. Horne that the resolution will be corrected at the Board's
August llth meeting. Please note that a copy of this letter is being
sent to Mr. Horne.
Please let me know if you have any questions or comments
concerning this matter. I am hopeful that the Department of Highways
and Transportation can move to take the described roadway into the
State system.

to Fort Collier Industrial Development. I understand that remarks
which I made to you by phone concerning estate settlement raised
concern as to Ft. Collier's continued development activity.
In order to set the record straight, we are continuing to offer
property for industrial development. As you know we have defined an
area of approximately 100 acres which is located on the southern
side of the property. This currently has all services available.
We recently participated in an offer to Abell Corporation. At this
time I certainly don't want to discourage interest from potential
customers and we will continue to cooperate with your office regarding
industrial site prospects.

On January 27, 1979 a letter to the Frederick County Board of Supervisors was
transmitted from Fort Collier which requested the Board's endorsement of
application for Industrial Access Road Funding. This was to serve the Harris
Intertype facility and extend roadway from Brooke Drive to the eastern boundry
of Lot No. 5.
The Board has to date refused this endorsement and per letter of July 12, 1979
"conditioned the approval for industrial access funds upon the second means
of access ---". Since that date, Fort Collier has endeavored to seek clearance
of a second access to the park. This has been delayed until property providing
for this access was acquired and arrangements worked out with an abutting
developer for rights of way leading from the Fort Collier property line to
the Baker Lane extension joining at the Winchester -Frederick County line.
I can report that an agreement has been reached for rights of way as described
above, providing for a second access to the industrial park. In addition,
survey and engineering of the second access road has been completed and documentation
submitted to the Virginia State Department of Highways for their approval.
-I would appreciate meeting with the Board of Supervisors at the meeting seheduled
for May 14, 1980 to review road construction plans and to request the Board's
consideration of the following:
1. Endorsement of Fort Collier's request for industrial access funds to construct
a roadway from Brooke Drive to the eastern boundry of Lot 5 serving Harris Intertype.
2. A means for site plan approval that will enable the continuation of development
consistent with the appropriate construction of roadway to serve new industry for
Frederick County.
I will plan to provide the Board with a full report on the activities concerning
the park. Please confirm that the proposed date is satisfactory.

Subject: Request for Industrial Access Road Funding
Dear Mr. Koontz:
During 1978 a 5-acre parcel was sold to Dawson Enterprises for the
purpose of constructing a facility for Harris Intertype. I have consulted
with the Virginia Department of Highways and have made them aware of our
interest in applying for industrial access funds. I received a call from
Mr. Reginald King this week and he suggested that the information be
presented to the Frederick County Board of Supervisors.
Information contained with this request covers the proposed road
extension within the Fort Collier property leading from Brooke Drive
to the site presently occupied by Harris Intertype. In addition I am
enclosing a letter from Mr. Donald H. Neale, Manager., Manufacturing,
Harris Intertype, describing the facilities. Engineering drawings
have been prepared which will enable resident engineers of the State
Highway Department to estimate the cost for the roadway extension..
I would appreciate the Frederick County Board of Supervisors
considering this request for funds to enable further extension of our
roadway system. This, also in addition to serving a new industryj, will
lead toward new access from the Industrial Park. At the present time
the proposed roadway extension terminates at the Harris Intertype
property line. We would like to advise you that the Norttmetern Forkshop
will be acquiring a 6-acre parcel from Fort Collier with the location
being directly south of the Frederick County School Board. The Northw+este=
Workshop is established as a source of training and enabling personnel
to work for industry. Tole hope that the location of. this facility can be
used to further justify the roadway extension.,
We look forward to your favorable consideration. of this request.
We will appreciate your written resolution which. you Pray send to the
attention of Mr. John Childs c/o Mr. Reginald King, Resident Engineer,

Gentlemen:
I received the attached letter today and would like to set the record
straight as to some facts concerning Smithfield Avenue Extended.
Dawson Investments was issued permission to connect to Smithfield Ave. for a period of 18 months or until such time as a second building was built,
whichever came first. Concurrent with this Fort Collier Industrial Park was
to construct another access road from Brooke Drive to connect Lot 5A at
whieb time the access from Smithfield Ave. would be closed.
My understanding is that this was a request to satisfy a letter received
by the city concerning excessive traffic_on Smithfield Ave. I don't see the
logic in restricting traffic at this point as Brooke Drive connects to Smith-
field Ave. at it's intersection with Route 11 North and the railroad tracks.
Concerning the maintenance of Smithfield Avenue Extended, I have been
told by Mr. Alfred Robinson at the Exxon Oil Co. that this road has been
routinely refurbished about every six years. T1r. Robinson said it has been
about that long since the last refurbishing.
I agreed that the Condition of the road was deteriorated to a point
where it needed repair and that the traffic from Harris Intertype as well as
the construction of the building for Harris.contributed to this..
In December of 1978 I contracted Perry Engineering to repairthe entire
length of said road. (Copy of.bill enclosed).
Since that time I have filled all the holes with gravel --on two separate
occasi6n8r,,at no expense to other property owners.
Up until July 15 and for 6 years prior no one has contributed, to my
knowledge, anything towards the maintenance of this road.
The construction of the Northwestern Workshop �-as again contributed to
the disrepair of the road because of the heavy construction equipment and the
cement trucl�s. It would be unwise to resurface until this project is com-
pleted which is scheduled for sometime in October.
In view of the fact that I have been granted only 6 additional months use
of this road, I offered to contribute another $500.00 toward the repair which
would bring my total expense for road repair to about $1,000.00.
The refurbishing of the road was reQently quoted by Perry Engineering
at a cost of $7,000.00. Historically this type of investment is resquired
each 6 years for an accrued annual outlay of $1,000.00 to $1,200.00 approximately,
depending on inflation. When you divide this amount by four property owners,
including Dawson Investments, you come up with $300.00 per property owner per
year.
Since I have contributed $500.00 in December and have agreed to contribute
an additional $500.00, and have used the road for only 18 months, I feel your
statement that I have not participated in the maintenance of that road is
unjust.

I would also like to suggest that if I was permitted permanent access
to Smithfield Avenue Extended I would contribute more than my share as this
would save me the cost of extending my road to the proposed road from Brooke
Drive.
I have been in contact with Mr. Fred Stine Jr. today. He advised me he
would contribute a like share not to exceed $2,000.00 towards the refurbishing
of Smithfield Avenue Extended if it could be a permanent access road serving
the ajoining existing property owners exclusive of Lot 4. Mr. Stine's
contribution would be a one time thing and would be contingent upon favorable
action in this regard by the Board of Supervisors.
If a favorable response from the Board of Supervisors could be obtained
on a permanent access I would be willing to pay an equal share of an annual
maintenance fee for the road repairs and for snow removal.
Mr. Stine also advixed me today that he has been denied approval of his
proposed access road to be constructed from Brooke Drive to my Lot 5A. This
certainly complicated matters in my regard as the original plan was for this
road construction to coincide with my 18 month temporary access. Although
this has been extended 6 months, no permanent solution has been formulated.
In view of the fact that no traffic problems or accidents have been
caused by using Smithfield Avenue Extended, and no complaints or problems
other than maintenance, have been brought forward, I would like to make a
request for a permanent access through Smithfield Avenue Extended for Dawson
Investments.
I hope the above request can be acted upon favorably by the Board of
Supervisors. If this request is not acted on favorably} then I wish to request
that the access to Smithfield Avenue Extended be continued until another access
is completed whenever that may be.
Harris Intertype management is very concerned about the threats made by
Mr. Alfred Robinson to put a gate across the road closing it to traffic.
Although I have assured them that Mr. Stine has documents showing legal right
of way, Harris Intertype is still concerned and feels harrassed by these threats.
Mr. Langdon Gordon of the planning commission at the June 1979 meeting assured
me that they, the planning commission, would not shut off my access.
A fast and permanent solution to these problems would certainly be
appreciated. Please advise me when the next meeting takes place so I might
attend AM answer any questions which might arise. If you have any questions
prior to that time please give me a call.

When I discussed with former C.czunty Administrator, J. O. Renalds,
III, the action of the Frederick County Board of Supervisors in approv-
ing the temporary use of Smithfield Avenue Extended, by Dawson
Investments, it was my opinion, based on information he had provided
me plus additional information obtained in my discussion with him, that
the Board did have the authority to grant temporary use of this roadway
and to attach certain conditions to said use.
When the temporary use of this road expires in January of 1980, Dawson
Investments will have to make application to the Frederick County Board
o_f Supervisors to obtain new approval for the use of Smithfield Avenue
Extended. Of course, granting of the new use should be temporary and on
the same conditions as before plus any new conditions the Board feels
appropriate.
If you or any member of the Frederick County Engineering Committee
have any questions regarding this matter, I will be glad to discuss it with
you.

This confirms our conversation this week concerning interest express/by a local
firm in acquiring a 5 Acre site from Fort Collier. I have jade the client aware
of the recent action taken by the Board of Supervisors to defer any site ].n approval
until we have cleared the right of way for a second access to our park.
You. are aware of my recentcontacts with 1•�. Maker representing the Hughes Estate
which has title to a portion of the land upon which we are attempting to gain
a right of way. You had planned to give Ar. ia.ker a followup call and advise me
of his current position. I had then planned to call Ilh% Baker to= obtain a definite
answer so that we can proceed with clearing the right of way. 'r+e� have stressed to
Yx. Baker that the dedication of only a small area of land would enable us to
lay final plans for a roadway which would serve the Hughes property as well.
I am requesting that the Board allow me to discuss our current situation with them
at their meeting after next which would be September 26, 1979. This would allow
further time for us to resolve the matter with 1,1r. Baker and for the Board to consider:__
some other alternates. Among these. would be another access that would civent
the Hughes property and also the prospect of condemnation of only a small portion
located in the vicinity of the City/County line.
We are of course anxious to bring the matter to some conclusion as it is preventing
our normal course of business and delaying location of neir industry in the County
which is of benefit to all concerned. Thank you for your consideration.
