Copp Transportation resident Engineer JAC/vcz Cy: Mr. Kenneth Wakeman CCPY TO: —NiBD ORICHNAL.: F'(LE WE KEEP VIRGINIA MOVING Moved by Mr. Grubb , seconded by Mrs. Welsh , that WHEREAS, Section 33.1-221 of the Code of Virginia provides a fund to "...be expended by the Board for constructing, reconstructing, maintaining or improving access roads within counties, cities, and towns to industrial sites on which manufacturing, processing or other establishments will be built under firm contract or are already constructed and to licensed, public -use airports; " and WHEREAS, the Frederick County Board of Supervisors has, by appropriate resolution, requested Industrial Access Funds to serve Eastgate Industrial Park, located off Route 642, and said access is estimated to cost $228,500; and WHEREAS, it appears that this request falls within the intent of Section 33.1-221 and complies with the provisions of the Commonwealth Transportation Board's policy on industrial access. NOW, THEREFORE, BE IT RESOLVED that $228,500 of the 1999-2000 Fiscal Year Industrial, Airport and Rail Access Fund be allocated to provide adequate access to Eastgate Industrial Park, located in Frederick County, Project 0800-034-239, N501, contingent upon: 1. all necessary right of way, environmental assessments, and utility adjustments being provided at no cost to the Commonwealth; 2. the execution of an appropriate contractual agreement between the County of Frederick (County) and the Virginia Department of Transportation (VDOT), to provide for: a. the design, administration, construction, and maintenance of this project; b. the payment of all ineligible project costs, and of any eligible project costs in excess of this allocation, from sources other than the Industrial, Airport and Rail Access Fund; c. the provision of an appropriate bond or other acceptable surety device by the County to VDOT, not to expire before July 15, 2005. Such surety device shall provide for reimbursement to VDOT of any expenses incurred by the Industrial, Airport and Rail Access Fund for this project's construction not justified by the eligible capital outlay of industries served by tht project. If, by June 15, 2005, qualified industry has not expended or entered into a firm contract to expend at least $2,285,000 of eligible capital outlay on parcels served exclusively by this project, then an amount equal to 10% of up to $2,285,000 of eligible capital outlay will be credited toward the project's allocation. This surety may be released or reduced at an earlier date if qualified industry or industries have provided documentation of eligible capital outlay; and d. VDOT determining eligible capital outlay in accordance with current policy and procedure. 3. Addition of the existing portion of Rainville Road to the Secondary System of Highways. As you are aware, the final plats for the Home Depot site were approved on January 23, 2003; the site plan for the Home Depot project was approved January 29, 2003. A transportation element of the site plan provides for the construction of a road segment, to be accepted by the State, connecting Route 522 with the Home Depot site. This proposed road segment is named "Maranto Manor Drive" and it follows the same road (Beechwood Drive) illustrated on the approved Master Plan for Eastgate Commerce Center. In an effort to facilitate the subdivision approval establishing the proposed Home Depot lot, a segment of road illustrated on the Eastgate Commerce Center Master Plan between the currently planned terminus of Maranto Manor Drive and the connection to Rainville Road, was not dedicated nor guaranteed. Prior to any future development adjacent to Maranto Manor Drive, it is expected that the land owner will dedicate and provide the necessary guarantees for the remaining segment of roadway illustrated on the approved Master Plan.
