referred to as Grantors; Tots of Virginia Development
Corporation, a Virginia corporation, hereinafter referred to
as Grantee; and Joy H. Costello and Rhonda L. Keller,
hereinafter referred to as parties of the third part.
WITNESSETH: That for and in consideration of the
sum of Ten Dollars ($10.00) and other good and valuable
consideration, the receipt of all of which is hereby
acknowledged, the Grantors do hereby grant, bargain, sell and
convey with general warranty of title unto the Grantee, its
successors and assigns, the following described property and
appurtenances thereunto belonging:

The above parcel is a portion of the
same property acquired by the Grantors
herein by deeds dated March 31, 1986 and
November 2, 1987, recorded in the Office
of the Clerk of the Circuit Court of
Frederick County, Virginia, in Deed Book
613 at Page 331 and Deed Book 664 at Page
396, respectively.
Reference is here made to the aforesaid instruments
and the attachments and the references therein contained for a
further and more particular description of the property hereby
conveyed.
This conveyance is made subject to all duly recorded
and enforceable restrictions, easements and rights of way.
The Grantors covenant that they have a right to
convey said property to the Grantee; that they have done no

act to encumber said property; that they will execute such
further assurances of title to said property as may be
requisite; that they are seized in fee simple of the property
conveyed; and that the Grantee shall have quiet possession of

Rhonda L. Keller, wife of Douglas M. Keller, join in this deed
for the purpose of conveying all of their right, title and

This is in reference to the plat of the future Fairfax Drive to connect Fredericktowne with
Fredericktowne Estates that you submitted to me and asked for comments.
This will require a subdivision application since it is creating a new parcel. A deed of
dedication will be required since the newly created parcel will be a portion of a state
maintained roadway.
This subdivision application will need to go to both the Planning Commission and the Board
of Supervisors, since this is not a part of an approved master development plan.
It will be necessary in the review of this proposal to point out that this is a nonconforming
lot since it is zoned RP, is less than 100,000 square feet, and does not have public sewer and
water extended to the lot. The Planning Commission and/or the Board of Supervisors could
possibly require that the available public sewer and water be extended to this property.
The right side 10' BRL should be from the right of way and not from the property line.

necessity since the .2615 acre parcel for Fairfax Drive is
coming off of this tract. Lot 1 is Zoned RP and has an
existing dwelling on it.
The comments from VDOT concerning the 18' ingress/egress
easement must be addressed prior to putting this plat to
record. I have been advised by the developer's engineer that
the easement that exists in the street right of way will be
abandoned and permits for private entrances will be obtained
to keep the easement open for the residents that require its
use.

stipulation that the VDOT requirement is satisfied prior to
