wife, parties of the first part; and Denny L. Place and Martha S
Place, his wife, parties of the second part.
WITNESSETH: That for and incconsideration of the sum
of Ten ($10.00) Dollars, and other good and valuable considerati
the receipt of which is hereby acknowledged, the said parties
of the first part do hereby grant and convey, with general
warranty of title, unto the said parties of the second part,
jointly, and as tenants by the entireties, in fee simple, with
the common law right of survivorship, all of that certain portio
of land, together with all rights, rights of way and appurtenanc
thereunto belonging, lying and being situate on the South Side
of Harvard Drive, in Shawnee Magisterial District, Frederick
County, Virginia, and designated as the West.portion of Lot 39,
On that certain Division Survey of College Park Subdivision,
Section 3, prepared by H. Bruce Edens, C.L.S., dated July 11, 19
hereto attached and by this reference made a part of this deed;
and being a part of the same property described in the Deed of
Dedication dated February 16, 1973, and of record in the Clerk's
Office of the Circuit Court of Frederick County, 'Irginia, in
Deed Book , Page , to which Deed and plat and the
references therein contained, reference is here made for a
further description of said property.
This conveyance is made subject to the following
covenants and restrictions, which shall be considered as
covenants real running with the land:
1. The herein described property shall not be used fo
any other purpose other than residential and only single
dwelling units shall be erected thereon at a cost of not less

2. No building shall be erected on any of the said
lots closer than 35 feet from the front nor closer than 10
feet from the side boundary lines, except as otherwise shown
on the plat.
3. No trailer or temporary dwelling shall be permitte
on any of said lots.
4. No hogs, chickens or livestock of any kind shall b
kept on any of said lots.
5. No dog kennels may be maintained on any of said
lots.
6. In the event the dwelling to be constructed on any
of said lots is prefabricated, sixty (60%) Per Cent of the
construction shall be of masonry.
7. No lot shall be used for storage of trash, rubbish
debris, excessive old cars, or other types of junk. All cars
stored on lots must have State Inspection Certificates.
The said parties of the first part covenant that they
have the right to convey the said property; that the said
property is free of any encumbrances; that the said parties of tl
second part shall enjoy quiet possession of said property, and tl
said parties of the first part will execute such further assurani
of title as may be requisite.

11980, by and between FLOURNOY L. LARGENT, JR., Executor of the
Estate of Blanche A. Lages, deceased, party of the first part;
and WILLARD A. KIMBALL and MARJORIE F. KIMBALL, his wife, parties
of the second part.
WHEREAS, the hereinafter described property was devised
to Blanche A. Lages by Will of Francis P. Lages dated September
22, 1965, admitted to probate in the Clerk's Office of the
Circuit Court of Frederick County, Virginia, and recorded in
lWill Book 76,,Page 724; and
WHEREAS, Blanche A. Lages died testate and by her Will
dated August 7,.1978, admitted to probate in the aforesaid
Clerk's Office and recorded in Will Book 79, Page 259, appointed
Flournoy L. Largent, Jr., as Executor.
WITNESSETH: That for and in consideration of the sum of
Ten ($10'.00) Dollars, and other good and valuable consideration,
receipt of which is hereby acknowledged, the said party of the
(first part doth hereby grant and convey, with general warranty of
title, unto the said parties of the second part, jointly, as
tenants by the entireties, in fee simple, with the common law
right of survivorship, all of that certain lot of land, together
with the improvements thereon and the appurtenances thereunto
belonging, lying and being situate on Harvard Drive, in Shawnee

1144 Harvard Drive and as Lot No. 34, on the plat of College Park
Subdivision, Section 3, prepared by H. Bruce Edens, C.L.S., dated
December 6, 1972, of record in the aforesaid Clerk's Office in
Deed Book 404, Page 699, more particularly described by that
certain plat and survey dated November 15, 1979, prepared by
H. Bruce Edens, C.L.S., hereto attached and by this reference
made a part of this Deed, which lot includes Lot No. 34, College

feet as shown on the said plat, which shall become a part of
the said Lot No. 34, and being a part of the same property
conveyed to Francis P. Lages, et ux, by Deed of Asa L. Rosenberger,
Widower, dated November 15, 1947, of record in the aforesaid
Clerk's Office in Deed Book 203, Page 134, to which deed and plats
and the references therein, reference is here made for a more
particular description of the said property.
This conveyance is made subject to the following
covenants and restrictions which shall be considered as covenants
real running with the land and shall be binding on all subsequent
owners thereof, enforceable by the party of the first part and
any purchasers therefrom:
1. The above described property shall not be used for
any purpose other than residential and only single dwelling units
shall be erected thereon at a cost of not less than $16,000.00,
based on the Revised Wholesale Price Index for Building Materials
(1947-1948 - $100.00), as of January 1, 1958, published by the
United States Department of Labor, Bureau of Vital Statistics.
2. No.building shall be erected on any of the said
