THIS DEED OF EASEMENT AND AGREEMENT made and dated thi;
6th day of June, 1978, by and between BLANCHE A. LAGES, Widow,
1party of the first part; and the CITY OF WINCHESTER, VIRGINIA,
1party of the second part.
WITNESSETH: That for valuable consideration, the said
party of the first part doth hereby grant unto the said party
of the second part an easement sixty (60) feet in width over and
through that certain proposed street more particularly described
by that certain plat and survey prepared by H. Bruce Edens,
C-.L.S., dated May 11, 1978, a copy of which is hereto attached-,
and by this reference made a part of this deed, for the purpose
of maintaining and servicing a sewer line located within the
boundaries of the aforesaid easement.
The said party of the first part further grants and
conveys all of her right, title and interest in and to the
existing sewer line located within the boundaries of the aforesai,
easement to the City of Winchester, Virginia, with the under-
standing and agreement that the use of the sewer line shall be
limited to the existing connection and a connection for property
designated as F. Clevenger on the aforesaid plat.
The said party of the second part joins in the executioi
of this agreement for the purpose of agreeing to maintain and
service the aforesaid sewer line.

signature of the City of Winchester, Virginia, by its City
Manager,

WHEREAS, the hereinafter described property was
devised to Blanche A. Lages by Will of Francis P. Lages dated
September 22, 1965, admitted to probate in the Clerk's Office
of the Circuit Court of Frederick County, Virginia, and recorded
in Will Book 76, at Page 724; and,
WHEREAS, Blanche A. Lages died testate and by her Will
(dated August 7, 1978, admitted to probate in the aforesaid
Clerk's Office and recorded in Will Book 79, at Page 259,
jappointed Flournoy L. Largent, Jr., as Executor.
WITNESSETH: That for and in consideration of the sum
of Ten Dollars ($10.00), and other good and valuable consideration
receipt of which is hereby acknowledged, the said party of the
first part does hereby grant and convey, with general warranty
and English covenants of title, unto the said party of the second
part, absolutely, all that certain lot of land, together with
all rights, rights of way and appurtenances thereunto belonging,
lying and being situate in Shawnee Magisterial District,
Frederick County, Virginia, containing 37,294 square feet, more
particularly described by that certain plat and survey dated
May 22, 1984, prepared by H. Bruce Edens, C. L. S., hereto
attached and by this reference made a part of this deed, and
being a part of the same property conveyed to Francis P. Lages
and Blanche A. Lages, his wife, by Deed of Asa L. Rosenberger,
Widower, dated November 15, 1947, of record in the aforesaid
Clerk's Office in Deed Book 203, at Page 134, to which deed
and plat and the references therein reference is made for a

as College Park, Section 4, lying and being situate northeast
of Millwood Pike - U. S. Highway No. 50, just southeast of the
City of Winchester, in Shawnee Magisterial District, Frederick

covenants and restrictions which shall be considered as covenants
real running with the land and shall be binding on all subsequent
owners thereof, enforceable.by the party of the first part and
any purchasers therefrom:
1. The above described property shall not be
used for any purpose other than residential and only single
dwelling units shall be erected thereon at a cost of not less
than $16,000.00, based on the Revised Wholesale Price Index
for Building Materials (1947-1948 - $100.00), as of January 1,
1958, published by the United States Department of Labor,
Bureau of Vital Statistics.
2. No building shall be erected on any of the said
lots closer than 15 feet from the side boundary lines nor shall
the combined total of the two side property lines be less than
35 feet.
3. No trailer or temporary dwelling shall be
permitted on any of the said lots.
4. No hogs, chickens or livestock of any kind shall
be kept on any of said lots.
S. No dog kennels may be maintained on any of said

6. In the event the dwelling to be constructed on
any of said lots is prefabricated, sixty (60%) percent of the
construction shall be of masonry.
7. No lot shall be used for storage of trash, rubbish,
debris, excessive old cars, or other types of junk. All cars
stored on lots must have State inspection certificates.

This is to follow-up on our meeting of January 5, 1991 to review the above
referenced street. As I stated the following items will need to be addressed
prior to the street being eligible for inclusion into the State's Secondary
Road System:
• It appears the street has not been maintained since completion.
Therefore, its entire length will need to be resealed. I have enclosed
for your use a copy of the originally approved typical section.
• The outlet end of the 17"x13" culvert at the intersection with Harvard
Drive has become partially buried. This pipe will need to be reopened to
drain properly and the ditch line restored, seeded and mulched..
Once the above items have been completed please give me a call so a final
inspection can be performed. However, in the meantime should you have any
concerns please give me a call.

Dedication to me, please enclose five (5) copies of the Subdivision Plat
and documented construction costs for the water and sewer lines and the

As requested, I aTn Herewith returning to you ane (1) bet of preliminary
plans for the nbove subdivision.
The drainage has 'been reviewed and the following .is advised:
A ?l+" pipe. or erui.vaalent is required at the connection with Harvard Drive.
An additional length of pipe will be required due to the flares on the
connection.
The pipe at station 13+60 needs to he skewed in order to outfall into the
drainage easement. It appears that an out -let ditch rock lined is necessary
to the hollow as marked on the plan. raved or rock ditch, erosion stone
and CD underdrains will be required at approximate locations marked on the
plans.
The vertiml curve at station 12!-15 should be lengthened to obtain a minim =
'OC' vertical Might distance.
A temporary turn -around is required at the end of the street. This eould be
provided on the S.al property to avoid ensements on lots 4 and 5.
The drainage easement to bt changed to 70' width and extend to a natural
water course which appears to be Abrams Creek.

Be" depth will be detamined by CSR tests that will be conducted by the Highway
Department at the expenses of the developer. These tests require approximately
two (`) weeks, therefore, It is suggested that you request these teats at least
two () weeks prior to starting the placing of base stone or after the rough
grading has been completed.
It is recommended that all surface laterals be installed to they property line
prior to paving the roadway.
A permit must be applied for and approved before performing avp mark on the State's
rivet of way for the entrance.

SANITARY SE14ER EXTENSIONS IN FREDERICK COUNTY
Sanitary sewer mains shall not be extended to any point in Frederick County
except to:
(1) Honor those contracts previously approved; namely:
(A) Senseny Heights Subdivision owned by E. L. Peters, agreement dated
March 10, 1971.
There are 30 lots within this subdivision to which a sewer main could
be extended; however, per an agreement with Frederick County dated
January 24, 1973, Mr. Peters agreed to the County serving 18 of these
lots. Therefore, the City still has a valid agreement to serve 12
lots in the beforementioned subdivision fronting on Massie Drive.
(B) Agreement with Nora L. Garber Trust, approved by Council September 9,
1975.

This sewer main extension will serve a maximum of five lots
situated east of Interstate 81, lying between Garber Road and
U. S. 522 South.
(2) Make main extensions into those subdivisions for which a request was
made prior to January 1, 1976; namely:
(A) College Park Subdivision, Section 4, owned by Francis P. Lages,
to service 12 lots located on Yale Drive and Vassar Circle.
(B) Heritage Hills Subdivision, Section I -A, owned by LDE Corpora-
tion, to service 7 lots on Huntcrest Road.
(3) Make main extensions to serve City -owned property.
All permitted sewer main extensions must have the unconditional approval of
the Frederick County Board of Supervisors.
The City shall continue to make individual sewer service connections to those
properties which are adjacent to an existing City sanitary sewer main.
