THIS DEED OF DEDICATION AND SUBDIVISION made this

and IRIS JOY FISH, his wife, hereinafter called Declarants.
WHEREAS, Raymond L. Fish and Iris Joy Fish, his wife, are
the owners in fee simple of a certain tract of land containing
16.00 Acres designated.as Tax Parcel 33-A((A))-146C, lying and
being situate along the East side of Interstate Route 81 and
the South side of Virginia Secondary Route 672 (Hopewell
Road), in Stonewall Magisterial District, Frederick County,
Virginia); and being a portion of the land acquired by Raymond
L. Fish, et ux, by deed dated April 13, 1992, and duly
recorded in the Office of the Clerk of the Circuit Court of
Frederick County, Virginia, in Deed Book 776, at Page 196; and
WHEREAS, Declarants desire to subdivide the same into two
(2) lots to be known as Tax Parcel Lots 33-((A))-164C (13.55
Acres) and 33-((A))-164F (1.9900 Acres) as shown on the plat
and survey drawn by Mark D. Smith, Land Surveyor, dated
January 16, 1997, revised December 19, 1997, and April 15,
1998, attached hereto and incorporated herein in full by this
reference; and
WHEREAS, the subdivision of said Tax Parcel Lots as shown
on the aforesaid plat is with the free consent and in
accordance with the desires of the undersigned owners.
NOW, THEREFORE, THIS DEED OF SUBDIVISION AND DEDICATION
WITNESSETH: That for and in consideration of the premises and
the benefits which will accrue by reason of this Deed of
Subdivision and Dedication, Declarants do subdivide those
certain lots designated Tax Parcel Lots 33-((A))-164C (13.55
Acres) and 33-((A))-164F (1.9900 Acres), as more fully set
forth on the plat attached hereto and referenced herein,

together with easements for drainage, storm water management,
utility, signage, grading, temporary access, ingress/egress
and septic as shown thereon and as hereinafter described.
DEDICATION: As provided by § 15.1-478, Code of Virginia
(1950), as amended, the recordation of this Deed of
Subdivision and Dedication with plat attached shall operate to
transfer in fee simple to the County of Frederick, Virginia,
the portion of the property containing 0.4598 acre as shown on
said plat and designated Hopewell Lane - 50' R/W; FURTHER,
said recordation shall operate to dedicate and transfer the
temporary cul-de-sac shown on said plat (to be extinguished,
however, upon street expansion).
EASEMENTS: Declarants hereby reserve unto themselves for
the benefit of the land herein subdivided, as well as other
adjacent land owned by Declarants, easements on, over and upon
all those portions of the land hereby subdivided which are
shaded, said easements being more particularly described as
follows:
1. DRAINAGE: To manage such drainage problems as may
exist on the subdivided land, whether originating thereon or
not.
2. STORM_WATER_MANAGEMENT: To manage such stormwater
problems as may exist on the subdivided land, whether
originating thereon or not.
3. UTILITY: To contain such public utility easements as
are required from time to time to serve the subdivided land.
4. SIGNAGE: To permit such signage servicing the
businesses on both the subdivided land and the adjacent land
of Declarants provided such signage is not in violation of
ordinances or regulations and provided further that such
sign(s) shall be located within that portion of the shaded

area situated at the Western side of the entrance of Hopewell
Lane from Hopewell Road lying Northeast of the straight line
marked "SIGN ESM'T" on said plat.
5. GRADING EASEMENT: Such easements for grading as may
be required in connection with the construction of Hopewell
Lane as shown on the attached plat.
6. TEMPORARY ACCESS EASEMENT: To benefit Lot

33-((A))-164C, which is to be extinguished upon completion of
street construction.
7. SEPTIC EASEMENT: Septic Easement as shown on the

attached plat extending from the Southwest corner of Lot
33-((A))-164F, to exist until such time as public sewer is

and terminate automatically without further act of the parties
or their successors in title.
8. INGRESS/EGRESS EASEMENT: An ingress/egress easement

adjoining land of Declarants as shown on the attached plat.
The foregoing subdivision and dedication is with the
approval of the County of Frederick, Virginia, as indicated on

Dear Dr. Fish:
I am returning the Irrevocable Letter of Credit Agreement submitted to our department on December
30, 1997. Upon review of the road plan pending approval by VDOT, a cost estimate of $35,000 was
determined to be sufficient by the County Engineer for the construction of the necessary road
improvements. Please provide us with a revised irrevocable letter of credit in this amount.

Dear Mark:
The final subdivision plat for Raymond L. Fish was received by this department on December 15,
1997. Upon review, it is evident that several issues must be resolved prior to final approval of this
subdivision plat. The most significant issue concerns the conformance of the subdivision with the
approved master development plan WP#005-95). All subdivisions must conform to the master
development plan approved for the land being subdivided.
Please revise the plat to identify the location of the road as shown on the approved master development
plan. The construction, or bonding, of the road to the limits of parcel 33-A-164F must occur with the
subdivision of this parcel. The addition of this road to the plat will necessitate an updated approval
from the.Virginia Department of Transportation. Also, the deed of dedication of this road to Frederick
County for public use must be reviewed and approved by the Subdivision Administrator prior to the
approval of the final plat.
In addition, please verify that the name chosen for the road is acceptable. This should be done through
Larry Phillips, Communication Center Supervisor. The final plat must also show the correct location of
the zoning district boundary and accurately depict the limits of the 100-year flood plain.

streets, curbing, gutter, sidewalks, above ground facilities,
underground utilities and facilities, recreational facilities,
drainage systems, designated open space and other required
improvements located in or on Kingdom Farm Project,
the approved subdivision or site plan. A statement signed by the
Zoning/Subdivision Administrator or his representative that:
"The drawing is for the explicit purpose of providing for the
completion or maintenance of a required facility or function
pursuant to the requirements of Chapter 144, Subdivision

Ordinance, and/or Chapter 165, Zoning Ordinance, of the Frederick
County Code and pursuant to the agreement of the Subdivider,
Developer, or his agent to comply with said ordinance as a
condition of the approval of the subdivision or site plan to the
satisfaction of the Zoning/Subdivision Administrator." We hereby
engage with drawers, endorsees and bona fide holders that all
drafts drawn in compliance with the terms of this credit shall be
duly honored upon presentation and delivery of the above
documents. This Irrevocable Letter of Credit shall remain in
full force and effect for a minimum of one (1) year from the date
hereof and shall be automatically extended for additional terms
of six (6) months from the present or future expiration dates,
unless sixty (60) days prior to such date or dates, the above
named bank or financial institution issuing the instrument,
notifies the County in writing by certified mail, that they elect
not to renew the instrument for such additional period. During
the last thirty (30) days while this Letter of Credit is in force
and effect after notice of termination has been given, the County
may draw up to the full amount of the sum when accompanied by a
document stating that Raymond L. Fish and Joy Fish have failed to
provide an acceptable substitute Irrevocable Letter of Credit or
deposit in escrow, and a document stating that "The drawing will

be held by the County for the sole purpose of providing for the
completion and/or maintenance of the site plan and/or subdivision
requirements to the satisfaction of the Zoning/Subdivision
Administrator or his authorized representative." This credit
shall be terminated upon the Zoning/Subdivision Administrator or
his authorized representative giving written release to
Raymond L. Fish and Joy Fish stating that they have
satisfactorily performed and fulfilled the obligations and
:requirements of the subject site plan or subdivision.

Dear Mark:
I offer the following comments in review of the subdivision plat:
1. Sheet 2 of 4:
Zoning classification line should match that of which is shown on the site development plan. (See
attached copy with approximate line drawing.)
2. Sheet 3 of 4:
Thirty-foot ingress/egress easement should be changed to 50 feet.
50' BRL setback from Hopewell Road should be changed to 35' BRL. BR Lines should be
