The Planning Department has received complaints regarding the condition of the open space in
Dominion Knolls Subdivision. A field visit with you: in attendance was conducted and it was
confirmed that the surface conditions of the open space is not satisfactory. Usable open space is a
required amenity of this development and the current residents of this subdivision are unable to use
it or have it properly maintained.
Frederick County currently holds a Letter of Credit in the amount of $370,000.00 to guarantee the
required. site improvements. The grading and soil stabilization for the open space must be completed
within 60 days of the receipt of this letter. If it does not occur within this time frame, Frederick
County will enforce the terms of the Letter of Credit at any time thereafter, by collecting the funds
and ensuring the completion of this project. If you have any questions, please feel free to call.

On August 16, 2002, VDOT accepted the construction on all right-of-way improvements
of the referenced development.
Attached is a copy of Information Needed for Subdivision Streets Prior to Acceptance
into the State's Secondary Road System. Items 1, 2, and 3 are needed at this time.
Once this information is received and on file in our office, an actual addition date can be
established along with the maintenance fee and one year surety bond amount
calculated. At that time a legal description will be forwarded to the Frederick County
Subdivision Administrator for the necessary Board of Supervisor's resolution.

SUBDIVISION STREETS INTO STATE SECONDARY SYSTEM
Subdivision streets may be considered eligible for acceptance into the State Secondary System
when:
• Built according to plans approved by the Department of
Transportation, properly maintained since completion and
• Rendering a public service [serving three (3)-occupied-&vellinIs or
three (3) businesses per street].

T AT LEAST THIRTY (30) DAYS PRIOR TO ADOPTION OF
THE RESOLUTION BY THE BOARD OF SUPERVISORS REQUESTING THE ADDITION:
1. Three (3) copies of as -built construction plans showing:
■ Roadway Geometrics
■ Drainage & Drainage Easements
2. Three (3) copies of the final plat with date & place of recordation,
deed book number and page number.
3. Signed permits covering all utilities, publicly or privately owned,
to occupy or cross the right-of-way and quitclaiming any prior
rights.
4. Bond to guarantee workmanship and performance of material for
one year from date of acceptance. (See reverse side for schedu'e.)
5. Maintenance Fee — check payable to the "Virginia Department of
Transportation". This fee is based on the length of the streets
involved from the date of acceptance to the end of the fiscal year
(June 30thh). No maintenance fee is required if the addition is
effective July 1st. (See reverse side for schedule.)
ADDITIONS WILL BE MADE EFFECTIVE ONLY ON THE FIRST OF THE MONTH.

This letter is to confirm that the above -referenced subdivision for Dominion Knolls, Section 3, was
administratively approved on February 26, 2001. Section 3 will contain 25 single-family lots (Zero
Lot Line) with an average lot size of 6,066 square feet. The development will be provided with:
asphalt, curb and gutter, sidewalks, street lights, and a landscape screening between the development
and Baker Lane and Fort Collier Road. As we have received the recorded plat and deed of
dedication, no further action is required on your part.

Met Chris Jennings on site to discuss the landscape buffer along the property's southern boundary
with the City of Winchester. A number of mature trees have been protected along this
buffer/screen area, and Mr. Jennings requests that the mature trees be included in the screening
calculations.
I walked the area and confer that the preserved hardwood trees would be included in the
calculations.
Determined that a single row of evergreens, 4-foot at time of planting continue to be required.
The required decidiuos trees will be supplemented by existing hgardwoods. We agreed that if a
space between the existing hardwoods exceeded 30 feet, then decidious trees should be installed
every 15 feet.

and between PETER P. WEIDLEIN, Trustee, party of the first part, and COUNTY OF
FREDERICK, VIRGINIA, party of the second part, and C. S. JENNINGS
CONSTRUCTION, INC., a Virginia Corporation, party of the third part.
WHEREAS, the party of the first part is the owner in fee simple of the real estate shown
on the attached plats drawn by P. Duane Brown, L.S., dated August 31, 2000, known as
Dominion Knolls, Section 3; and
WHEREAS, said real estate, as shown on the aforesaid attached plats has been
subdivided into lots, which plats show the metes and bounds of the subdivided land, together
with the dimensions of each lot thereof and those certain drainage, open space, maintenance
easements, and buffer areas, and easements reserved for installation and maintenance of water
and sewer facilities for said lots; and,
WHEREAS, the parties hereto previously dedicated Section 1 of Dominion Knolls by
Deed of Dedication dated June 2, 1998 of record in the Office of the Clerk of the Circuit Court
of Frederick County, Virginia, in Deed Book 906, at Page 841 and also filed an Amended Deed
of Dedication dated September 1, 1998 of record in the aforementioned Clerk's Office in Deed
Book 915, at Page 245. Those aforementioned documents contained nine articles, which
included restrictions and covenants, definitions, membership, voting rights, property rights in
common properties, covenants for maintenance assessment for the association, easements, and
general reservations and other matters. It is the intent of the parties hereto to incorporate all of
those terms and conditions set forth in the Deed of Dedication dated June 2, 1998 and the
Amended Deed of Dedication dated June 1, 1998 of Section 1, Dominion Knolls so that they
may apply to Section 3 of Dominion Knolls.
NOW THEREFORE, THIS DEED OF DEDICATION WITNESSETH: That for and in
consideration and the benefits which will accrue by reason of this Dedication, the party of the
first part does hereby subdivide all of that certain tract of land designated as Dominion Knolls,
Section 3, situate in Stonewall Magisterial District, Frederick County, Virginia, and being more
particularly described by the aforesaid plats of P. Duane Brown, L.S., dated August 31, 2000,
attached hereto and made a part hereof and by this reference incorporated herein as if set out in
full; and does hereby dedicate the streets and roadways shown to Frederick County for public
use.
FURTHER, the parties hereto do hereby incorporate Articles I through IX, inclusive,
