THIS DEED OF DEDICATION, made and dated this 26`s day of September, 2005, by and
between DOGWOOD LANDING, LLC, a Virginia Limited Liability Company, party of the first
part, hereinafter called the DECLARANT (Grantor for indexing purposes), and FREDERICK
COUNTY. VIRGINIA. party of the second part (Grantee for indexing purposes), and THE
FREDERICK COUNTY SANITATION AUTHORITY. party of the third part (Grantee for
indexing purposes), and ARTHUR TSIAMIS. Trustee, party of the fourth part (Grantor for
indexing purposes), and METRO FINANCE, L.L.C, party of the fifth part (Grantor for indexing
purposes).
WHEREAS, the DECLARANT is the owner in fee simple of the real estate shown on the
attached plat drawn by Cory M. Haynes, dated November 20, 2004, revised October 13, 2005,
known as Dogwood Village, which property is further described on the Final Master Development
Plan of Dogwood Village as filed in the Office of the County of Frederick Department of Planning
and Development. This is the same land conveyed to DOGWOOD LANDING, LLC, a Virginia
limited liability company, by Deed dated June 28, 2004 from T. W. Grove, Incorporated, a Virginia
corporation, of record in the Clerk's Office of the Circuit Court of Frederick County, Virginia, as
Instrument No. 04-0012161; and,
WHEREAS, said property is subject to a Deed of Trust dated May 5, 2005 from Dogwood
Landing, LLC to Arthur Tsiamis, Trustee, to secure a certain obligation to Metro Finance, L.L.C.,
of record in the aforesaid Clerk's Office as Instrument No. 05-0009634; and,
WHEREAS, said real estate, as shown on the aforesaid attached plat, has been subdivided
into lots for the construction of single family homes thereon, and the attached plat shows accurately
the metes and bounds of the subdivided land, together with the dimensions of each lot thereof and
also shows certain surrounding lands in said Subdivision to be used as common open space, storm
water detention easement, landscaping easements, access and driveway easements, sanitary sewer
easements, drainage easements, and utility easements over and across said lots, and further shows
a certain private street to be used by all lot owners in common which street is known as April
Avenue, and which common open space, driveway, access easements, and April Avenue shall be
owned and maintained by Dogwood Village Homeowners Association, Inc., upon the terms and
conditions set forth hereinafter; and,

WHEREAS, the DECLARANT now desires to subdivide the same into lots to be known N
as Dogwood Village, the subdivision of said real estate, as it now appears on the aforesaid attached
plat, is with the free consent and in accordance with the desires of the undersigned DECLARANT,
and the DECLARANT hereto further desires to subdivide the aforesaid real estate in accordance
with the provisions of"The Virginia Land Subdivision Act" as are applicable and in force and effect
as of the date of execution of this Deed of Dedication; and,
WHEREAS, the parties of the fourth and fifth part as Trustee and Beneficiary, respectively
of the aforesaid Deed of Trust, of record as Instrument No. 04-0012152, desire to express their
consent to the subdivision of the aforesaid tract of land.
NOW, THEREFORE, THIS DEED OF DEDICATION WITNESSETH:
That for and in consideration of the premises and the benefits which will accrue by reason of
this Dedication, the DECLARANT does hereby subdivide all of that certain tract or parcel of land
designated as Dogwood Village Subdivision, Lots I through 22, inclusive, lying and being situate
in Opequon Magisterial District, Frederick County, Virginia, and being more particularly described
by the aforesaid plat of Cory M. Haynes, dated November 20, 2004, revised October 13, 2005,
attached hereto and made a part hereof and by this reference incorporated herein as if set out in full,
and which plat is drawn in conformity with the final master development plan for Dogwood Village,
on file in the Office of the Frederick County Department of Planning and Development. The
derivation of title for the aforesaid land is as stated herein before in the recitals.
All of the lots shown on the plat attached hereto shall be subject to the Declaration of
Covenants, Conditions and Restrictions to be recorded contemporaneously with this Deed of
Dedication
The Dedication and Subdivision of the land as shown on the attached plat is with the free
consent and in accordance with the desire of the undersigned DECLARANT, Trustee and
Beneficiary of the land being subdivided, and is in conformity with the provisions of "The Virginia
Land Subdivision Act' as are applicable, together with the applicable ordinances and regulations of
the governing body of the County of Frederick, Virginia.

We've revised the plans per your comments of a couple of weeks ago. The changes are:
1. We've adjusted the lot lines to ensure the new walking trail to the park does lie in an easement.
2. We've revised the note on the swap of land to provide for donation of the land in the event of a problem
at the Interior Department.
3. We've added a typical planting plan for the lots on the landscaping plan.
4. We've clearly delineated on the Park buffer landscaping sheet that that plan is for landscaping design
only.
Finally, I'd like to address Mr. Davenport's comment regarding an easement on the Park. Please note, we are not
proposing any other improvements on the Park property than what is needed to extend the walking trail to the
existing trail. We understand that the Park will continue to maintain those facilities which lie on their property;
therefore we believe no easement is required. Further, the site currently discharges to the proposed point of
discharge; therefore again, we believe no easement is required.
We trust these comments and the plan revisions satisfy your concerns. Please let me know if you need additional
copies for signature.

The plans appear satisfactory and are approved. Please advise the developer accordingly. Please
provide six (6) sets of approved construction plans with signed seal for VDOT distribution.
I offer the following comments:
• A preconstruction conference be held by the engineer and/or developer with the attendance of
the contractor, various County agencies and VDOT prior to initiation of work.
• Materials used and method of construction shall apply to current observed VDOT Road &
Bridge Specifications applicable during construction of this development.
• Our review and comments are general in nature. Should conditions in the field exist such
that additional measures are warranted, such measures shall be completed to the satisfaction
of the Department prior to inclusion into the Secondary Road System.
• All drainage is to be carried within the right-of-way in ditch lines or gutters along the street to
a pipe or drainage easement.
• The contractor shall notify VDOT when work is to begin or cease for any undetermined
length of time. VDOT will also require 48 hours notice for inspections.

• The appropriate land use permits shall be obtained before any work is performed on the
State's right-of-way. The permit is issued by this office and will require a minimum
processing fee, surety bond coverage, and the salary & expenses of a State assigned Inspector.
• Private entrances will be installed in accordance with VDOT Standard CG-11 (at Route 277).
This is the developer's responsibility.
• Any entrances constructed from the referenced street(s) shall meet VDOT minimum
standards. This is the developer's responsibility.
• Any signs to be installed will be in accordance with attachments.
• I suggest any utilities and/or storm sewer placed within the proposed right-of-way be
backfilled completely with C.R. Type 21-B Stone. This will greatly reduce the possibility of
any pavement settlement.
• A copy of any/all RECORDED PLATS of dedication to public use (the County of
Frederick) for drainage easements or additional right-of-way required for implementation of
this proposed project should be provided for VDOT review prior to issuance of any land use
permit.

I offer the following comments:
• A preconstruction conference be held by the engineer and/or developer with the attendance of
the contractor, various County agencies and VDOT prior to initiation of work.
• Materials used and method of construction shall apply to current observed VDOT Road &
Bridge Specifications applicable during construction of this development.
• Our review and comments are general in nature. Should conditions in the field exist such
that additional measures are warranted, such measures shall be completed to the satisfaction
of the Department prior to inclusion into the Secondary Road System.
• All drainage is to be carried within the right-of-way in ditch lines or gutters along the street to
a pipe or drainage easement.

• The appropriate land use permits shall be obtained before any work is performed on the
State's right-of-way. The permit is issued by this office and will require a minimum
processing fee, surety bond coverage, and the salary & expenses of a State assigned Inspector.
• Private entrances will be installed in accordance with VDOT Standard CG-11 (at Route 277).
This is the developer's responsibility.
• Any entrances constructed from the referenced street(s) shall meet VDOT minimum
standards. This is the developer's responsibility.
• Any signs to be installed will be in accordance with attachments.
• I suggest any utilities and/or storm sewer placed within the proposed right-of-way be
backfilled completely with C.R. Type 21-B Stone. This will greatly reduce the possibility of
any pavement settlement.

I have had the opportunity to provide a second review of the subdivision design plan (SDP) for Dogwood Village
received by this office on June 22, 2004. 1 offer the following comments which remain unresolved from the first
review:
A drainage easement appears to be necessary on the Northern adjoiner.
The landscaping specified on the SDP remains incorrect. Refer to §165-65F(2) for the required
plantings. It is permissible to place some of the required plantings for each lot in an open space area.
However, each lot must have a majority of the required plantings. The full landscape plan should be
illustrated on one sheet. Sheet 10 of 14, prepared by others, does not conform to the proposed layout.
If you must separate the landscape elements on individual sheets, the subdivision layout must be
consistent from sheet to sheet. The SDP will not be approved until the plan sheets are consistent
throughout.
The proposed trail is to be located outside the boundaries of any residential lots.
Please revise and resubmit. In order to provide the most expedient review process, I recommend that you provide
responses to the previous review comments. If you have any questions, please feel free to call.

12'outbound right and 12' outbound Left to allow for smoother flowing access. A stop bar for
outbound traffic should be provided. Adjustment may be made for low fixed volume. However,

Upon review of the subject subdivision plan, we offer the following comments:
1) Sheet 1 of 12: It will be necessary to ensure that the notes under what the
developer shall provide reflect the revised erosion sediment control ordinance as
amended on December 10, 2003.
2) It will be necessary to advise the developer and ensure that they are aware of all
policies and procedures as outlined in the erosion and sediment control ordinance
as well as land disturbance permit application procedures.
3) The proposed drainage ditch XX located along the west side of the site shall be
placed in a platted drainage easement.
4) It will be necessary to ensure that all drainage ditches and channels have a
minimum slope of two (2) percent. Because sump pumps will be used to dewater
the areas around all units, the subdivision plan should reflect a means to avoid any
future drainage problems associated with development in the Martinsburg Shale
geology. It is possible to place the sump pumps in a dedicated drainage network
to prevent the rear of the lots frorn becoming saturated by the discharge of
groundwater. Lot 15 shall have a proper means to drain in the rear.
5) You have indicated DI-7 drop inlets for the stormwater structures. Specify the use
of a type III grate within the subdivision. Please note that the opening of a DI-7 is

wide enough to allow sorneone's foot to slip in which, in turn, could cause an
injury. Verify that all drop inlet structures are designed to convey a 100-year
storm event to ensure that the proposed units will not be impacted or flooded from
these storm events.
6) Because this is Frederick County, not Stafford County, provide the specified
design manual for our review. Frederick County is required to adhere to the
Erosion and Sediment Control law and Minimum Standard Six. However, you.
may apply for a variance to this requirement, but a review of the design manual
will be performed by Frederick County.
7) Justify why the pre -developed CN number for the site is 75 and the post -developed
CN for the site is 80. There should be a greater change in the runoff coefficient.
The existing site is currently vegetated with woods and high grass and the
proposed site is largely impervious.
