WEIDLEIN, Trustee, party of the first part, and COUNTY OF FREDERICK, VIRGINIA, of the second part, and C. S. JENNINGS CONSTRUCTION, INC., a Virginia corporation, party of the third part. WHEREAS, the party of the first part is the owner in fee simple of the real estate shown on the attached plats drawn by P. Duane Brown, L.S. dated April 6, 1998, known as Dominion Knolls, Section 1; and, WHEREAS, said real estate, as shown on the aforesaid attached plats has been subdivided into lots, which plats show the metes and bounds of the subdivided land, together with the dimensions of each lot thereof and those certain drainage, open space, maintenance easements, and buffer areas, and easements reserved for installation and maintenance of water and sewer facilities for said lots. NOW THEREFORE, THIS DEED OF DEDICATION WITNESSETH: That in consideration of the premises and the benefits which will accrue by reason of this Dedication, the party of the first part does hereby subdivide that certain tract of land designated as Dominion Knolls, Section 1, situate in Stonewall Magisterial District, Frederick County, Virginia, and being more particularly described by the aforesaid plats of P. Duane Brown, L.S. dated April 6, 1998, attached hereto and made a part hereof and by this reference incorporated herein as if set out in full; and does hereby dedicate the streets and roadways shown thereon to Frederick County for public use. RESTRICTI AONS AND COVENANTS All of the lots shown on the plats attached hereto shall be subject to the following restrictions and covenants, which are covenants running with the land, and shall be binding upon all parties having any right, title and interest in and to the aforesaid lots or any part thereof, their heirs, successors and assigns, and shall inure to the benefit of each owner thereof. BK906PG08Li2 1. The lots shall be used exclusively for residential purposes. No business or occupation of any kind, other than a "home occupation," shall be carried on or permitted on these lots. A home occupation is defined to be an occupation carried on by the occupant of a dwelling as a secondary use in connection with which there is no display and no one is employed other than the members of the family residing in the premises. No building shall be erected, altered, placed or permitted to remain on any lot other than one single family detached dwelling, garage and other approved structures for use solely by the occupants. Except for those related to real estate sales and construction, no sign, advertisement or message, other than for identification purposes only, shall be displayed or published which offers or implies commercial or professional services, or which may constitute any other kind of business solicitation in or from any residence or residential property. Notwithstanding the foregoing, Peter P. Weidlein, Trustee, or C. S. Jennings Construction, Inc. or its successors in interest, may, for a period not to exceed two (2) years from the date of this instrument, erect, maintain, and operate real estate sales and construction offices, model homes, displays and signs, and special lighting on any part of the property and on or any building or structure now or hereafter erected thereon while owned by Peter P. Weidlein, Trustee, or C. S. Jennings Construction, Inc. or it successors in interest. 2. No clothing, laundry, or wash shall be aired or dried at any time on the open space easements, as set forth below, nor on any portion of the lots in the area other than in the rear yard of the lots. Further, only one umbrella type clothesline will be allowed in the rear yard of any lot. J. No noxious or offensive activity shall be carried on upon any lot, nor shall anything be done or placed thereon which may become an annoyance or nuisance to the neighborhood. Owners shall, at all times, maintain their property and appurtenances thereto in good repair and in a state of neat appearance. All lawns shall be kept mowed and shall not be permitted to grow beyond a reasonable height. 4. No sign of any kind that is illuminated and/or larger than two square feet shall be displayed to the public view on any lot, except temporary real estate signs not more than 2 BK906PG08Li3 four square feet in area advertising the property for sale or rent, and except as provided elsewhere herein. No animals shall be kept or maintained on any lot except common household pets, such as dogs and cats, provided that they are not kept, bred or maintained for commercial purposes and do not create a nuisance or annoyance to surrounding lots nor the neighborhood and are in strict compliance with the applicable Frederick County Ordinances. Trash and garbage containers shall not be permitted to remain in public view, except on days of trash collection. No accumulation or storage of litter, new or used building materials, or trash of any kind, shall be permitted on any lot. 7. The exteriors of all structures, including walls, doors, windows and roofs, shall be kept in good maintenance and repair. No structure shall be permitted to stand with its exterior in an unfinished condition for longer than six months after the commencement of construction. In the event of fire, windstorm, or other damage, the exterior of no structure shall be permitted to remain in a damaged condition for longer than three months. No dwelling may be erected or maintained on any of said lots to have a ground floor space for ranch -type or singe story homes of less than 1000 square feet; two-story homes shall not have less than 650 square feet of main living area on the first floor; split foyer homes, cape cod homes and homes with one and one-half stories shall riot have less than 1000 square feet of main living area on the first floor, exclusive is any portion thereof used for garage, porch, patio, car port, basement and attic. Any garage, car port or car shelter constructed on said lot shall be attached to and be a part of the main structure. Peter P. Weidlein, Trustee, or C. S. Jennings Construction, Inc. reserves for themselves and their successors and interests the right to determine what structure is to be regarded as a two story dwelling. 9. No lot on the attached plats shall at any time be subdivided, conveyed, leased, nor sold except as a whole, unless such subdivision, conveyance, lease, or sale involves multiple lots so that each of the portions into which the lots are divided for the purpose of subdivision, conveyance, lease or sale results in the lots being created for the purpose of such after such subdivision, conveyance, lease or sale, being of a size larger than the lots as shown on the plats which is recorded 4eter P. Jennings Construction, Inc., however, for itself and its successors in interest, reserves the right to resubdivide any of the lots shown on the attached plats and to alter, amend and change any lot lines or subdivision plan so long as it owns any of said lots. 10. No fence, hedge or other visual barrier shall be erected or planted in the front yard of any lot shown on the attached plats, and no trees, hedge or shrub plantings shall be maintained anywhere on any lot in such a manner as to obstruct sight lines for vehicular traffic. Fencing of the backyards may include side yards, but may not extend beyond a line corresponding with the rear wall of the dwelling and extending to each side yard boundary. 11. No unlicensed, or uninspected, or inoperable, motor vehicles shall be parked, kept or maintained, on any lot or street within the subdivision. No tractor trailers, recreational vehicles, motor homes, or trucks larger than one ton may be parked on any lot or street within the subdivision. This includes, but is not limited to, moving vans, wreckers, hearses, buses, travel trailers, or camping equipment. Boats may be kept in the garage or in the rear yard if the boat is covered. No vehicle may be parked for a period greater than 60 days on any lot or any platted street as shown on the attached plats unless such vehicle bears a current valid Virginia inspection windshield sticker. Notwithstanding the foregoing, Peter P. Weidlein, Trustee, and C. S. Jennings Construction, Inc., or their successors in interest may, erect, maintain, and operate real estate sales and construction offices, model homes, displays, signs and special lighting on any part of the property and on or in any building or structure now or hereafter erected thereon. 12. No exterior antennas or satellite dishes shall be erected or placed on any lot or attached to any dwelling, except one satellite dish under two feet in diameter, shall be permitted. 13. All driveways located within the subdivision shall be on a hard surfaced material of either concrete or paved. Any parking areas shall also be concrete or paved. 14. All lots within this subdivision must be serviced by Frederick County Sanitation Authority or its successors for sewer and water service. 11 BK906PG0045 15. No trailers or temporary buildings shall be erected or maintained on any of the lots within the subdivision. No metal auxiliary/storage building shall be permitted on any lot. Only one auxiliary/storage building will be permitted in the rear year of any lot and must be of like material of the house on said lot. Exceptions would be for a wood sided auxiliary/storage building. 16. All lots are required to observe building restriction lines as indicated on the plats attached hereto, in addition to those applicable requirements of applicable Frederick County ordinances. 17. If in the construction of any dwelling by Peter P. Weidlein, Trustee, or C. S. Jennings Construction, Inc. there occurs an encroachment, the such encroachment shall be deemed a perpetual easement for the benefit of the dominant lot. 18. Peter P. Weidlein, Trustees, and C. S. Jennings Construction, Inc. reserve the right for itself and its successors in interest to waive any one or all of the restrictive covenants, conditions, reservations, or restrictions as to any or all lots, except that it cannot change the development from residential to commercial. This waiver shall not affect the binding effect of the covenants, restrictions, and conditions upon any other lots. Peter P. Weidlein, Trustee, or C. S. Jennings Construction, Inc. do further reserve the right for itself and its successors in interest to impose additional restrictive covenants, conditions, reservation, and restriction on any or all lots and such imposition shall not affect the binding effect of these provisions upon any other lots. The aforementioned provisions shall not apply to the construction or development of improvements on any lot by Peter P. Weidlein, "Trustee, or C. S. Jennings Construction, Inc. or its successors in interest, commencing within two (2) years from the date of submission of said lot to these restrictive covenants. 19. Any Dominion Knolls -Section 1 homeowner shall have the right to enforce, by a proceeding at law or in equity, all restrictions, covenants, and conditions now or hereafter imposed by the provisions of this deed. Failure of any homeowner to enforce any right, restriction, provision, condition, or covenants granted by this deed of dedication shall not 5 BK906PG0846 constitute a waiver of the right of such homeowner to enforce such right, restriction, provision, condition, or covenant in the future. 20. Invalidation of any one of these covenants or restrictions by judgment or court order shall in no way effect any other provisions, which shall remain in full force and effect. ARTICLE II OTHER RS The property dedicated hereby is subject to certain easements designated "Sewer Easement" on said attached plats, which easements are hereby dedicated for public use and access. Peter P. Weidlein, Trustee, and C. S. Jennings Construction, Inc. does hereby grant and convey unto the Frederick County Sanitation Authority perpetual easements for the installation and maintenance of water and sewer lines and any related facility on the easements designated on said plats as Sewer Easements. 2. The property dedicated hereby is subject to those certain easement or rights of way designated "Drainage Easement" on the aforesaid attached plats for the purpose of surface .water drainage easement, which easements are hereby dedicated for public use and access. No structures of any kind which substantially impede or obstruct the flow or ponding of surface drainage water may be placed within said surface water drainage easement designated on the aforesaid attached plats. Said surface water drainage easement may not be altered or modified without the proper consent of the County of Frederick, and Peter P. Weidlein, "Trustee, and C. S. Jennings Construction, Inc. do hereby grant and convey unto the County of Frederick a perpetual right of way or easement over the aforesaid designated surface drainage easements for the purpose of so providing surface drainage. Peter P. Weidlein, Trustee, and C. S. Jennings Construction, Inc. does further agree that Frederick County shall be under no obligation to maintain said drainage easements. No owner of any lot shall interfere with the natural drainage of surface water from such lot to the detriment of any other property shown on said plats. 3. Peter P. Weidlein, Trustee, or C. S. Jennings Construction, Inc. reserves unto itself, its successors or assigns, the right to erect, maintain, operate and replace underground R G�g06?G0841 and above ground telephone and electric light conduits, related equipment, and other facilities, sewer, gas, water and television lines and related equipment, and other utility equipment where such utility lines and equipment are now located and long a strip 10' along all boundary lines of each lot and along those areas intended for public access on the attached plats. In addition, there shall be service easements for each lot for all public utilities upon any of the lots shown which shall exist at the location of such utilities at the date each lot is conveyed or shall be located as such utilities are actually extended tot he individual lot after the call for connection by the lot owner. 4. The covenants and restrictions of this deed shall run with and bind the land, and shall inure to the benefit of and be enforceable by the owner of any lot subject to his deed and declaration, his legal representatives, heirs, successors an assigns, for a term of ten years from the date this deed of dedication is recorded, after which time said covenants shall be automatically extended for successive periods of ten years. The covenants and restrictions of this deed of dedication may be amended in whole or in part, provided that any such amendment during the first ten year period shall have the assent of not less than seventy-five percent of the lot owners, and thereafter any amendment shall have the assent of no less than sixty percent of the lot owners. Any amendment must be properly executed and acknowledged by the owners and recorded among the land records of Frederick County, Virginia. C. S. Jennings Construction, Inc. joins in this instrument as contract purchaser of the subject property herein. 1 FI ARTICLE Section 1. "Association" shall mean and refer to the Dominion Knolls Homeowners Association, Inc., a nonstock Virginia Corporation, its successors and assigns. The Associationi shall also apply to any future sections of Dominion Knolls. Section 2. "Common Areas" shall mean and refer to that certain real property described as open space, and such additions thereto as may hereafter be brought within the jurisdiction of the Corporation. 7 BK906Pv0848 Section 3. "Lot" shall mean and refer to any of the lots in Dominion Knolls --Section 1 and future sections designated upon any plats of the subdivision which includes Section I and future sections, with the exception of the open space defined as "Common Areas" hereinabove. Section 4. "Member" shall mean and refer to every person or entity who holds membership in the Association. Section 5. "Owner" shall mean and refer to the record owner, whether one or more persons or entitles, of a fee simple title to any Lot which is a part of the Dominion Knolls -- Section 1 as shown on the attached plats of P. Duane Brown, L.S., including contract sellers, but excluding those having such interest merely as security for the performance of an obligation. ARTICLEEIVNTEMB-ERI,P Every person or entity who is a record owner of a fee or undivided fee interest in any Lot which is subject by covenants of record to assessments by the Association, including contract sellers, shall be a member of the Association. The foregoing is not intended to include persons or entities who hold an interest merely as security for the performance of an obligation. Only one membership shall be accorded per Lot. Membership shall be appurtenant to and may not be separated from ownership of any Lot which is subject to assessment by the Association. Ownership of such Lot shall be the sole qualification for membership. ARTICLE V VOTING RIGHTS Each member of the Association shall have one vote for each lot owned in which said Member shall hold the interest required for membership in Article IV. When more than one person holds such interest in any Lot, all such persons shall be Members. The vote for such Lot shall be exercised as they among themselves determine, but in no event shall more than one vote be cast with respect to any Lot. BOARD OF DIRECTORS The affairs of the Association shall be managed by a Board of not less than three (3), but no more than seven (7) directors, who must be members of the Association. The initial M06PG0849 Board of Directors shall be appointed by the Association and serve until the first annual meeting following conveyance of the first Lot in Dominion Knolls --Section 1; thereafter, the Board of Directors shall be elected by the Membership as determined in the By Laws of the .Association. IyI DLW012117 The Treasurer of the Association shall be bonded, with the expense of such fidelity bond for said officer to be borne by the Association. ARTICLE VI PROPERTY RIGHTS IN CO ON PROPERTIES Section 1. Members' Easements of Enjoyment: Every Member shall have a right and easement of enjoyment in and to the "Common Areas," specifically including but not limited to the rights of ingress and egress across the aforesaid "Common Areas" and such easement shall be appurtenant to and shall pass with the title to every assessed Lot, subject to the following provisions: (a) The rights of the Association, in accordance with its Articles and ByLaws, to borrow money for the purpose of improving the aforesaid "Common Areas." The Association is further empowered, with the consent of at least two-thirds (2/3) of the members, to mortgage the area in said Subdivision designated as "Common Areas" to secure any such borrowed funds, but such mortgage shall be subordinate to the rights of the Homeowners hereunder. In computing the required vote of the members in connection with any such mortgage of the "Common Areas", the lots owned by the party of the first part shall not be included. All members shall be given notice of any such proposed mortgage of said "Common Areas" as set forth in Paragraph (c), infra. (b) The rights of the Association to suspend the voting rights and the right to the use of the ."Common Areas" by a Member for any period during which any assessment against his Lot remains unpaid; and for a period not to exceed thirty (30) days for any infraction of its published rules and regulations. (c) The rights of the Association to dedicate or transfer all or part of the "Common Areas" to any public agency, authority, or utility for such purposes and subject to such conditions as may be agreed to b the Members. No such dedication or transfer shall be effective unless an instrument signed by Members entitled to cast two-thirds (2/3) of the votes has been recorded agreeing to such dedication or transfer, and unless written notice of the proposed action is sent to every I BK906PG0850 member not less than twenty-five (25) days nor more than fifty (50) days in advance. Section 2. De_ legation of Use: Any Member may delegate, in accordance with the By Laws, his right of enjoyment to the "Common Areas" to the members of his family, his tenants, or contract purchasers who reside on the property. Section 3. Title to the "Common Areas". The party of the first part, or such other entity as is vested with title at the time of conveyance, hereby covenants that fee simple title to the open space (referred to hereinabove as "Common Areas") will be conveyed to the Association free and clear of all liens and encumbrances provided, further that the party of the first part shall not be required to convey the Common Areas at one given time, but rather may convey the same by multiple deeds at various times. ARTICLE VII COVENANTS MAINTENANCE ASSESSMENT FOR THE ASSOCIATION Section 1. Assessments: Each Owner of any Lot, by acceptance of a deed therefor, whether or not it shall be so expressed in any such deed or other conveyance, is deemed to covenant and agrees to payJo the Association (1) annual assessments or charges, and (2) special assessments for capital improvements, such assessments to be fixed, established and collected from time to time as hereinafter provided. The annual assessments and special assessments, together with such interest thereon and costs of collection thereof, as hereinafter provided, shall be a charge on the land and shall be a continuing lien upon the property against which each such assessment is made. Each such assessment, together with such interest, costs and reasonable attorney's fee, shall also be the personal obligation of the person who was the Owner of such property at the time when the assessment fee was due. The personal obligation shall not pass to his successors in title unless expressly assumed by them, but shall continue as a lien upon said lot as set forth hereinabove. Section 2. Purpose of Assessments: The assessments levied by the Association shall be used exclusively for the following purposes, to -wit: Improvements and maintenance of the "Common Areas", specifically including but not limited to, payment of real estate taxes, i[17 ov qwOBI repairs, maintenance and reps l6f drainage and detention facilities, maintenance and repair of street lights and payment of all utility charges therefor, maintenance and repair of utility and drainage easements, and further, for the purpose of promoting the recreation, health, safety and welfare of the residents in the "Common Areas" of Dominion Knolls --Section 1. Section 3. Basis and Maximum of Annual Assessments: Until January 1 of the year immediately following the conveyance of the first Lot to an Owner the maximum annual assessment shall be One Hundred Dollars ($ l 00.00) per Lot for all Lots of Dominion Knolls -- Section I and future sections. (a) The maximum annual assessment per Lot may be increased above that set forth hereinabove by a vote of the Members for the next succeeding year and at the end of each year's period, for each succeeding period of one year, provided that any such change shall have the assent of two-thirds (2/3) of the votes of Members who are voting in person or by proxy, at a meeting duly called for this purpose, written notice of which shall be sent to all Members not less than thirty (30) days nor more than sixty (60) days in advance of the meeting, setting forth the purpose of the meeting. The limitations hereof shall not apply to any change in the maximum and basis of the assessments undertaken as an incident to a merger or consolidation in which the Association is authorized to participate under its Articles of Incorporation. (b) After consideration of current maintenance costs and future needs of the Association, the Board of Directors may fix the annual assessments at an amount not in excess of the maximum. Section 4. Special Assessments for Capital Improvements: In addition to the annual assessments authorized above, the Association may levy in any assessment year a special assessment applicable to that year only, for the purpose of defraying, in whole or in part, the cost of any construction or reconstruction, unexpected repair or replacement of a described capital improvement upon the "Common Areas", specifically including but not limited to maintenance, repair and improvement of any Association -owned areas within said Subdivision, including the necessary fixtures and personal property related thereto, provided that any such assessment shall have the assent of two-thirds (2/3) of the votes of Members who are voting in EK9060GO852 person or by proxy at a meeting duly called for this purpose, written notice of which shall be sent to all Members not less than thirty (30) days nor more than sixty (60) days in advance of the meeting, setting forth the purposes of the meeting. Section 5. Quorum for any Action Authority Under Sections 3 and 4: At the first meeting called, as provided in Sections 3 and 4 hereof, the presence at a meeting of Members or of proxies entitled to cast sixty-seven percent (67%) of all votes shall constitute a quorum. If the required quorum is not forthcoming at any meeting, another meeting may be called, subject to the notice requirement set forth in Sections 3 and 4 and the required quorum at any such subsequent meeting shall be one-half (1/2) of the required quorum at the preceding meeting. No such subsequent meeting shall be held more than sixty (60) days following the preceding meeting. Section 6. Date of Commencement of Annual Assessments - DUE DATE: The amlual assessments provided for herein shall commence as to all Lots on the first day of the month following the incorporation of the Association. The first annual assessment shall be adjusted according to the nurnber of months remaining in the calendar year. The Board of Directors shall fix the amount of the annual assessment against each Lot at least thirty (30) days in advance of each annual assessment period. Written notice of the annual assessment shall be sent to every Owner subject thereto. The due dates shall be established by the Board of Directors. The Association shall, upon demand at any time, furnish a certificate in writing signed by an officer of the Association, setting forth whether the assessments on a specified Lot have been paid. A reasonable charge may be made by the Board for the issuance of these certificates. Such certificates shall be conclusive evidence of payment of any assessment therein stated to have been paid. Section 7. Effect of Non -Payment of Assessments: Remedies of the Association: Any assessments which are not paid when due shall be delinquent. If the assessments are not paid within thirty (30) days after the due date, the assessment shall bear interest from the date of delinquency at the rate of twelve percent (12%) per artnum, and the Association may bring an action at law against the Owner personally obligated to pay the same, or file a Notice of Lien 12 BK9O6PG0853 among the land records and foreclose said lien against the property, and interest, costs and reasonable attorney's fees on any such action shall be added to the amount of such assessment. No Owner may waive or otherwise escape liability for the assessments provided for herein by non-use of the "Common Areas" or abandonment of his Lot. Section 8. Subordination of the Lien to Mortgages: The lien of the assessments provided for herein shall be subordinated to the lien of any mortgage or mortgages now or hereafter encumbering any Lot. Sale or transfer of any Lot shall not affect the assessment lien. However, the same or transfer of any Lot which is subject to any mortgage, pursuant to a decree of foreclosure thereof, shall extinguish the lien of such assessments as to payments thereof which become due prior to such sale or transfer. No sale or transfers shall relieve such Lot from liability for any assessments thereafter becoming due from the lien thereof. Section 9. Exempt Property: The following property subject to this Declaration shall be exempt from the assessments created herein; (a) Any property owned by the Association; (b) All properties dedicated to and accepted by a local public authority; (c) Any and all lots owned by the parties of the first part and the third part, its successors or assigns except for out - conveyances to third party lot owners in the regular course of business and in which the party of' the first part has no legal interest; arid, (d) All properties owned by a charitable or non-profit organization exempt from taxation by the laws of the State of Virginia. However, no lot with a residence and occupied as a dwelling shall be exempt from these assessments. Section 10. Failure to Maintain "Common Areas": In the event that the Association, or its successors, shall fail to maintain the "Common Areas" in reasonable order and condition. the County of Frederick may take such action as authorized by the County of Frederick's applicable Ordinances. AAR�TICLE VIII Section 1. Public Utility and Drainage Easements: The property described hereby is, and shall be, subject to those certain easements or rights of way designated, or to be designated, as Drainage Easements, Gas Easements and Utility Easements on the plats of Dominion 13 BK906PG0854 Knolls --Section 1 that have been recorded or will be recorded (including the plat attached hereto). The party of the first part does hereby grant and convey unto the County of Frederick, Virginia, or other agency having jurisdiction thereof, a perpetual right of way or easement for the maintenance and repair of the aforesaid easements and any related facility designated on the aforesaid plats as Water Easements, Sanitary Sewer Easements, Gas Easements and Utility Easements. Section 2. Maintenance of Drainage Easements and Detention Areas: The maintenance of all drainage easements and detention areas located within the subdivision shall be maintained by the Association and in the event that said Association does not maintain said areas, and keep the same in good repair, then the party of the first part and/or Frederick County, as the case may be, may come upon said property and make necessary repairs and perform whatever maintenance is necessary with the cost of the same to be borne by the Association and in the event that said Association does not pay for said repairs and/or maintenance when billed, then said charge shall become a lien upon the property belonging to the Association. If requested, the Association, by the acceptance of a deed to the common areas, agrees to enter into any agreement absolving Frederick County of any and all liability with regard to said drainage easements and/or detention areas. Section 3. Reservations: (a) The party of the first part reserves unto itself, its successors or assigns, the right to erect, maintain, operate and replace underground telephone and electrical conduits, related equipment, and other facilities, sewer, gas, water and television lines and related equipment, and other utility equipment where such utility lines and equipment are located within the easements reserved herein or as set forth on the attached plats of P. Duane Brown, L.S. of Dominion Knolls --Section 1 and over the "Common Areas," as needed, provided that such easements shall not interfere with the use and enjoyment of the "Common Areas." (b) The party of the first part further reserves unto itself, its successors or assigns, for a period of five (5) years from the date hereof, a blanket easement and right on, over and under the ground within said Subdivision to maintain and correct drainage of surface water problems BK906PG0855 in order to maintain reasonable standards of health, safety and appearance. Such right expressly includes the right to cut any trees, bushes or shrubbery, make any grading of the soil or to take any other similar action reasonably necessary, following which the party of the first part shall restore the affected property to its original condition as near as practical. The party of the first part shall give reasonable notice of intent to take such action to all affected owners, unless in the opinion of the party of the first part an emergency exists which precludes such notice. Reservation by the party of the first part of such blanket easement and rights contained herein shall not, in any way, obligate the party of the first part to undertake any maintenance, repair or corrective action whatsoever and shall not impose any liability or responsibility upon the party of the first part therefore. WEIDLEIN, Trustee, party of the first part, and COUNTY OF FREDERICK, VIRGINIA, of the second part, and C. S. JENNINGS CONSTRUCTION, INC., a Virginia corporation, party of the third part. WHEREAS, the party of the first part is the owner in fee simple of the real estate shown on the attached plats drawn by P. Duane Brown, L.S. dated April 6, 1998, known as Dominion Knolls, Section 1; and, WHEREAS, said real estate, as shown on the aforesaid attached plats has been subdivided into lots, which plats show the metes and bounds of the subdivided land, together with the dimensions of each lot thereof and those certain drainage, open space, maintenance easements, and buffer areas, and easements reserved for installation and maintenance of water and sewer facilities for said lots. NOW THEREFORE, THIS DEED OF DEDICATION WITNESSETH: That in consideration of the premises and the benefits which will accrue by reason of this Dedication, the party of the first part does hereby subdivide that certain tract of land designated as Dominion Knolls, Section 1, situate in Stonewall Magisterial District, Frederick County, Virginia, and being more particularly described by the aforesaid plats of P. Duane Brown, L.S. dated April 6, 1998, attached hereto and made a part hereof and by this reference incorporated herein as if set out in full; and does hereby dedicate the streets and roadways shown thereon to Frederick County for public use. ARTICLE I RESTRICTIONS AN OVENANTS All of the lots shown on the plats attached hereto shall be subject to the following restrictions and covenants, which are covenants running with the land, and shall be binding upon all parties having any right, title and interest in and to the aforesaid lots or any part thereof, their heirs, successors and assigns, and shall inure to the benefit of each owner thereof. The lots shall be used exclusively for residential purposes. No business or occupation of any kind, other than a "home occupation," shall be carried on or permitted on these lots. A home occupation is defined to be an occupation carried on by the occupant of a dwelling as a secondary use in connection with which there is no display and no one is employed other than the members of the family residing in the premises. No building shall be erected, altered, placed or permitted to remain on any lot other than one single family detached dwelling, garage and other approved structures for use solely by the occupants. Except for those related to real estate sales and construction, no sign, advertisement or message, other than for identification purposes only, shall be displayed or published which offers or implies commercial or professional services, or which may constitute any other kind of business solicitation in or from any residence or residential property. Notwithstanding the foregoing, Peter P. Weidlein, Trustee, or C. S. Jennings Construction, Inc. or its successors in interest, may, for a period not to exceed two (2) years from the date of this instrument, erect, maintain, and operate real estate sales and construction offices, model homes, displays and signs, and special lighting on any part of the property and on or any building or structure now or hereafter erected thereon while owned by Peter P. Weidlein, Trustee, or C. S. Jennings Construction, Inc. or it successors in interest. 2. No clothing, laundry, or wash shall be aired or dried at any time on the open space easements, as set forth below, nor on any portion of the lots in the area other than in the rear yard of the lots. Further, only one umbrella type clothesline will be allowed in the rear yard of any lot. 3. No noxious or offensive activity shall be carried on upon any lot, nor shall anything be done or placed thereon which may become an annoyance or nuisance to the neighborhood. Owners shall, at all times, maintain their property and appurtenances thereto in good repair and in a state of neat appearance. All lawns shall be kept mowed and shall not be permitted to grow beyond a reasonable height. 4. No sign of any kind that is illuminated and/or larger than two square feet shall be displayed to the public view on any lot, except temporary real estate signs not more than four square feet in area advertising the property for sale or rent, and except as provided elsewhere herein. 5. No animals shall be kept or maintained on any lot except common household pets, such as dogs and cats, provided that they are not kept, bred or maintained for commercial purposes and do not create a nuisance or annoyance to surrounding lots nor the neighborhood and are in strict compliance with the applicable Frederick County Ordinances. 6. Trash and garbage containers shall not be permitted to remain in public view, except on days of trash collection. No accumulation or storage of litter, new or used building materials, or trash of any kind, shall be permitted on any lot. 7. The exteriors of all structures, including walls, doors, windows and roofs, shall be kept in good maintenance and repair. No structure shall be permitted to stand with its exterior in an unfinished condition for longer than six months after the commencement of construction. In the event of fire, windstorm, or other damage, the exterior of no structure shall be permitted to remain in a damaged condition for longer than three months. 8. No dwelling may be erected or maintained on any of said lots to have a ground floor space for ranch -type or singe story homes of less than 1000 square feet; two-story homes shall not have less than 650 square feet of main living area on the first floor; split foyer homes, cape cod homes and homes with one and one-half stories shall not have less than 1000 square feet of main living area on the first floor, exclusive is any portion thereof used for garage, porch, patio, car port, basement and attic. Any garage, car port or car shelter constructed on said lot shall be attached to and be a part of the main structure. Peter P. Weidlein, Trustee, or C. S. Jennings Construction, Inc. reserves for themselves and their successors and interests the right to determine what structure is to be regarded as a two story dwelling. 9. No lot on the attached plats shall at any time be subdivided, conveyed, leased, nor sold except as a whole, unless such subdivision, conveyance, lease, or sale involves multiple lots so that each of the portions into which the lots are divided for the purpose of subdivision, conveyance, lease or sale results in the lots being created for the purpose of such after such subdivision, conveyance, lease or sale, being of a size larger than the lots as shown on -the plats which is recorded with this instrument. Peter P. Weidlein, Trustee, or C. S. Jennings Construction, Inc., however, for itself and its successors in interest, reserves the right to resubdivide any of the lots shown on the attached plats and to alter, amend and change any lot lines or subdivision plan so long as it owns any of said lots. 10. No fence, hedge or other visual barrier shall be erected or planted in the front yard of any lot shown on the attached plats, and no trees, hedge or shrub plantings shall be maintained anywhere on any lot in such a manner as to obstruct sight lines for vehicular traffic. Fencing of the backyards may include side yards, but may not extend beyond a line corresponding with the rear wall of the dwelling and extending to each side yard boundary. 11. No unlicensed, or uninspected, or inoperable, motor vehicles shall be parked, kept or maintained, on any lot or street within the subdivision. No tractor trailers, recreational vehicles, motor homes, or trucks larger than one ton may be parked on any lot or street within the subdivision. This includes, but is not limited to, moving vans, wreckers, hearses, buses, travel trailers, or camping equipment. Boats may be kept in the garage or in the rear yard if the boat is covered. No vehicle may be parked for a period greater than 60 days on any lot or any platted street as shown on the attached plats unless such vehicle bears a current valid Virginia inspection windshield sticker. Notwithstanding the foregoing, Peter P. Weidlein, Trustee, and C. S. Jennings Construction, Inc., or their successors in interest may, erect, maintain, and operate real estate sales and construction offices, model homes, displays, signs and special lighting on any part of the property and on or in any building or structure now or hereafter erected thereon. 12. No exterior antennas or satellite dishes shall be erected or placed on any lot or attached to any dwelling, except one satellite dish under two feet in diameter, shall be permitted. 13. All driveways located within the subdivision shall be on a hard surfaced material of either concrete or paved. Any parking areas shall also be concrete or paved. 14. All lots within this subdivision must be serviced by Frederick County Sanitation Authority or its successors for sewer and water service. .19 15. No trailers or temporary buildings shall be erected or maintained on any of the lots within the subdivision. No metal auxiliary/storage building shall be permitted on any lot. Only one auxiliary/storage building will be permitted in the rear year of any lot and must be of like material of the house on said lot. Exceptions would be for a wood sided auxiliary/storage building. 16. All lots are required to observe building restriction lines as indicated on the plats attached hereto, in addition to those applicable requirements of applicable Frederick County ordinances. 17. If in the construction of any dwelling by Peter P. Weidlein, Trustee, or C. S. Jennings Construction, Inc. there occurs an encroachment, the such encroachment shall be deemed a perpetual easement for the benefit of the dominant lot. 18. Peter P. Weidlein, Trustees, and C. S. Jennings Construction, Inc. reserve the right for itself and its successors in interest to waive any one or all of the restrictive covenants, conditions, reservations, or restrictions as to any or all lots, except that it cannot change the development from residential to commercial. This waiver shall not affect the binding effect of the covenants, restrictions, and conditions upon any other lots. Peter P. Weidlein, Trustee, or C. S. Jennings Construction, Inc. do further reserve the right for itself and its successors in interest to impose additional restrictive covenants, conditions, reservation, and restriction on any or all lots and such imposition shall not affect the binding effect of these provisions upon any other lots. The aforementioned provisions shall not apply to the construction or development of improvements on any lot by Peter P. Weidlein, Trustee, or C. S. Jennings Construction, Inc. or its successors in interest, commencing within two (2) years from the date of submission of said lot to these restrictive covenants. 19. Any Dominion Knolls -Section 1 homeowner shall have the right to enforce, by a proceeding at law or in equity, all restrictions, covenants, and conditions now or hereafter imposed by the provisions of this deed. Failure of any homeowner to enforce any right, restriction, provision, condition, or covenants granted by this deed of dedication shall not 5 constitute a waiver of the right of such homeowner to enforce such right, restriction, provision, condition, or covenant in the future. 20. Invalidation of any one of these covenants or restrictions by judgment or court order shall in no way effect any other provisions, which shall remain in full force and effect. ARTICLE II OTHER RS The property dedicated hereby is subject to certain easements designated "Sewer Easement" on said attached plats, which easements are hereby dedicated for public use and access. Peter P. Weidlein, Trustee, and C. S. Jennings Construction, Inc. does hereby grant and convey unto the Frederick County Sanitation Authority perpetual easements for the installation and maintenance of water and sewer lines and any related facility on the easements designated on said plats as Sewer Easements. 2. The property dedicated hereby is subject to those certain easement or rights of way designated "Drainage Easement" on the aforesaid attached plats for the purpose of surface water drainage easement, which easements are hereby dedicated for public use and access. No structures of any kind which substantially impede or obstruct the flow or ponding of surface drainage water may be placed within said surface water drainage easement designated on the aforesaid attached plats. Said surface water drainage easement may not be altered or modified without the proper consent of the County of Frederick, and Peter P. Weidlein, Trustee, and C. S. Jennings Construction, Inc. do hereby grant and convey unto the County of Frederick a perpetual right of way or easement over the aforesaid designated surface drainage easements for the purpose of so providing surface drainage. Peter P. Weidlein, Trustee, and C. S. Jennings Construction, Inc. does further agree that Frederick County shall be under no obligation to maintain said drainage easements. No owner of any lot shall interfere with the natural drainage of surface water from such lot to the detriment of any other property shown on said plats. 3. Peter P. Weidlein, Trustee, or C. S. Jennings Construction, Inc. reserves unto itself, its successors or assigns, the right to erect, maintain, operate and replace underground 0 and above ground telephone and electric light conduits, related equipment, and other facilities, sewer, gas, water and television lines and related equipment, and other utility equipment where such utility lines and equipment are now located and long a strip 10' along all boundary lines of each lot and along those areas intended for public access on the attached plats. In addition, there shall be service easements for each lot for all public utilities upon any of the lots shown which shall exist at the location of such utilities at the date each lot is conveyed or shall be located as such utilities are actually extended tot he individual lot after the call for connection by the lot owner. 4. The covenants and restrictions of this deed shall run with and bind the land, and shall inure to the benefit of and be enforceable by the owner of any lot subject to his deed and declaration, his legal representatives, heirs, successors an assigns, for a term of ten years from the date this deed of dedication is recorded, after which time said covenants shall be automatically extended for successive periods of ten years. The covenants and restrictions of this deed of dedication may be amended in whole or in part, provided that any such amendment during the first ten year period shall have the assent of not less than seventy-five percent of the lot owners, and thereafter any amendment shall have the assent of no less than sixty percent of the lot owners. Any amendment must be properly executed and acknowledged by the owners and recorded among the land records of Frederick County, Virginia. 5. C. S. Jennings Construction, Inc. joins in this instrument as contract purchaser of the subject property herein. ARTICLE III DEFINITMNS Section 1. "Association" shall mean and refer to the Dominion Knolls Homeowners Association, Inc., a nonstock Virginia Corporation, its successors and assigns. The Association shall also apply to any future sections of Dominion Knolls. Section 2. "Common Areas" shall mean and refer to that certain real property described as open space, and such additions thereto as may hereafter be brought within the jurisdiction of the Corporation. Section 3. "Lot" shall mean and refer to any of the lots in Dominion Knolls --Section 1 and future sections designated upon any plats of the subdivision which includes Section 1 and future, sections, with the exception of the open space defined as "Common Areas" hereinabove. Section 4. "Member" shall mean and refer to every person or entity who holds membership in the Association. Section 5. "Owner" shall mean and refer to the record owner, whether one or more persons or entitles, of a fee simple title to any Lot which is a part of the Dominion Knolls -- Section 1 as shown on the attached plats of P. Duane Brown, L.S., including contract sellers, but excluding those having such interest merely as security for the performance of an obligation. ARTICLE IV Every person or entity who is a record owner of a fee or undivided fee interest in any Lot which is subject by covenants of record to assessments by the Association, including contract sellers, shall be a member of the Association. The foregoing is not intended to include persons or entities who hold an interest merely as security for the performance of an obligation. Only one membership shall be accorded per Lot. Membership shall be appurtenant to and may not be separated from ownership of any Lot which is subject to assessment by the Association. Ownership of such Lot shall be the sole qualification for membership. ARTICLE V VOTING RTGHTS Each member of the Association shall have one vote for each lot owned in which said Member shall hold the interest required for membership in Article IV. When more than one person holds such interest in any Lot, all such persons shall be Members. The vote for such Lot shall be exercised as they among themselves determine, but in no event shall more than one vote be cast with respect to any Lot. BOARD OF DIRECTORS The affairs of the Association shall be managed by a Board of not less than three (3), but no more than seven (7) directors, who must be members of the Association. The initial Board of Directors shall be appointed by the Association and serve until the first annual meeting following conveyance of the first Lot in Dominion Knolls --Section 1; thereafter, the Board of Directors shall be elected by the Membership as determined in the By Laws of the Association. TREASURER The Treasurer of the Association shall be bonded, with the expense of such fidelity bond for said officer to be borne by the Association. ARTICLE VI PROPERTY RIGHTS IN CO ON PROPERTIES Section 1. Members' Easements of Enjoyment: Every Member shall have a right and easement of enjoyment in and to the "Common Areas," specifically including but not limited to the rights of ingress and egress across the aforesaid "Common Areas" and such easement shall be appurtenant to and shall pass with the title to every assessed Lot, subject to the following provisions: (a) The rights of the Association, in accordance with its Articles and ByLaws, to borrow money for the purpose of improving the aforesaid "Common Areas." The Association is further empowered, with the consent of at least two-thirds (2/3) of the members, to mortgage the area in said Subdivision designated as "Common Areas" to secure any such borrowed funds, but such mortgage shall be subordinate to the rights of the Homeowners hereunder. In computing the required vote of the members in connection with any such mortgage of the "Common Areas", the lots owned by the party of the first part shall not be included. All members shall be given notice of any such proposed mortgage of said "Common Areas" as set forth in Paragraph (c), infra. (b) The rights of the Association to suspend the voting rights and the right to the use of the "Common Areas" by a Member for any period during which any assessment against his Lot remains unpaid; and for a period not to exceed thirty (30) days for any infraction of its published rules and regulations. (c) The rights of the Association to dedicate or transfer all or part of the "Common Areas" to any public agency, authority, or utility for such purposes and subject to such conditions as may be agreed to by the Members. No such dedication or transfer shall be effective unless an instrument signed by Members entitled to cast two-thirds (2/3) of the votes has been recorded agreeing to such dedication or transfer, and unless written notice of the proposed action is sent to every 0 member not less than twenty-five (25) days nor more than fifty (50) days in advance. Section 2. Delegation of Use: Any Member may delegate, in accordance with the By Laws, his right of enjoyment to the "Common Areas" to the members of his family, his tenants, or contract purchasers who reside on the property. Section 3. Title to the "Common Areas". The party of the first part, or such other entity as is vested with title at the time of conveyance, hereby covenants that fee simple title to the open space (referred to hereinabove as "Common Areas") will be conveyed to the Association free and clear of all liens and encumbrances provided, further that the party of the first part shall not be required to convey the Common Areas at one given time, but rather may convey the same by multiple deeds at various times. ARTICLE VII COVENANTS MAINTENANCE ASSESSMENT FOR THE ASSOCIATION Section 1. Assessments: Each Owner of any Lot, by acceptance of a deed therefor, whether or not it shall be so expressed in any such deed or other conveyance, is deemed to covenant and agrees to pay to the Association (1) annual assessments or charges, and (2) special assessments for capital improvements, such assessments to be fixed, established and collected from time to time as hereinafter provided. The annual assessments and special assessments, together with such interest thereon and costs of collection thereof, as hereinafter provided, shall be a charge on the land and shall be a continuing lien upon the property against which each such assessment is made. Each such assessment, together with such interest, costs and reasonable attorney's fee, shall also be the personal obligation of the person who was the Owner of such property at the time when the assessment fee was due. The personal obligation shall not pass to his successors in title unless expressly assumed by them, but shall continue as a lien upon said lot as set forth hereinabove. Section 2. Purpose of Assessments: The assessments levied by the Association shall be used exclusively for the following purposes, to -wit: Improvements and maintenance of the "Common Areas", specifically including but not limited to, payment of real estate taxes, 10 repairs, maintenance and repair of drainage and detention facilities, maintenance and repair of street lights and payment of all utility charges therefor, maintenance and repair of utility and drainage easements, and further, for the purpose of promoting the recreation, health, safety and welfare of the residents in the "Common Areas" of Dominion Knolls --Section 1. Section 3. Basis and Maximum of Annual Assessments: Until January 1 of the year immediately following the conveyance of the first Lot to an Owner the maximum annual assessment shall be One Hundred Dollars ($100.00) per Lot for all Lots of Dominion Knolls -- Section 1 and future sections. (a) The maximum annual assessment per Lot may be increased above that set forth hereinabove by a vote of the Members for the next succeeding year and at the end of each year's period, for each succeeding period of one year, provided that any such change shall have the assent of two-thirds (2/3) of the votes of Members who are voting in person or by proxy, at a meeting duly called for this purpose, written notice of which shall be sent to all Members not less than thirty (30) days nor more than sixty (60) days in advance of the meeting, setting forth the purpose of the meeting. The limitations hereof shall not apply to any change in the maximum and basis of the assessments undertaken as an incident to a merger or consolidation in which the Association is authorized to participate under its Articles of Incorporation. (b) After consideration of current maintenance costs and future needs of the Association, the Board of Directors may fix the annual assessments at an amount not in excess of the maximum. Section 4. Special Assessments for Capital Improvements: In addition to the annual assessments authorized above, the Association may levy in any assessment year a special assessment applicable to that year only, for the purpose of defraying, in whole or in part, the cost of any construction or reconstruction, unexpected repair or replacement of a described capital improvement upon the "Common Areas", specifically including but not limited to maintenance, repair and improvement of any Association -owned areas within said Subdivision, including the necessary fixtures and personal property related thereto, provided that any such assessment shall have the assent of two-thirds (2/3) of the votes of Members who are voting in person or by proxy at a meeting duly called for this purpose, written notice of which shall be sent to all Members not less than thirty (30) days nor more than sixty (60) days in advance of the meeting, setting forth the purposes of the meeting. Section 5. Quorum for any Action Authority Under Sections 3 and 4: At the first meeting called, as provided in Sections 3 and 4 hereof, the presence at a meeting of Members or of proxies entitled to cast sixty-seven percent (67%) of all votes shall constitute a quorum. If the required quorum is not forthcoming at any meeting, another meeting may be called, subject to the notice requirement set forth in Sections 3 and 4 and the required quorum at any such subsequent meeting shall be one-half (1/2) of the required quorum at the preceding meeting. No such subsequent meeting shall be held more than sixty (60) days following the preceding meeting. Section 6. Date of Commencement of Annual Assessments - DUE DATE: The annual assessments provided for herein shall commence as to all Lots on the first day of the month following the incorporation of the Association. The first annual assessment shall be adjusted according to the number of months remaining in the calendar year. The Board of Directors shall fix the amount of the annual assessment against each Lot at least thirty (30) days in advance of each annual assessment period. Written notice of the annual assessment shall be sent to every Owner subject thereto. The due dates shall be established by the Board of Directors. The Association shall, upon demand at any time, furnish a certificate in writing signed by an officer of the Association, setting forth whether the assessments on a specified Lot have been paid. A reasonable charge may be made by the Board for the issuance of these certificates. Such certificates shall be conclusive evidence of payment of any assessment therein stated to have been paid. Section 7. Effect of Non -Payment of Assessments: Remedies of the Association: Any assessments which are not paid when due shall be delinquent. If the assessments are not paid within thirty (30) days after the due date, the assessment shall bear interest from the date of delinquency at the rate of twelve percent (12%) per annum, and the Association may bring an action at law against the Owner personally obligated to pay the same, or file a Notice of Lien 12 among the land records and foreclose said lien against the property, and interest, costs and reasonable attorney's fees on any such action shall be added to the amount of such assessment. No Owner may waive or otherwise escape liability for the assessments provided for herein by non-use of the "Common Areas" or abandonment of his Lot. Section 8. Subordination of the Lien to Mort aces: The lien of the assessments provided for herein shall be subordinated to the lien of any mortgage or mortgages now or hereafter encumbering any Lot. Sale or transfer of any Lot shall not affect the assessment lien. However, the same or transfer of any Lot which is subject to any mortgage, pursuant to a decree of foreclosure thereof, shall extinguish the lien of such assessments as to payments thereof which become due prior to such sale or transfer. No sale or transfers shall relieve such Lot from liability for any assessments thereafter becoming due from the lien thereof. Section 9. Exempt Property: The following property subject to this Declaration shall be exempt from the assessments created herein; (a) Any property owned by the Association; (b) All properties dedicated to and accepted by a local public authority; (c) Any and all lots owned by the parties of the first part and the third part, its successors or assigns except for out - conveyances to third party lot owners in the regular course of business and in which the party of the first part has no legal interest; and, (d) All properties owned by a charitable or non-profit organization exempt from taxation by the laws of the State of Virginia. However, no lot with a residence and occupied as a dwelling shall be exempt from these assessments. Section 10. Failure to Maintain "Common Areas": In the event that the Association, or its successors, shall fail to maintain the "Common Areas" in reasonable order and condition, the County of Frederick may take such action as authorized by the County of Frederick's applicable Ordinances. ARTICLE VIII EASEMENW Section 1. Public Utility and Drainage Easements: The property described hereby is, and shall be, subject to those certain easements or rights of way designated, or to be designated, as Drainage Easements, Gas Easements and Utility Easements on the plats of Dominion 13 Knolls --Section 1 that have been recorded or will be recorded (including the plat attached hereto). The party of the first part does hereby grant and convey unto the County of Frederick, Virginia, or other agency having jurisdiction thereof, a perpetual right of way or easement for the maintenance and repair of the aforesaid easements and any related facility designated on the aforesaid plats as Water Easements, Sanitary Sewer Easements, Gas Easements and Utility Easements. Section 2. Maintenance of Drainage Easements and Detention Areas: The maintenance of all drainage easements and detention areas located within the subdivision shall be maintained by the Association and in the event that said Association does not maintain said areas, and keep the same in good repair, then the party of the first part and/or Frederick County, as the case may be, may come upon said property and make necessary repairs and perform whatever maintenance is necessary with the cost of the same to be borne by the Association and in the event that said Association does not pay for said repairs and/or maintenance when billed, then said charge shall become a lien upon the property belonging to the Association. If requested, the Association, by the acceptance of a deed to the common areas, agrees to enter into any agreement absolving Frederick County of any and all liability with regard to said drainage easements and/or detention areas. Section 3. Reservations: (a) The party of the first part reserves unto itself, its successors or assigns, the right to erect, maintain, operate and replace underground telephone and electrical conduits, related equipment, and other facilities, sewer, gas, water and television lines and related equipment, and other utility equipment where such utility lines and equipment are located within the easements reserved herein or as set forth on the attached plats of P. Kiracofe Fire Marshal I have completed my review of the Subdivision plan submittal for Dominion Knolls, proposed for construction, in the area of Baker Lane and Ft. Collier Rd. The Fire and Rescue Dept. recommends approval of the subdivision plan, but I would like to request further thought and discussion to one aspect of the plan, that being the construction of a 6' board fence along the rear of the lots on the south side of the property. Most of the existing homes in Briarcliff Subdivision, (City of Winchester) that back up to the proposed Dominion Knolls Subdivision, have fenced back yards with various types of fencing. Placing a 6' fence parallel to the existing fences, for the entire length of the Dominion Knolls property is going to create in essence a "no -mans land", that will not be maintained, will become a dumping area for brush, weeds, and other debris, and will be an attractive area for juvenile fire setting activities. Such fires have been experienced again and again in subdivisions throughout Frederick County, in areas such as the one being designed here. Another factor that makes this less than desirable for the Fire Dept. is the inaccessibility to the area. Fires typically have a chance to become larger, due to the quantity of available fuels from discarded brush, reduced response time of firefighters, and often threaten storage sheds, and out buildings that are inevitably built along the rear property lines. The fence creates a physical barrier that separates the homeowners yard from an area that is left unattended, and thus the problem for the Fire Dept.
