Planning and Zoning:
Public Meeting Requirement
The Subdivision Ordinance requires that land divisions in the RP (Residential Performance) Zoning
District, without an approved master development plan, be presented to the Board of Supervisors for
final approval (§ 144-12-B). The Master Development Plan (MDP) requirement may be waived, and
has been waived for this project, based on the scale of the subdivision proposal. This project contains
land zoned RP, and does not contain an approved MDP; therefore, Board review and action is
necessary.
Staff Review
This 1.0282-acre parcel is zoned RP (Residential Performance), and is bounded by Front Royal Pike
(Route 522S) and Bentley Avenue. There is an existing residence. Bentley Avenue is the entrance
road into the Chapel Hill subdivision. Presently a private street, Bentley Avenue is being constructed
to state standards, and will be placed into the state road system in the near future. The applicant of
this subdivision is presently constructing Bentley Avenue and the Chapel Hill development.
The 1.0282-acre parcel currently contains one residence; the residence maintains an entrance onto
Front Royal Pike.
The proposed land division would create two lots; Lot 1 being 29,789 sq. ft. (containing the existing
residence), and Lot 2 of 15,000 sq. ft. Lot 1 would maintain an entrance onto Front Royal Pike,
while Lot 2 would gain access via Bentley Avenue. Lot 2 would be of comparable dimensions to the
lots within the adjacent Chapel Hill subdivision. Based on these lot sizes, no open space and
recreational amenities are required.
After a review of the agency comments, there do not appear to be any significant concerns regarding
this application.
STAFF RECOMMENDATION FOR 03/03/99 PLANNING COMMISSION MEETING:
Staff recommends approval of this subdivision application contingent upon the applicant's satisfying
all review agency comments.

PLANNING COMMISSION SUMMARY AND ACTION OF 03/03/99:
Members of the Commission had questions concerning the location of entrances for the proposed
lots, and whether the lots would be part of the existing Chapel Hill subdivision.
The applicant stated that Lot 2 would be accessed from Bentley Avenue, and would become part of
the Chapel Hill subdivision (covenants, HOA, etc.). The applicant further commented that Lot 1
would not be included in the Chapel Hill subdivision. Lot 1 currently has an entrance on Front Royal
Pike; the Commission asked that this access be eliminated, if possible.
By unanimous vote, the Planning Commission recommended approval of the subdivision contingent
on the applicant's satisfying all review agency comments, and including Lot 2 in the Chapel Hill
subdivision.

Attached is a preliminary plat that would establish a residential lot on Bentley Avenue. (FYI -
Bentley Avenue is part of the Chapel Hill subdivision off Route 522S).
I'm not sure if you recieved a request for this project, so bear with me....
The owner of this property is an elderly woman (72 years old, with Alzheimers and arthritis). She
has vacated the residence on the property as it was impossible for her to get up/down the stairs.
She is living in temporary quarters until this property is subdivided and sold. The sale is necessary
to fund her new residence, a ranch style home. No stairs to worry about... Jim Vickers has a
contract to purchase the established lot; he will make it part of the Chapel Hill subdivision.
The catch is Ms. Destifano desperately needs to complete the subdivision. Therefore, your
comments would be appreciated.. As the Chapel Hill development has water/sewer, I don't
imagine any barriers...... I've placed this project on the next PC agenda, to be mailed out
tomorrow. Therefore, I would appreciate it if you could provide me with a comment
ASAP .... Please fax it to my office.
