RE: Dominion Knolls Site Inspection
Dear Mr. Jennings:
On Thursday, April 1, 2004, you and I visited the subject development for the purposes of noting any
remaining items to be completed prior to release of the construction guarantee. Frederick County currently
maintains the Letter of Credit amount at $280,000.00. During the site visit the following items must be
completed or obtained prior to release of the guarantee:
Written confirmation from Public Works that the storm water management system and soil
stabilization is adequate and in accordance with the approved subdivision plan. (I will personally
deliver this written request.)
All open space areas are to be adequately graded, stabilized and loose rocks removed, which will
leave said areas in a maintainable condition for the Dominion Knolls Homeowner's Association.
Completion of plantings of remaining trees in areas where the last house is being constructed and
various other areas along the perimeter of the development.
In the near future, I will have a discussion with the Homeowner's Association of Dominion Knolls and

RE: Subdivision #005-97 - Dominion Knolls, Approval of Section II
Dear Steve:
This letter is to confirm that the final plats for Dominion Knolls, Section II, were administratively
approved on July 29, 1999. Section II will contain twenty-five (25) single-family zero lot line lots with
an average lot size of 6,099 square feet. The development will continue to provide asphalt, curb and
gutter, sidewalks, street lighting, and landscape screening as required.
Frederick County currently holds a bond in the amount of $370,000.00 for the completion of the
improvements associated with the Dominion Knolls Subdivision recorded to date. This office has also
been provided with recorded copies of the final plats; therefore, no further action is required on the part
of the developer.

THIS DEED OF DEDICATION, made and dated this 17th day of June, 1999, by and
between PETER P. WEIDLEIN, Trustee, party of the first part, and COUNTY OF
FREDERICK, VIRGINIA, party of the second part, and C. S. JENNINGS CONSTRUCTION,
INC., a Virginia corporation, party of the third part..
WHEREAS, the party of the first part is the owner in fee simple of the real estate shown
on the attached plats drawn by P. Duane Brown, L.S. dated April 12, 1999, known as Dominion
Knolls, Section 2; and,
WHEREAS, said real estate, as shown on the aforesaid attached plats has been
subdivided into lots, which plats show the metes and bounds of the subdivided land, together
with the dimensions of each lot thereof and those certain drainage, open space, maintenance
easements, and buffer areas, and easements reserved for installation and maintenance of water
and sewer facilities for said lots; and,
WHEREAS, the parties hereto previously dedicated Section 1 of Dominion Knolls by
Deed of Dedication dated June 2, 1998 of record in the Office of the Clerk of the Circuit Court
of Frederick County, Virginia, in Deed Book 906, at Page 841 and also filed an Amended Deed
of Dedication dated September 1, 1998 of record in the aforementioned Clerk's Office in Deed
Book 915, at Page 245. Those aforementioned documents contained nine articles, which
included restrictions and covenants, definitions, membership, voting rights, property rights in
common properties, covenants for maintenance assessment for the association, easements, and
general reservations and other matters. It is the intent of the parties hereto to incorporate all of
those terms and conditions set forth in the Deed of Dedication dated June 2; 1998 and the
Amended Deed of Dedication dated June 1, 1998 of Section 1, Dominion Knolls so that they
may apply to Section 2 of Dominion Knolls.
NOW THEREFORE, THIS DEED OF DEDICATION WITNESSETH: That for and in
consideration and the benefits which accrue by reason of this Dedication, the party of the first
part does hereby subdivide that certain tract of land designated as Dominion Knolls, Section 2,
situate in Stonewall Magisterial District, Frederick County, Virginia, and being more

particularly described by the aforesaid plats of P. Duane Brown, L.S. dated April 12, 1999,
attached hereto and made a part hereof and by this reference incorporated herein as if set out in
full; and does hereby dedicate the streets and roadways shown thereon to Frederick County for
public use.
FURTHER, the parties hereto do hereby incorporate Articles I through IX, inclusive,
and all of terms and conditions contained therein of the Deed of Dedication dated June 2, 1998
of Dominion Knolls, Section 1 of record in the aforementioned Clerk's Office in Deed Book
906, at Page 841 and the terms and conditions of the Amended Deed of Dedication dated
September 1, 1998 of Dominion Knolls, Section 1 of record in Deed Book 915, at Page 245 so
that they apply to Dominion Knolls, Section 2.

Dear Steve:
Per your request, the following items must be addressed prior to gaining subdivision approval for Dominion
Knolls, Section II:
1. Improvements Guarantee. Please provide this office with an estimate of all required improvements
associated with Section II. Such estimate should include roads (curb/gutter/surface), water and sewer,
stormwater management facility, buffer and screening, street lighting and signs. Once we receive this
estimate, an appropriate guarantee amount will be determined.
2. Agency Approval Signatures. The Final Plat should be approved (contain approval signatures) of the
property owner, Engineer, Frederick County Sanitation Authority, and the Virginia Department of
Transportation.
Once these two items are addressed, provide the County with the final plats, the guarantee, and the deed
covenants for Section II approval.
I might also bring to your attention that the required landscape screening associated with Section I, has not been
completed Such landscape requirements should be completed within 30 days, or the Section I guarantee may
be utilizW so that the County may complete the Section I landscaping.
