Dear Ms. Dorman:
As we discussed this morning, the proposed front porch (see attachment) on the above referenced
property would be in violation of the Frederick County Zoning Ordinance. The zoning ordinance
requires that structures comply with a 35-foot setback from the road right-of-way. This property's
plat, see attachment, illustrates that the structure is setback 35.7 feet from the right-of-way.
Therefore, the house itself is in compliance, but the porch would be in violation.
In order to comply with the zoning ordinance, the porch should be reduced to its' original size ( 6 by
7 feet) or a variance must be obtained from the Board of Zoning Appeals (BZA).
Enclosed is the variance application. If you chose to pursue a variance, please review and complete
the application and submit to this department by July 24, 1998. All applications received before July
24, 1998 will be placed on the BZA's August 18, 1998 agenda.

Mark - I know the formal resubmission process is normally via hardcopy to your office. However, given the last
round of comments, if you wouldn't mind, I think it would help to address the attached comments via email before
we formally resubmit. I think a couple elements of the previous submission may not have been obvious to you nor
depicted clearly and we'd prefer to avoid another wholesale revision if acceptable to you. A material element of
the last 2 submissions is that although we are adjusting some internal boundary lines, we are also consolidating a
few parcels; the net effect is creating two (2) parcels out of the existing eight (8). That said, some of your last
comments may not be applicable, and some lines may have been missing that affected another setback
comment. Here are my responses to your comments dated 09/21/21:
1. I revised the BRL's for the existing boundary lines to remain that are parallel to Valley Mill Road to 25'
fronts.
2. The front BRL along Martin Drive is retained as previously shown. I think part of the right of way (RW) line
of the adjoining bulb and arc was missing on the previous plot thus insinuating the setback was to
continue to the point where it intersected the existing RW; the current plot indicates where the front
remains to its intersection with the intersecting "side" property line and resultant 10' side yard setback; I
added another label to clarify.
3. Because parcels ("lots") 54-5-1 and 54-5-9 are being consolidated into new Parcel 54-5-10, the depicted
BRL's are relative to the new parcel outlines.
4. The County GIS map panels stop floodplain delineation on a panel east of the subject parcel. I therefore
checked the current FEMA map panel which indicates the entire subject parcels are in Zone `X'. I therefore
added a floodplain note to sheet 2.
If this is acceptable, we'll make a formal resubmission with the application and check so you can take another
look at it and hopefully approve it for recordation. Please call or email if you have any questions.
