A field visit with you: in attendance was conducted and it was confirmed that the surface conditions of the open space is not satisfactory. Usable open space is a required amenity of this development and the current residents of this subdivision are unable to use it or have it properly maintained. Frederick County currently holds a Letter of Credit in the amount of $370,000.00 to guarantee the required. site improvements. The grading and soil stabilization for the open space must be completed within 60 days of the receipt of this letter. If it does not occur within this time frame, Frederick County will enforce the terms of the Letter of Credit at any time thereafter, by collecting the funds and ensuring the completion of this project. A number of mature trees have been protected along this buffer/screen area, and Mr. Jennings requests that the mature trees be included in the screening calculations. I walked the area and confer that the preserved hardwood trees would be included in the calculations. Determined that a single row of evergreens, 4-foot at time of planting continue to be required. The required decidiuos trees will be supplemented by existing hgardwoods.
